AN ORDINANCE relating to downtown vehicle parking; repealing Chapter 9.49 of
the Yakima Municipal Code regarding downtown Yakima parking
commission; amending Section 9.50.215 regarding parking in city -
owned public parking lots.
WHEREAS, the City Council has previously adopted ordinances creating and
defining duties and powers of the Downtown Yakima Parking Commission, as codified at
Chapter 9.49 of the Yakima Municipal Code ( "YMC "); and has previously adopted
ordinances designating and regulating downtown vehicle parking and public parking lots,
as codified at Chapter 9.50 YMC; and
WHEREAS, the City Council finds and determines that Chapter 9.49 YMC
pertaining to the Downtown Yakima Parking Commission should be repealed; and
WHEREAS, the City Council finds and determines that Section 9.50.215 YMC
regarding vehicle parking in city -owned public parking lots should be amended to
facilitate public use of such lots; and
WHEREAS, the City find finds and determines that such amendments and
repeals are in the best interest of residents of the City of Yakima and will promote public
use and economic development of downtown Yakima, and will promote the general
health, safety and welfare; now, therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 9.49 YMC is hereby repealed, with the powers and duties
formerly exercised by the Downtown Yakima Parking Commission vested in the City
Council.
Section 2. Section 9.50.215 YMC is hereby amended to read as follows, as
shown in legislative format:

Parking Regulated.
A. "City -owned parking lot" means each of the following city -owned public
parking lots:
Lot 1. East "A" Street Parking Lot — Lots 23 through 32 BLOCK 50 of
the Town of North Yakima (now City of Yakima). This parking lot is
bounded on the west by North 2nd Street, and on the north by East "A"
Street
Lot 2. South 3rd Street Parking Lot — Lots 13 through 32, BLOCK 51, of
the Town of North Yakima (now City of Yakima). This parking lot is
bounded on the east by South 3rd Street, on the south by East Chestnut
Avenue. and on the west by South 2nd Street.
Lot 4. North 1 st Street and East "A" Street Parking Lot — Lots 23 through
27, BLOCK 50, of the Town of North Yakima (now City of Yakima). This
parking lot is bounded on the north by East "A" Street and on the west by
North 1 st Street.
Lot 5. North 1St Street Parking Lot — Lots 13 through 19, BLOCK 10, of
the Town of North Yakima (now City of Yakima). This parking lot is
bounded on the east by North 1St Street.
Lot 6. South 2nd Street Parking Lot — Lots 8 and 9, BLOCK 32. This
parking lot is located at 112 South 2nd Street.
When signs are erected in each city -owned parking lot giving notice thereof, no
person shall park a vehicle for longer than four (4) hours between the hours of
eight a.m. and five p.m. of any day except Saturdays, Sundays and public
holidays. For the purpose of this section, it is unlawful for any person to move a
vehicle from any public parking space within any above described city -owned
parking lot and to park that vehicle at any other parking space within that city -
owned parking lot in such a manner so that the accumulated parking time
exceeds four (4) hours.
B. The fee s "�;e parking restrictions in subsection A of this section shall be
in force during the hours from eight a.m. and five p.m., Monday through Friday,
with the exception of the following holidays, Saturdays and Sundays:

C. The procedures for enforcing the parking prohibitions of this section shall be
those procedures provided by Chapter 9.60 of the city code as applicable to parking
violations: provided, that the chief of police or his agent is authorized to immediately
impound or cause to be impounded any unauthorized vehicle parked in city owned
public parking lots described in subsection A of this section. The applicable
provisions of Chapter 9.47 of the city code shall govern towing, storage, redemption,
or other disposition of any vehicle impounded pursuant to this section.
Section 3. Except as amended herein, Title 9 YMC shall remain unchanged.
Section 4. The City Manager is hereby authorized and directed to prepare and
install appropriate signage for the city -owned public parking lots in conformity with
the amendments adopted herein.

Section 5. This ordinance shall be in full force and effect 30 days after its
passage, approval, and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
The City Council has previously discussed strategies to promote downtown Yakima and to
encourage people to shop and attend events in the downtown. Part of this discussion
included the need to revise parking limitations in city -owned public parking lots, and staff
was directed to prepare suitable legislation to accomplish these goals. This Ordinance
repeals Chapter 9.49 YMC regarding the Downtown Yakima Parking Commission, whose
duties thereby revert to the City Council. The Ordinance amends YMC 9.50.215 regarding
parking in city -owned public parking lots, imposing a four -hour parking limit and providing for
enforcement. The Ordinance also repeals YMC 9.50.220 effective December 31, 2012
regarding long term parking permits in city -owned public parking lots. The intent is to
promote availability of free four -hour parking for the public in downtown city -owned parking
lots, and encourage long term parking in alternate private lots. Upon adoption of the
Ordinance, city staff can proceed to create and install appropriate signage for the city -
owned parking lots and advise its current long term parking permit holders of the repeal of
the long term parking permit process, and the availability of alternate long term parking in
private lots.
