ROLL CALL The City Council met in session on this date at 2:00 p.m., in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council Members Clarence Barnett, Ernie Berger, Bill Brado, and Bernard Sims present on roll call. Council Members Henry Beauchamp and Lynn Buchanan absent and excused. City Manager Zais, City Attorney Paolella, and City Clerk Roberts also present. Mayor Berndt introduced LIFT Students, Alma Montes De Oca and Ray Ochs. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Ray Ochs. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER A. PROCLAMATIONS (IF APPLICABLE) Mayor Berndt declared March 1994 as American Red Cross Month and presented the proclamation to Gail Weaver. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council to remove Item No. 9 from the Consent Agenda and remove Items Nos. 8 and 10 as requested by Hector Franco. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BARNETT, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote; Beauchamp and Buchanan absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 1/ 5. PUBLIC HEARING ON PROPOSED LEGISLATION A. ANTI- CRUISING ORDINANCE ORDINANCE NO. 94 - 10, AN ORDINANCE relating to traffic; prohibiting motor vehicles from cruising designated routes within the City of Yakima; and enacting a new section, Section 9.25.010 of the City of Yakima Municipal Code. 1 1 MARCH 1, 1994 B. CURFEW /PARENTAL RESPONSIBILITY ORDINANCE ORDINANCE NO. 94 - 11, AN ORDINANCE relating to public safety and morals; prohibiting minors from remaining in any public place in the downtown area; defining the duties of parents and guardians charged with the custody or care of minors; providing penalties for violations thereof; adding a new Chapter 6.09; and adding Sections 6.09.010, 6.09.020, 6.09.030, and 6.09.040 all of the City of Yakima Municipal Code. 6. AUDIENCE PARTICIPATION *7. CONSIDERATION OF RESOLUTION AUTHORIZING CITY MANAGER TO APPLY FOR STATE NEIGHBORHOOD REINVESTMENT AREA DESIGNATION RESOLUTION NO. R 94 - 20, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to file an application with the State of Washington Department of Community Development for designation as a Neighborhood Reinvestment Area. 8. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF PROFESSIONAL SERVICES AGREEMENT WITH KI -YAK FOR WASHINGTON STATE AGRICULTURAL SHOWCASE RESOLUTION NO. R 94 - 21, A RESOLUTION authorizing the City Manager and the City Clerk of Yakima to execute a professional services agreement between the City of Yakima and the Kittitas- Yakima Resource Conservation and Economic Development District. 9. CONSIDERATION OF RESOLUTION SETTING APRIL 12, 1994 AS DATE OF PUBLIC HEARING FOR CONFIRMATION OF THE 1994 IRRIGATION MAINTENANCE ASSESSMENT ROLL *10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF COMPLIANCE SERVICES CONTRACT RESOLUTION NO. R 94 - 22, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute Compliance Consulting Services Agreements between the City of Yakima and private contractors. *11. ACCEPTANCE OF JANUARY 1994 REVENUE AND EXPENDITURE REPORT The January 1994 Budget Report was accepted. *12. APPROVAL OF 4TH QUARTER 1993 VEHICLE INCIDENT REPORT The 4th Quarter 1994 Vehicle Incident /Collision Report was accepted. 2 ry 179 MARCH,1, 1994 *13. FIRST READING OF AN ORDINANCE AMENDING 1994 BUDGET FOR 1993 YEAR END ENCUMBRANCES (NO FORMAL ACTION REQUIRED THIS MEETING) An Ordinance amending the 1994 Budget and appropriating funds for 1993 year -end encumbrances, having been read by I/ title only, was laid on the table for one week, until March 8, 1994. 14.
