The minutes of the- .r.6gular meeting of Monday, March 26, 1956 were approved as read. This being the time for the hearing on Resolution No. C -1350, providing for the vacation of that certain 20 foot alley running North and South between Lots 1'to 8, inclusive and Lots ,9 to 16, inclusive Block 275, Lund's Addition, and there being no objections in writing, or otherwise, to said vacation proceedings, or any part thereof; it was MOVED by Huey, seconded by Huza that-Ordinance No. B -1865, vacating said property and every part thereof,be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1865, AN ORDINANCE providing-,for the vacation of that certain 20.foot alley running in a North and South direction from Pine Street to Maple Street through Block 275, Lund's Addition to N.orth Yakima (now Yakima), and situate in the City of Yakima, Washington. Moved by Huza, seconded by Burns that the following warrants be cancelled: Current Expense Warrants No. 76748, in the sum of $272.69 and No. 84438, in the sum of $5.65; Sewer Construction Warrant No. 1839.8 in the sum of $4,095.01; City Street Warrant No. 23668,___in the sum of $194.00. These warrants are being cancelled for the reason that said warrants have never been called for or claimed by the parties to whom they were drawn: carried, Burns, Huza and Huey voting aye on roll call Moved.by Huza, seconded by Huey that the City Clerk is hereby authorized.to advertise for bids for the purchase of two (2) Packer Type Garbage Bodies for the Sanitation Department; said bids to be-received on Monday, April 16, 1956, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Clerk is hereby authorized to give notice to contractors for the construction of a pipe sewer in L.I.D. No. 836; said bids to be received on Monday, April 16, 1956 at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huza, seconded by Burns that the report of the Investment Committee for invest- ments purchased during the month of March 1956, be approved as follows: carried, Burns Huza and Huey voting aye on roll call. ORDINANCE NO. B -1866, AN ORDINANCE amending Section 15 of the Zoning Ordinance No. B -293, entitled "AN ORDINANCE regulating and restricting the location of trades and industries; regulating and limiting the use of buildings and premises; and the height and size of buildings; providing for yards, courts and other open spaces; establishing districts for said purposes, and providing for a board of adjustment, and repealing Ordinances Nos. B -22, B -35, B -431 B -511 B -71, B -1261 B -147 and B- 17211; and permitting off = street parking facilities in residence districts under certain circumstances. ORDINANCE NO. B -1867, AN ORDINANCE eliminating certain property from the irrigation maintenance roll. Moved by Huza, seconded by Burns that Resolution C -1359, authorizing the Mayor and City Clerk to execute a supplemental agreement on behalf of the City of Yakima and the 81 v' ,g� APRIL 2,. 1956 United States of America for the purpose of modifying lease contract No. C4ca- 2790 -A dated May 31, 1950, relative to the Yakima Municipal Airport, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1359, BE IT RESOLVED PY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Mayor on behalf of said city is hereby authorized to execute that certain supplemental agreement between said city and the United States of America modifying lease contract with the Government No. C4ca- 2790 -A dated May 31, 1950 relative to a. portion of the Yakima Municipal Airport so as to include additional land, to -wit: approximately 1435 square feet for the installation of a 16 foot by 12 foot engine generator building and power substation; a copy thereof being attached hereto and incorporated by reference herein. BURNS Mayor Moved by Huza, seconded by Burns that Resolution No. C -1360 authorizing the Mayor and City Clerk to execute on behalf_ of the City of Yakir{a a mutual cancellation agreement with the General Petroleum Corporation on that certain lease dated February 19, 1948, relative to certain property of the Yakima Municipal Airport, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1360, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Mayor and City Clerk are hereby authorized to execute on behalf of said city a mutual.cancellation agreement cancelling by mutual consent that certain service station ground lease between said City and General Petroleum Corporation dated February 19, 1948, c.ov.ering a portion of the Yakima Municipal Airport; a copy of said mutual cancellation agreement being attached hereto and incorporated by reference herein. RESOLUTION NO. 01361, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the.City of Yakima does hereby exercise its option referr- ed to in paragraph 1 of option agreement dated November 21, 1955, for the purchase from Squire - Ingham Co., a corporation, of the following described real estate containing four acres, more or less, situated in Yakima County, Washington, to. -wit: The following described portion of the Northwest quar..ter of the Northwest quarter of the Southwest quarter of Section 10, Township 13 North, Range 18 E.W.M.: Beginning 2222.6 feet north of the.Southwest corner of said Section 10 and 242.6 feet east of the west line of said Section 10, running thence east 417.4 feet, more or less, to the east line of the Northwest quarter of the Northwest quarter of the Southwest quarter of said Section 10; thence North along said east line 417.4 feet, more or less, to the northeast corner of said Northwest quarter of the Northwest quarter of the South -- west quarter of said Section 10; thence west along the north line of the Northwest quarter of the Northwest quarter of the Southwest quarter of said Section 10 to a point 242.6 feet east of the west line of said Section 10, thence south 417.4 feet, more or less to the point of beginning; and the appropriate city officials are hereby authorized and directed to pay therefor., pursuant to said option agreement, the sum of $500.00 said property being purchased for the sole purpose of use by the city as a site for a well and infiltration system connected therewith, for obtaining additional domestic water, and said payment to be made from the Water Department fund; and subject to the right of'the seller to re- purchase said property from the city for the sum of $1.00 if and in.the event that.at any future time the city abandons said well site. C -1362 A RESOLUTION fixing the time for hearing on Petition for Vacation of Street. WHEREAS, a petition has been filed with the City Commission of the City of Yakima, a municipal Corporation, praying for the vacation of a portion of a street described as follows, to -wit: The east 10 feet of the west 20 feet of 20th Avenue South lying adjacent to Lot 11 of Chase Hill Residence Tracts and extending southerly from Lombard Lane to the right -of -way of the Naches and Cowiche Canal, situate in the City of YakimR, Yakima County, State of Washington. NOW, THEREFORE,.BE,IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That said petition shall be brought on for hearing and determina= tion on Monday, the 30th day of April, 1956, at the hour of 10:00 o-lclock in the fore- noon on said day at the office of the City Commission of the City of Yakima, at the City Hall in Yakima,-Yakima County, Washington, or as soon thereafter as the same may be heard, and that notice of such hearing be give as provided'by law. BURNS City Clerk Mayor Moved by Huey, seconded by Burns that Resolution No. C -13631 authorizing the Mayor and City Clerk to execute an agreement on behalf of the City of Yakima, with Sterling Codifiers of Weiser, Idaho, for the purpose of codifying the ordinances of the City of Yakima, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO-. C -1363, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the Mayor and City Clerk on behalf of said city are here- by authorized and directed to execute a codification agreement with Sterling Codifiers, pursuant to the bid heretofore submitted by them and accepted by the city, for the re- vision, compilation, codification and indexing of the general and franchise ordinances of said city and printing of 200 copies thereof by the offset method, after approval thereof by the Yakima City Commission and City Attorney, and for the preparation of quarterly, loose leaf supplements thereto and printing 200 copies thereof quarterly by the offset method;_for a period of seven years; the agreed compensation for said codifi- cation being $4500.00 and the agreed compensation for said quarterly supplements.,being $450-00 annually, payable in quarterly installments; said work to be done in accordance with the terms and conditions of the said codification agreement, copy of.which is attached hereto and incorporated by reference herein.
