The minutes of the regular meeting of Monday, December 5, 1955 and adjourned meeting thereof, were approved as read. This being the time for receiving bids for the sale of the triangular piece of ground lying between East Yakima Avenue and'Moxee Avenue, the bid of Theodore Sirrs in the sum of $105.00 was the only one received. It was MOVED by Burns, seconded by Huza that final action on said bid be deferred to a later date: carried, Burns and Huza voting aye on roll call. Huey voting "No ". This being the time for the hearing on rezoning Lot' 5, Lenox Avenue Addition from "B" Residence District to Business District, and Lots l and 2, Block 88, City of Yakima, located at the northwest corner of Naches Avenue and "B"t" Street, from "B" Residence District to Limited Business District; also the property on the south side of Nob Hill Boulevard from 17th Avenue South to 19th Avenue South and extending southerly for a distance of 160 feet from "B ": Residenct District to Limited Business district and from Area 2 to Area 4; it was'MOVED by Huey seconded by Huza that Ordinance-No. B -1787 be passed as read: carried, Burns:- Huza and Huey voting aye on roll call. ORDINANCE NO. B -1787, AN ORDINANCE rezoning certain specific property situate in the City of Yakima, Yakima County, Washington. This being the time for the hearing on the annexation of the petition of Stephen E. Gardner for a portion of the 'NW --of the SE-1 of the NE-. of Section 36 -13 -18 EWM, being Lot 18 of the Plat of Section 36, and there being no objections in writing or otherwise to said annexation, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance B -1788, annexing said property and-every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1788, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property co ntiguous "to the City of Yakima, Washington. This being the time for the hearing on the petitions of Emma Bartell and others and Donald D. DeZone for annexing the property immediately south of Terrace Heights Way and there being no objections to said annexation of said property or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance-No. B -1789 annexing said property and every "part thereof be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1789, AN ORDINANCE providing for the annexation by the City of Yakima, Washington of certain property contiguous to the City of Yakima, Washington. This being the time for the hearing on the assessment roll covering L.I.D. No. 809, providing for the construction of 21st Avenue South sewer district, and there being no objections to said assessment roll, or any part thereof; it was MOVED by Huey, seconded by Huza; that Ordinance No. B -1790, confirming said assessment roll and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1790, AN ORDINANCE fixing the time of delinquency of installments of assessments " levied for the payment of the cost of the improvement in Local Improvement District No. 809, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. This being the time for the hearing on the assessment roll covering L.I.D. No. 810 pro- viding for the alley paving in Blocks 132 and 133, City of ,Yakima, and there being no objections in-writing. or otherwise to said assessment roll, or any part thereof; it was MOVED by Huey, seconded by Huza that Ordinance No. B- 1791,.confirrning said assessment roll and every part thereof, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1791, AN ORDINANCE fixing the time of delinquency of installments of assessments "levied for the payment of the cost of .the improvement in Local Improvement District No. 810, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Huey, seconded by Huza that Ordinance No. B -1792 providing and authorizing the conveyance ' of certain property held by the City of Yakima as park property to the Metropolitan Park District of Yakima for perpetual use for public park and playground purposes, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1792, AN ORDINANCE providing for and authorizing the conveyance of certain. property held by the City as park property to the Metropolitan Park District of Yakima for perpetual use for public park and playgound purposes. Moved by Huey, seconded by Huza that Ordinance No. B -1793, amending Ordinance No. B -1714 passed on the 18th, day of July 1955, and entitled: "AN.ORDINANCE of the City of Yakima, Washington, specifying and adopting a system or plan of additions to and betterments and extensions of, the sewerage system of the City, and providing that the existing sewage disposal plant which has heretofore been combined with and become a part of the waters utility of the City, together(with the remainder of the existing system of sewerage, including all add'it,ion thereto and extensions and betterments thereof, shall be consider- ed as a part of and belonging to the waterworks utility of the City; declaring the estimated cost of said system or plan, as nearly as may be; providing fcrr the issuance and sale-of "Water and Sewer Revenue Bonds, 1955" in the principal sum of not to exceed $325,000.00 in one or more series, to provide the funds required to pay the cost thereof; creating a special fund to provide for payment of said bonds; and declaring an emergency' and declaring an "emergency, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. Moved by'Huza, seconded by Huey that Ordinance No. B- 1794, providing for the issuance of 8400,000.00 par value,of tWater and'Sewer Revenue Bonds, 195611 for the purpose of paying the cost of acquiring, constructing, and completing additions to and betterments and ex- tensions of the sewerage system of the City, all to become a part of the waterworks utility of the City, as' adopted in Ordinance No. B- 1714', as amended by Ordinance No. B -1793, fixing the date, form, maturities, maximum interest rate, covenants and terms of said bonds and providing for the calling of bids for the sale thereof, and declaring an emergency, be passed as read: carried, Burns, Huza and Huey voting aye on roll call. ORDINANCE NO.' B -1794, AN ORDINANCE of the City of Yakima, idashington, providing for the issuance of $400,000.00 par value of 1'Water and Sewer Revenue Bonds, 1956,11 for the pur- pose of paying the cost of acquiring, constructing and completing additions to and betterments and extensions of the sewerage system of the City, ' all to become a part of the waterworks utility of the City, as adopted in Ordinance No. B -1714, as amended by Ordinance No.-B-1793; fixing the date, form, maturities, maximum interest rate, covenant and terms of said bonds; and providing for the calling of bids for the sale thereof; and declaring an emergency. Moved by Huza, seconded by Huey that an ordinance providing for the expenditure of funds not budgeted for Tahoma Cemetery, in the sum of $1100..00 to defray expenses of said Tahoma Cemetery was introduced, and read in full by the Cit� Clerk, and laid on the table for one week, 'as provided by law and the ordinances of the ity of Yakima: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that the City Engineer'having reported the completion of the construction of a sewer in Heyduck Park No. 2, L.I.D. No. 827, by the contractor, said work is hereby accepted a.nd the City Engineer instructed to prepare an assessment roll , for said district, and the City Clerk is hereby -ai_ithorized to give notice of hear- ing on said assessment roll for Tuesday, January 3rd, 1956, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call. Moved by Huey, seconded by Huza that Resolution No. C -1314, being a Resolution of Inten- tion to construct the necessary water mains fire hydrants, valves and other appurten- ances for supplying domestic water on Fair Avenue and other property more particularly described in said resolution,*and. fixing Tuesday, January 3; 1956, as the date of herein at the hour. of 10 o'clock a.m. be adopted as read: carried, Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1314, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That it is its intention to improve the following property by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection. The district to-be served by and assessed for the above described improvement is situate in Yakima County, 1ashington, and described as follows, to -wit: Beginning at the intersection of the centerline of Fair Avenue and the centerline of Terrace Heights l-,ay; thence Last 326.9 feet ; thence South parallel with Fair Avenue to the south line of the Southwest quarter of the Northwest quarter of the Northwest quarter of.Section 20, Township 13 North, Range 19 E.W.M.: thence west along the south line of said subdivision to a point 132 feet east of the Southwest corner thereof; thence south parallel with Fair Avenue to the centerline of East Spruce Street; thence west 132 feet to the centerline of Fair Avenue; thence north along the centerline of Fair Avenue to the point of be- ginning; said improvement to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. All persons who may desire to object to said proposed improve- ment, are hereby notified to appear and present such objections, if any, at' a meeting of the City Commission, to be held at its office in the City Hall in the Gity of Yakima, Yakima- County, Washington, at the hour of 10P00 a.m. on Tuesday the 3rd day of January, 1956, which time and place are hereby fixed for the hearing of all matters relating to the said improvement, or objections thereto, and for determining the method of payment therefor; and the City Clerk is hereby directed to-give due notice of said hearing and of the intention to make the aforesaid improvement. A portion of the costs and expenses of said improvement, includ- ing the engineering, inspection, advertising, publication of notices, and any other expenses incident thereto, shall be levied and assessed against the above described property and the balance of said costs and expenses shall be borne by the City Water Department; and the pity Engineer is hereby directed to submit to the City Commission at or prior to the date fixed herein for said hearing, all of the data and other informa- tion required by law to be by him submitted. RESOLUTION NO. C- 1315, WHEREAS, the budget of the Street Department for 1955 as shown by Ordinance No. B -1606 contains the following items: "Superintendent of Streets, $5,400.00 ", "Street .Foreman, 4.,800.0011 and "Sidewalk Repair, �$4,000.0011; and it appear- ing that subsequent to the adoption of said budget it has been ascertained that said sums will not'be entirely used for said items; and it further appearing that an addi- tional-13,100.00 is needed for extra labor for said street department, and an additional $1,200.00 is needed for the purchase of rock salt for use by said street department; now therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the sum of 92,700.00 is hereby transferred from the said $5,400.00 item, and the sum of 6400.00 is hereby transferred from the said $4,800.00 item,•said $3,100.00 to be used for extra labor for•said street department; and the sum Of $1,200.00 is hereby transferred from the said $4,000.00 item for the purchase of additional rock salt for use by said street department; and the expenditure of said sums for said purposes being hereby fully and in all respects authorized and approved, the appropriate city officials are hereby authorized empowered -and directed to do any and al � things necessary or proper to carrying out this resolution. Nashem, Jr. and Harry Hazel to serve as Judges Pro'Tempore, during absences of the presiding Judge, Thomas E. Grady, Jr., be adopted as read.: carried, Burns, Hliza and Huey voting aye on roll call. RESOLUTION NO. C -13161 A RESOLUTION relating to Police Judge Pro Tempore.. WHEREAS, on Au gust 3, 1953, the City Commission of the City of Yakima passed Ordinance No. B -1481 entitled "AN ORDINANCE relating to Police Judge Pro Tempore, providing for the method of his appointment, and fixing his compensation," and WHEREAS, Judge Thomas E. Grady, Jr.,-- Police Judge of the City of Yakima will'be temporarily absent on vacation for a period of two weeks commencing December 12, 1955; and Norman R. Nashem, Jr. and Harry Hazel are suitable and qualified persons to act as Police Judge Pro Tempore; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That Norman R. Nashem, Jr., is hereby appointed Police Judge Pro Tempore to act as such during said two weeks period; and Norman R. Nashem, Jr. and Harry Hazel are each appointed Police Judge'Pro'Tempore to act as such at any future times that Police Judge Thomas E.- Grady, Jr. may be disqualified, incapacitated or necessarily absent; and upon their taking an oath as provided in said ordinance, they, and each of them shall have all of the powers and duties as Police Judge Pro Tempore and shall be compensated as provided by said Ordinance No. B- lz�81. RESOLUTION NO. C -1317, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That' the Mayor and `'ity Clerk are hereby authorized and directed to execute on behalf of said city a contract with Ranney Method Western Corporation for the construction and installation of certain water facilities near. the Naches River below Nelson Bridge in consideration of the payments to be made and in accordance- -with the terms and conditions as provided in said contract, a copy of which is attached hereto and incorporated by -reference herein; and subject to the proper performance thereof by the said contractor, the appropriate city officials are hereby authorized and directed to make any and all payments and to do any and all things to be performed by the city thereunder as and when therein provided.
