HomeMy WebLinkAbout2013-002 Yakima Arts Commission; Amending Membership, Vacancies and Attendance; YMC 1.36.030ORDINANCE NO. 2013 -002 AN ORDINANCE relating to the Yakima Arts Commission; amending Section 1.36.030 of the Yakima Municipal Code regarding membership, vacancies and attendance. WHEREAS, the City Council has previously adopted ordinances establishing the Yakima Arts Commission and providing criteria for membership and duties of the commission, all as codified at Chapter 1.36 YMC; and WHEREAS, the City Council finds and determines that Section 1.36.030 YMC should be amended to supplement existing procedures and implement new procedures regarding membership, vacancies and attendance; and WHEREAS, the City Council finds and determines that Section 1.36.030 YMC should be amended as shown and set forth in Exhibit "A" attached hereto and by this reference incorporated herein, and that such amendment is in the best interest of residents of the City of Yakima and will promote the general health, safety and welfare; now, therefore BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.36.030 of the Yakima Municipal Code is hereby amended to read as set forth in Exhibit "A" attached hereto and incorporated herein. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. A Membership The Yakima arts commission shall have no less than thirteen and no more than fifteen members, comprised as follows 1 A Two working artists ( "working artist' shall be a person who has had their works of art exhibited in professional gallery spaces and /or has had their work included in professionally buried exhibitions or permanent collections), 249 Four to six community members, of which at least three shall be residents of the city of Yakima The community members shall be from diverse backgrounds and shall have no vested interest in any particular art or cultural endeavor, 2_4; Six persons each of whom represents one of the following six professionally staffed local arts organizations the Yakima Symphony Orchestra, the Capitol Theatre, Allied Arts of Yakima Valley, the Seasons Music Festival, the Larson Gallery, and the Yakima Valley Museum, 49 One member of the Yakima city council If any of the local arts organizations listed in subsection (3) above fails to present a person qualified to be appointed as the member representing the interests of such organization on the commission within sixty (60) days after notification by certified mail, return receipt requested, from the commission that such vacancy exists, the city council may appoint an additional community member, or working artist who works in the general field of that local arts organization Upon qualification and appointment of such community member or working artist, such community member or working artist shall serve the full term of the position of member representing such local arts organization B Terms of Service, 1 Term of Appointment All members shall be appointed by the Yakima city council The initial commission members shall serve staggered terms One -third of the initial total membership shall be appointed for an eighteen -month term, one -third shall be appointed for a thirty -month term, and one -third shall be appointed for a forty- two -month term Thereafter, appointed members shall each serve a four - year term, with each term ending on June 30th of its termination year No member shall serve for more than two four -year terms 2 Attendance If a member is absent without excuse, or without advance permission of the commission, from three consecutive regular meetings of the commission, or from twenty -five percent (25 %) of the duly scheduled meetings of the commission within any calendar year, the membership shall be deemed vacant and shall be filled as any other vacancy 1 BUSINESS OF THE CITY COUNCIL YAKIMA, WASHINGTON AGENDA STATEMENT / 1 Item No. l For Meeting of: February 5, 2013 ITEM TITLE: Ordinance amending YMC 1.36.030 regarding membership, vacancies and attendance for Yakima Arts Commission. Chapter 1.36 YMC describes the functions of the commission as well as criteria for selection and appointment of commission members. The commission has requested an amendment to YMC 1.36,030 to define procedures for filling vacant positions and establishing attendance criteria. The attached ordinance amends YMC 1.36.030 to establish procedures to notify participating organizations of vacant positions, provide for filling of vacant positions, and establish attendance requirements. The City Council retains the right to appoint all members to the commission, and it is anticipated that the new procedures will enhance the purposes and efficiency of the Yakima Arts Commission.
