CITY OF YAKIMA, WASHINGTON
JUNE 21, 1994
SPECIAL MEETING
The City Council met in session on this date at 7:00 a.m., in the
Board Room of the Yakima Center, Yakima, Washington. Mayor Pat
Berndt, presiding, Council Members Clarence Barnett, Ernie Berger,
Bill Brado, Lynn Buchanan, and Bernard Sims present. Council
Member Henry Beauchamp absent and excused. Staff members present
were City Manager Zais, Assistant City Manager Rice, City
Attorney Paolella, Assistant City Attorney Peterson, Glenn
Valenzuela, Director of Community and Economic Development, Bruce
Benson, Associate Planner, and City Clerk Roberts.
Following a brief discussion regarding items on today's Council
meeting agenda, Mayor Berndt announced she will have to leave for
a while this morning to attend a brief 7:30 a.m. meeting.
1. INFORMAL DISCUSSION AMONG COUNCIL MEMBERS
A. PRESENTATION OF ANNEXATION REPORT
Glenn Valenzuela stated this report is in response to
Council's direction for staff . to provide historical
information and current status of annexations in process,
along with recommendations for future action. He asked for
further direction from Council regarding an approach for
annexations. He asked whether Council wants staff to take a
more aggressive approach to annexation and use the Outside
Utility Agreements rather than rely on the petition method.
Bruce Benson reviewed the report and made the following
recommendations:
1) South 1st Street /E. Viola Avenue (Broadway Fire
District 11 area). The recommendation is to pursue immediate
annexation. This area is currently being served by the City.
Mr. Benson stated his approach would be to send the seven
property owners, who have sufficient property valuation to
complete the annexation, a registered letter regarding the
Outside Utility Agreement and then follow up with a telephone
call if they don't send a signed petition. If that doesn't
work, then he would ask the Legal Department to send a
letter. His alternative suggestion is,to use the signed
Outside Utility Agreements as annexation petition signatures.
Following discussion, it was the general consensus to speak
directly to the seven property owners and bring Council a

report prior to taking any further action.
2) South 40th Avenue /West Viola (West Valley Fire
District 12). The recommendation is to withdraw the
annexation and seek smaller areas to be annexed.

3) Modesto (previously Fruitvale Fire District 10). This
annexation has been withdrawn and'staff is pursuing smaller
areas for annexation.
4) Stephenson Tract, Cascade Villa, Modesto Heights,
Castlevale Court and Matthews. These annexations are in
process and almost completed.
5) Nob Hill /Mead (Union Gap's East Mead Annexation), Perry
Street, and Pierce Street (Broadway Fire District). The
recommendation is to initiate annexations immediately;
however, Union Gap has stayed the annexation initiation for
the Nob Hill /Mead area by calling for an annexation election
for that area. All these areas are within the Railroad water
service area. Assistant City Attorney Peterson stated it
would be desirable to initiate annexation of these areas
prior to the court decision regarding the East Mead
Annexation. Union Gap is asserting that Yakima has not taken
any annexation action for these areas. City Manager Zais
stated this action should be taken at today's Council
meeting, prior to the Boundary Review Board's hearing.
(Mayor Berndt temporarily absent at 7:50 a.m.) It was the
general consensus to initiate the immediate annexation of the
Perry Street and Pierce Street areas. No action can be taken
to annex the Nob Hill /Mead area until after the Boundary
Review Board hearing.
6) Fruitvale. The recommendation is to annex small areas,
rather than one large annexation. The City is providing fire
protection until December' 1995.
Mr. Valenzuela stated Yakima's policy should be that since the
City is the provider of urban services, the County should not be
allowed to permit development in the City's service boundary
without City annexation. Council Member Brado asked why the City
has to get a signature on a petition if a citizen has signed the
Outside Utility Agreement. He suggested that maybe in the future,
staff should just use the Outside Utility Agreement as the
property owner's signature to annex. Mr. Paolella stated the
Outside Utility Agreement on today's agenda is an updated
agreement to add clarity of the law and it would conform our
agreement to the Court decision. Bruce Benson distributed a map
indicating the proposed annexation areas. Referencing page 15, it
III was the general consensus to add the word future to Item No. 3,
"Any future city initiated annexations." It was the general
consensus of Council to change the wording in Item No. 4 to make
it a more positive statement.
B. OPEN DISCUSSION /OTHER ITEMS
Council Member Barnett commented he had heard some
suggestions from the Chamber of Commerce and the County that
Mr. West should have a budget. After calling Mr.. West and

also speaking to Glenn Rice about this, Mr. West will submit
a budget to the Council at today's meeting. (Mayor Berndt
present after 8:10 a.m.)
Following a brief discussion regarding the water conservation item
on today's agenda, the meeting adjourned at 8:15 a.m.
