CITY OF YAKIMA, WASHINGTON
APRIL 5, 1994
BUSINESS MEETING /STUDY SESSION
1. ROLL CALL
I/
The City Council met in session on this date at 2:00 p.m.,
in the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Henry
Beauchamp, Ernie Berger, Bill Brado, and Lynn Buchanan
present on roll call. Council Members Clarence Barnett and
Bernard Sims absent and excused. City Manager Zais, City
Attorney Paolella, and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Buchanan.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A. PROCLAMATIONS (IF APPLICABLE)
None.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent
Agenda, questioning whether there were any additions or
deletions from either Council members or citizens present.
The City Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED BY
BUCHANAN, SECONDED BY BERGER, THAT THE CONSENT
AGENDA, AS READ, BE ADOPTED. The motion carried by
unanimous roll call vote; Barnett and Sims absent.
(Subsequent paragraphs preceded by an asterisk ( *) indicate
items on the Consent Agenda handled under one motion without
further discussion.)
*5. APPROVAL OF THE MINUTES OF THE MARCH 8 AND 15, 1994 BUSINESS
MEETINGS AND MARCH 22, 1994 ADJOURNED AND BUSINESS MEETINGS
The minutes of the March 8 and 15, 1994 Business meetings
and March 22, 1994 Adjourned and Business meetings were
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. AUDIENCE PARTICIPATION
Jeff Howell and Dave Hansen, KXXS Radio, described some of
the activities that took place during the Senseless Acts of
Kindness Day on March 31. After thanking the City for their
support, they related stories portraying the positive affect

that being kind has on, ; .,everyone,.. ;,.. Mayor Berndt thanked them
for kicking it off and agreed the event was a tremendous
success and perhaps it can be done again next year.
Jennifer Rosal presented Council with information on
1/ tattooing and requested reconsideration of the decision not
to lower the age without parental consent to 18.
Mayor Berndt read the proclamation declaring May 30, 1994 as
City of Yakima Day at the Races (Emerald Racing).
A. PRESENTATION ON STATUS OF 1994 AGRICULTURAL SHOWCASE
Glenn Phipps, Ki -Yak, and Scott Jackson, TRADEC, expressed
their appreciation for the City of Yakima's participation,
commitment, and support of the 1994 Washington State
Agricultural Showcase. Michelle Bogard, TRADEC, introduced a
promotional video presentation that emphasized developments
surrounding the Showcase. The Steering Committee's
participation was recognized and includes representation from
various agricultural elements throughout the state. There is
a lot of visibility in terms of people who will be attending
the Showcase, both from the public and private sectors, with
continued exhibitor /sponsor recruitment activities taking
place. Several Sponsors also made presentations concerning
the importance of foreign trade to the agricultural industry
as well as to the Yakima Valley.
B. PRESENTATION REGARDING PROPOSAL TO ESTABLISH A YAKIMA
BICYCLE ADVISORY COMMITTEE
Phil Hoge, 1512 Folsom, submitted for Council consideration a
request to establish a Bicycle /Pedestrian Advisory Committee.
The committee would consist of interested residents and
appropriate staff who deal with transportation, pathways, and
planning. An effort has been made to include a group that is
inclusive of a lot -of the local organizations who are
interested in this issue, of which many are members of the
bicycling community. The purpose of the committee would be
to aid in the formation of a bike /pedestrian master plan and
to work on an ongoing basis to provide input into
bike /pedestrian transportation planning and enhancement
projects. Mr. Hoge introduced Stan Berndt, who is also
1/ instrumental in establishing this .request.. Mr. Berndt
provided information concerning what has been done in other
communities to address the need and provide direction for
pedestrian /bicycle planning. In answer to a question from
Council Member Beauchamp concerning how Yakima compares to
other cities, Mr. Berndt described an increasing awareness of
both the pedestrian and the bicyclists in merging them with
transportation planning, and as a result of that everyone is
becoming more educated to the needs of the pedestrian and
bicyclists. As far as educating motorists concerning safety,
it has been discovered in other communities that the issue is

best addressed through various channels, such as the school
system or community service organizations. Neil McClure, an
active cyclist, spoke in favor of adopting the resolution and
explained the establishment of this committee would actually
enhance the quality of life in Yakima and would be good for
the citizens. Gary Beeman, District 5 Representative to the
State Bicycling Committee and staff contact for DOT
bicycle /pedestrian issues, also encouraged the formation of
the Yakima Bicycle /Pedestrian Advisory Committee and the

passage of the proposed resolution. The DOT encourages
communities to form advisory committees that will bring
support, leadership, knowledge, and guidance to communities
as they prepare bicycle plans. This committee would provide
assistance and support to various projects, such as the
Powerhouse pathway, an integral link to the Greenway.
Resolution No. R -94 -37 having been read by title, it was
MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT
THE RESOLUTION. The motion carried by a unanimous roll
call vote; Barnett and Sims absent. Mayor Berndt requested
staff to prepare further interlocal agreements as well as
directing staff to advertise for applications to the
committee. There was a brief amount of discussion concerning
whether this committee would be open only to City residents
or open to anyone in the Upper Valley. It was the consensus
that members must be City residents.
7. APPROVAL OF 1993 YAKIMA CENTER ANNUAL REPORT
Kathy Coffey, General Manager of the Yakima Convention
Center, announced 1993 is another record breaking year for
the Center. She highlighted the Yakima Center 1993 Annual
Report, introduced her key staff members who also made
presentations, and was prepared to answer any questions.
John Fisher, President of the Yakima Valley Visitors &
Convention Bureau, expressed appreciation of the continued
support by the City of Yakima. It was MOVED BY BUCHANAN,
SECONDED BY BEAUCHAMP, TO ACCEPT THE REPORT. The
motion carried by unanimous voice vote; Barnett and Sims
absent.

8. APPROVAL OF YAKIMA PUBLIC AFFAIRS CABLE (YPAC) 1993 ANNUAL
REPORT
Referencing a handout listing all the programs produced by
YCTV, City Manager Zais described these YPAC accomplishments
as being quite remarkable and attributed it to
Randy Beehler's assistance and Wendy Warren's direction of
the Department.
Randy Beehler, Municipal Producer, highlighted
accomplishments of activities and presented statistics on
Yakima Public Affairs Cable (YPAC) programming produced in
1993. He also provided Council with up -to -date information
about 1994 programming, anticipating continued success.
Council members recognized the excellent coverage and how
well received this programming has been. It was MOVED BY
BUCHANAN, SECONDED BY BERGER, TO ACCEPT THE REPORT.
The motion carried by unanimous voice vote; Barnett and Sims
absent.
*9. CONSIDERATION OF RESOLUTION REPEALING THE MODESTO WAY /NORTH
50TH AVENUE ANNEXATION INITIATION
RESOLUTION NO. R 94 - 38, A RESOLUTION repealing the
Modesto Way /North 50th Avenue Annexation.
*10. NOTICE OF INTENTION TO COMMENCE CITIZEN INITIATED MODESTO
HEIGHTS ANNEXATION (STANDARD MOTIONS A & B)
April 5, 1994 was set as the time of a meeting with the
initiating parties who have signed a Notice of Intent to
Commence Annexation Proceedings, the initiating parties being
Frank J. and Sharon Fitterer.
The annexation proposed by the above parties was accepted by
the City of Yakima and the area to be annexed was required to
assume its share of the City's existing indebtedness, and
staff was directed to file a Notice of Intent to Annex with
the Yakima County Boundary Review Board.
*11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT
WITH CHARRON COMPANY, INC. FOR UTILIZATION OF WASTEWATER
1/ TREATMENT PLANT BIOSOLIDS
RESOLUTION NO. R 94 - 39, A RESOLUTION authorizing the
renewal of a contract with Charron Company, Inc. for
utilization of Wastewater Treatment Plant biosolids.

*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH THE YAKIMA VALLEY UMPIRES ASSOCIATION
RESOLUTION NO. R 94 - 40, A RESOLUTION authorizing
execution of an Agreement with the Yakima Valley Umpires
Association.
*13. APPROVAL OF 1993 REBOUND PLUS ANNUAL REPORT
The 1993 Annual Rebound Plus Report was accepted.
*14. FIRST READING OF ORDINANCE AMENDING THE 1994 BUDGET AND
APPROPRIATING FUNDS FOR PREPARATION OF A YAKIMA INTERURBAN
LINES PLAN (NO ACTION REQUIRED AT THIS MEETING)
An Ordinance amending the 1994 Budget and appropriating funds
for the preparation of a Yakima Interurban Lines Plan, having
been read by title only, was laid on the table for one week,
until April 12, 1994.
15. PRESENTATION REGARDING PUBLIC AWARENESS CAMPAIGN FOR CITY
ANTI - CRUISING AND CURFEW /PARENTAL RESPONSIBILITIES ORDINANCES
Marketa Oliver, Administrative Assistant to the City Manager,
outlined the public awareness campaign, which utilizes
various avenues to provide information about the City's
recently - passed Anti - cruising and Curfew /Parental
Responsibility Ordinances. A brochure has been prepared,
available in English and Spanish, and will be sent to all
alternative, middle, and high schools within Yakima County as
well as to youth centers, the public library, and any
organization requesting them. Community Policing Officers
will also distribute this information and it will be
available through the Yakima Police Department. In addition
to the brochures, the information has been published in the
City's Newsletter. Ms. Oliver narrated a video presentation
of three public service announcements which have been created
in an effort to further promote public awareness and dispel
misconceptions about the legislation to take effect
April 3, 1994. Additional public service announcements have
also been produced to air on the radio. There was discussion
among Council members and staff concerning the impact the
language contained in these ordinances will have in
relationship to the adoption of similar legislation in other
jurisdictions. Council Member Beauchamp requested a plan be
implemented to monitor the status of the activity of the
Anti - cruising Ordinance. City Manager Zais stated that is
essentially part of the process of adoption. It includes a
follow -up report with the first report due within the next 60
days. Ms. Oliver stated the Task Force is meeting again on
May 9, and on the agenda for that is a report from the Police
Department regarding the ordinances. Mayor Berndt commented
the report to Council should be submitted in about six

months; however, it %s important to keep in touch with the
:Police Department to monitor its activity.
16. OTHER BUSINESS
: Pertaining to Mayor Berndt's upcoming visit to China, there
was discussion among Council members and staff concerning the
possibility of initiating a Sister City relationship in
China. There was discussion among Council members and staff
regarding funding and budget concerns. Staff was directed to
look for possible funding sources in the 1995 Budget.
Glenn Valenzuela, Director of Community and Economic
Development, reminded Council that this is Spring Fest '94
week and invited Council to attend the volunteer recognition
program to be held.
Mayor Berndt reported that Yakima has been designated as a
Community Empowerment Zone by the State in.an effort to help
strengthen the local economy.
Council Member Brado asked if an on -going
graffiti /neighborhood clean -up program could be established.
City Manager Zais announced that the adjourned meeting
scheduled for April 12, 1994 has been canceled.
An Executive Session was requested to discuss pending and
prospective litigation. It was MOVED BY BUCHANAN,
SECONDED BY BERGER', TO MOVE INTO EXECUTIVE SESSION
FOR THE PURPOSE OF DISCUSSING PENDING AND PROSPECTIVE
LITIGATION,: WITH IMMEDIATE ADJOURNMENT THEREAFTER.
The motion carried by unanimous voice vote; Barnett and Sims
absent.
