AFKESOLWTION authorizing acceptance ofPassenger Facility Charge revenues from
U.8.Department ofTransportation.
WNEREAS, the City of Yakima (City) owns and operates an airport and airport
facilities known as the Yakima Air Terminal-McAl lister Field; and
WHEREAS, the City of Yakima has notified the Federal Aviation /\d0iOist[8tOO of
its intent bzassess and collect Passenger Facility Charges authorized pursuant Uz4SU.5.C.
§4O177and 14Code ofFederal Regulations, Part 158(City ofYakima Application No. PFC-
21'20-C-00-YKM);mnd
WHEREAS, pursuant to the City opp|icaton, federal statute and regulations
referenced above, the revenues from the Passenger Facility Charges, upUza nlaxirnunn of
$801.300 DoUmro, can be allocated and used by the City for the financing and construction
ofcapital improvements and aethe City'oshare ofmatching funds for construction ofcapital
improvements to the Yakima Air Terminal -McAllister Field and its facilities; and
WHEREAS. the airport held an airline consultation meeting on April 5. 3021 to
review the Capital Improvement Projects and highlighted the need to collect and use
Passenger Facility Charge funds in order to complete the planned Capital |rnpnJVennent
Projects and the airlines approved the collection ofsuch funds; and
WHEREAS. the City Council finds and determines that such funds should be
authohzed, collected and used for such uoao as stated in City ofYakima Application No.
PFC-21-2O-C-OO-YKK8.and that the City Manager should haauthorized toprepare, execute,
submit and administer any and all applications and documents necessary orappropriate to
receive and use such funds for such purposes; and
WHEREAS. the City Council finds and determines that such approval and
authorization serves the best interests of maintaining the vitality of the Yakima Air Terminal -
McAllister Field as an important City asset, as well as promoting the general health, safety
and vvo|fmns of the {}ity'a residents and those utilizing the Airport; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The City Council hereby authorizes the receipt and use of funds in
the maximum amount of $861,200 Dollars, or such other amount as may become available
from the Passenger Facility Charges authorized pursuant toCity ofYakima Application No.
PFC-21-20-C-00-YPCM and applicable federal laws and regu|atione, to be used as
appropriate by the City ofYakima as a direct source of funding, as well asfor City required
matching funda, in support of financing programs and grants for designated capital
improvement projects for the `/okinno Air Term ina|-K8o4|lister Field and its facilities.
Section 2. The City Manager is hereby authorized to prepare, execute, submit
and administer applications and documents necessary or appropriate to secure the funding
authorized pursuant to Section 1 above, and to secure financing funds and grants using
such funds as appropriate for City required matching funds for capital improvement projects
for the Yakima Air Terminal -McAllister Field and its facilities.

Design, Engineer and Construct SRE Building
In 2016, the Federal Aviation Administration implemented Runway
Condition Assessment Matrix in order to increase aircraft safety during
inclement weather Since this change, the airport acquired additional
Snow Removal Equipment in order to meet new safety standards.
Currently, the airport has 11 pieces of Snow Removal Equipment
where the current size of the building can only accommodate up to 6
pieces of equipment, where the FAA requires the equipment to be
stored in a heated building. This project will expand the Snow
Removal Equipment building in order to accommodate the equipment.

Acquire Two High -Speed Runway Plows
In June 2017, the airport in conjunction with the airport's engineer
developed a design report in order to identified the quantity and type of
Snow Removal Equipment required during inclement weather The
design report highlighted the airport is required to have four
displacement plows in order to clear priority -one surfaces. This project
would replace a 1982 and 1996 displacement plow, which has outlived
their useful life.

In accordance with 158.23(a)(4), the airport will hold an Air Carrier Consultation Meeting at 9:00am, April 5th at the Airport
Administration Office, 2406 West Washington Ave, Suite B, Yakima, WA 98903 If any additional project information presents
itself, it will be available at that time By utilizing the PFC's funds we will be able to design, engineer, and expand the Snow
Removal Equipment building in order to ensure the airport's equipment is stored in a heated building while being ready to
respond during inclement weather Additionally, these funds will allow for the airport to replace two high-speed runway plows,
which has outlined their useful life and are required to meet FAA snow removal clearance requirements Furthermore, this
application allows for the design, engineer, and construction of Taxiway C extension, which is identified in the Airport Master
Plan to accommodate additional hangar development. Finally, by utilizing the PFC funds we will be able to complete these
needed projects in a timely manner

In accordance with 49 U.S.C. § 40117, the Federal Aviation Administration (FAA)
acknowledges your notice of intent to impose a PFC charge at Yakima Air Terminal/McAllister
Field (YKM) and to use PFC revenue at YKM. The authority to impose a PFC is contingent on
your continued compliance with the terms of 49 U.S.0 40117, 14 Code of Federal Regulations
(CFR) Part 158 and any conditions included in this letter.
Your notice of intent, submitted on May 26, 2021, has been assigned the following PFC
Application Number: 21-20-C-00-YKM. The FAA does not have any particular objections to
your notice of intent or proposed projects. Therefore, the FAA acknowledges that you will begin
collecting a PFC at a $4.50 PFC level on August 1, 2021 and complete your collections on
December 1, 2027. Furthermore, the FAA acknowledges that you will collect a total of $861,200
in PFC revenue to for the following projects:

The FAA also acknowledges your proposal to exempt that class of air carrier defined as Air
taxi/commercial operators - nonscheduled/on-demand air carriers, filing FAA Form 1800-31 that
are operating at YKM from the requirement to collect the PFC. We request that you notify the
carriers in this excluded class, which were listed in your notice of intent, of their exemption.
All public agencies collecting PFC's are subject to reporting, record keeping, and auditing
requirements as described in 14 CFR Part 158, Subpart D (14 CFR section 158.61 et. seq.).
Specifically, you are reminded that, pursuant to 158.67(c), at least annually during the period the
PFC is collected, held or used, each public agency shall provide for an audit of its PFC account.
After completion of your audit, please provide the ADO a copy of the audit.
Also be advised, that the ability to collect on PFC Application Number 21-20-C-00-YKM is
governed by either the charge -expiration date, noted above, or when full collection authority
(PFC collections plus interest) is reached - whichever comes first. Therefore, it is important to
monitor your rate of collection and adjust your charge expiration date as necessary.
Also, you are responsible for coordinating any construction with the appropriate federal offices
as you would with any non -federally funded construction.
Be advised, 14 CFR section 158.33(a)(1) requires you to implement your concurrent impose and
use project that the FAA has not objected to within the 2 years of this date. 14 CFR section
158.33(a)(1) requires the public agency to begin implementation of a project no later than 2 years
after receiving clearance to use PFC revenue on that project.
Finally, you must comply in accordance with your certification of 14 CFR Part 158 assurance
number 9, standards and specifications and ensure PFCs are used only for eligible components,
spaces and/or equipment.
