Final Contract Payment for Columbia Asphalt & Gravel, Inc. - Fire Station 95 - Pavement Repair (Standard Motion V -B- Accept the project and approve the final payment) C. Audience Participation Community members are invited to address items that are not listed on the regular business meeting agenda. A guideline of three (3) minutes per speaker is in place in order to allow as much opportunity as possible for audience participation A speaker's time may be extended at the discretion of the Mayor and /or the consensus or vote of the Council. Written communication and e-mail messages are strongly encouraged PUBLIC HEARINGS 6. Public Meeting to consider citizen comments on the proposed 2013 Annual Action Plan for Community Development Block Grant (CDBG) and HOME Fund Programs 7. Public Hearing and Resolution adopting proposed Findings of Fact supporting enactment of moratorium regarding adult entertainment and adult entertainment businesses. CITY MANAGER REPORTS 8. Resolution authorizing the execution of a Promissory Note Modification Agreement to extend the final payment by United Builders of Washington, Inc. for repayment of a CDBG loan, said loan being secured by The Seasons Music Hall property together with the personal guarantees of J. Patrick Strosahl and Stephen R. Strosahl. 9. Resolution authorizing the execution of a Work Out Agreement to resolve and retire indebtedness to the City resulting from certain HUD Section 108 Loans provided to TrailWagons, Inc., said loans secured by certain real property owned by Chinook Business Park, LLC and by the personal guarantee of Gary and Mary Lukehart. 10. Adjournment • The next meeting will be a Council Study Session on September 11, 2012 at 10 a.m. in the Council Chambers. 11. Council Generated Information A. Council General Information Any invocation that may be offered before the official start of the Council meeting shall be the voluntary offering of a private citizen, to and for the benefit of the Council. The views or beliefs expressed by the invocation speaker have not been previously reviewed or approved by the Council, and the Council does not endorse the religious beliefs or views of this, or any other speaker. I have learned that the city shop is a state of the art facility but the only thing they use are the chairs! Dave Edler does all the work. mci4, 2. I have not observed the fire or water department flu hg , � ester lines the way that they used to 30 -50 years ago. Why not? Look at this water from Amanda's house. This sediment filled up the water tank and ruined the water heater. It must have weighed 400 lbs with the sediment and plugged up pipes. Will the city pay for the replacement of the tank? Dear Mr. Lemon: I was interested to read recently in the Yakima Herald- Republic that you have a problem with the City of Yakima Wastewater Division. I too have seep various corrupt things with. that Department. I expect that you are not familiar with my information, because it is not common knowledge. Yet it shows the far - reaching extent of City corruption. I have tried to interest the YHR as well as several Yakima City Council members. None of them what to hear anything, and even have made excuses for the corruption. Frankly, I want you to know as well! I don't expect you to do anything, but at least someone else should know the facts of corruption. I am going to remain anonymous at this time, but you easily verify some of the information by a GOOGLE search About 11 years ago Max Linden was hired by the City of Yakima as a Wastewater Engineer (he recently retired). Max had been a unit supervisor for the Washington Department of Ecology in the water quality program. He was given the City position, which required a Washington- certified engineer, even though he was never an engineer. The other candidate was both a Civil Engineer as well as a past Regional Manager of Ecology. Suffice to say, that Max's friend was Doug Mayo who was the Wastewater Superintendent. Max was given the position only to increase his retirement benefit via a much higher salary than he had with Ecology (and no supervisory responsibilities). The corruption between Ecology personnel and the City of Yakima Wastewater division did not stop The present Wastewater Assistano Superintendent is Dave Schneider. Before, Dave was an Environmental Scientist with Ecology (working for Max) He was unfortunately let go (fired) due to mis- management of a small project. The City's position requires years of experience in wastewater. Dave had never even been in a wastewater treatment facility prior to being hiring by the City. Dean Smith was also hired away from Ecology to the City of Yakima. He also worked in the Water Quality Program in Yakima and worked closely with Max. In fact, in his last days at Ecology Dean was acting unit supervisor. Most recently, Ryan Anderson was selected as the City's Utility Engineer. Ryan also worked for Max as an Environmental Scientist Ryan is not an engineer and never has taken an engineering course, but yet was given the position The Utility Engineer position was a replacement position for Max's Wastewater Engineer position. There is another Ecology person now working for the City of Yakima wastewater division I never met her but is surely is a coincidence that so many people who worked with Max Linden are now City Employees (all at much higher salaries)>
