BUSINESS MEETING

• 1. ROLL CALL
The 'City Council met in session on this date at 2:00 p.m.,
in.the Council Chambers of City Hall, Yakima, Washington.
Mayor Pat Berndt, presiding, Council Members Clarence
Barnett, Henry Beauchamp (present after 2:07 p.m.), Bill
Brado, Skip Semon and Bernard Sims present on roll call.
• Council Member Lynn Buchanan absent on City business and
excused. City Manager City Attorney Paolella, and
City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The'Pledge of Allegiance was led by Council. Member Sims.
3. .OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt reported that agenda item No. 7 will not be
heard. The applicant, the Greenway Foundation, has withdrawn
its application and will resubmit it at a later date. City
Attorney Paolella stated the reason the application has been
withdrawn is that the Greenway will be revising. the SEPA
environmental checklist and there will be a new determination
made at a future date.
A. PROCLAMATIONS (IF APPLICABLE)
Mayor Berndt presented a certificate to Irene Gutierrez for
the Yakima Alley Cats 1993 Outstanding Performance Award * from
the Substance Abuse Coalition.
Mayor Berndt presented to Wendy Warren an outstanding service
award from the Yakima County Substance Abuse Coalition and
the Yakima Gang Prevention Coalition for the Cable Division's
"Volunteers Make the Difference" program. Wendy Warren
accepted the certificate on behalf of Marc Lecuyer, Ray Young
and Randy Beehler.
1/ Mayor Berndt reported that she, Council Members Sims and
Beauchamp, and staff attended the legislative priorities
meeting at noon. There.was a common theme found among the
different entities relating to affordable housing, youth
violence and economic development for the youth in our
community. (Council Member Beauchamp present after
2:07 p.m.)'
Following the Committee recommendation, it was MOVED BY
BARNETT, SECONDED BY SIMS, TO APPOINT GARY KISSLING

TO THE YAKIMA VALLEY' REGIONAL LIBRARY BOARD OF
— TRUSTEES. The motion carried by unanimous voice vote;
Buchanan absent.
4. CONSENT AGENDA
Mayor Berndt referred to items placed on the Consent
Agenda, questioning whether there were any additions or

deletions from either Council members or citizens present.
There being no changes, the City Clerk then read the Consent
Agenda items, including resolutions and ordinances by title.
It was MOVED BY SIMS,;:SECONDED BY SEMON, THAT THE
CONSENT AGENDA, AS READ, BE ADOPTED. The motion
carried by unanimous roll call vote; Buchanan absent.
(Subsequent paragraphs preceded by an asterisk ( *) indicate
items on the Consent Agenda handled under one motion without
further discussion.)
*5. APPROVAL OF THE MINUTES OF THE OCTOBER 13, 1992 ADJOURNED
MEETING
The minutes of the October 13, 1992 Adjourned meeting was
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. SECOND PUBLIC HEARING ON COMMUNITY REDEVELOPMENT FINANCING
ORDINANCE (Bring previously distributed material)
This being the time set for the second hearing on the
Community Redevelopment Financing (CRF) Ordinance, Mayor
Berndt opened the public hearing. Joe Gero, representing
New Vision, submitted a letter in support of the creation of
the CRF District. Becky Yeaman, Thurston Wolfe Winery,
thanked the Mayor for responding to her letter last week.
She stated she is on the Yakima Center Board and the Visitors
and Convention Center Board. She supports the CRF program,
and requested funding consideration for both entities. She
spoke about the conventions lost due to the small size of the
Yakima Center. John Puccinelli, 314 North 1st Street and
Kay Chin, representing the Yakima Valley Restaurant
Association, spoke in support of this program.
Mr. Puccinelli stated he is in favor of the Visitors and
Convention Center project since it brings money into the
Valley through tourism. Ed Beehler, Umpire Association,
ASA Softball District 4, spoke about how Yakima is losing
tournaments to other cities who have improved sports
facilities. Ron King, 320 Stanley Boulevard, stated he

understands there are more projects being considered for the
CRF funding that are more critical than a sports complex;
however, Yakima is facing a crossroads now in the sports
industry. He estimated that with a proper complex, at an
estimated $2 million cost, serving 40 teams a weekend for 32
weekends, $89,500 in tourism revenue could be generated.

John Fisher, partnerith Mas.t,er, and Daniels, representing
the Visitors and Convention Bureau, spoke in support of the
CRF program and the expansion of the Yakima Center as the
primary and single recipient of the grant award. Tim
Peterson, General Manager of Cavanaugh's Yakima Center,
encouraged the development of the. Community Redevelopment
Financing District. He encouraged Council to consider the
funds for capital improvements that encourage private
development within the district, and, in particular, the
expansion of the Yakima Center. He asked Council to consider
enlarging the size of the district to lessen the risk to the
General Fund. Corday Trick, North Front Street
Association, again supported the CRF program. He supported
the expansion of the Yakima Center, but asked Council to also
give improvements to Front Street consideration. Judy
Garcia, representing the Yakima Indian Nation Cultural
Heritage Center, spoke in support of the expansion of the
Yakima Center because increased tourism in Yakima leads to
increased tourism in Toppenish and the Lower Valley. Nancy
Rayner, 25 North Front Street at the Opera House, expressed
support of the expansion of the Yakima Center, and also
requested funds for the Front Street improvements. Phil
Pleasant, 701 South 7th Avenue, requested that Council
include the southeast community in this reinvestment
opportunity, by making infrastructure improvements. Gordon
Wonder, asked if earmarking increased property tax revenue
would jeopardize funding future City operations. Council
Member Semon stated that is a small risk; however, the City
cannot include more than 2.5% of the entire assessed
valuation of the City in thisdistrict. Also, the funding
for the project is in the form of . a bond. Only a project
which supports the sale of the bond would be financed. There
being no other citizen wishing to speak, Mayor Berndt closed
the public hearing. She announced there will be a third
hearing tonight at 7:00 p.m. at the Yakima Center.
7. PUBLIC HEARING ON SEPA APPEAL FOR THE GREENWAY PATHWAY WEST
PROJECT, FILED BY JOE SCHONS
Public hearing not held due to withdrawal of application.
8. AUDIENCE PARTICIPATION
I/ Dan Danielson distributed a letter requesting Council's
assistance in obtaining close captioning in Yakima to serve
the deaf community. He requested Council form a task force,
to include deaf people and Yakima TV station, managers, to
consider options to giving the hearing impaired access to the
local news and City announcements, etc. on TV. He reminded
Council about the requirements in the Americans with
Disabilities Act. He stated that the City's Cable TV
Division is willing to assist in this project. Council
. Member Beauchamp recommended that Council follow the
suggestion to form a task force to look into this, including

bringing in the three network stations. Jeannette
Stoutimore, associate working with Dan on close captioning,
stated she would like to have some businesses sponsor the
purchase of the close captioning equipment. She stated she
is working on a petition signed by people who are hearing
impaired and deaf. Mayor Berndt commented the start -up costs
are just one factor, and asked if there would be anyone
interested in the interpreting service on a volunteer basis.
City Manager Zais stated that Wendy Warren is already
involved in this and will continue in that regard.
9. REPORT ON PROPOSED MODIFICATIONS TO THE UTILITY CUSTOMER
BILLING FORM
City Manager Zais introduced this topic by commenting that
the purpose of revising the utility customer billing form is
to reflect the distribution of costs assigned for each of the
various service elements and to focus on the mandated costs
which are the principal expenses for our utilities. Council
member Barnett expressed his gratitude for this revision and
asked if staff could use another term for "City general
services." He suggested "administrative City overhead" or
some other term to include legal, finance, engineering, etc.
Mayor Berndt agreed with that suggestion. Following further
discussion, it was MOVED BY BARNETT, SECONDED BY
BEAUCHAMP, TO ACCEPT THE FORMAT IN THE TIME FRAME
WHICH IS ACCEPTABLE TO STAFF, FIRST USING THE
EXISTING STOCK. The motion carried by unanimous voice
vote; Buchanan absent.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT
WITH YAKIMA SCHOOL DISTRICT FOR THE DARE PROGRAM
RESOLUTION NO. R - 93 - 126, A RESOLUTION authorizing the
City Manager to execute the D.A.R.E. Program Agreement with
the Yakima School District.
*11. SET DATE OF PUBLIC HEARING FOR DECEMBER 21, 1993 FOR ADA
TRANSIT PLAN UPDATE
December 21, 1993 was set as the date of public hearing on
the American with Disabilities Act Plan Update for 1994.
*12. SET DATE OF HEARING BEFORE THE HEARING EXAMINER FOR
JANUARY 13, 1994 TO CONSIDER RIGHT -OF -WAY VACATION IN

VICINITY OF 17TH STREET, 15TH STREET AND RIVERSIDE, FOR KPFF
RETAIL CENTER
RESOLUTION NO. R - 93 - 127,: A RESOLUTION fixing time for
public hearing before the Hearing Examiner on a petition to
vacate portions of Riverside Street, South 15th Street, South
16th Street, and South 17th Street all in the vicinity south
of East Chestnut Street and East of the right -of -way 1 -82.

*13. FIRST READING OF AN:.,ORDINANCE AMENDING THE 1993 BUDGET AND
APPROPRIATING FUNDS FOR DIAL -A -RIDE (N) FORMAL ACTION REQUIRED THIS
MEETING)
An Ordinance amending the 1993 budget and appropriating
additional funds for Dial -A -Ride services, having been read
by title only, was laid on the table for one week, until
December 14, 1993.
14. OTHER BUSINESS
Director of Finance and Budget Hanson reported some changes
to the budget which were inadvertently omitted from the
budget wrap -up and will be included in the budget ordinance
for adoption next week.
Executive Session
It was MOVED BY SIMS, SECONDED BY BEAUCHAMP, TO MOVE
INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING
PENDING LITIGATION ON THE CLIESE LAWSUIT, WITH
IMMEDIATE ADJOURNMENT THEREAFTER TO 7:00 P.M.
TONIGHT, THEW TO DECEMBER 9TH AT 6:30 P.M. The motion
carried by unanimous voice vote; Buchanan absent.
