AN ORDINANCE relating to the regulation of land use and development in the City
of Yakima and amending the following sections of Title 15 of the
City of Yakima Municipal Code: 15.04 Table 4 -1, 15.05 Table 5 -2,
15.05.030 (B), 15.05.055, and 15.06.050 (D).
WHEREAS, the Planning Commission of the City of Yakima has considered certain
amendments to Title 15 of the Yakima Municipal Code pertaining to regulation of land use and
development in the City of Yakima; and
WHEREAS, the Planning Commission has held an open record public hearing on
August 22, 2012, pursuant to notice, and has received and considered all evidence and
testimony presented; and
WHEREAS, the Planning Commission, having conducted such public hearing, found,
determined and recommended that the City Council approve such amendments; and
WHEREAS, the City Council has held a closed record hearing on October 2, 2012,
pursuant to notice, to consider such amendments as recommended by the Planning
Commission; and
WHEREAS, the City Council of the City of Yakima, having considered the record herein
and the recommendation from the Planning Commission, hereby finds and determines that
approval of such amendments is in the best interests of residents of the City of Yakima and will
promote the general health, safety and welfare; therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 15.04 Talbe 4 -1 Permitted Land Uses of the City of Yakima
Municipal Code is hereby amended to reinstate the: "Office Contractor Building and Trade
(Plumbing, Heating, Electrical, and Painting)" land use category in Table 4 -1 between the land
uses of "Offices and Clinics" and "Outdoor Advertising (Billboards) ". Furthermore, the level of
review and permitted zoning districts shall be equal to to that of the "Office and Clinics" land use
category with the exeption of the M -1 zoning district which shall be elevated to a Type 2 Review.
Section 2. Section 15.06.050 (D) of the City of Yakima Municipal Code is hereby
amended to read as follows:
D. Tandem Parking. Parking spaces in tandem, having a single means of ingress and
egress shall not be counted as two off - street parking spaces for the purpose of fulfilling the
requirements of this Chapter; except that, each tandem space for single - family dwellings and
duplexes shall be counted as a required parking space.
Section 3. Section 15.05.020 Table 5 -2 Subdivision Requirements of the City of Yakima
Municipal Code is hereby amended to read as follows:

NOTES:
1. In the Residential Districts, these minimums apply when lots are served by a public or
community water system and either the regional or approved community sewer system.
2. The lot width at the rear line of the required front yard shall not be less than 50 feet. (Note:
this provision only applies to those districts with a minimum lot width of 50 feet or larger.)
3. One acre shall be the minimum lot size in Residential Districts within the Floodplain and
Greenway Overlays.
4. See Special Development Standards for Zero Lot line Development, YMC 15.09.040.
5. Lots created for utility purposes may be created below the minimum lot size listed in YMC
Ch. 15.05, Table 5 -2, as long as the lot is designated as "nonbuildable lot for utility
purposes" on the face of the plat and the proposed lot is reviewed for compatibility. The lot
must still meet the minimum lot width established in YMC Ch. 15.05, Table 5 -2, and
structures built on the lot must still meet the setback requirements in YMC Ch. 15.05, Table
5 -1.
Section 4. Section 15.05.030 (B) of the City of Yakima Municipal Code is hereby
amended to read as follows:
B. Maximum Number of Dwelling Units Permitted Per Net Residential Acre. Maximum
number of dwelling units permitted per net residential acre is used to determine the
maximum number of dwelling units permitted within a single subdivision, short subdivision,
mobile home park, multifamily development, or planned residential development. This
standard is intended to:

1. Assure that residential densities in new subdivisions, multifamily developments, or
planned residential developments are compatible with the existing or planned level of
public services and the density of the zoning district;
2. Permit the clustering of dwelling units (when clustering occurs, open space shall be
provided in accordance with YMC 15.09.030); and
3. Permit a variety of residential dwelling types within a development.
The following formula shall be used to determine the maximum number of dwelling units
permitted for any particular subdivision, short subdivision, mobile home park, multifamily
development or planned residential development
THE MAXIMUM NUMBER OF UNITS PERMITTED ON A SITE _ (the total site area in
acres) — (the area of streets, rights -of -way, and access easements, in acres) X (the
maximum number of dwelling units permitted per net residential acre).
Any fraction of a dwelling unit shall be rounded up to the next whole number if 0.5 or over or
down to the next whole number if less than 0.5. Once approved under the provisions of this
title, no subdivision, resubdivision, or short subdivision shall be further modified or divided in
a manner that will raise the density of the subdivision beyond the maximum number of
dwelling units permitted per net residential acre by Table 5 -2; provided, that development
exceeding the maximum number of dwelling units per net residential acre may be allowed in
the R -1 and R -2 districts as a Class (3) use in accordance with Table 4 -1. This higher -
density development shall be allowed only on those limited occasions when, after Class (3)
review, the hearing examiner finds that the location and site plan of the project is such that
the higher density would be compatible with neighboring land uses and the level of public
services, and is consistent with the goals and objectives in the Yakima urban area
comprehensive plan.
The application of this provision shall not prohibit the subdivision of land already developed
with more dwelling units than would be permitted by this section when:
1. The lots created meet the lot size and lot width requirements established in Table 5 -2;
2. The existing structures meet the building area and setback requirements in Table 5 -1;
and
3. No new dwelling units are built.
Section 5. Section 15.05.055 of the City of Yakima Municipal Code is hereby amended
to read as follows:
15.05.055 – New Development Improvement Standards
All development within the Yakima Urban Growth Area (UGA) must meet the urban standards of
the City of Yakima including the following.
1. Fire apparatus access roads for multiple - family residential developments and one- or
two - family residential developments shall be subject to the provisions of sections D106
and D107, respectively, of Appendix D of the International Fire Code (2009 edition).
Additionally, such residential developments shall be subject to the requirements of
section D105 of Appendix D, International Fire Code (2009 edition), pertaining to aerial
fire apparatus roads, as applicable. All provisions of the International Fire Code
referenced above are hereby adopted and incorporated herein by this reference, as now
existing or as hereafter amended and adopted by the city. Minimum requirements for
the primary and secondary access will be at least 20 feet wide, unobstructed, paved
lanes.

2. In order to promote safety for emergency access and circulation within and between new
developments, cul -de -sac streets (public or private) shall not exceed 600 feet.

SUMMARY EXPLANATION:
On August 22, 2012, the City Planning Commission adopted written findings and
recommendations concerning City initiated text amendments to its Municipal Code Title 15
Urban Area Zoning Ordinance.
The following sections are proposed for amendment: Sections: 15.04 Table 4 -1, 15.05 Table
5 -2, 15.05.030 (B), 15.05.055, and 15.06.050 (D).
Council is requested to hold a closed record public hearing to consider the Yakima Planning
Commission's recommendations regarding these City initiated amendments to its Urban
Area Zoning Ordinance.

CITY OF YAKIMA PLANNING COMMISSION
FINDINGS OF FACT, AND RECOMMENDATION
City of Yakima 2012 Urban Area Zoning Ordinance Amendments
August 22, 2012
WHEREAS, the City of Yakima, hereafter referred to as the "City" pursuant to RCW
36.70A.040 is required to plan under the provisions of the Growth Management Act; and
WHEREAS, pursuant to RCW 36.70A.130(1) the City is required to take legislative
action to review and revise its comprehensive plan and development regulations in
accordance with the Growth Management Act; and
WHEREAS, pursuant to RCW 36.70A.020, goals are set forth to guide the
development and adoption of comprehensive plans and adoption of development
regulations; and
WHEREAS, on November 15, 2011, the City of Yakima adopted ordinance 2011 -52
updating Yakima Municipal Code (YMC) Title 15 Yakima Urban Area Zoning Ordinance;
and
WHEREAS, on May 9, 2012, May 9, 2012, the YPC docketed the submitted UAZO
text amendments and future land use application requests for the 2012 annual
Comprehensive Plan Amendment process, which included review of the following topics
the City's YMC Title 15.
1. 15.04 Table 4 -1 Permitted Uses;
2. 15.05 Table 5 -2 Subdivision Requirements;
3. 15.05.030(B) Creation of New Lots — Subdivision Requirements,
4. 15.05.055 New Development Improvement Standards; and
5. 15.06.050 (D) Off - Street Parking and Loading — Computation of Required
Spaces, and
WHEREAS, on June 29, 2012, the City submitted a Zoning Ordinance amendment
application and State Environmental Policy Act (SEPA) Checklist, and
WHEREAS, pursuant to RCW 36.70A, and YMC 15.23.020, the YPC is authorized
to make a recommendation to the Yakima City Council, hereafter referred to as the
"Council" for their review, consideration, and adoption of development regulation
amendments; and
WHEREAS, pursuant to City Ordinance #2004 -14 and RCW 36.70A.130 (2) the
City followed its adopted public participation program, which included the following:
1. Twenty days of public comment starting July 5, 2012, and ending on July 25,
2012;

2. Posting on the City of Yakima's web site of the draft zoning amendments on July
5, 2012; and
3. Published notice in a local newspaper of general circulation, and issued a press
release to local media on July 5, 2012; and
WHEREAS, pursuant to RCW 36.70A.106 notice of all amendments to the City's
development regulations were sent to the Washington State Department of Commerce
prior to the amendments being considered for adoption; and
WHEREAS, On May 9, 2012 thru June 27; 2012, the YPC held multiple study
sessions to review the proposed zoning amendments; and
WHEREAS, pursuant to the State Environmental Policy Act (SEPA) WAC 197 -11
and YMC 6.88, and prior to the Commission's hearing, the City issued a Determination
of Non- significance (DNS) on the proposed zoning ordinance amendments on July 5,
2012, and
WHEREAS, on July 26, 2012, pursuant to the State Environmental Policy Act
(SEPA) WAC 197 -11 and YMC 6.88, the City's Planning Division retained its DNS on the
proposed amendments, and
WHEREAS, an open record public hearing regarding the proposed text
amendments occurred on August 22, 2012, where all persons desiring to comment on
the proposed amendments were given a full and complete opportunity to be heard; and
WHEREAS, the Commission following public comment and deliberation reviewed
and revised staff's recommended amendments; and those proposed revisions were
approved by staff; and
NOW, THEREFORE, BE IT RESOLVED by the Commission that, in making the
hereinabove recommendation, that these proposed amendments to the YMC Title 15
Yakima Urban Area Zoning Ordinance have been sufficiently considered, and the
Commission hereby enters the following Finding of Fact:
FINDINGS OF FACT
1 Pursuant to the provisions of Chapters 36.70 and 36.7013 RCW the
Commission has the legal authority to make a recommendation concerning
the adoption of official controls that implement comprehensive plans.
2. The Commission held multiple study sessions from May 9, 2012 thru June
27, 2012, regarding the draft ordinance and suggested various changes to
the draft ordinance which were incorporated prior to the required public
hearing on August 22, 2012.

3. The Commission held the required public hearing on the above specified
date and approved the proposed amendments.
4. The Commission finds that the proposed amendments will have the following
benefits:
a) The amendments to Table 4 -1, Permitted Land Uses will reinstate the
Office: Contractor Building and Trade (Plumbing. Heating. Electrical and
Painting) land use category and correct an existing deficiency.
b) The amendment to Table 5 -2 is envisioned to provide.
i. Increased residential density and flexibility in accordance with the
goals and policies of the Washington State Growth Management
Act; and
ii. Provide a wider array of affordable housing choices which better
accommodate the needs of the citizens of the City of Yakima.
c) The amendment to YMC 15.05.055 will provide sufficient Fire Department
access standards to promote continued development within the City of
Yakima without compromising the public's health or safety; and
d) The amendment to YMC 15.06 050 (D) to allow tandem parking for
duplexes will provide additional parking options for duplexes on small
restricted lots.
5. The Commission finds that the City provided timely public participation in
consideration of the proposed amendments, consistent with RCW
36.70A.140, WAC 365- 195 -600, and its adopted Public Participation
Program Guidelines.
6. The Commission considered public testimony related to the proposed
amendments.
7. The Commission concurs with the Determination of Non - significance (DNS)
that was issued on July 5, 2012, for the proposed amendments.
8. The Commission members present voted five to one to recommend approval
of the amendments as set forth in Attachment "A ".
9. The Commission's recommendation is consistent with and implements the
City's Comprehensive Plan goals and policies.

It is for the above reasons that the Commission recommends that Council adopt
the City of Yakima's 2012 Amendments to the City's YMC Title 15 Yakima Urban
Area Zoning Ordinance with a revision date of August 22, 2012.

Based upon the findings outlined above, it was moved and seconded that the City of
Yakima Planning Commission recommends APPROVAL of the submitted Zoning
Ordinance amendments. The motion was carried by a unanimous vote.

Staff recommends to the Yakima Planning Commission (YPC) that the following
proposed text amendments to the UAZO be forwarded to the Yakima City Council with
an endorsement for their approval.
BACKGROUND:
On May 9, 2012, the YPC met to docket all amendment applications submitted for
consideration in 2012. Included were six (6) applications submitted for amendments to
the future land use map of the City's Comprehensive Plan and seven (7) were text
amendment requests to the UAZO. Two of the text amendment requests were
submitted by city staff and there were five others that were submitted by citizens. In all,
amendments were requested to sections 15.04 Table 4 -1, 15.05 Table 5 -2,
15.05.030(B), 15.05.055, 15.06.050 (D), 15.06.060 (D) and (E), and 15.28 of the UAZO.
Following docketing, the YPC held study sessions on May 91h, June.13th, and June 27'
to review the proposed UAZO text amendments, it was during the second of these study
sessions that the requested amendments to YMC 15.06.060 (D) and (E), and YMC
15.28 were withdrawn from further consideration by their proponents.
ANALYSIS OF PROPOSED AMENDMENTS:
1. YMC 15.04 Table 4 -1 Permitted Uses - Reinstatement of the: "Office
Contractor Building and Trade (Plumbing, Heating, Electrical, and
Painting)" land use category:
In 2011, the Office: Contractor Building and Trade (Plumbing, Heating Electrical
Painting) land use category was combined with the Call Center, Government,
Professional, Medical and Dental, and Service Agencies office. The intent of the
original amendment was to streamline the permitting process for office uses.
Over the past year the Planning Division has discovered that on a whole the
combining of the office use land use categories have not created many
inconsistencies. However, one negative effect of this change is that the office
land use category for Contractor Building and Trade offices are no longer a Class
(1) permitted use in the Light Industrial M -1 zoning district where they would
normally be permitted. Therefore, to correct this inconsistency the Planning

Division is proposing to reinstate the Office: Contractor Building and Trade
(Plumbing. Heating. Electrical and Painting) land use category as depicted in the
draft ordinance.
2. 15.05.030 (B) Creation of New lots — Subdivision requirements - Calculation
of a fraction of a dwelling unit:
The Planning Division is proposes to change the way that a fraction of a dwelling
unit is rounded to be consistent with usual mathematical practices. At present, a
fraction of a dwelling unit is "rounded up to the next highest whole number." This
practice has resulted in situations where fractions as small as .001 rounds up to
the next whole number. The Planning Division is proposing to amend YMC
15.05.030 (B) to read ...Any fraction of a dwelling unit shall be rounded up to the
next highest number if 0.5 or over or down to the next whole number if less than
0.5.
1 15.05 Table 5 -2 Subdivision Requirements - Reduction in the minimum lot
size for common wall and zero lot line single - family homes identified in
YMC 15.05 Table 5 -2:
The purpose of YMC 15.05 Table 5 -2 is to regulate the minimum lot size that is
allowed in a particular zoning district when the underlying land is subdivided,
short plated, re- subdivided, or when lot lines are adjusted. "In the residential
zoning districts this standard is intended to maintain the residential character of
the area and will vary by dwelling type..."
On December 18, 2011, the City of Yakima at the request of the local
development community adopted a UAZO text amendment to YMC 15.05 Table
5 -2 for single - family homes which reduced the minimum lot size from 7,000 sq. ft.
to 6,000 sq. ft. for the Suburban Residential, Single - Family Residential, and the
commercial zoning districts. The minimum lot size for single - family common wall
and zero lot line developed lots was left unchanged as they were not requested
to be amended.
As a result of their successful amendment, and the fact that there have been
numerous single - family homes which have utilized this smaller lot size and
coverage standards without any negative impacts, the development community
has returned this year with a request to reduce the minimum lot size for common
wall and zero lot line single - family homes. Specifically, the minimum lot size for
the Suburban Residential and Single - Family zoning districts is requested to be
reduced to 4,000 square feet, and the minimum lot size in the Two - Family and
Multi - Family zoning districts reduced to 3,500 square feet.
The Planning Department reviewed the proposed standards and took advanced
public input through the three study sessions on this year's text amendments and
found that:
1. There is no known conflict of regulations within the UAZO which would
prohibit this request from being adopted;

2. The amendment request is consistent with the 2011/12 text amendments
for a lot size reduction for single - family homes in the Suburban
Residential and Single - Family Residential zoning districts; and
3. The proposed amendment supports the principals of infill development
and increased residential densities.
4. 15.05.055 New Development Improvement Standards:
The purpose of YMC 15.05.055 is to provide specific access standards to ensure
that new single - family, multi - family, or mixed use residential developments have
adequate public street connections for both primary and secondary access to the
public street system that promote safety for emergency access and circulation
within and between developments.
YMC 15.05.055 was adopted in 2008/09 following specific concerns from the City
of Yakima Code Administration Division and City of Yakima Fire Department that
the number of dwelling units allowed upon a single means of access into
subdivisions and multi - family apartment complexes was not sufficiently regulated
by the International Fire Code.
Over the past years the city of Yakima has successfully implemented the
requirements of YMC 15.05.055 in the design of various new subdivisions and
multi - family apartment complexes without issue. However, as the economic
climate for development within the city has become constrained, developers have
indicated that these two portions of the code are overly restrictive thereby making
development difficult, and have requested that the City remove YMC 15.05.055
and utilize the provisions of the International Fire Code.
As a result of the requested text amendment to remove YMC 15.05.055, the City
of Yakima Code Administration, Fire Planning, and Legal Departments have
studied the proposed request and have found the following:
1. The City of Yakima has not adopted Chapter 5 or Appendices "D° of the
International Fire Code which deals specifically with Fire Department access
and safety issues for single and multi - family developments.
2. Although the city is well within its right to adopt regulations which are more
restrictive than the fire code, the thirty dwelling unit restriction which is the
turning point for a second point of access in YMC 15.05.055 is not based
upon any known fire safety standard;
3. If the International Fire Code Appendix "D" and Chapter 5 were adopted, the
requirements for two points of access for multi - family residential development
and single - family residential development would be limited to:
a. Multi- family residential projects having more than 100 dwellings units
would require two separate and approved fire apparatus access roads,
With the exception that developments that are fire sprinklered throughout
could have up to 200 dwelling units with one single point of access;

b. One -or- two- family dwelling residential developments where the number
exceeds 30 would be required to have two separate fire apparatus access
roads, unless all dwellings on the fire apparatus road that exceed 30
dwelling units are sprinklered.
4. Removal of YMC 15.05.055 would not be prudent until such time as the
appropriate sections of the International Fire Code are adopted;
5. YMC 15 05.055 should not be removed, but amended to appropriately
reference the International Fire Code as indicated in the draft ordinance; and
6. The amendment of YMC 15.05.055 referencing the fire code should provide
sufficient relief from the current standards to promote continued development
within the city of Yakima while still maintaining the public's health or safety
7. 15.06.050 (D) Off - Street Parking and Loading – Computation of Required
Spaces:
The purpose of the Off - Street Parking and Loading requirements of YMC
15.06.050 (D) is to restrict tandem parking for commercial, duplexes, and multi-
family developments that have a single means of ingress and egress so that
parking lots, stalls, and areas are not created that have restricted access.
At present only single - family homes are exempt from the provisions of YMC
15 06 050(D) allowing tandem parking stalls to count towards a land uses
required parking.
Upon reviewing this issue the City of Yakima Planning Division found that:
1. Tandem parking equally affects both duplexes and single - family homes in
that a vehicle in the first parking stall cannot back out on to the public street
until the second vehicle is removed.
2 Allowing tandem parking for duplexes will generally only affect the occupants
of the structure; and
3. Tandem parking could provide additional parking options for duplexes on
small restricted lots.
ENVIRONMENTAL REVIEW (SEPA)
On July 5, 2012, the City of Yakima issued a Notice of Application, Public Hearing and
Determination of Non- Significance (DNS) for this application.
Following the required 20 -day public comment period where all interested parties and
agencies had the right to comment, and no public comments were received. The City of
Yakima retained its DNS on July 25, 2012. The 14 -day appeal period for this
environmental determination lapsed on August 9, 2012, with no appeals filed.

CONCLUSIONS
1. The text amendments are mainly minor in nature,
2. No adverse impacts have been identified by the approval of these amendment
requests.
3. The requested text amendments to the City of Yakima's Urban Area Zoning
Ordinance are supported by the City's Yakima Urban Area Comprehensive Plan
2025.
4. The amendments to Table 4 -1, Permitted Land Uses will reinstate the Office:
Contractor Building and Trade (Plumbing Heating, Electrical and Painting) land
use category and correct an existing deficiency.
5. The amendment to Table 5 -2 is envisioned to provide:
a. Increased residential density and flexibility in accordance with the goals
and policies of the Washington State Growth Management Act; and
b. Provide a wider array of affordable housing choices which better
accommodate the needs of the citizens of the City of Yakima.
6. The amendment to YMC 15.05.055 will provide sufficient Fire Department access
standards to promote continued development within the City of Yakima without
compromising the public's health or safety.
7. The amendment to YMC 15.06.050 (D) to allow tandem parking for duplexes will
provide additional parking options for duplexes on small restricted lots.
RECOMMENDATION
The Department of Community and Economic Development recommends APPROVAL
of the foregoing proposed text amendment requests.

URBAN AREA ZONING ORDINANCE AMENDMENTS
NOTICE IS HEREBY GIVEN that the Yakima City Council will conduct a closed record public
hearing to consider the City of Yakima Planning Commission's recommendations for
amendments to the Yakima Urban Area Zoning Ordinance (UAZO), Yakima Municipal Code
Title 15. Closed Record Hearing means the public is invited to testify on the existing City
Planning Commission's recommendations but will not be allowed to introduce any new
information.
The closed record public hearing will be held on Tuesday, October 2, 2012 at 7:00 p.m., or
soon thereafter, in the Council Chambers at Yakima City Hall, 129 N. 2 "d Street, Yakima,
Washington.
-The UAZO is a land use document that provides zoning regulation and development standards
for property both within the City of Yakima and its Urban Growth Area. The ordinance also
provides a basis for determining applicable budget decisions related to future development of
Yakima.
Any citizen wishing to comment on the ordinance amendments is welcome to attend the closed
record public hearing or contact the City Council in the following manner;
1) Send a letter via regular mail to "Yakima City Council, 129 N. 2"d Street, Yakima, WA

1. The 2008 ordinance was either written with a mistake in it, or it was poorly conceived.
(Should have been, single or two family, not multi - family.)
The one or two family residences are separate from the multi- family residences
in the building and fire code books. Therefore; they should be handled in the same
manner under the City Ordinance. It is foolish and just not effective to compare them.
See attached copy of 2006 IFC Code. The 2008 ordinance was very poorly thought
through, and is still not written effectively. I offered to go through these issues with city
planning in January 2012. I was told that they would get back to me for my input, but 1
was never contacted. I feel they have not spent adequate time researching this, and you
should not approve any changes at this time. I recommend that you remove the existing
language until they research this issue, or use the language out of the IFC. That is a well
thought out and long standing code. Unless, they can point out a major failure with the
code, why try to reinvent or question it? The new ordinance is just over regulating,
which makes it more difficult for anyone to do business.
2. Comment on the purpose of intent.
Yes, public health, safety, and general welfare are important. That is why we have
the well written IBC, IRC, and IFC: They are a National and State Standard. Why is our
Planning Department so much smarter than everyone else? Yet, they can't see the
wisdom of one or two family residences being different from multi- family residences.
One major difference is that one or two family residences are NOT required to have
sprinklers and multi - family residences ARE required to have sprinkler systems.
3. Comment on the argument about emergency vehicles.
The second access as they have interpreted can be just a 20 foot fire lane. It can be
gated with a Knox box. The Fire Department would be the only one with a key.
4. Comment on the adjustment criteria.
If you start way above the required standards for IBC, IRC, and IFC, there is no
way for the applicant to demonstrate that public health, safety, and general welfare are
preserved.
5. Comment on the language in the proposed ordinance.
The proposed language states that 50 units or more will require two public street
connections. Fifty units is less than is required by IFC for one or two family residences.
This will result in the city depending on the 1FC to enforce the lower standard for the one
or two family homes. As proposed, the multi - family residents will be changed from the
existing 200 units with sprinklers to 50 units with or without. This is a 75% reduction and
is a major change from what the excepted standard in IFC.

DEVELOPMENTS
D107.1 One - or two- family dwelling residential develop-
ntents. Developments of one- or two- family dwellings where
the number of duelling units exceeds 30 shall be provided with

of the property or area to be served, measured in a straight-line
between accesses.

AERIAL FIRE APPARATUS ACCESS ROADS
D105.1 Where required, Buildings or portions of buildings or
facilities exceeding 30 feet (9144 mm) in height above the low-
est level of fire department vehicle access shall be provided
with approved fire apparatus access roads capable of accom-
modating Fire department aerial apparatus. Overhead utility
and power lines shall not be located within the aerial fire appa-
ratus access roadway,
0105.2 Width. Fire apparatus access roads shall have a mini-
mum unobstructed width of 26 feet (7925 mm) in the immedi-
ate vicinity of any building or portion of building more than 30
feet (914} mm) in height,
D105.3 Proximity to building. At least one of the required
access routes meeting this condition shall be located within a
minimum of 15 feet (4572 mm) and a maximum of 30 feet
(9144 mm) from the building, and shall be positioned parallel
to one entire side of the building.

D106.1 Projects having more than 100 dwelling units. Mul-
tiple- family residential projects having more than 100 dwell-

have a single approved fire apparatus access road when all

Joan,
Thank you for your recent letter and phone message informing us that time was running out for us to make
recommendations concerning infill. We really appreciate your encouraging us to participate in the process of amending
some of the city's laws that affect development.
We're sorry, but we may have to miss this cycle of proposed zoning ordinance amendments. We have been so busy
lately that we haven't had time to craft language concerning infill. Besides this, we won't even be in town on
Wednesday, June 13, when the study session meets.
We have begun to study the issue, however. We found a great website loaded with information. It is called the
Municipal Research and Services Center of Washington. It can be found at www.mrsc.ore. You probably know of it.
As we get toward the end of June, we will find more free time to read and prepare. We don't want to waste anyone's
time until we have a solid proposal, until we know a little of the history of efforts by other communities to write and
implement infill laws, until we have looked at actual infill laws on the books in other cities, etc. When we are prepared,
we'd be happy to join a future study session.
