ROLL CALL The City Council met in- session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington, Mayor Lynn Buchanan, presiding. Council Members Clarence Barnett, Henry Beauchamp, Ernie Berger, John Klingele, John Puccinelli, and Bernard Sims present on roll call. City Manager Zais, City Attorney Paolella, and City Clerk Roberts also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Council Member Klingele. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) There were no items presented for Council consideration. 4. CONSENT AGENDA Mayor Buchanan referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council to remove Item No. 12 from the Agenda and to add Items Nos. 6 and 7 A & B to the Consent Agenda. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY KLINGELE, THAT THE CONSENT AGENDA, AS AMENDED, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE SEPTEMBER 17, 1996 BUSINESS MEETING, OCTOBER 8, 1996 ADJOURNED MEETING AND NOVEMBER 19, 1996 BUSINESS MEETING The minutes of the September 17, and November 19, 1996 Business meetings and October 8, 1996 Adjourned meeting were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. *6. PRESENTATION OF YAKIMA VALLEY CONFERENCE OF GOVERNMENTS' PROPOSED 1997 BUDGET Council Member Barnett indicated that information has been requested from Lon Wyrick and he asked that City Clerk Roberts pass them out to the Council. 240 DECEMBER 3, 1996 The Proposed 1997 Budget of the Yakima Valley Conference of Governments was accepted. *7. CONSIDERATION OF AIRPORT BUDGET ISSUES: A. CONSIDERATION OF JOINT RESOLUTION APPROVING AMENDMENT NO. 2 TO THE 1996 AIRPORT BUDGET RESOLUTION NO. R -96 -154, A JOINT RESOLUTION Of the City of Yakima and Yakima County approving the Yakima International Airport - McAllister Field 1996 Budget Amendment #2. B. PRESENTATION OF PROPOSED 1997 BUDGET RESOLUTION NO. R -96 -155, A RESOLUTION approving the Yakima International Airport - McAllister Field 1997 Budget. 8. PUBLIC HEARING ON NORTH 21ST AVENUE ANNEXATION (SEE ORDINANCE ANNEXING PROPERTY) This being the time set for the public hearing, Bruce Benson, Associate Planner, briefly described the North 21st Avenue proposed annexation area located within the Fruitvale Fire Protection District. The area has an assessed valuation of $2,193,250 and is approximately 13.88 acres in size. He reported that signed petitions or Outside Utility Agreements have been received from 83% of the property owners within the assessed valuation area. Mr. Benson urged the Council to approve the ordinance annexing the property into the City of Yakima. Mayor Buchanan opened the public hearing for public comment. Claudia Koehler, 522 North 22nd Avenue, expressed concern about having to connect to City water and sewer and the service connection fees and regular billings associated with that. She also asked about snow removal and taxes. She is currently on private well water and septic tank. Mayor Buchanan explained that unless the private systems fail, there is no requirement to connect to City water and sewer, and garbage collection will remain with the current service for about five years. Mayor Buchanan asked if anyone else would like to comment about the proposed annexation. There being no one else wishing to speak, he closed the public hearing. Ordinance No. 96 -76 having been read by title only, it was MOVED BY SIMS, SECONDED BY PUCCINELLI, TO PASS THE ORDINANCE. The motion carried by unanimous roll call vote. ORDINANCE NO. 96 -76, AN ORDINANCE annexing property to the City of Yakima and zoning said property, effective February 1, 1996. (North 21st Avenue Annexation) 2 DECEMBER 3, 1996 241 9. PUBLIC HEARING ON ENGLEWOOD AT 24TH AVENUE ANNEXATION (SEE ORDINANCE ANNEXING PROPERTY) This being the time set for the public hearing, Bruce Benson, Associate Planner, briefly described the proposed Englewood at 24th Avenue Annexation which is contiguous to the North 21st Avenue Annexation passed in Item No. 8. The area's valuation is $596,650. The City has received petitions or utilized Outside Utility Agreements signed by the owners of 77 percent of the area's assessed valuation. Mr. Benson urged the Council to approve the ordinance annexing the property into the City of Yakima. Mayor Buchanan . opened the public hearing and invited public comment. There being no one wishing to comment, he closed the public hearing. Ordinance No. 96 -77 having been read by_title only, it was MOVED BY SIMS, SECONDED BY PUCCINELLI, TO PASS THE ORDINANCE. The motion carried by unanimous roll call vote. ORDINANCE NO. 96 - 77, AN ORDINANCE annexing property to the City of Yakima and zoning said property, effective February 1, 1996. (Englewood at 24th Avenue Annexation) 10. AUDIENCE PARTICIPATION • Jeff Marshall, 1108 Ledwich Avenue, expressed dissatisfaction with snow removal efforts of the City. There was discussion about the equipment limitations experienced during the recent record snowfall. The Council will be reviewing the snow removal program in the near future. Keith Larrabee, 2919 South 90th Avenue, Ted .Flynn, Cadillac Ted's Cab Company, Joe Garcia, South 18th Street, Dan Nichols, Jerry Henderson, and Bob Clem, Airport Manager, addressed the Council regarding airport policy relating to taxi service at the airport. After a considerable amount of discussion about the loading zone, it was MOVED. BY SIMS, SECONDED BY BERGER, TO SCHEDULE A JOINT MEETING WITH YAKIMA COUNTY AND ALL AFFECTED PARTIES TO RESOLVE THE DIFFERENCES. The motion carried by unanimous voice vote. Council directed staff to schedule the meeting. Jake Rufer, South 38th Avenue, spoke about the Airport Master Plan, and there was discussion about the Growth Management process. Aileen Kane, 803 North 5th Avenue, expressed satisfaction with the Transit service during the recent winter weather with bad road conditions. Lynn Kittelson complained about ice and snow on the sidewalks making it impossible for those who walk. She encouraged home owners as well as businesses to clean the sidewalks of the solid ice. There was a considerable amount of discussion about the snow removal. 3 242 DECEMBER 3, 1996 *11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AMENDED PURCHASE AND SALE AGREEMENT WITH MICHAEL AND KATHY MERCY REGARDING PROPERTY AT THE NE CORNER OF EAST SPRUCE AND SOUTH THIRD STREET RESOLUTION NO. R -96 -156, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Purchase and Sale Agreement with Michael M. Mercy and Kathy Mercy, husband and wife, for the purchase of unimproved property located at Spruce and Third Streets in the City of Yakima. *12. APPROVAL OF RIGHT -OF -WAY USE PERMIT FOR SIGN IN THE VICINITY OF RIVER ROAD, REQUESTED BY BUTLER /HANEY This item was removed from the agenda. *13. CONSIDERATION OF CITY OF YAKIMA 1997 LEGISLATIVE PRIORITIES The list of 1997 Draft City /County Legislative Issues was accepted. *14. SET DATE OF PUBLIC HEARINGS FOR DECEMBER 17, 1996 FOR: A. RASMUSSEN ANNEXATION December 17, 1996 was set as the date of hearing to consider the Rasmussen annexation petition. B. NORTH SCENIC ANNEXATION December 17, 1996 was set as the date of hearing to consider the North Scenic annexation petition. *15. APPROVAL OF OCTOBER 1996 REVENUE AND EXPENDITURE REPORT (BUDGET) The October 1996 Revenue and Expenditure (Budget) Report was approved. *16. CONSIDERATION OF ORDINANCE AMENDING THE MUNICIPAL CODE RELATING TO COURT FILING FEE ORDINANCE NO. 96 -78, AN ORDINANCE relating to City government administration: setting filing and warrant fees and amending Section 1.60.070 of the City of Yakima Municipal Code. *17. SECOND READING OF ORDINANCE AMENDING THE 1996 BUDGET AND APPROPRIATING FUNDS FOR WATER RIGHTS LITIGATION EXPENSES An Ordinance amending the 1996 budget and appropriating funds for water rights litigation costs and Irrigation System repair costs previously having been read by title only, was brought before the Council for a second reading. 4 DECEMBER 3, 199 243 • ORDINANCE NO. 96 -79, AN ORDINANCE amending the 1996 budget for the City of Yakima; making appropriations for Water Rights Litigation and Irrigation System Repair Costs from Unappropriated Fund Balances within various Funds for expenditure during 1996. 18. OTHER BUSINESS It was MOVED BY BEAUCHAMP, SECONDED BY PUCCINELLI, TO RE- APPOINT TO THE DARC SEVEN MEMBERS .CURRENTLY SITTING IN THAT POSITION INCLUDING BERT MCDONNELL (POSITION 2), JOSEPH MORRIER (POSITION 3); PAUL CAMPBELL (POSITION 4); PAT GILMORE (POSITION 6); MEL LEWIS (POSITION 9); ROBERT CRISP (POSITION 10); AND BRUCE SMITH (POSITION 11). The motion carried by unanimous voice vote. Information Items: Items of information provided to Council were: Letter from Donna Hill urging Council not to change the format of Yakima Community TV. 11/26/96; Letter from Wendy Warren in opposition to Council Budget Policy Issue to eliminate public access TV. 11/26/96; Fire Department Monthly Activity Report for October 1996; Assignments Pending in Office of Environmental Planning as of November 5, 1996; and Yakima Wastewater Treatment Facility Progress Report for September 1996. 19. EXECUTIVE SESSION REGARDING PENDING AND PROSPECTIVE LITIGATION AND DISPOSITION OF PROPERTY: A. ACQUAVELLA B. TERRACE HEIGHTS /UNION GAP BILLING DISPUTE C. FORMER FIRE STATION NO. 2 ON 7TH AVENUE (material available Tuesday) D. HEARING EXAMINER INTERPRETATION E. DONNA PEARCY COMPLAINT FILED BY D. PUTNEY It was MOVED BY PUCCINELLI, SECONDED BY KLINGELE, TO ADJOURN TO EXECUTIVE SESSION FOR APPROXIMATELY 30 MINUTES TO DISCUSS PENDING AND PROSPECTIVE LITIGATION AND DISPOSITION OF PROPERTY. City Manager Zais reported that the adjourned meeting scheduled for December 16 was changed to December 18, 1996. The question was called for a vote on the motion.
