DECEMBER 5, 1955
The City Commission met in regular session, Mayor Burns and Commissioners Huza and Huey
present on roll call.
The minutes of the regular meeting of Monday, November 28, 1955, were approved as read.
Moved by Huey, seconded by Huza that J. 0. White,Meat Inspector be given an(extension of
time from January 1, 1956 to January 1, 1957 for his services with the City of Yakima;
carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the City Engineer having reported the completion of
the Glenview Irrigation District, L.I.D. No. 822 said work is hereby accepted, and the
City Engineer instructed to prepare an assessment roll fo'r said district, and the City
Clerk authorized to give notice of hearing on said roll for Tuesday, December 27, 1955
at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the City Engineer having reported the completion
of the Clinton Way Irrigation System, L.I.D. No. 817, said work is hereby accepted, and
the City Engineer intructed to prepare an assessment roll for said district, and the
City Clerk authorized to give notice of hearing on said roll for Tuesday, December 27,
1955 at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huey, seconded by Huza that the City Engineer having reported the completion of
the Lenox Avenue Curb and Gutter District, L.I.D. No. 813, by the contractor, said work
is hereby accepted, and the City Engineer instructed to prepare an assessment roll for
said district, and the City Clerk authorized to give notice of hearing on said roll for
Tuesday, December 27, 1955, at 10 o'clock a.m.: carried, Burns.. Huza and Huey voting
aye on roll call.
Moved by Huza, seconded by Huey that the report of the Investment Committee for invest-
ments purchased during the month of November 1955, is hereby approved as follows:

tion of Emma Bartell and others for annexation of the property immediately south of
Terrace Heights Way and east of Fair Avenue; said hearing to be on Monday, December 12,
1955, at 10 o'clock a.m.: carried, Burns, Huza and Huey voting aye on roll call.
Moved by Huza, seconded by Huey that the claim of James G. King relative to additional
pension frbm the Policemens Relief & Pension Fund, was referred to the �'ity Attorney f (or

Moved by Huey, seconded by Huza that the City Clerk.is hereby directed to give notice of
hearing on the petition of Stephen E. Gardner for annexation to the City of Yakima of the
NW-1 of the SE-1 of the NE-1 of Section 36- 13 -18- E.W.M. being Lot 18 of the Plat of Section
36; hearing on said annexation to be Monday, December 12, 1955, at 10 o'clock a.m.:
carried, Burns, Huza and Huey voting aye on 'roll call.
Moved by Huey, seconded by Huza that the City Clerk is hereby instructed to give notice
of hearing on the petition of Donald D. De Zone for the annexation to the City of Yakima
the following described property: beginning 100 feet south of the NW corner of the NW4
of the SW-1 of the NE4 of Section 20 -13 -19 E.W.M., the boundaries of which are as'follows:
on the south parallel with the east line of Fair Avenue to the center line of East Spruc
Street; thence west along the center line of East Spruce Street to the center line of
Fair Avenue; thence north along the center line of Fair Avenue to the point of beginning;

Moved by Huza, seconded by Burns that Resolution No. C -1313, providing for the sale of
a triangular,strip of land lying between Moxee Avenue and East Yakima Avenue etc., be
adopted-as read: carried, Burns and Huza voting aye on roll call.- Huey not voting.
RESOLUTION NO. C -1313, WHEREAS, Ordinance No. B -522 passed on August 4., 1941, provided
for..-the vacation as a street of a triangular strip of land lying between Moxee Avenue
and East Yakima Avenue and being a portion of the following described real property
situate in Yakima County, Washington, to -wit:
That portion of the northeast quarter of the Northeast quarter of Section 19,
Township 13 North, Range 19 E.W.M., described as follows: Beginning at a point
in the north line of Moxee Avenue, 627 feet South and 840 feet West of the North--
east corner of said Section; thence North parallel with the East line of said
Section; thence North parallel with the East line of said Section 109.8 feet,
more or less, to the southerly line of Yakima Avenue; thence southwesterly along
said southerly line and said line produced 335.95 feet to the north line of
Moxee Avenue produced west; thence East 317.5 feet to the point of beginni.ng;and
WHEREAS, a question has recently arisen with reference to the
title to said property; and the City of Yakima has no use or need for said property, and
it is for the best interest of said city that said property, or the interest of the city
therein, be sold as soon as practicable; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA:
That the City of Yakima and its appropriate city officials shall
forthwith offer for sale the right, title. and interest, if any of the City of Yakima
(to be conveyed by quit claim deed) in the herein above described real. estate, for cash
to the highest and best bidder therefor, without warranty and without fu_rni_shing title
insurance; the city reserving the right to reject any and all bids.

for bids for the sale of said triangular piece of land referred to in Resolution No.
C -1313; said bids. to be received on Monday,'the 12th day of December, 1955, 10 o'clock
a.m.: carried, Burns and Huza voting aye on roll call. Huey not voting-.

ADJOURNED MEETING, WEDNESDAY, DECEMBER 7,'1955, 3 :00 P.M.
The City Commission met pursuant to adjournment, Mayor Burns and Commissioners Huza and
Huey present on roll call.
Moved by Huey, seconded by Burns that the Mayor and City Clerk are hereby authorized to
execute on- behalf of said Oity that certain contract of even date herewith - between the
City of Yakima and the Ranney Method Western Corporation, a Nevada Corporation with prin-
cipal offices at Sacramento, California, for the construction of a Ranney Method
Horizontal -Water Collector, -as more fully provided in said contract, atop -y of'which is
on'.file'in the City Clerk's office, said construction contract having been prepared by
Cornell, Howland, Hayes and Merryfield, consulting engineers, and approved as to form by
the city attorney; and..as and when provided therein the appropriate city- officials are
authorized,to pay to said contractor the sum of $5000.00 for the hydrogeological survey
and $120,000.00 for the Ranney Method Horizontal Water Collector complete to the eleva-
tion stated therein, for a guaranteed capacity of quality and quantity as therein more
fully provided.and the sum of $10,000.00 for each million gallons per day in excess of
six million gallons per 24 hours for guaranteed capacity of acceptable quality, and the
unit price of $250.09 for extension of the caisson above the elevation therein stated,
all of the same being in accordance with the terms and conditions more fully provided in
said contract and the other contract documents incorporated by reference therein; said
sums to be paid out of the Water Department Fund of said city; and the appropriate city
officials are hereby authorized and directed to do any and all things necessary, advis-
able or proper for carrying out this contract:: carried, Burns, Huey and Huza voting aye
on roll call.
