SEPTEMBER 24, 1991
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, *presiding, Councilmembers Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, Skip Semon and Bernard Sims present on
roll call. Councilmember George Pechtel absent and excused.
Assistant City Manager Stouder, City Attorney Vanek, City Clerk
Roberts and Deputy City Clerk Lovell also present.
2. INVOCATION/PLEDGE OF ALLEGIANCE
Councilmember Buchanan led the Pledge of Allegiance.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Councilmember Sims reported on the Council Committee „meeting with
Selah regarding alternatives to the trolley going to the Selah
Civic Center. They agreed to meet again after staff has an
opportunity to review the suggestions made at the meeting.
4. CONSENT AGENDA '
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Councilmembers or citizens' present.. Item No 17 was removed
' from the Agenda. There being no other changes, the City ".Clerk then
read the Consent Agenda items, includingresolutiohS 'and ordinances
by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE
CONSENT AGENDA, AS READ, BE PASSED. The motion carried by
unanimous roll call vote. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled under
one motion without further discussion.)
*5. APPROVAL OF MINUTES OF THE SEPTEMBER 10, 1991 BUSINESS MEETING AND
SEPTEMBER 17, 1991 ADJOURNED MEETING
The Council minutes of the September 10, 1991 Business Meeting and
the September 17, 1991 Adjourned Meeting were approved, having been
duly certified accurate by two Council members and no one present
wishing to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
Sheridan Folsom, 1409 South 29th Avenue, presented a petition
requesting two four -way stop signs on 10th Avenue, between Nob Hill
Boulevard and Mead Avenue. He recommended Logan and Viola Avenues
as the best locations for stop signs. Mayor Berndt could see no
objection to the request since this is a residential neighborhood,
and the residents would like the signs. Councilmember Sims felt

that staff should study the request since 10th Avenue is a main
north/south route across town. It'was MOVED,BY BUCHANAN, SECONDED
BY BEAUCHAMP, TO DIRECT STAFF TO STUDY THESE INTERSECTIONS AND
REPORT TO COUNCIL NEXT WEEK. 'The motion- .carried by unanimous voice
vote; Pechtel absent.
7. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
DEBRIS ABATEMENT PROGRAM
Code Administration Manager Shampine stated that he had nothing to
add to the staff. report. There being no one present.to speak to

. the issue, and Resolution No. D -5995, having.�been;read,by title, it
was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE RESOLUTION.
The motion carried by unanimous roll call vote; Pechtel absent.
RESOLUTION NO. D -5995, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
8. CONSIDERATION OF A RESOLUTION TO DECLARE A CHANGE IN DOWNTOWN
TROLLEY SERVICE AND DECLARE THE CHANGE FARE -FREE
Transit Planner Haddix reviewed the staff recommendation to modify
the downtown trolley route to serve the hotel /restaurant trade on
North First Street. Resolution No. D -5996, having been read by
title, It was MOVED BY SIMS, SECONDED BY. BUCHANAN, TO ADOPT THE
RESOLUTION. The motion carried by unanimous, voice vote; Pechtel
absent:

RESOLUTION NO. D -5996, A RESOLUTION modifying the routing of the
fare free downtown trolley _bus service..
9. REPORT FROM ENGINEERING AND FINANCE DIVISIONS REGARDING CLEAR CREEK
DAM FUNDING
Finance and Budget Director Hanson presented a proposal to fund a
$50,000 contribution to the Clear Creek Task Force through savings
in construction costs on the Fairview -Sumac project. Councilmember
Barnett questioned the legality of using funds designated by
emergency resolution for a specific project. Mr.,Hanson suggested
the 'Water: Reserve Fund as;le an, alternative funding source. It was
MOVED BY BEAUCHAMP, SECONDED BY SIMS, TO APPROVE THE REPORT AND
FUND THE $50,000 REQUEST THROUGH THE WATER RESERVE 'FUND. The
motion carried by.unanimous voice vote.; Pechtel absent. On behalf
of the Clear Creek Task Force, Shirley Doty, 4902 Englewood,
thanked Council for approving the contribution. City Attorney
Vanek recommended that the contribution be sent directly to the
Bureau of Reclamation.
*10. CONSIDERATION OF RESOLUTION' AUTHORIZING VACATION OF AN EASEMENT
DEED WITHIN PROPERTY LOCATED ON SOUTH 18TH AVENUE /TAHOMA AVENUE
RESOLUTION NO. D- 5997, A RESOLUTION authorizing the City Manager

*11. CONSIDERATION OF RESOLUTION AUTHORIZING - CONTRACT FOR INDUSTRIAL
WASTE SPRAYFIELD'(WWTP)
RESOLUTION NO. D -5998, A RESOLUTION authorizing the execution of a
contract with Larry Darman d /b /a LD MAR Farms for a sprayfield
grazing and forage operation.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING THE EXECUTION OF GRANT
DOCUMENTS FOR YAKIMA AIR TERMINAL
RESOLUTION NO. D -5999, A JOINT RESOLUTION OF THE CITY OF YAKIMA AND
YAKIMA COUNTY authorizing, ratifying, and adopting a Project
Application, Standard DOT Title Assurances, and Grant Agreement
for federal assistance, between the Federal Aviation Administration
and the Yakima Air Terminal Board for project number 3 -53- 0089 -12.
13. CONSIDERATION OF ORDINANCES ADOPTING THE 1991 EDITION OF THE
UNIFORM CODES
Code Administration Manager Shampine advised Council that he met
with the officers of the Home Builders Association, and they
are all in concert with the adoption of the new codes.
A. UNIFORM FIRE CODE., 1991 EDITION -
Ordinance No. 3394, having been read by title; it was MOVED BY
SIMS, SECONDED BY BUCHANAN, TO ADOPT THE ORDINANCE. The motion
carried by unanimous roll call vote; Pechtel absent.
ORDINANCE NO. 3394, AN ORDINANCE relating to fire code; adopting by
reference the Uniform Fire Code, 1991 Edition, copyright 1991 by
the International Conference of Building Officials and the Western
Fire Chiefs Association, and making deletions therefrom and
amendments thereto; and amending Sections 10.05.010, 10.05.020, and
10.05.025, all of the City of Yakima Municipal Code.
B. WASHINGTON STATE ENERGY CODE
Ordinance No. 3395, having been read by title, it was MOVED BY
SIMS, SECONDED BY BUCHANAN, TO THE ORDINANCE. The motion
carried by unanimous roll call vote;' Pechtel absent.
ORDINANCE NO. 3395, AN ORDINANCE relating to building regulations;
adopting by reference the Washington State Energy Code, setting new
energy - conservation standards for commercial and residential
structures within the City of Yakima; repealing existing energy
code standards; repealing Chapter. 11.05 and reenacting a new
Chapter 11.05 and the various sections thereof as a new chapter and
new sections of the City of Yakima Municipal Code.
C. UNIFORM BUILDING CODE
Ordinance No. 3396, having been read by title, it was MOVED BY
SIMS, SECONDED BY , BUCHANAN, TO ADOPT THE ORDINANCE. The motion

4 ,ORDINANCE NO. 3396, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Building Code, 1991 Edition,
copyright 1991 by the International Conference of Building
Officials, regulating the erection, construction, enlargement,
alteration, repair, moving, removal, conversion,; demolition,
occupancy, ; . equipment, use, ,height, area maintenance of
buildings or structures in the City of Yakima; and amending
Sections 11.04.010, 11.04.015, 11.04.020, 11.04.025, 11.04.027,
• 11.04.055 and 11.04.070, all of the City of YakimarMunicipal Code.
D. UNIFORM HOUSING CODE •
Ordinance No. 3397, having been read by title, it was MOVED BY
SIMS, SECONDED BY BUCHANAN, TO ADOPT THE ' ORDINANCE. The motion
carried by unanimous roll call vote; Pechtel absent.
ORDINANCE NO. 3397, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Housing Code, 1991. Edition,
published by International Conference of Building Officials, as
the housing code of the City of Yakima and making amendments
thereto; declaring violations thereof to constitute misdemeanors
and providing punishment for such and amending Sections
11.20.005, 11.20.010, 11.20.030, 11.20.050, 11.20.055, and
11.20.060, all of the City of Yakima Municipal Code.
E. UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS
Ordinance No. 3398, having been read by title, it was MOVED BY
SIMS, SECONDED BY BUCHANAN, TO ADOPT THE ORDINANCE. The motion
carried by unanimous roll call vote; Pechtel absent.
ORDINANCE NO. 3398, AN ORDINANCE relating to buildings; adopting by
reference the Uniform Code for the Abatement ; of .; ; +Dangerous
Buildings, 1991 Edition, published by the International Conference
of Building Officials, and making amendments thereto; defining
terms; providing for the repair or demolition of dangerous
buildings; establishing procedures for recovering the cost of such
repair or demolition; amending Sections 11.46.010, 11.46.030, and
11.46.040, all of the City of Yakima Municipal Code.,

adopting by reference and amending certain sections of the Uniform
Mechanical Code, 1991 Edition, by the International Conference of
Building Officials and the International Association of Plumbing
and Mechanical Officials, together with "Appendix A ", Uniform
Mechanical Code Standards, and "Appendix B ", Steam and Hot Water
Boilers, Steam and Hot Water Piping (Hydronics), "Appendix C ",
Sizing of Ventilating Systems serving appliances equipped with

Ordinance No. 3400, having been read by title, it was MOVED BY
SEMON, SECONDED BY BUCHANAN, TO ADOPT THE ORDINANCE. The motion
carried by unanimous roll call vote; Pechtel absent.

adopting by reference, and amending certain sections of, the
Uniform Sign Code, 1991 Edition, copyright 1991 by the
International Conference of Building Officials; amending Sections
11.08.010, 11.08:020, 11.08.025, 11.08.027 and 11.08.029, all of
the City of Yakima Municipal -Code. '
H. UNIFORM PLUMBING CODE

adopting by reference the Uniform Plumbing Code, , 1991 Edition, of
the International Association of Plumbing and Mechanical Officials;
amending Sections 11.44.010, 11.44.040, 11.44.041, 11.44.042 and
Subsection 11.44.050 B ;'all of the City of Yakima Municipal Code.
14. CONSIDERATION OF AN ORDINANCE AUTHORIZING- ISSUANCE AND SALE OF
GENERAL' OBLIGATION BONE6 FOR SINGLE FAMILY REHAB PROGRAM /HOUSING
5 -YEAR PLAN
Block Grant Manager Kracht advised Council that this ordinance
gives the City the authority to borrow $400,000 to be used within
the Housing budget for single family rehabilitation programs. This
is the first step of the 5 -year financial plan approved by Council
on November 20, 1990. Ms. Kracht explained that a public hearing
is a requirement for a bond issue. Mayor Berndt opened the public
hearing and asked if there was anyone present to speak to the
issue. There being none, Mayor Berndt closed the public hearing.

ORDINANCE• NO. 3402," AN ORDINANCE of the Council" of'the City of
Yakima, Washington, providing for the issuance, sale and delivery
of limited tax general obligation bonds for the purpose of funding
a program for rehabilitation of single - family owner- occupied
residences; authorizing the execution of bonds of the City in the
principal amount of not to exceed $400,000; providing for the
disposition of the proceeds of such bonds; fixing the form,
interest, rate, terms, maturity and covenants of such bonds; and
creating a fund from which the principal of and interest on such
bonds shall be paid. •

*15. CONSIDERATION OF LEGISLATION REGARDING SEMI AUTOMATIC
DEFIBRILLATION EQUIPMENT:
A. CONSIDERATION OF RESOLUTION AUTHORIZING SOLE SOURCE PURCHASE TO
PHYSIO CONTROL 0
RESOLUTION NO. D -6000, A RESOLUTION authorizing the procurement of
• .LifePak- 300 Automatic Defibrillators - from.' Physio Control
Corporation, Redmond, Washington, without calling for bids.
B. FIRST READING OF AN ORDINANCE AMENDING THE 1991 BUDGET AND
APPROPRIATING FUNDS FROM EMS FUNDS FOR EQUIPMENT PURCHASE
An Ordinance amending the 1991 Budget and appropriating funds, for
the purchase of defibrillator equipment, having been read by title
only,. was laid on the table for one week7' until October 1, 1991.
*16. CONSIDERATION OF AN ORDINANCE .RELATING 'ID PERSONNEL .BENEFITS FOR
EXEMPT EMPLOYEES
ORDINANCE NO. 3403, AN ORDINANCE relating to personnel, relating
specifically to employment benefits provided to management
employees, amending Subsections 2.04.030 A,- 2.20 A, 2.24,010 B,
2.40.020 A, and 2.40.030 A, and amending .Sections 2.04.060 and
2.20.085, all of the City of Yakima Municipal Code.
*17. CONSIDERATION OF AN ORDINANCE REGARDING SICK LEAVE AND VACATION
POOL FOR EXEMPT EMPLOYEES
This item was removed from the Agenda.
*18. FIRST READING OF AN ORDINANCE AMENDING THE 1991 TRANSIT CAPITAL
FUND BUDGET PROVIDING FOR PROPERTY ACQUISITION
An Ordinance amending the 1991 Budget and appropriating funds for
the Transit Transfer Facility land acquisition and relocation
costs, having been read by title only, was laid on the table for
one week, until October 1, 1991.
19. OTHER BUSINESS
Mayor Berndt recognized the presence of 5th grade Camp Fire Girls
from Roosevelt School and their leader, Ann Harrison. The girls
attended the meeting as part of a leadership project.
