For Meeting of: March 16, 2021 ITEM TITLE: Resolution authorizing an addendum to an Agreement with Perteet, Inc. for the Cowiche Canyon Trail Project SUBMITTED BY: Scott Schafer, Director of Public Works Bill Preston, City Engineer- (509) 575-6754 SUMMARY EXPLANATION: In June of 2015, the Cowiche Canyon Trail project was selected as one of the Tier 2 Pedestrian and Bicycle Safety Projects of the Connecting Washington funding program; awarding the City of Yakima (City)with a$2,000,000 Connect Washington grant. The project is to further extend the Cowiche Canyon Trail by constructing approximately two miles of new pathway with bike/pedestrian bridges. In 2017, the City used the MRSC Roster process to select Perteet, Inc. to develop the project and design the plans. Design is well underway and final plans are due June 30, 2021. In order to go to ad, a Joint Aquatic Resources Permit Application (JARPA) must be submitted, and approved, to complete the environmental documentation. The JARPA was not part of the original scope of work for the Perteet contract. Since Perteet has the project knowledge, and the expertise to complete the JARPA, an addendum is required to add this work to the Perteet Agreement. The terms of the Addendum to the Agreement (Amendment No. 4)with Perteet shall be in an amount not to exceed $34,680 and has been attached for City Council review. The expenditure of$34,680 for the JARPAwill be funded out of the $2,000,000 Connect Washington grant. R-2021- A RESOLUTION authorizing an Addendum to an Agreement with Perteet, Inc. for the Cowiche Canyon Trail Project; WHEREAS, the Yakima City Council has accepted a 2015 grant from the State Legislature's Tier 2 Pedestrian and Bicycle Safety Projects as part of the Connecting Washington funding program in the amount of $2,000,000; and WHEREAS, the City of Yakima followed the procedure established by the State of Washington to select and recommend an engineering consulting firm using the Municipal Research and Service Center (MRSC) Professional Services Roster process to select a firm to perform the design work; and WHEREAS, Perteet, Inc. was determined to be the most qualified firm to prepare the plans and oversee the work, and has shown that they are qualified to perform the work required; and WHEREAS, Perteet, Inc. already has the plans, specifications, and project details needed to complete the required Joint Aquatic Resources Permit Application (JARPA) accurately and timely; and WHEREAS, the amended Scope of Work and Budget included in this addendum meet the needs and requirements of the City of Yakima for this project in the amount not to exceed $34,680; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute an Addendum to an Agreement between the City of Yakima, Washington and Perteet, Inc. attached hereto and incorporated herein by this reference not to exceed Thirty-Four Thousand, Six Hundred and Eighty Dollars ($34,680) to provide the professional services to complete the JARPA as described in the Addendum to the Agreement. All provisions in the basic agreement remain in effect except as expressly modified by this amendment. The changes to the agreement are described as follows: SECTION 2: SCOPE OF SERVICES The original scope of services will be amended to include additional services to complete the project as described in Exhibit"A",attached hereto and made a part of this agreement. SECTION 5: COMPENSATION This section shall be amended as follows: These additional services will cause an increase in the amount of Thirty-Four Thousand Six Hundred and Eighty Dollars ($34,680). These additional services will be invoiced in accordance with Exhibit"B",fee determination and 2021 Hourly Rates for Perteet and subconsultants, attached hereto and made a part of this agreement.
