ROLL CALL The City Council met in session on this date at 2:00.P._M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, • presiding, Councilmembers Clarence Barnett, Henry Beauchamp, Lynn Buchanan, George Pechtel, Skip Semon and Bernard Sims present on roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Lovell also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE Councilmember Buchanan led the Pledge of Allegiance. 3. OPEN DISCUSSION FOR THE QJOD OF THE ORDER None. 4.. CONSENT AGENDA A Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Councilmembers or citizens present. Mayor Berndt stated that Item No. 10 has been removed from the Agenda because the weedy lots have all been cleared. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE SEPTEMBER 24, 1991 BUSINESS MEETING The Council minutes of the September 24, 1991 Business meeting were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. PUBLIC HEARING ON VORENKAMP ANNEXATION (VICINITY OF MUOTH AND WEBSTER) (SEE ORDINANCE ANNEXING PROPERTY) This being the time set for public hearing, Associate Planner . Benson had nothing to add to the staff report. Mayor Berndt opened the public hearing and asked if there was anyone present to speak to the issue. There being none, Mayor Berndt closed the public hearing. Ordinance No. 3406, having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE ORDINANCE. The motion carried by unanimous roll call vote. • ORDINANCE NO. 3406, AN ORDINANCE annexing property to the City of Yakima and zoning said property. (Vorenkamp Annexation) 2 2 OCTOBER 8, 1991 7. AUDIENCE PARTICIPATION A. APPEARANCE BY UNITED WAY Mayor Berndt read a proclamation designating October, 1991 as United Way Month. Mike Bernazzani accepted the proclamation on behalf of the United Way Board of Directors, and thanked the Council and City staff for their continuing support. Richard Andring, 203 South 8th Avenue, requested that the City study traffic congestion before construction begins on the Davis High School expansion project at 7th Avenue and Tieton Drive. He also requested continuation of the bike route in the area. 8. CONSIDERATION OF RESOLUTION AUTHORIZING FREE TRANSIT SERVICE IN CELEBRATION OF TRANSIT WEEK Transit Manager Schultz stated that October, 1991 marks the 25th anniversary of public transportation being provided by the City. The Transit Division proposes to commemorate this occasion by offering free transit service for the week of October 14 -19. • Resolution No. D -6003, having been read by title, it was MOVED BY BUCHANAN, SECONDED BY BEAUCHAMP, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. Councilmember Semon referred to a letter from Janet Rowley, and asked questions regarding transit hours and scheduling. Mr. Semon suggested a review of the transit schedule to determine if ridership can be increased with minor scheduling changes. Councilmember Buchanan requested discussion of this letter at the next Transit Committee meeting. In a related matter, City Manager Zais distributed copies of the letter from the Advocates for Transportation requesting reconsideration of the PTBA issue. Mr. Zais stated.that.the letter has not yet been officially received by the City, and this copy was obtained from the Yakima Herald Republic. Councilmember Pechtel mentioned that on -duty transit operators have been heard making critical remarks about the City. Mr. Schultz will investigate the situation. RESOLUTION NO. D -6003, A RESOLUTION providing for free public use of the City transit system for the week of October 14 -19, 1991. 9. PRESENTATION OF YAKIMA VALLEY CONFERENCE OF GOVERNMENTS PROPOSED 1992 BUDGET Executive Director Lon Wyrick presented the 1992 budget for the Yakima Valley Conference of Governments (COG). COG is requesting $21,194 from the City for 1992, as well as a special program assessment of $6,343. Mr. Wyrick said that the overall general assessment rate increase is 14.1%. The increase to the City of Yakima will be 25 %, due to population increases and a change in the per capita rate. Councilmember Buchanan asked if the assessment reflects computer time and services that the City provides to COG. Mr. Wyrick said that COG is billed by the City and pays for mapping and data processing service. The budget will be returned to the Council for final approval after reviewand.adoption by the general COG membership later this month. Councilmember Beauchamp was concerned with the absence of minority employees in the agency, and • OCTOBER 8, 1991 2 3 asked if COG has an Affirmative Action hiring policy. Mr. Wyrick said that COG contracts with the Yakima County Personnel Office to fill vacancies, and follows the County's Affirmative. Action policy. Councilmember Pechtel requested verification that an Affirmative Action policy is in place prior to final approval of the budget. • Mr. Wyrick will review the process and present it to Council with the final budget request. 10. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS DEBRIS AND VEGETATION PROGRAM Item removed from agenda. *11. CONSIDERATION OF RESOLUTION AFFIRMING APPEAL OF.H. E. SCHMIDT /DEAN TATRO TO HEARING EXAMINER'S DECISION DENYING 24 -HOUR OPERATION OF TEXACO /CONVENIENCE STATION AT 40TH AVENUE /FRUITVALE RESOLUTION N0. D -6004, A RESOLUTION reversing the decision of the Hearing Examiner and adopting the Findings and Conclusions in the matter of the application of H. E. Schmidt and Dean Tatro on behalf of Texaco Refinery and Marketing, Inc. for 24 hour operation of a gasoline station and convenience store. *12. CONSIDERATION OF RESOLUTION AUTHORIZING MULTIPLE FAMILY HOUSING PARTICIPATION AGREEMENT WITH SECURITY PACIFIC BANK • RESOLUTION NO. D -6005, A RESOLUTION authorizing the Director of Community and Economic Development to enter into an agreement. with Security Pacific Bank Washington for implementation of a Multi - Family Loan Program. * 13. CONSIDERATION OF RESOLUTION ADOPTING AIRPORT REGULATIONS REGARDING GROUND VEHICLE OPERATIONS AND RATES, FEES AND CHARGES FOR AIRPORT USER FEE CUSTOMS SERVICES - RESOLUTION NO. D -6006, A JOINT RESOLUTION of the City of Yakima and Yakima . County approving certain Yakima Air Terminal Board . resolutions and authorizing implementation. *14. CONSIDERATION OF RESOLUTION AUTHORIZING DISPOSITION OF SURPLUS PROPERTY ;RESOLUTION NO. D -6007, K.-RESOLUTION authorizing the sale of surplus personal property owned by. the City. *15. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT WITH YAKIMA VALLEY COMMUNITY COLLEGE FOR FIRE SCIENCE CLASSES RESOLUTION NO. D -6008, A RESOLUTION authorizing the Chief of the Yakima Fire Department to execute a .contract.between Yakima Valley Community College and the Yakima Fire Department whereby the Yakima Fire Department would provide instruction in fire science and the college would function as the accrediting agency. * 16. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH THE YAKIMA COUNTY PROSECUTOR FOR PROSECUTION SERVICES FOR 1992 • 2 4 OCTOBER 8, 1991 ` RESOLUTION NO. D = 6009, A RESOLUTION authorizing the City Attorney to execute an agreement with the Yakima County Prosecutor for prosecution services for the calendar year 1992. *17. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR HAND -HELD COMPUTER SYSTEM FOR CODE INSPECTION DIVISION An Ordinance amending the 1991 budget and appropriating funds for a hand -held computer system for the Code Inspection Division, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 3407, AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $43,120 in the General Fund for expenditure during 1991 for the purchase of a hand -held computer system for Code Inspection. * 18. FIRST READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR AQUATIC AND SENIOR CENTER TOUR PROGRAMS OPERATIONAL COSTS (NO FORMAL ACTION REQUIRED THIS MEETING) An Ordinance amending the 1991 budget and appropriating funds for aquatic and senior center tour programs operational costs, having been read by title only, was laid on the table for one week, until October 15, 1991. 19. OTHER BUSINESS Council reviewed the final draft of the annexation /sewer service opinion poll to be mailed to City utility customers. Mr. Zais explained that the three- question format was used to incoLporate specific issues raised by Councilmembers. Councilmember Buchanan suggested personalizing the letter by changing the last sentence to a question rather than a statement. Councilmember Pechtel objected to the third question, stating. that an opinion should not.be asked about a legally binding document. Councilmember Semon felt that it is important to obtain as much information as possible in order to accurately represent the citizens of the City. Mr. Semon noted that there is nothing binding in the survey results. It is simply a means of asking for information and opinions from the people. It was MOVED BY SEMON, SECONDED BY BUCHANAN, TO ACCEPT THE DRAFT AS PRESENTED, WITH THE LAST. SENTENCE CHAFED TO A QUESTION, TO BE MAILED TO RESIDENTIAL CUSTOMERS. Councilmember Beauchamp questioned the accuracy of the 1976 date in the document, and was assured by Mr. Zais that the dates are correct. Mr. Zais said that the survey will be sent to residential utility customers in a . special mailing to cost approximately $3,000. Assuming a 5% return rate, the final cost could reach a total of $4,000- 4,500. The question was called for a vote on the motion. The motion carried by 4 -3 voice vote; Barnett, Berndt and Pechtel voting nay. Councilmember Barnett stated that he is against opinion polls, and especially the third question. Councilmember Pechtel liked the idea of an opinion poll, but objected to asking the third question. OCTOBER 8, 1991 2 5 City Manager Zais briefly reported on his recent trip to the ICMA 2 National Conference in Boston. EXECUTIVE SESSION It was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADJOURN TO EXECUTIVE SESSION REGARDING PROPERTY DISPOSITION, TO BE FOLLOWED BY IMMEDIATE ADJOURNMENT THEREAFTER. The motion carried by unanimous voice vote.
