R-2012-41 A RESOLUTION authorizing the City Manager to execute an addendum to the collective bargaining agreement between the City of Yakima and the Yakima Police Management Unit. WHEREAS, pursuant to Washington State law, the City and the Teamster Local #760 Police Management Unit had negotiated a collective bargaining agreement for Police Captains and Lieutenants for July 1, 2009 — December 31, 2012; and WHEREAS, the Police Management Unit and City of Yakima opened negotiations and negotiated in good faith to reach the proposed addendum to the current agreement and extend the life of the agreement from December 31, 2012 to December 31, 2014; and WHEREAS, the bargaining unit has voted on and approved the attached addendum to extend the collective bargaining agreement from December 31, 2012 to December 31, 2014, and WHEREAS, the City Council has determined that it is in the best interest of the City of Yakima to agree to the terms and conditions of the attached addendum for the agreement to be extended to December 31, 2014, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute the attached addendum to collective bargaining agreement between the City of Yakima and the Yakima Police Management Unit for wages, hours, and working conditions for July 1, 2009 - December 31, 2012 and extend the life of the agreement to December 31, 2014. Micah Cawley, Mayor ORMONAL ADDENDUM TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF YAKIMA AND TESMSTERS LOCAL #760 YAKIMA POLICE MANAGEMENT UNIT THIS ADDENDUM to the 2009 - 2012 Collective Bargaining Agreement (CBA) is made and entered into by and between Teamsters Local #760 Police Management Unit, hereinafter the "Union" and the City of Yakima, a Washington municipal corporation, hereinafter the "City" WHEREAS, the City and the Union executed a collective bargaining agreement effective November 17, 2009 that expired December 31, 2012; and WHEREAS, pursuant to the collective bargaining agreement and state law, the City and the Union engaged in negotiations on the matter of CBA expiration, wages, benefits, AR -15 acquisition and withdrawal from the City of Yakima Employees' Welfare Benefit Program, and WHEREAS, the parties have reached an agreement on wages, benefits and to extend "roll" the 2009 — 2012 CBA forward and change the contract expiration date to December 31, 2014. NOW, THEREFORE, it is agreed by and between the City and the Union as follows; The Collective Bargaining Agreement will remain in effect until December 31, 2014; Effective March 1, 2012: • The members of the Captains and Lieutenants Unit (Union) will withdraw from the City of Yakima Employees' Welfare Benefit Program in accordance with the Program documents. The City will make the following payments to the Teamsters UEBT Plan A-6 (medical trust), Northwest Administrators Dental Plan A, and Vision Plan on behalf of each bargaining unit member who had at least (40) compensable hours in the prior month UEBT. $748.00 per month/per employee Dental: $125.59 per month/per employee Vision: $ 14.00 per month/per employee $887 59 The City of Yakima will increase benefit premium amounts to a maximum of 6% annually. In the event the City's plans go up more than 6%, the City will match the increase up to a maximum of 8%. • The City and the Union agree to the phased acquisition of AR -15 rifles for employees electing to purchase such rifles. The cost of the purchase shall be repaid by Captains and Lieutenants at 0% interest rate over a two (2) year period in equal deductions from the employees' paycheck. Employees who terminate employment shall have the remaining unpaid balance removed from their final paycheck. Effective January 1, 2013: • 0% base wage adjustment • $41,500 maximum VEBA cash out Effective January 1, 2014 • 0% base wage adjustment THIS Memorandum of Understanding is an exclusive agreement unique in nature. It does not set a precedent or establish a "past practice" between the parties The terms of this agreement shall be incorporated into the next collective bargaining agreement for 2015 should such an agreement be reached THIS ADDENDUM is executed by the parties this 7 day of,Eeiary, 2012. Recognition shall be amended to include the position of Chief and Assistan Deputy Chief The additional Articles that shall apply to these positions are Article 2 Union Security/Dues check off and Maintenance of membership, Article 8 Retiree Health Care Benefits and the Addendum to the Collective Bargaining Agreement signed March 7 t h 2012 resolution #R2012-41. The Chief and Assistant/Deputy Chief shall have no voting or grievance rights on the Collective Bargaining Agreement. All other benefits and working conditions shall be provided for by The City of Yakima policy and procedure manual/ City ordinance and or personal contract.
