SUBJECT: Weekly Issues Report
• CITY /COUNTY STUDY SESSION: The City and County are having a joint study
session on Tuesday, October 9 at 10:00 a.m. in Council Chambers to talk about jail
issues.
• NOMINATING COMMITTEE: This Committee (Adkison, Bristol and Ensey) will be
meeting on Tuesday, October 9 at 9:30 a.m. in the Mayor's office.
• SEPTEMBER SALES TAX DISTRIBUTION: The sales tax numbers for September
were posted. We received $1,148,706, which is $120,949 or 11% more than
September 2011. Year to date we are $507,915 or 5.4% ahead of 2011.
• BREAST CANCER AWARENESS FUNDRAISER: SunComm will be holding its 5th
Annual Breast Cancer Awareness Fundraiser on Monday, October 8 from noon to
8:00 p.m. at 201 S. 3rd Street (across from the police department). Last year they
raised over $3,500 and hope to raise more this year. You can have lunch for $5.00
(hot dog, chips and soda), purchase pink hair extensions for $10.00, participate in a
raffle for $1.00 or purchase items from the bake sale. Please stop by and show your
support.
• 17 ANNUAL SPAGHETTI FEED: The 17 annual Fireman's Spaghetti Feed will
be on Wednesday, October 10 from 5:30 -8:00 p.m. at Fire Station 91. They
changed the date of the event so it would not conflict with the City Council meeting.
• POLICE DEPARTMENT OPEN HOUSE: The Yakima Police Department will be
hosting an open house on Wednesday, October 10 from 5:00 p.m. to 8:00 p.m.
There will be several displays, tables, demonstrations, and the like to entertain and
educate the public about Department operations. Chief Rizzi will be on hand to
meet and greet along with other Department staff.
• PIRATE PLUNDER RACE: The Sports Commission is hosting the first Pirate
Plunder Race on Sunday, October 7. The event takes place at the wastewater
treatment facility from 6:00 a.m. to 7:00 p.m.
• CITY MANAGER PRESENTATIONS: On Tuesday, October 9 at 6:30 p.m. the
City Manager will be speaking at the Grass Roots meeting at the County. Then on
Thursday, October 11 at 5 p.m. he will be the guest speaker at YCDA's Board
meeting.

Dear Mayor Wilson:
We are in receipt of your letter which enclosed a number of legislative proposals relating to the
Public Records Act.
We are in full support of the transparency of government, believe fully in our citizens' right to
knowledge about government, and support the goals of the Public Records Act. However, we
agree that amendments could be made to the Public Records Act which would be consistent with
those important values, while also addressing the significant and increasing impacts on cities in
responding to requests under the Act.
We have been advised that the Flexible General Government Operations Subcommittee, one of
the Association of Washington Cities ( "AWC ") Legislative Committees, will be reviewing
proposed legislation relating to the Public Records Act. AWC Director of State and Federal
Relations Dave Williams has advised that AWC has Othello's proposals, and the Flexible
General Government Operations Subcommittee will be reviewing them along with other
proposals for amendments to the Public Records Act for the 2013 legislation session.
Furthermore, the City of Yakima is in the process of developing its legislative priorities for the
upcoming legislative session. Public Records Act amendments have been part of Yakima's
legislative priorities in the past, and we anticipate they will continue to be part of our priorities.

Honorable Mayor Cawley,
The City of Othello is in full support of the first amendment and transparency of government,
believing fully in our citizens' right to knowledge. However, there are those who would
endeavor to harass, interfere and strive to create a dysfunctional government rather than joining
in constructive participation through the Public Records Act.
Please join me in soliciting our state legislators in requesting relief for cities relative to the
increasingly onerous compliance issues in regards to the Public Records Act.
Please review the attached letter to our state legislators, and if you agree please join me in this
endeavor.

Re: Public Disclosures
We are seeking your support in legislation that would amend the Public Records Act to allow
citizens to be proactive with their government while preventing excessive interference with the
City's functions. We are in full support of the first amendment and transparency of government,
believing fully in our citizens' right to knowledge. However, there are those who would
endeavor to harass, interfere and strive to create a dysfunctional government rather than
joining in constructive participation through the Public Records Act.
The City of Othello, like many other Washington cities, is facing increasingly onerous
compliance issues relative to the Public Records Act. We ask that you consider legislation
relative to the following:
1. The Act contains potentially conflicting provisions that require balancing the City's
legal obligation to protect public records against the public's right to open access to
public records during regular City business hours. City staff is required to observe
the inspection of records in order to ensure the protection of public records as mandated
by the Act. This requires that the City reassign an employee(s) from their regular job
duties to the task of observing the inspection of public records. The City has limited staff
resources and this reassignment of job duties has an adverse impact on the City's ability
to process normal City business.
At what point does the City's responsibility to its regular business take priority over a
requestor's statutory right to make inspection of public records during regular business
hours? Who should be responsible to absorb the extra costs of reassigning employees or
providing additional staff to oversee a records inspection that requires more than three
hours — the requestor or the City? Should the Act be amended to permit the City
additional time within which to allow the inspection in order to better accommodate
staff schedules?
2. The City suggests that the Act be amended to require that cities make every effort to
accommodate the expeditious inspection of public records without unduly
compromising or unreasonably interfering with the essential functions of the City.
In accommodating the request for inspection of public records, the City may consider the
•
size of the request, the ease with which the requested records can be made available for
__ inspection any special accommodations required - n order to- inspect- the -re or-ds -the
availability (schedule) of the requestor to conduct inspections, the availability of City
staff to observe the inspection, the time constraints on staff availability imposed by other
current City business, and any other relevant circumstance. Based upon analysis of the
above factors, the City would have the discretion to propose the schedule for inspection.
Such an amendment would preserve the rights of the public to access to public records
without compromising the ongoing governmental functions of the City.
3. The requestor may petition the City Council and /or Mayor for reconsideration of any
staff decision made regarding the inspection schedule.
4. Implementation of a state PRA Review Board established to investigate complaints
by requestors and public agencies. This would avoid immediate court action and
permit a board (with expertise on PRA issues) to act as the first review and decision
level.
The City is committed to providing public access to its public records, but the PRA as currently
written lacks adequate protection for public agencies, particularly when the intent of the
requestor is to harass.
