CITY OF YAKIMA, WASHINGTON
SEPTEMBER 17, 1991
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Councilmembers Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, George Pechtel, Skip Semon and Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek
and Acting City Clerk Lovell also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
Councilmember Barnett led the Pledge. of Allegiance.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
None.
.4. CONSENT AGENDA
Mayor Berndt referred to the .items placed on the Consent Agenda,
questioning whether there were any .additions or deletions from
either Councilmembers or citizens present. There being none, the
Acting City Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED BY SIMS,
SECONDED BY PECHTEL, THAT THE CONSENT AGENDA, AS READ, BE PASSED.
The motion carried by unanimous voice vote. (Subsequent paragraphs
preceded by an asterisk ( *) indicate items on the Consent Agenda
handled under one motion without further discussion.
*5. APPROVAL OF MINUTES OF THE SEPTEMBER 3, 1991 BUSINESS MEETING AND
SEPTEMBER 4, 1991 ADJOURNED MEETING
The Council, minutes of the September 3, 1991 Business Meeting and
the September 4, 1991 Adjourned Meeting were approved, having been
duly certified accurate by two Council members, and no one present
wishing to have said minutes read publicly.
6. PUBLIC HEARING TO CONSIDER HEARING EXAMINER'S RECOMMENDATION ON
THE YAKIMA SCHOOL DISTRICT (DAVIS HIGH SCHOOL) REQUEST TO VACATE
RIGHT -OF -WAY FOR 6TH. AVENUE, AND THE ALLEY BETWEEN 6TH & 7TH
AVENUES, BETWEEN PINE AND TIETON
This being the time set for public hearing, Supervising Associate
Planner Davenport stated that Yakima School District No. 7 is
requesting the vacation of a portion of South 6th Avenue and an
alleyway. The Hearing Examiner recommends approval of the request,
subject to several conditions. Mrs. Davenport noted that action
today addresses only the street vacation; field development will
require a Class III review at a later date. She verified that the
applicant is responsible for the cost of utility line relocations.
She added that the School District has timed this project to
coincide with street improvements underway on Tieton Drive.

Mayor Berndt opened the public hearing and asked if there was
anyone present to speak in favor of the application. Bob
_Alexander supported the application on behalf of the Yakima School
Disrict. He noted voter support of this development proposal in a
bond issue 2 -1/2 years ago._. Anticipated growth in school
enrollment necessitates expansion of the facilities. The School
District believes that expansion of th e ballfield will reduce
hazards to pedestrians and traffic on 5th Avenue. Mr. Alexander
said the facilities will be available for community recreational
needs, .including youth baseball and soccer programs. Mr. Alexander
stated that recent studies show. adequate. parking for the
facilities, .and_the removal of 23 residences will further reduce
neighborhood parking needs. Phil Hoge, 1512 Folsom, supported the
expansion project, but encouraged Council to maintain the current
bicycle route on 6th Avenue. Mr. Hoge presented a site plan
'showing alternative bike routes for consideration. '
Mayor. Berndt asked if there was anyone present to speak in
opposition .to the ,request. Fred .Williams, 807 Tieton Drive,
objected to the proposal because , the project will,, require the
" removal of a large number of mature trees. Mr2
the planning process used by the School District, and felt that the
proposed parking will be inadequate. Councilmember Buchanan agreed
that the trees are a significant concern, and said that they will
be considered at the Class III hearing. Richard Smith, 416 South
23rd Avenue, addressed Council as a concerned owner of property at
607 W.- Pine. Mr. Smith did not object to the street vacation,
however, he mentioned. serious traffic. and parking problems. in the
area. He cautioned'Qouncil that these issues must be carefully
considered during the Class III review. There being no further
comments, Mayor Berndt 'closed the_ public hearing, and asked
Councilmembers to declare any outside contact. There' none,
and Ordinance No. 3392, having been read by title, it was MOVED BY
BEAUCHAMP, SECONDED BY BUCHANAN, TO ADOPT THE ORDINANCE. The
motion carried by unanimous roll call vote.
ORDINANCE NO. 3392, AN ORDINANCE vacating certain street right -of-
way located on South 6th Avenue bounded by Tieton Drive and Pine
Street and certain alley right -of -way bounded by South 6th Avenue,
South 7th Avenue, Tieton Drive and Pine Street, subject to certain
conditions.
7. AUDIENCE PARTICIPATION zs
A. PRESENTATION FROM CLEAR CREEK DAM TASK FORCE
Shirley Doty, Chairman of the Clear Creek Dam Task Force,
introduced speakers who were present to request'City assistance in
funding the Clear Creek Dam project. 'Joe Andreotti, 1802 West
Chestnut, reviewed the history of Clear Lake and its value as a
recreational resource. YMCA Board member Jim Berg, 271 Canfield
Road, noted the importance of Clear Lake in providing recreational
opportunities for local youth at Camp Dudley. Norm Anderson, Vice
President of the Camp Prime Time Board, stressed the value of the
Lake for camp activities for terminally ill children and their
families. Neil Dickinsen, co -chair of the Finance Committee,

stated that the Task Force is requesting a $50,000 contribution
from the City. This would duplicate the amount of the Yakima
County contribution. Mr. Dickinsen stated that the Task Force
would like a pledge by October but payment could. be. made in
the first quarter of 1992. Mrs. Doty added that church camp
sponsors (LDS and Grace Brethren) have been involved, in the
fund raising_ drive, and this has truly become a,community wide
project. Betty Nelson, 5107 Douglas Drive, endorsed the project on
behalf of Soroptomist, International. Prime Time Board Member
Ralph Berthon, 19 Hall Avenue, encouraged Council to authorize the
expenditure. It was MOVED BY BEAUCHAMP, SECONDED BY BUCHANAN, TO
INSTRUCT STAFF TO EXPLORE POSSIBLE FUNDING SOURCES" TO .PARTICIPATE
IN THIS PROTECT AT THE REQUEST ) AMOUNT, WITH A REPORT TO COUNCIL
IN ONE WEEK. The motion carried by unanimous voice vote.
8. REPORT FROM CUSTOMER' SERVICE DEPARTMENT REGARDING CLEAN AIR
AUTHORITY'REQUEST FOR ADDITIONAL PARKING SPACE
Finance and Budget Director Hanson had nothing to add to the staff
report. It was MOVED BY BUCHANAN, SECONDED BY PECHTEL, TO APPROVE
THE STAFF RECOMMENDATION TO DENY THE REQUEST FOR FREE PARKING. The
. _,motion.carried by ,unanimous.voice vote._
9. CONSIDERATION OF RESOLUTION - REGARDING HAZARDOUS DEBRIS AND
VEGETATION PROGRAM
There was no one present to speak to this issue. Resolution No.
D -5994, having been read by title, it was MOVED BY BUCHANAN,
SECONDED BY PECHTEL, TO ADOPT THE RESOLUTION. The motion carried
by unanimous roll call vote.
RESOLUTION NO. D -5994, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
*10. APPROVAL OF REVENUE & EXPENDITURE REPORTS FOR AUGUST, 1991
The Revenue & Expenditure rerts ,for, August, 1991%ere approved.

*11. SET DATE OF PUBLIC HEARING FOR OCTOBER 8, 199 ON THE VORENKAMP
ANNEXATION
October 8, 1991 was set as date for public hearing for the
Vorenkamp Annexation.
*12. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND
APPROPRIATING FUNDS FOR RELOCATION OF RUBBERIZED PADS AT TWO
RAILROAD GRADE CROSSINGS
,,ORDINANCE D. 3393, AN ORDINANCE amending the 1991 budget for the Ilr
City of Yakima; and making an appropriation of $51,000 in the
Arterial Street Fund for expenditure during 1991 for City -wide
Railroad Crossing Rubberized Pad Relocation.

IMMEDIATE AEGOURNMEDTT THEREAFTER. The motion carried by unanimous
voice vote. _
