ROLL CALL The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Councilmembers Clarence Barnett, Henry Beauchamp, Lynn Buchanan, George Pechtel, and Bernard Sims present on roll call. Councilmember Skip Semon present at 2:25 P.M. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Lovell also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE Councilmember Buchanan led the Pledge of Allegiance. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER The 25th anniversary of the City Transit System was celebrated with cake and a special appearance by former Transit Manager Bob Knight. 4. CONSENT AGENDA Mayor Berndt referred to the items placed oi% the. Consent Agenda, questioning whether there were any additions -or deletions from either Councilmembers or citizens present. It "was - the consensus of Council that the addition of Item No. 9 and the deletion of Items No. 10 and 21, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote; Semon absent. (Subsequent paragraphs • preceded by an asterisk ( *) indicate items on the‘ Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE OCTOBER 8, 1991 ADJOURNED AND BUSINESS MEETINGS The Council minutes of the October 8, 1991 Adjourned and Business meetings were approved, having been duly certified accurate by two Councilmembers, and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION Mayor Berndt read a proclamation designating October 21 -27, 1991 as Women in Math and Science Week in the City. of Yakima. The proclamation was accepted by Jean Vanek. Phil Pleasant, 701 South 7th Avenue, requested clarification from Councilmember Barnett on his paid political advertisement regarding Transit funds. Mr. Pleasant criticized the City's efforts to hire minority consultants, and noted an absence of minority employees at City subsidized facilities, including the Visitors and Convention Center, the Capitol Theatre and the Airport. OCTOBER 22, 1991 3 5 Jeanne Hall, 417 South 17th Avenue, objected to the number of police vehicles and officers responding to complaints at the - Women's Health Center. She felt the response was excessive, and protested the abuse of police protection by the clinic. (Councilmember Semon present at 2:25 P.M.) Police Chief Green . explained the standard procedure used by the Police Department to respond to calls for assistance. He stated that the Department responds to all complaints at the Center to protect the rights of both the protestors and the clinic. 7. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND DEBRIS PROGRAM Code Administration Manager Shampine stated that he had nothing to add to the staff report, and noted that this will probably be the last weedy lot resolution this year. There being no one present to speak to the issue, and Resolution No. D -6014, having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE RESOLUTION. The motion carried by unanimous voice vote. RESOLUTION NO. D -6014, A RESOLUTION authorizing the Code Administration Manager to clear certain weedy lots. 8. REPORT FROM PUBLIC WORKS REGARDING PETITION FOR 4 -WAY STOP SIGNS ON 10TH AVENUE Supervising Traffic Engineer Willson outlined research conducted in response to a petition requesting a 4 -way stop sign on 10th Avenue at Viola or Logan. Staff recommends denial of the request, and encouraged the petitioners to participate in the Neighborhood Speed Watch Program to reduce speeding problems. Staff also suggested a request be made to the school district for marked school crossings. Councilmember Semon encouraged Council to approve the request with trial installation of a stop sign, to be reviewed after a specified period of time. Councilmembers Sims and Buchanan argued that Council should uphold the staff recommendation and follow specific warrants before stop signs are installed. Councilmember Pechtel agreed that neighborhood concerns should be considered, but felt that going against the staff recommendation would set a bad precedent. Mayor Berndt observed that use of arterial streets should be encouraged in order to preserve neighborhoods. Sheridan Folsom, 1409 South 29th Avenue, said that the neighbors have reviewed the staff recommendations, and still wish to have a stop sign installed. It was MOVED BY SEMON, SECONDED BY BEAUCHAMP, TO TRY A 4 -WAY STOP SIGN AT 10TH AVENUE AND VIOLA, WITH REVIEW AFTER THE FIRST OF THE YEAR. Councilmember Buchanan called this action micromanagement by Council, and felt that the technical basis of the staff decision should be affirmed. Councilmember Pechtel felt the action was unjustified, and would increase the number of requests coming to Council. The question was called for a vote on the motion. The motion carried by a 4 -3 voice vote; Buchanan, Pechtel and Sims voting nay. Councilmembers Pechtel and Buchanan asked that all future requests for stop signs come directly to Council for review. No decision was reached, as Council discussed their responsibility to citizens and the appropriateness of reviewing every staff decision. OCTOBER 22, 1991 36 *9. REPORT FROM PUBLIC WORKS REGARDING 16TH AVENUE AND RIVER ROAD The item was added to the Consent Agenda. The staff recommendation to refer the project to the Engineering and Utilities Department to determine funding and scheduling was accepted. 10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONSULTANT CONTRACT FOR I -82 /YAKIMA AVENUE VICINITY AND FAIR AVENUE PROJECT Councilmember Barnett stated that he removed this item from the Consent Agenda to ask for clarification of the consultant's intent to meet the City's WMBE goals. Engineering and Utilities Director Covell explained that the figures are confusing because the WMBE is calculated on a dollar value. Percentages will vary in different phases of the project, but the firm is geared to meet the 10% overall requirement. Resolution No. D -6015, having been read by title, it was MOVED BY SIMS, SECONDED BY PECHTEL, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. D -6015, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement with CH2M -Hill for professional services. *11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF RENEWAL CONTRACT WITH SCOTT WETZEL SERVICES, INC. FOR THIRD PARTY WORKER COMPENSATION SERVICES RESOLUTION NO. D -6016, A RESOLUTION authorizing the City Manager and the City Clerk to execute an amendment to the agreement with Scott Wetzel Services, Inc. for workers' compensation services in 1991. *12. CONSIDERATION OF RESOLUTION AUTHORIZING RENEWAL OF SLUDGE APPLICATION AGREEMENT WITH ROBERT CHARRON RESOLUTION NO. D -6017, A RESOLUTION authorizing the renewal of a contract with Charron Company, Inc. for disposal of Wastewater Treatment Plant sludge. *13. CONSIDERATION OF RESOLUTION AUTHORIZING CORRECTION TO BOND ORDINANCE NO. 3402 REGARDING SEMI - ANNUAL REPAYMENT SCHEDULE RESOLUTION NO. D -6018, A RESOLUTION of the Council of the City of Yakima, Washington authorizing the Clerk of the City to correct a clerical mistake occurring on pages 3, 4 and 5 of Ordinance No. 3402 of the City. *14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LEGAL SERVICES AGREEMENT WITH ROBERT JOHNS, LAW FIRM OF REED MC CLURE RESOLUTION NO. D -6019, A RESOLUTION authorizing the hiring of Robert Johns of the law firm of Reed McClure for the purpose of representing the City before the Boundary Review Board and in the matter of the City of Yakima v. Yakima County, et al. OCTOBER 22, 1991 3 7 *15. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF WORK EXPERIENCE AGREEMENT WITH CENTRAL WASHINGTON HOME BUILDERS ASSOCIATION TO BUILD GAZEBO AT MILLER PARK RESOLUTION NO. D -6020, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Work Experience Agreement with the Central Washington Home Builders Association. *16. CONSIDERATION OF RESOLUTION AUTHORIZING CANCELLATION OF CLAIMS FUND WARRANTS AND TREASURY CHECKS RESOLUTION NO. D -6021, A RESOLUTION authorizing the cancellation of outstanding claims warrants and Treasury checks. *17. SET DATE OF PUBLIC MEETING FOR NOVEMBER 12, 1991 FOR SUNCREST II FINAL PLAT November 12, 1991 was set as the date for public meeting on the Suncrest II final plat in the vicinity of Mead and So. 28th Avenue. *18. SET DATE OF PUBLIC MEETING ON NOVEMBER 19, 1991 REGARDING CONSIDERATION OF PARTICIPATION IN PTBA _ November 19, 1991 was set as the date of public meeting regarding consideration of participation in a Public Transit Benefit Area by the City of Yakima. *19. APPROVAL OF THIRD QUARTER 1991 TREASURY REPORT The report from the Director of Finance and Budget dated October 22, 1991, regarding the investments of the City of Yakima for the third quarter of 1991, was accepted and approved. *20. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR THE YAKIMA AVENUE /I -82 /FAIR AVENUE PROJECT An Ordinance amending the 1991 budget and appropriating funds for the Yakima Avenue /I -82 /Fair Avenue project, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 3410, AN ORDINANCE amending the 1991 budget for the City of Yakima; making appropriations for the Yakima Avenue /I- 82 /Fair Avenue Project from Unappropriated Fund Balances within various Funds for expenditure during 1991. 21. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR THE FRUITVALE CANAL, PHASE II PIPING PROJECT Councilmember Barnett removed this item from the Consent Agenda to ask for clarification of Phase 2. Engineering and Utilities Director Covell explained that this is a multiple phase project reaching from the PP &L canal at Chesterley Park to the Boise Cascade pond. Phase 1 was the piping in Chesterley Park; Phase 2 3 8 OCTOBER 22, 1991 will run from Chesterley Park to 20th Avenue and Lincoln. The request to keep a segment of this area open can be accommodated. Action today authorizes utilization of grant money received to date. About 15% of the grant funds have been received, and proper appropriation is needed to spend some of those monies this year on design. Mr. Barnett was concerned about increased irrigation rates, and Mr. Covell confirmed that this project does have that impact on the irrigation system. Ordinance 3411, having been read by title, IT WAS MOVED BY BEAUCHAMP, SECONDED BY SIMS, TO ADOPT THE ORDINANCE. The motion carried by unanimous roll call vote. Councilmember Barnett stated that he voted in favor of the Ordinance, although he voted against the initial proposal because he did not like the irrigation rate increase. He is still opposed to that portion of the funding mechanism of this project. ORDINANCE NO. 3411, . AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $15,000 in the Public Works Trust Construction Fund for expenditure during 1991 for the Fruitvale Canal, Phase II Piping Project. *22. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR THE FIRST AVENUE STREET RECONSTRUCTION PROJECT An Ordinance amending the 1991 budget and appropriating funds for the 1st Avenue Street Reconstruction project, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 3412, AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $15,000 in the Cumulative Reserve for Capital Improvement Fund for expenditure during 1991 for the 1st Avenue Street Reconstruction Project. *23. FIRST READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR REPLACEMENT COSTS FOR EMERGENCY LIGHTING UNIT AT THE YAKIMA CENTER (NO FORMAL ACTION REQUIRED THIS MEETING) An Ordinance amending the 1991 budget and appropriating funds for replacement costs for emergency lighting unit at the Yakima Center, having been read by title only, was laid on the table for three weeks, until November 12, 1991. 24. OTHER BUSINESS Councilmember Buchanan noted that individual Councilmember requests are generally supported by Council. He objected to the fact that Council ignored his suggestion to have Council review all stop sign requests. Mr. Buchanan feels that if Council is going to adjudicate any of these requests, they should adjudicate all of them. Councilmember Semon felt that Council should listen to any citizen who wishes to appear, but did not see the need to add these as Agenda items. Councilmember Sims felt that Council should remain in the appeal process, and not be the decision making authority on technical codes. Councilmember Pechtel agreed that Council lacks the technical expertise to adjudicate safety OCTOBER 22, 1991 3 9 standards, and should defer to staff. City Manager Zais stated that staff will continue to make their professional analysis and recommendations. If staff decisions are not accepted by the public, Council will continue to serve as the avenue of appeal. EXECUTIVE SESSION It was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO MOVE INTO EXECUTIVE SESSION REGARDING PENDING LITIGATION AND COLLECTIVE BARGAINING, WITH IMMEDIATE ADJOURNMENT THEREAFTER.
