CITY OF YAKIMA, WASHINGTON
JULY 15, 1997
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington,
Mayor Lynn Buchanan, presiding. Council Members Clarence
Barnett, Henry Beauchamp, Ernie Berger, John Klingele, and
John Puccinelli present on roll call. Council Member
Bernard Sims absent and excused. City Manager Zais, City
Attorney Paolella, and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member
Puccinelli.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. INTRODUCTION OF NEW SALVATION ARMY DIRECTOR
Mayor Buchanan introduced David Sholin as the new Salvation
Army Director in Yakima. Mr. Sholin commented about the
changes taken place over the years and described some of
activities planned for Yakima.
B. PROCLAMATIONS (IF APPLICABLE)
Glenn Valenzuela, Director of Community and Economic
Development, introduced Bill Cook, the new Neighborhood
Development Services Manager.
Cec Vogt, member of the Bicycle /Pedestrian Advisory
Committee, presented copies of the new bike route map to the
Council. The map, which is available to the public, was
developed by the Bicycle /Pedestrian Advisory Committee, City
staff, and citizens. Ms. Vogt recognized the businesses in
the community. that financially sponsored the printing of the
maps and also introduced members of the Bicycle /Pedestrian
Advisory Committee. Several members of the community
commended the group for developing the map.
4. CONSENT AGENDA
Mayor Buchanan referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
It was the general consensus of the Council to remove Agenda
Item No. 11 from the Consent Agenda and to add Off Agenda
Item No. 14A to the Consent Agenda. The City Clerk then
read the Consent Agenda items, including resolutions and
ordinances by title. It was MOVED BY KLINGELE, SECONDED BY
PUCCINELLI, THAT THE CONSENT AGENDA, AS AMENDED, BE ADOPTED.
The motion carried by unanimous roll call vote; Sims absent.

5. AUDIENCE PARTICIPATION
There was no one wishing to speak.
I/ 6. PUBLIC HEARING TO CONSIDER SARGENT ANNEXATION (SEE ORDINANCE
ANNEXING PROPERTY)
This being the time set for the public hearing, Bruce
Benson, Associate Planner, provided information about the
single lot annexation located on the corner of North 58th
Avenue and Marilane which includes a total assessed
valuation area of $144,900. The city has received a
petition for annexation signed by the owners of one - hundred
percent of the area's assessed valuation.
Mayor Buchanan opened the public hearing and invited
testimony from the public. There being no one wishing to
speak, he closed the public hearing. Ordinance No. 97 -46
having been read by title only, it was MOVED BY KLINGELE,
SECONDED BY PUCCINELLI, TO PASS THE ORDINANCE. The motion
carried by unanimous roll call vote; Sims absent.
ORDINANCE NO. 97 -46, AN ORDINANCE annexing property to the
City of Yakima and zoning said property, effective
September 1, 1997, (Sargent Annexation).
*7. CONSIDERATION OF RESOLUTION AUTHORIZING AGREEMENT WITH THE
STATE OF WASHINGTON REGARDING SALES AND USE TAX COLLECTION
AND FEES
RESOLUTION NO. R-97-97, A RESOLUTION authorizing and
directing the City Manager and the City Clerk of the City of
Yakima to execute an Agreement with the State of Washington
Department of Revenue for the administration and collection
of an optional local sales and use tax.
*8. CONSIDERATION OF RESOLUTION AUTHORIZING ON- THE -JOB TRAINING
AGREEMENT WITH JAMES HENNESS AND THE DEPARTMENT OF LABOR AND
INDUSTRIES
RESOLUTION NO. R- 97 -98, A RESOLUTION authorizing and
directing the City Manager and the City Clerk of the City of
Yakima to execute an On- the -Job Training Agreement with
James Henness and representatives of the treatment facility.

ACTIVITIES
The report from Parks and Recreation regarding Bilingual
Program Activities was accepted.

*10. REPORT FROM WASTEWATER DIVISION REGARDING RESIDENTIAL
WASTEWATER STRENGTH AND RATE RECOMMENDATION
The report from the Wastewater Division regarding
residential wastewater strength and rate recommendation was
accepted.
11. REPORT REGARDING SPEED REDUCTION PROPOSAL FOR. NORTH 58TH
AVENUE REQUESTED BY YAKIMA COUNTY

Shelley Willson, Supervising Traffic Engineer, explained the
circumstances surrounding the County's request of the City
to consider reducing the speed limit to 20 mph on North 58th
Avenue between Englewood Avenue and Scenic Drive. The staff
recommendation is to maintain the 25 mph speed limit on
North 58th Avenue. Ms. Willson reported signs warning of
curves in the roadway have recently been installed.
Ms. Willson responded to questions concerning snow removal,
and she referred to other options to address the site
distance problem other than reducing the speed limit, such
as closing the hill off or the prudent driver's rule.
Council Member Barnett asked what was the basis of this
request from the Yakima County Commissioners.
James Carmody, 405 East Lincoln Avenue, provided background
information about the County Commissioner's request which
originated from safety and functionality concerns raised by
citizens during the County's public hearing process for the
De Atley subdivision application. Since the jurisdiction is
divided between the City and the County at this location,
the Commissioners made the request to the City to consider
lowering the speed limit on the portion of North 58th Avenue
from Scenic Drive to Englewood Avenue. This stretch of the
road is relatively steep and the primary safety concerns
expressed by the citizens during the public hearing involved
site distance from the proposed intersection on the west
side of 58th to serve the new development. Mr. Carmody
reported that in the context of the public hearing, there
was considerable testimony given concerning accidents. He
submitted copies of testimony from the Yakima County public
hearing. He submitted a transcript of testimony from Mary
Place during the public hearing concerning the problem with
access and minor accidents associated with North 58th
Avenue. Mr. Carmody urged the Council to reduce the speed
limit to 20 mph to increase the site distance. He feels the
speed limit reduction would increase the safety potential
for the functionality of the roadway in this area.
Bill Huibregtse, 3800 Sunimitview Avenue, presented a four -
page handout of site distance calculations and layout of
North 58th Avenue without any of the features of the
proposed intersection. He described the existing site
distance and access criteria for the intersection of North
58th Avenue and Marilane. He also described the proposed
access and site distance calculations for both the proposed
20 mph speed limit and the existing 25 mph speed limit.
Additionally, he also described the proposed access and site

located opposite the intersection of North 58th Avenue and
Marilane. He suggested the arborvitae, located in public
right -of -way of the newly annexed property of the Sargent
Annexation, be removed to improve the site distance at the
intersection.
Al De Atley, 8710 Hawthorne Drive, expressed concern about
the liability associated with the site distance issue and
questioned the City staff recommendation to retain the
25 mph speed limit on North 58th Avenue.
Fred Rowland, 5604 Marilane, disagreed with the 20 mph speed
reduction proposal because he doesn't think the drivers will
go 20 mph. He feels the site distance of 290 feet should be
done as well as other safety considerations.
Karen Kerns, 5605 Marilane, feels the layout of the land is
the reason for the unsafe conditions and feels there should
be more than one entrance proposed for the new subdivision
to handle the increased traffic which will be created by the
new development. Council Member Puccinelli pointed out that
the City only has jurisdiction to consider the speed limit
issue, not property development issues.
Mary Place, 5710 Marilane, asked for no speed reduction on
North 58th Avenue. As a point of clarification, she
explained that the Commissioners' recommendation on the
record from their public hearing is to close North 58th
Avenue, but has been changed to . recommend the speed limit
reduction to 20 mph. She pointed out that the letter from
the Commissioners and the form letters came from County
residents, and theirpetition was signed by City residents.
She explained the reasons °why they are requesting the speed
limit stay the same. She feels cars and trucks will not be
able to get up the hill on North 58th Avenue in ice or snow
going 20 mph. Ms. Place indicated she is very happy with
the new advisory signs installed recently and she urged the
Council to retain the 25 mph speed limit until the new
intersection is established and then the situation could be
reviewed again. She reported this issue is in litigation,
and the major problem is the hindrance of site distance.
She feels 290 feet is not sufficient and provided some
handouts to the Council concerning information from WSDOT
about site distance and braking distance for turning
vehicles. Also included in the information is a copy of a
letter from Dan Hesse. She reported information in the
handout indicates a site distance recommendation of 290 feet
for 25 mph. She also feels entrance will not accommodate
I/ big trucks; she indicated nine trees have been removed from
the right -of -way; one more tree will be removed if it is
necessary.
James Carmody explained the reduced speed limit would
provide adequate site distance and feels the speed limit
should be reduced based on the previous testimony of
speakers at the County's public hearing.

Council Member Puccinelli feels the 20 mph would not allow
people to make it up the hill in ice and snow. Council
Member Berger pointed out that with unrealistic speed
limits, people actually ignore the speed limits.
Shelley Willson described the various locations of the curb
warning for the grade and speed limit signs which were
recently installed. It was MOVED BY KLINGELE, SECONDED BY
BARNETT, TO ADOPT THE STAFF RECOMMENDATION TO WHICH
MAINTAINS THE 25 MPH SPEED LIMIT. The motion carried by
unanimous voice vote; Sims absent.
*12. APPROVAL OF 4TH QUARTER 1996 TREASURY REPORT
The 4th Quarter 1996 Treasury Report was accepted.
*13. SECOND READING OF ORDINANCE AUTHORIZING THE USE OF CREDIT
CARDS FOR VARIOUS PURPOSES
An Ordinance authorizing the use of credit cards for
various purposes, previously having been read by title
only, was brought before the Council for a second
reading.
ORDINANCE NO. 97 -47, AN ORDINANCE adopting a system for the
issuance, use and control of credit cards by City officials
and employees; and directing the Department of Finance and
Budget to adopt rules and procedures to implement such
system.
14. OTHER BUSINESS
Mayor Buchanan explained there has been pressure from
various citizens to establish a sister city relationship and
he would like a committee appointed to address this. He
suggested Council Members Beauchamp and Puccinelli sit on
the committee, with him to look into appointing a committee
of citizens. It was the censensus of the Council to
approvce this request.
*A. SET DATE OF PUBLIC MEETING FOR AUGUST 5, 1997 TO
CONSIDER HEARING EXAMINER RECOMMENDATION ON GATEWAY
CENTER REZONE
August 5, 1997 was set as the date of public meeting to
consider the recommendation from the Hearing Examiner
regarding a rezone application for the Gateway Center, Phase
2 site, filed by Gateway Center Partnership and Gary
Lukehart.
