HomeMy WebLinkAbout11/22/1994 Special Meeting 12 CITY OF YAKIMA, WASHINGTON NOVEMBER 22, 1994 SPECIAL MEETING The City Council met in session on this date at 9:00 a.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat I/ Berndt, presiding, Council Members Clarence Henry Beauchamp (present after 9:03 a.m.);Ernie Berger, Bill Brado, and Lynn Buchanan present on roll call. Council Member Bernard Sims absent and excused. City Manager Zais, City Attorney Paolella, City Clerk Roberts, and Department Assistant III Moen also present. 1. CONSIDERATION OF LEGISLATION RELATING TO THE POLICE STATION /LEGAL CENTER PROJECT City Manager Zais stated he has been notified by the second low bidder of the potentiality of a lawsuit being filed. Staff has researched that carefully and feel we have solid ground to proceed. He reported there is a difference of about $70- $80,000 between the two bids. He requested an executive session to discuss prospective litigation. It was MOVED BY BUCHANAN, SECONDED BY BERGER, TO MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PROSPECTIVE LITIGATION. The motion carried by unanimous` voice vote; Beauchamp dnd Sims absent. The Council went into executive session at 9:02 a.m. and resumed the meeting in public at 9:.18 a.m. A. RESOLUTION AWARDING CONTRACT FOR CONSTRUCTION OF POLICE STATION /LEGAL CENTER TO CREE CONSTRUCTION Resolution No. R -94 -152 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by 5 -1 roll call vote;Brado voting nay; Sims absent. Council Member Brado cited his concerns about project cost and funding source as the basis for his nay vote. RESOLUTION NO. R - 94 - 152, A RESOLUTION awarding contract for the construction of the Yakima Police Station /legal I/ Center to Cree Construction Company, Inc. of Lynnwood, Washington in accordance with the construction specifications, and addendums thereto, for Police Station /Legal Center, City of Yakima, Yakima, Washington, dated October 1994. 13. NOVEMBER 22, 1994 SPECIAL MEETING B. RESOLUTION AUTHORIZING INTER -FUND LOAN FOR PARTIAL FUNDING OF THE POLICE STATION /LEGAL CENTER PROJECT I/ Resolution No. R -94 -153 having been read by title, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by 5 -1 roll call vote; Brado voting nay; Sims absent. RESOLUTION NO. R -94 -153, A RESOLUTION authorizing an Interfund Loan from the 551 - Equipment Rental Fund, to the 333 -Law & Justice Capital Fund, and providing for repayment.
