The minutes of the regular meeting of Monday, March 12, 1956, were approved as read. This being the time for the hearing on Resolution No. 0-1348, providing for the construc- tion of pipe sewers with the necessary wye branches, manholes and flush.tank, and there being no objections in writing or otherwise to said improvement, or any part thereof, it was MOVED by Huey, seconded -by Huza that Ordinance No. B- 1858 -a, creating L.I.D. No. 836,. be passed as read: carried,- Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B- 1858 -a, AN - ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches, manholes and flush tank with water connections therefor; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the time for the hearing on the petition for annexation of Lots 1 to 27, inel sive, of Liebert's Addition, to the City of Yakima, and there being no objections in writing or otherwise to said annexation of said property, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No..B -1859, annexing said territory and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE N0, B -18599 AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, Washington. This being the time for the hearing on the petition.to annex certain property beginning 816 .feet south and 20 feet-east of the Northwest quarter of the Northeast quarter of Section 22- 13 -18, and other property more fully described and set forth in said ordinance and there being no objections in writing or otherwise to the.annexation of said property, or any part thereof; it was MOVED by Huey,. seconded by Huza that Ordinance No. B -1860, annexing said territory and every part thereof, be passed as read: carried,..Burns, Huza and.Huey voting aye on roll call. ORDINANCE NO. B- 1860, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the.City of Yakima, Washington. Moved by Huza, seconded by Huey that - Ordinance No. B -1861, providing for the expenditure of funds not budgeted for the employment of an additional clerk in the City Clerk's office, at a monthly rate of $225.00 for the remainder of the year, beginning March 1, 1956, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -18619 AN ORDINANCE providing for the expenditure of funds not budgeted for the employment of an additional clerk in the city clerk's offices and declaring an emergency. An ordinance was introduced and read -in full by the City Clerk for the expenditure of funds not budgeted for the payment of the cost of repairing fire damages of the Street Department shed, in the total sum of $10493.38, and laid on the table for one week as provided by law and the city charter. Moved by Huey, seconded by Huza that Resolution No. 0-1352, being a resolutiong of inten- tion to improve the West 139 feet of Lots 1 to 4 of Burrows Suburban Tracts, and other property more fully described and set forth in said resolution, and fixing the date of hearing on said resolution for Monday, the 9th day of April, 1956 at 10 o'clock a.m., be adopted as read: carried, - Burn$, Huza and Huey voting aye on roll calla RESOLUTION NO. C -13529 BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following property by constructing the necessary mains, valves and other appurtenances for the purpose of sup- plying water for domestic use. The district to be served by and assessed for the above describ improvement is situate in Yakima - County, Washington, and described as follows, to -wit: The West 139 feet of Lots 1 to 4, inclusive of Burrows Suburban Tracts; The West 90 feet of Lots 5 and 6 of Burrows Suburban Tracts; AND The West 139 feet of the East half of the Southeast quarter of the. Southwest quarter of the Southeast quarter of Section 22, Township 13 North, Range E.W.M. ; said improvement to be constructed in full accordance with the plans and specif ieations to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improvemen are hereby notified to appear and present such objections, if any, at a meeting of the City Commission, to be held at its office in the .City Hall on Monday the 9th day of Apri 1956, which time and place are hereby fixed for the hearing of all matters. relating to the said improvement, or objections thereto and for determining the method of payment therefor; and the City Clerk is-hereby directed to give due.notiee of said hearing and o the intention to make the aforesaid improvement. A portion of the costs and exepenses of said improvement, includ- ing the engineering, inspection, advertising, publication of notices, and any other ex- penses incident thereto, shall be levied and assessed against the above described proper- ty and the balance of said costs and expenses shall be borne by the City Water Department and the City Engineer is hereby directed to submit to the-City-Commission at or prior to the date fixed herein for said hearing, all of the data and other information required b.1 law to be by him submitted. RESOLUTION NO. 0-13530 BE IT RESOLVED BY THE CITY COMMISSION OF THE -CITY OF YAKIMA: That the Mayor and the City Clerk on behalf of said City are hereby authorized and directed to execute an agreement with Yakima School District No. 7 with reference to the relocation. and subsequent removal of fences on the west and south sides of Davis Field in said city, a copy of said agreement being attached hereto and incorporated by reference herein. BURNS Mayor Moved by Huza, seconded by Huey that Resolution No. C -1354, extending the time of that certain Memorandum of Agreement by the City of Yakima with the Meter Advertising Company from March 15, 1956 to and until the end of the month during which the Winkenwerder test case now pending in the Yakima Superior Court shall have been fully terminated, and such other matters contained in said resolution, be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1354, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: 1. Except as hereinafter changed or modified, Ordinance No. B-1720 passed on July 26, 1955, and that certain Memorandum of Agreement of the same date between the City of Yakima and the Meter Advertising Company with reference to ad- vertising signs on parking meters in said city, shall remain in full force and effect, and the term thereof' is hereby extended from March�15, 1956 to and until the end of the month during which the Winkenwerder test case now pending in the Yakima County Superior Court,.Cause No. 40414, and any appellate proceedings therein shall be fully terminated including the filing in said Superior Court of the•remittitur following the decision by the State Supreme Court on any appeal therein. 2. During any extended period, the-Meter Advertising Company shall maintain not less than six nor more than 500 advertising signs on parking meters in said city pursuant to the terms and conditions of said ordinance and memorandum of agreement, and said Meter Advertising Company shall pay to the city the sum of $1.00 per parking meter per month for all parking meters upon which said advertising signs are places, and a. minimum of not less than $10.00 per month during said period. The guaran- teed payment referred to in.paragraph 3 of said agreement shall not be applicable•to sai extended term. C -13550 BEFORE THE CITY COMMISSION OF THE CITY OF YAKIMA, STATE OF WASHINGTON IN THE MATTER OF THE VACATION OF ) that certain roadway approximately ) 20 feet wide, running along the west ) line of the east half of the northeast ) quarter of the northwest quarter of section ) 27, township 13 N., range 18, E.W.M., sit- ) uated in Yakima, Yakima County, Washington. Such roadway running from Tieton Drive to ) the south line of said subdivision to a j road designated as Arlington. Resolution No. C -1355 A RESOLUTION fixing the time for hearing on petition for vacation of roadway. Huza absent. RESOLUTION NO. C -1356, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That-the Mayor and City Clerk on behalf of said city are hereby authorized and directed to execute and deliver a quit claim deed to Howard Ebbons and Ros Ebbons, husband and wife, conveying the following described..proper"ty situate in Yakima County, Washington, to -wit: All of Lots 257, 2589 259, 260, 261, 262, 2639 264, and 266; ALSO, all of Lots 268, 269 and 270, excepting the north 400 feet thereof and .excepting right of way 100 feet wide-over Lot 268; all in POMONA "HEIGHTS,.DIVISION N0. 14, according to the plat thereof recorded in Volume "Bu of Plats, page 82, records of Yakima County, Washington. .SUBJECT TO easements, rights of way and reservations shown of record with reference thereto; upon repayment to the city of the purchase price paid by the City for said property, to- wit, the sum of $1292-.00; and that the pending suit of Ebbons vs. City of Yakima, Cause No. 40145 in Yakima County Superior Court, shall be compromised and settled by the de- livery of said deed, the repayment of said money and the dismissal of said action without costs. RECESSED MEETING, TUESDAY, MARCH 20, 1956, 2 :00 P.M. The City Commission met pursuant -to recession, Mayor Burns and Commissioners Huza and present on roll call. The following bids were received for furnishing a comprehensive blanket automobile policy covering bodily injury and property damage, including unlicensed equipment as well as non ownership and hired car endorsement on the fleet of cars and trucks for the City of Yakim and the Metropolitan Park District; in the sum of $100,000.00 and $300,000.00 bodily in- jury and $10,000.00 property damage, to -wit: Goldade Insurance Agency $2,588.52 Farmers Insurance Group 3,196.23 Hargreaves & Junker 2,852.47 it was MOVED by Huza, seconded by Huey that the bid of Goldade Insurance Agency, in the sum of $2,588.52, be accepted as the lowest and best bid: carried, Burns,. THE 13th DAY OF MARCH 1956 BE IT REMEMBERED, that the City Commission of the City of Yakima, Washing- ton, and the City Clerk of said city, _constituting the City Election Board of the City-General-elect ion., held on the 13th day of March 1956, for the purpose of electing-a Mayor, a Commissioner of Finance and Accounting and a Commissioner of Public Works, respectively, have met for-the purpose of canvassing the returns of said General election as required by law, and we find that a total of 12,414 votes were cast at said election, and after a full, true and correct canvass of said re- turns thereof, we do hereby certify that the following officers were elected for the offices above set forth, to wit: For the office of Mayor, Carl H. Behnke, received 6360 votes, and G.W. Burns, received 5,915 votes. For the office of Commissioner of Finance andAccounting,-Kenneth C. Schutt, received 6,925 votes, and B.K. Gage received 5,246 votes. For the office of Commissioner of Public Works, Laurence C..Mathews received 101113 votes., and Grant E. Huey received 2,076 votes. We, Therefore find and determine, that Carl H. Behnke, was elected to the office of Mayor; that Kenneth C. Schutt was elected.to the office of Commissioner of Finance and Accounting, and that Laurence C. Mathews was elected to the office of Commissioner of Public Works. WE FURTHER-FIND AND DETERMINE, that at said General election, the follow - ing proposition was voted upon; "Shall the City of Yakima create an indebtedness.., in the sum of.:,Four� _Hundred- -'- Fifty,,,Thousand (450,000.00) Dollars, and issue general obligation negotiable bonds of-the City of Yakima, Washington, in the aggregate sum of Four Hundred Fifty Thousand ($450,000.00) Dollars, bearing interest at an effective rate over the life of the bonds not to exceed four per cent (4/) per annum, payable semi - annually; said '.bonds shall mature in from two to.t.wenty years from-date'of issue, and the principal and interest thereof shall be payable out of annual tax levies to be made without limitation as to rate or amount, for the pur- pose of providing funds for the improvement of Lenox.Avenue by eXtending the same across the right of way of the Northern Pacific Railway Company, and the right of way of the Union Pacific Railroad Company by the construction of a two -lane over- pass over said railway rights of war, all of wi ich is more fully set forth in Ordinance No. B -1835, of said city ?' and that the number of votes cast for "Bonds= - Yes" was 3,895, and the number of votes cast for "Bonds - -No" was 8,258; We, Therefore find and determine, that said proposition was defeated. WE FURTHER FIND AND DETERMINE, that at said General election the following proposition was voted upon; "Shall the City of Yakima, Washington, pipe, cover and or fence the existing open irrigation ditches and the Pacific Power & Light Waste - way within the City, and to pay part of the cost thereof, issue its general obli- gation bonds in the principal sum of Four Hundred Thousand ($400,000.00) dollars both principal and interest thereof to be payable by annual tax levies, to be made without limitation as to'rate or amount, to bear interest at a -rate not to exceed six (6%) per cent per annum, and to mature in from two to twenty years from date of issue, all as-more specifically provided for in Ordinance No. B -1843, of the City of Yakima ? ", and that the number of votes cast for "Bonds- -Yes" was 51549, and the number of votes cast for "Bonds - -No ", was 69462; We, Therefore find and determine, that said proposition was defeated. BE IT FURTHER REMEMBERED, that at said General election, the following proposition was voted upon; "Shall the City of Yakima amend A ;titles II and III of its City. Charter, in the manner provided in the petition therefor filed with the City Clerk on February 10th, 1956, for the adoption of the Council - Manager form of Government, and that the number of :votes cast "For The Charter Amend,,went" was 7,451, and the number of votes cast "Against the Charter-Amendment" was 3,803; We, Therefore find and determine, that said:. >proposition.i_casried. BE IT FURTHER,REMEM3ERED, that at said General election, the proposition of electing Three (3) Commissioners to the Metropolitan Park Board was submitted; said names being as follows; J.S. Applegate John F. Chesterley Rettie'E. Roberts Fred H. Westberg each for a term of six years, and that the number of votes cast for J.S. Applegate was 8, 872, ' for John F. Chesterley, 7, 811, for Fred H. Westberg, 7,808, and Rettie E. Roberts, 5,906; 7 S We, Therefore, Find and Determine, that J.S. Applegate, John F. Chesterley and Fred H'.
