1. EXECUTIVE SESSION REGARDING PERSONNEL (CITY MANAGER ANNUAL
EVALUATION)
The City Council met in executive session on this date at
11:30 a.m. to conduct the annual evaluation of the City
Manager's performance, in the Veranda Room at Cavanaugh's,
Yakima, Washington Mayor Lynn Buchanan, presiding,
Council Members Clarence Barnett, Henry Beauchamp, Ernie
Berger, John Klingele, John Puccinelli, and Bernard Sims
were present. City Manager Zais was also present for a
portion of the meeting. ,
The meeting adjourned at 1:25 p.m.

BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington,
Mayor Lynn Buchanan, presiding. Council Members Clarence
Barnett, Henry Beauchamp, Ernie Berger, John Klingele, John
Puccinelli, and Bernard Sims present on roll call. City
Manager Zais, City Attorney Paolella, and City Clerk Roberts
also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Buchanan.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Council Member Berger announced that former Fire Chief and
Council Member W. K. "Pete" Moore passed away this past

week. He announced that the funeral will be this Saturday
at 11:00 a.m. at First Presbyterian Church.
A. PROCLAMATIONS
• BUD WILLIAMS DAY
Mayor Buchanan read a proclamation for Bud Williams Day.
Mr. Williams was present to accept the proclamation.
Several citizens spoke in tribute to Mr. Williams and
Snookie gave a performance in his honor.
• AMERICAN RED CROSS 80TH ANNIVERSARY
Council Member Klingele read a proclamation declaring the
80th American Red Cross Anniversary. The proclamation was
presented to Craig Naas and Frank Gutierrez, American Red
Cross members.
• NATIONAL PUBLIC WORKS WEEK
Council Member Berger read a proclamation declaring May 18-
24, 1997 as National Public Works Week. The proclamation
was presented to Bill Schultz, Transit Manager, accepting
for Jerry Copeland, Public Works Manager.
• HIRE A VETERAN MONTH
Council Member Puccinelli read a proclamation declaring June
as Hire a Veteran Month. The proclamation was accepted by
Bob Harcum.
4. CONSENT AGENDA
Mayor Buchanan referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
It was the general consensus of the Council to remove Item
No. 17 from the Consent Agenda. The City Clerk then read
the Consent Agenda items, including resolutions and
ordinances by title. It was MOVED BY SIMS, SECONDED BY
PUCCINELLI, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED.
The motion carried by unanimous roll call vote. (Subsequent
paragraphs preceded by an asterisk ( *) indicate items on the Consent
Agenda handled under one motion without further discussion.)
*5. APPROVAL OF THE MINUTES OF THE MAY 6, 1997 ADJOURNED MEETING
The minutes of the May 6, 1997 Adjourned meeting was
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. PUBLIC HEARING TO CONSIDER TCI CABLE TV FRANCHISE REVIEW
This being the time set for the public hearing, Randy
Beehler, Cable Communications Manager, reviewed the staff
report. The purpose of the franchise review was to

determine TCI's compliance with all provisions of the
franchise ordinance and the continued effectiveness of the
franchise to serve the community needs. The staff
recommendation is to accept the findings of the review,
which was favorable, and to direct staff to prepare
legislation to extend the franchise with TCI for an
additional year. Mayor Buchanan opened the public hearing
for citizen testimony. There being no citizen wi'shing to
speak to this issue, the public hearing was closed. Council
Member Klingele commented that TCI needs to pay more
attention when changes are made by the power company to the
poles. He stated that some of their equipment is hanging on
ropes. It was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO
GRANT THE ONE YEAR EXTENSION TO TCI. The motion carried by
unanimous voice vote.
7. AUDIENCE PARTICIPATION
There was no citizen present wishing to speak at this time.
8. REPORT FROM PARKS AND RECREATION REGARDING YARD OF THE MONTH
PROGRAM
Denise Nichols, Parks and Recreation Manager, and Jessica
Rowe, intern from Washington State University, described the
proposed Yard of the Month Program. The program is designed
to enhance the appearance of the City by recognizing
citizen's efforts to beautify their property. The city
would be divided into four quadrants and, based upon
nominations, would recognize four residents with a
certificate presented at a Council meeting. Ms. Nichols and
Ms. Rowe responded to Council's questions concerning the
mechanics of the program. Ms. Nichols reported that at the
first Council meeting each month between May and September,
staff will present to Council the award winners to receive
their certificates.
*9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AMENDED
GATEWAY CENTER FINAL PLAT FOR PROPERTY LOCATED IN THE
YAKIMA /I -82 INTERCHANGE
RESOLUTION NO. R- 97 -71, A RESOLUTION authorizing the mayor
to sign the Amended Yakima Gateway Center Final Plat.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AMENDMENT TO AGREEMENT WITH THE SOCIAL SECURITY
ADMINISTRATION REGARDING INCENTIVE PAY FOR INFORMATION
RESOLUTION NO. R- 97 -72, A RESOLUTION authorizing the City
Manager and the City Clerk to execute an Agreement and
Addendums between the City of Yakima and the Social Security
Administration for purposes of the City receiving incentive
pay for providing certain information to the Social Security
Administration.

*11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH ALLIED.,ARTS FOR „.,YOUTH ARTS PROGRAM
RESOLUTION NO. R- 97 -73, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement between the City of Yakima and the Allied Arts
Council of Yakima Valley, to provide a visual and performing

arts program for youth.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH THE SALVATION ARMY FOR SUMMER PLAYGROUND
PROGRAM AT MILROY PARK
RESOLUTION NO. R- 97 -74, A RESOLUTION authorizing the City
Manager and City Clerk of the City of Yakima to execute an
agreement between the City of Yakima and the Salvation Army,
a California corporation, to provide a summer playground
program at Milroy Park.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH CHARRON COMPANY FOR BENEFICIAL UTILIZATION OF
WASTEWATER TREATMENT PLANT BIOSOLIDS
RESOLUTION NO. R- 97 -75, A RESOLUTION authorizing the renewal
of a contract with Charron Company, Inc. for utilization of
Wastewater Treatment Plant Biosolids.
*14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AMENDMENT NO. 2 TO CONTRACT WITH GRAY AND OSBORNE, INC.
REGARDING TAMARACK PUMP STATION CONSTRUCTION
RESOLUTION NO. R- 97 -76, A RESOLUTION authorizing the
amendment of an agreement for professional services between
the City of Yakima, a municipal corporation, and Gray &
Osborne, Inc.
*15. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH DAMES AND MOORE, INC. FOR PROCESS SAFETY /RISK
MANAGEMENT PROGRAM DEVELOPMENT AND SAFETY PLAN REVIEW
RESOLUTION NO. R- 97 -77, A RESOLUTION authorizing the City
Manager and the City Clerk of the City of Yakima to execute
an Agreement for Professional Engineering and Consulting
Services with Dames and Moore, Inc.
*16. NOTICE OF INTENT TO COMMENCE MCKINLEY AVENUE ANNEXATION
(STANDARD MOTIONS A & B)
May 20, 1997 was set as the time of a meeting with the
initiating parties who have signed a Notice of Intent to
Commence Annexation Proceedings, the initiating party being
Yakima Women's Christian Association.
The annexation proposed by the Yakima Women's Christian
Association was accepted by the City of Yakima and the area
to be annexed was required to assume its share of the City's
existing indebtedness, and staff was directed to file a

Notice of Intent to Annex with the Yakima County Boundary
Review Board.
17. APPROVAL OF FINAL CONTRACT PAYMENT FOR POWERHOUSE CANAL
PATHWAY PROJECT (STANDARD MOTION V -B -- ACCEPT PROJECT AND APPROVAL FINAL
PAYMENT )
Council Member Puccinelli reported that Council previously
heard testimony from a citizen concerned about children
playing in this area, scaring away the birds and wildlife.
A second concern is the lack of parking for this play area.
Ms. Nichols responded that it was over three years ago that
the grant money was received for this pathway, at which
staff later determined there was space for a playground.
She stated that after recent consideration of this project,
a public meeting was held with the local residents about the
project. The residents are also concerned about too much
development in that area; they want benches and garbage cans
only. Staff is considering options such as barriers to keep
vehicles off the pathway and determined the playground is
not a viable option at this time. Council Member Puccinelli
asked if the report needs to be amended before Council
authorizes the final payment. Fred French, City Engineer,
recommended Council proceed with approving this report
because the final contract payment for this project only
relates to the contract for installed improvements. It was
MOVED BY SIMS, SECONDED BY KLINGELE, TO APPROVE THIS
CONTRACT FOR FINAL PAYMENT. The motion carried by unanimous
voice vote.
*18. APPROVAL OF FIRE DEPARTMENT 1996 ANNUAL REPORT
The 1996 Annual Report of the Fire Department Activities was
approved.
*19. APPROVAL OF APRIL 1997 REVENUE AND EXPENDITURE REPORT
The April 1997 Revenue and Expenditure Report was approved.
20. CONSIDERATION OF LEGISLATION AMENDING THE MUNICIPAL CODE
REGARDING WASTEWATER CONNECTION FEE
Chris Waarvick, Wastewater Superintendent, and Doug Mayo,
Supervising Sanitary Engineer, were available to respond to
questions posed by the Council concerning the basis for the
connection charge and future increases. Mr. Waarvick
commented that if the connection fee is not accepted, then
the needed revenue will have to come from increased monthly
rates; to raise one million dollars would necessitate a 15%
increase. Steve Fuhriman, Central Washington Home Builders
Association, commented that the Association is not
expressing opposition to the study or the ordinance, but is
requesting Council to delay action for several weeks until
they have more time to review the study. Ron Anderson,
Governmental Affairs Chair for the Yakima Realtors, also
asked Council to delay taking action on this item for two
weeks. Marty Miller, Office of Rural and Farm Worker
Housing, submitted a letter to Council, and requested
Council give consideration of the impact this has on

affordable housing. Council. Member Puccinelli asked if
there would be any" " problem•;; c reated by delaying action on
this item. Mr. Waarvick responded that a short delay would
not create any problems. Dick Anderwald, Yakima County
Planning Director, referenced the County Commissioner's
letter requesting a delay of more than two weeks. The
I/ County is considering engaging a consultant to study the
feasibility of a County sewer system; however, a contract
would not be signed until June or July. He requested a
delay of 75 days. Mayor Buchanan calculated that a delay of
three months would equate to a 3 -4% increase of rates for
City residents. Mr. Anderwald stated the minimum time the
County would need to review this information is one month.
Following further discussion, it was MOVED BY PUCCINELLI,
SECONDED BY BERGER, TO MOVE THIS RATE INCREASE TO BE
DISCUSSED AT THE JUNE 3, 1997 MEETING. Council Member
Beauchamp encouraged the Council to grant a 30 day delay for
the County to review this issue. The question was called
for a vote on the motion. The motion carried by 6 -1 voice
vote; Beauchamp voting nay.
• *21. CONSIDERATION OF ORDINANCE AMENDING THE MUNICIPAL CODE
REGARDING PLANTERS ON SIDEWALKS
ORDINANCE NO. 97 -34, AN ORDINANCE relating to sidewalk cafes
and street beautification projects repealing Chapter 8.16 of
the City of Yakima Municipal Code; and amending sections
5.80.010, 5.80.020, 5.80.030, 5.80.040, 5.80.060, 5.80.070,
5.80.080, and 5.80.090.
*22. CONSIDERATION OF ORDINANCE AMENDING THE CLASSIFICATION AND
COMPENSATION PLAN FOR THE GRANTS WRITER /COMPLIANCE OFFICER
POSITION
ORDINANCE NO. 97 -35, AN ORDINANCE relating to City
personnel; adopting a classification and compensation plan
for City employees to be effective June 22, 1997; amending
Subsections 2.20.100 A, 2.20.100 C, 2.20.110 A, and
2.20.110 G, all of the City of Yakima Municipal Code.
*23. FIRST READING OF ORDINANCE AMENDING THE 199.7 BUDGET AND
APPROPRIATING FUNDS FOR DEVELOPMENT OF PROVIDENCE
NEIGHBORHOOD PLAN (NO ACTION REQUIRED THIS MEETING)
An Ordinance amending the 1997 budget and appropriating
funds for the development of a neighborhood plan for the
vicinity of Providence Medical Center having been read by
title only, was laid on the table• for two weeks, until
June 3, 1997.
*24. CONSIDERATION OF ORDINANCE REZONING PROPERTY IN THE VICINITY
OF 1111 EAST MEAD REQUESTED BY FLOYD BLINSKY
ORDINANCE NO. 97 -36, AN ORDINANCE rezoning 0.88 acre in the
vicinity of 1111 East Mead in Yakima, Washington, from Two -
Family Residential (R -2) to Light Industrial (M -1) and
amending the zoning map of the Yakima Urban Area
accordingly.

*25. CONSIDERATION OF ORDINANCE GRANTING WASHINGTON MIDDLE SCHOOL
RIGHT -OF -WAY VACATION
ORDINANCE NO. 97 -37, AN ORDINANCE relating to zoning and
land uses; vacating portions of the right -of -way of both
Maple Street an South Seventh Street near Washington Middle
School; granting Class 3 approval of a parking lot with 18-
foot parking stalls; and granting an administrative
adjustment allowing 82% lot coverage.
26. OTHER BUSINESS
Mayor Buchanan noted that the Parks Division is planting
Cherry trees in place of Hawthorne trees and inquired if the
City has a sprayer to care for these trees. City Manager
Zais stated he would obtain the answer to the Mayor's
question.

It was MOVED BY KLINGELE, SECONDED BY PUCCINELLI, TO MOVE
INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING
PROSPECTIVE LITIGATION, FOLLOWED BY IMMEDIATE ADJOURNMENT.
The motion carried by unanimous voice vote.
28. ADJOURNMENT
Following the conclusion of the executive session, the
meeting adjourned at 3:35 p.m.
