CITY OF YAKIMA, WASHINGTiON
NOVEMBER 19, 1991
BUSINESS MEETING
1. ROLL CALL
The City Council net in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Oouncilmembers Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, George Pechtel, Skip Semon and Bernard
Sims present on roll call. City.Manager Zais, City Attorney Vanek,
.City Clerk Roberts and Clerk Harris also present.
2. INVOCATION/PLEDGE OF ALLEGIANCE
The Invocation was given by Councilmember Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt announced she will be attending the AWC Urban Agenda
meeting in Seattle on Thursday, November 21, 1991, and on Friday,
November 22, she and City Manager Zais will attend the AWC
Legislative Committee meeting.
4. CONSENT AGENDA
Mayor ,Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Councilmembers or citizens present. It was the general
consensus that Item No. 11, as requested, be removed from the
Agenda. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED BY
SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE
PASSED. The motion carried by unanimous roll call vote.
(Subsequent paragraphs preceded by an asterisk ( *) indicate its
on the Consent Agenda handled under one motion without further
discussion.)
*5. APPROVAL OF MINUTES OF COUNCIL MEETING OF NOVEMBER 5, 1991
The Council minutes of the November 5, 1991 Business meeting were
approved, having been duly certified accurate by two Council-
members and no one present wishing to have said minutes read
publicly.
6. PUBLIC MEETING ON $UNCREST II FINAL PLAT (VICINITY 28TH AVE./MEAD)
(SEE RESOLUTION APPROVING FINAL PLAT) (CONTINUED FROM 11/12/92)
This being the time set for the public. meeting, Associate Planner
{ Davenport recommended approval of the final plat. City Engineer
French showed a video and circulated photographs of the property.
It was the consensus of the Council that property being improved by

private developers should follow the standards as Public Works
projects, for the goodwill of the neighborhood. Mayor Berndt
expressed concern over the abandoned autos and the lack of
sidewalks on both sides of the street. Resolution No. D -6025,
having been read by title, it was MOVED BY SEMON, SECONDED BY SIMS,
THAT THE RESOLUTION BE ADOPTED. The motion carried by unanimous
roll call vote: Councilmembers Beauchamp and Buchanan expressed
their desire to have a follow -up on this property to see if the
general clean -up improvements were accomplished.
.:RESOLUTION NO. D - 6025, A RESOLUTION approving the Suncrest II final
plat and subdivision submitted by United Builders of Washington for
27 -lots at South 28th Avenue, South of Mead Avenue, subject to all
of the conditions contained in the Hearing Examiner's
Recommendation; and authorizing the Mayor to sign the final plat
for Suncrest II.
7, PUBLIC HEARING REGARDING RECONSIDERATION OF CITY PARTICIPATION IN
THE PUBLIC TRANSPORTATION BENEFIT AREA
This being the time set for public hearing, Transit Manager Schultz
• stated the City's position on the Public Transportation Benefit
Area (PTBA). Mayor Berndt opened the public hearing. Speaking
in favor of the City's participation were: Larry Matthews, 805 S.
17th, Avenue; representing the Citizens for Accountability and
Responsible Government, Mary Hersey, 419 S. 67th Avenue, Jerry
Henderson, 309 N. 35th Avenue, Jim McLean, 1418 Jefferson, Eve
Franz, 7 N. 9th Avenue,'; Greg Heartburg, 1508 S. 74th Avenue,
. 'Sister Maryrita Rbade;. representing Heritage College, Daniel
Snobel, 9303 Wide Hollow Road, Lucinda Getz, 4908 Castleview,
Office of Aging & Long Time Care; Betsy Nagle-McNaughton, 207 S.
31st Avenue, Planned Parenthood; Matt Fairbanks, 814 S. 5th Avenue,
Interfaith Volunteer Services; Nancy Faller, 2207 Barge, and Bill
Wright, former owner of the Selah Trolley. It was the consensus of
these citizens that it would be a benefit to the City of Yakima and
its citizens to be a part of the PTBA, both for environmental and
financial reasons - , as well as citizen convenience.
• There being no further public. comment, Mayor Berndt closed the
public hearing. It was the consensus of the Council that they need
more information to act on this issue in a responsible manner. It
was MOVED BY PECHTEL, SECONDED BY SEMON, TD OBTAIN ADDITIONAL
INFORMATION AND MAKE A DECISION BY DECEMBER 3, 1991 AND MAKE THIS
(1/ DECISION KNOWN TO THE PUBLIC. The motion carried by unanimous
voice vote.
8. PUBLIC HEARING ON EAST VIOLA/FRONTAGE ROAD ANNEXATION (SEE
ORDINANCE ANNEXING PROPERTY)
Bruce Benson, Associate Planner, reviewed the annexation with
Council and recommended approval. This being the time set for
public hearing, Mayor Berndt opened the public hearing and asked
for anyone wishing to speak. There being no citizen wishing to
speak to this issue, the public meeting was closed. Ordinance No.
3415 having been read by title, it was MOVED BY BUC ANAN, SECONDED ;"

BY SIMS, THAT THE ORDINANCE BE ADOPTED. The motion carried by unanimous roll call vote.
ORDINANCE NO. 3415, AN (ORDINANCE annexing property to the City of
Yakima and zoning said property. (East Viola /Frontage Road
Annexation)
9. AUDIENCE PARTICIPATION
None
10. CONSIDERATION OF ACCEPTANCE OF CONFERENCE OF GOVERNMENTS\ 1992
BUDGET
Lon Wyrick, Director of Conference of Governments presented his
budget and explained their personnel staffing practices. It was
QED BY SIMS, SECONDED BY BEAUCHAMP, TO APPR NE THE BUDGET. The
motion carried by unanimous voice vote.
11. CONSIDERATION OF RESOLUTION APPOINTING- GLEN WARREN AS THE CITY'S
PUBLIC DEFENDER FOR 1992 AND 1993
Councilmember Semon felt the public defender service should be put
out for bid, considering the high cost and the time lapse since the
last bid. Councilmember Beauchamp suggested approving the contract
for one year, then putting it out for bid. It was MOVED BY

PECHTEL, SECONDED BY BEAUCHAMP, 10 APPOINT GLEN WARREN AS CITY
PUBLIC DEFENDER FOR ONE YEAR, THEN DIRECT STAFF TO GO OUT FOR BIDS
FOR THE 1993 CONTRACT. It was MOVED BY BUK ANAN, SECONDED BY
BEAUCHAMP, 1U AMEND THE MOTION TO INCLUDE THE 5% INCREASE FOR 1992.
The motion carried by 5-2 roll call vote. Berndt and Sims voting
nay. Mayor Berndt stated she voted against the motion because she
felt it should be a two year contract. Councilmember Sims stated
he voted against the motion because he felt the process should
begin right away, if it was going to be put out for bids. The
question was called for a vote on the motion as amended. The
motion carried by 6-1 voice vote; Sims voting nay.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF SEWER
REIMBURSABLE AGREEMENT WITH GARY LUKEHART FOR PROPERTY CN 34TH
AVENUE
RESOLUTION NO. D -6026, A RESOLUTION authorizing the City Manager
and City Clerk of the City of Yakima to execute an agreement with
Gary Lukehart for the partial reimbursement of construction cost
for a public sewer line.

*13. APPROVAL OF THIRD QUARTER 1991 INSURANCE REPORT
The Third Quarter 1991 Insurance Report was accepted.
' *14. APPROVAL OF FINAL CONTRACT PAYMEN'1S FOR: '
A. WEST CHESTNUT SEWER PROJECT
The report from the City Engineer dated November 7, 1991, with
respect to the completion of the work on the West Chestnut Sewer
Project, performed by Central Concrete & Utilities, was approved,
the work accepted and payment of the final estimates as therein set
forth was authorized.
. B. 40TH AVENUE COORDINATION PROTECT
The report from the City Engineer dated November 12, 1991, with
respect to the completion of the work on the 40th Avenue
Coordination Project, performed by Columbia Asphalt & Gravel, was
approved, the work accepted and payment of the final estimates as
therein set forth was authorized.
15. CONSIDERATION OF ORDINANCE CREATING A'150' WIDE FIRE BREAK IN LIEU
OF REMOVAL OF HAZARDOUS VEGETATION
Leonard Hall, Supervising Code. Inspector, and Councilmember
Beauchamp explained the proposed fire break 'amendment.
Councilmember Beauchamp expressed a need for the City to check fire
breaks, for tumbleweeds. Ordinance No. 3416 having. been read by
title, it - was MOVED BY BOCHANAN, SECONDED BY BEAUCHAMP, THAT THE
ORDINANCE. BE ADOPTED. The motion carried by unanimous roll' call
vote. •
ORDINANCE NO. 3416, AN ORDINANCE relating to fire; requiring
property owners to remove growing or dead vegetation and debris
which constitutes an existing or potential fire hazard; or in lieu
of removal, creating a 150 foot wide .firebreak; and amending
Subsection 10.05.100A of the City of Yakima Municipal Code.
*16. SECOND. READING OF ORDINANCE AMENDING THE 1991 WATER BUDGET AND
APPROPRIATING FUND FOR PURCHASE OF MATERIALS FOR NEW WATER SERVICES
An Ordinance amending the 1991 Water Budget and appropriating funds
for the purchase of materials for new water services, having been
read by title only at the previous meeting, was brought before the
Council for a second reading.
ORDINANCE NO. 3417, AN FINANCE amending the 1991 budget for the
City of Yakima; making an appropriation of $70,000 in the 474 - Water
Fund for expenditure during 1991 for the purchase of new water
meter service material.

*17. SECOND READING OF ORDINANCE AMENDING THE 1991 IRRIGATION BUDGET AND
APPROPRIATING FUNDS FOR PAYMENT OF WATER SHARE ASSESSMENTS,
OVERTIME, PROFESSIONAL SERVICES, REPAIR AND MAINTENANCE BY
CONTRACTORS AND OPER2;TING EQUIPMENT IN THE IRRIGATION DIVISION
An Ordinance amending the 1991 Irrigation Budget and appropriating
funds for payment of water share assessments, overtime,
professional services, repair and maintenance by contractors and
operating equipment in the Irrigation Division, having been read by
title only, was brought before the Council for a second reading.
ORDINANCE NO. 3418, AN ORDINANCE amending the 1991 budget for the
City of Yakima; making an appropriation of $28,200 in the 146 -
Irrigation Fund for expenditure during 1991 for payment of water
share assessments, overtime, professional services, repair and
maintenance by contractors and operating equipment.

19. EXECUTIVE SESSION REGARDING PROPERTY ACQUISITION
It was MOVED BY BEAUCHAMP, SECONDED BY BUL IANAN, TO MOVE INTO
EXECUTION SESSION FOR THE PURPOSE OF DISCUSSING PROPERTY
ACQUISITION, WITH IMMEDIATE ADOOURNMENT THEREAFTER TO DER 26,
1991, AT 8:30 A.M., FOR CONTINUATION OF BUDGET REVIEW. The motion
carried by unanimous voice vote.
20. 3:30 P.M. — CONTINUATION OF BUDGET REVIEW (PARKS AND RECREATION -
BUDGET PAGE 349 - POLICY ISSUE PAGE 104)
Due to lateness of the hour, this discussion was postponed to 8:30
A.M. on November 26, 1991.

21. ADJOURNMENT
