RESOLUTION NO. R-2012-25 A RESOLUTION approving a preliminary long plat, for the Preliminary Plat of Englewood Ridge, a thirty-one lot subdivision, located in the vicinity of southwest corner of Englewood and N. 74th Avenues. WHEREAS, on December 14, 2011, the Planning Commission held an open -record public hearing to consider the application for a Preliminary Plat known as Englewood Ridge, submitted by Two Bluff's, LLC (PLP#003-11, and SEPA#036-11); and, WHEREAS, on December 14, 2011, the Planning Commission issued their Recommendation for approval of the proposed plat subject to conditions; and, WHEREAS, the proposed application conforms with the City of Yakima Zoning Ordinance, Subdivision Ordinance, Development Standards Ordinance, and other applicable land use regulations; and, WHEREAS, at the Closed Record Public Meeting on February 7, 2012, after notice duly given according to the requirements of the Yakima Municipal Code, the Yakima City Council adopted the Planning Commission's Recommendation; and, WHEREAS, the City of Yakima has complied with the substantive, procedural, and notice requirements associated with SEPA, the Growth Management Act, and the Yakima Municipal Code for the purpose of reviewing the Application; and, WHEREAS, the Yakima City Council finds that it is in the best interest of the City of Yakima to pass the following; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Incorporation of Recitals. The above recitals are hereby incorporated into this resolution. Section 2. Incorporation of the Planning Commission's Recommendation and Conditions of Approval. The Planning Commission's Recommendation is hereby adopted and ratified by the Yakima City Council as its conditional decision of approval of the Application herein. A copy of the Recommendation is attached hereto as Exhibit "A" and incorporated herein by this reference. Section 3. Findings. The Yakima City Council adopts the findings of the Planning Commission as its own findings herein, and further finds that the requirements of RCW § 58.17.110 have been met. Section 4. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this resolution is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this resolution. PLP #003-11 SEPA #036-11 A. Introduction. The public hearing process for this application may be summarized as follows: (1) The Yakima Planning Commission (YPC) conducted an open record public hearing for this application on December 14, 2011. (2) The staff report presented by Associate Planner Jeff Peters recommended approval of the proposed 31 -lot preliminary plat subject to the conditions stated within the staff report, and the addition of the recommended conditions stated within the Yakima County Flood Control District's comment letter received December 12, 2011. (3) The applicant's Development Director, Duane Rogers, testified in favor of the application and joined in Mr. Peters' recommendation for approval of this proposed preliminary plat subject to conditions. (4) Three members of the public (Jenny Snyder, Warren Hurley, Dave Wagner) provided verbal testimony regarding open space, parks, street design, and frontage improvements and seven written comments or inquiries from residents or other members of the public were submitted prior to the public hearing. (5) This recommendation has been issued within ten business days of the hearing. B. Summary of Recommendation. The Yakima Planning Commission recommends approval of this preliminary plat subject to conditions. Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 1 DOC. INDEX #AA -1 C. Basis for Recommendation. Based on a view.of the site; consideration of the staff report, exhibits, testimony and other evidence presented at an open record public hearing on December 14, 2011; and a consideration of the applicable subdivision ordinance requirements, zoning ordinance requirements, development standards and consistency criteria; the YPC makes the following: FINDINGS I. Applicant. This preliminary plat application was submitted by Two Bluffs, LLC, 2550 Barton Road, Yakima, Washington 98903. II. Location. The location of the proposed preliminary plat is the vicinity of the southwest corner of Englewood and N. 74th Avenues, in the City of Yakima; Assessor's tax parcel number 181320-21400. III. Application. This application seeks approval to subdivide a lot which is about 9.96 acres in size into 31 residential lots ranging in size from 8,214 to 11,470 square feet. The property is within the Single -Family Residential (R-1) zoning district. IV. Notices. Notices of the December 14, 2011, open record public hearing were provided in accordance with applicable ordinances, including Titles 14, 15 and 16 of the Yakima Municipal Code, in the following manner: Mailing of Notice of Hearing to owners within 300 feet: Publishing of Notice of Hearing in the Yakima Herald -Republic: Posting of Land Use Action Sign on the property: October 7, 2011 October 7, 2011 October 4, 2011 V. Environmental Review. The SEPA Responsible Official issued a Determination of Nonsignificance (DNS) on October 28, 2011, which became final without an appeal. VI. Transportation Capacity Management Ordinance. This preliminary plat of 31 lots was reviewed under the City of Yakima's Traffic Capacity Analysis Ordinance (YMC 12.08) on September 11, 2011. The development will not exceed the PM peak hour capacity of the City Arterial street system and reserve capacity exists on all impacted streets. VH. Zoning and Land Uses. The zoning of the property within the proposed preliminary plat is Single -Family Residential (R-1). The property is currently vacant. The adjacent properties are also zoned R-1 and are used for single-family homes. Comments from the Development Services Team meeting of September 21, 2011 and from public agencies with an interest in the proposed preliminary plat were as follows: 1) Nob Hill Water Association: Nob Hill Water Association will be able to provide fire flow of 4,000 gpm at 20 psi for the Englewood Ridge development. The static pressure for the development will be approximately 62 psi. In order to provide this fire flow we will have to utilize the 8" main line that is currently stubbed out from the Orchard Pointe subdivision on the west side of proposed Lot 9 of Englewood Ridge, to create a looped system. 2) City of Yakima Surface Water Engineer: Complete stormwater design plans, specifications and runoff/storage calculations supporting the stormwater design are required pursuant to the Eastern Washington Stormwater Manual and City of Yakima standards. These plans and control measures must be completed by a licensed Professional Engineer and then be reviewed and approved by the City of Yakima Surface Water Engineer prior to construction. UIC Registration - Stormwater In accordance with Chapter 2 Section 2.4 of the December 2006 edition of the Department of Ecology's Guidance for UIC Wells that Manage Stormwater Publication Number 05-10-067, Underground Injection Control (UIC) wells constructed on or after February 3, 2006 are considered new and must be registered with the Department of Ecology (DOE) prior to construction. Therefore, if UIC wells are used in the drainage design, the U1C wells must be registered with DOE and a copy of the DOE UIC Well registration form with a Professional Engineer's stamp and signature for each well shall be delivered to the City of Yakima's Surface Water Engineer before final project approval shall be granted. There are no Yakima County DID drain lines in this area. All existing drain lines are City of Yakima drains. Any drain lines to be relocated shall be within the road right-of-way or within a public service easement. Relocated drain lines will need the approval of the City of Yakima Surface Water Engineer. 3) City of Yakima Development Engineer: In accordance with Yakima Municipal Code (YMC) sections 12.01.020, 12.05.010, 12.06.070, and 12.06.080, the developer is required to install the following improvements: Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74"' Avenues, Yakima, WA 98908 DOC„ INDEX 3 Plans: The owner is required to submit civil engineering plans for improvements per the requirements of YMC Title 12, stamped and signed by a civil engineer. Utilities: Storm drainage is not shown on the submitted preliminary plan. Sanitary Sewer: Sewer is available within the right-of-way of 74th Avenue and along the west boundary of the property. Stormwater: Stormwater shall be treated and disposed of per the Yakima County Regional Stormwater Manual for both private property and city right-of-way. Frontage: Frontage improvements shall consist of new curb, gutter, and sidewalk along the entire frontage of the property, along with '/ roadway improvement, installing street lights at the proposed access road, "Two Bluffs" off of Englewood Ave and at the intersection of Englewood and 74th Avenues. Said improvements shall match existing adjacent curb, gutter and sidewalk in location. No driveway access shall be allowed onto 74th Avenue by any lots within this long plat. Shared driveway access will be allowed for lots 10,. 11, 12, and 13 onto Englewood Avenue. This shall be noted on the recorded plat. Internal Roadway Requirements: The internal roadway shall meet all YMC Title 12 improvement requirements for residential streets including, but not limited to asphalt roadway, concrete curb, gutter and sidewalk. Utilities include street lights, domestic water, sanitary sewer, and stormwater treatment. All construction shall meet the requirements of the City of Yakima standard plans and specifications and is subject to final approval by the City of Yakima Engineer. 4) City of Yakima Building Codes: Code Administration will work with Nob Hill Water for placement of any new hydrants. Plan review, permits and inspections are required prior to occupancy of any structures. 5) City of Yakima Streets & Traffic Operations Manager: No direct lot access to 74th Avenue is allowed. Lot 20 can share the flag lot access with Lot 19. Although 74th Avenue is not presently designated as a collector road, it is likely to be so in the future. I also have a concern with the potential of a steeply graded driveway onto 74th Avenue. The existing driveways on the east side of 74th Avenue are problematic in the winter and I would expect the same for any driveway on the west side that may require similar grades. Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 DOC. INDEX 4 I recommend a second public street access into the subdivision from Englewood Avenue. The purpose for this is to promote pedestrian activities and reduce inter - neighborhood trip lengths. Ideally, the second connection would have been directly into the adjacent neighborhood. No stub street was provided from the existing neighborhood so a direct connection is not possible. The developer is responsible for installation including stop signs, speed limit signs, and installed at each intersection and at the end metered circuit. The luminaries shall be approved equal. 6) City of Yakima Transit Project Planner: The proposed development is within Yakima Transit's service area. Yakima Transi requests sidewalks with ADA ramps (at intersections) throughout the development alon the street frontages of both Englewood and 74th Avenues to allow access for youth elderly, handicapped, and other individuals with special needs. 7) City of Yakima Building Codes (Addressing): Addressing for this subdivision is provided in Exhibit "A" as attached. 8) State of Washington Department of Ecology Projects with Potential to Discharge Off -Site Ecology concurs, the NPDES Construction Stormwater General Permit from the Washington State Department of Ecology is required if there is a potential for stormwater discharge from a construction site with disturbed ground. This permit requires that the SEPA checklist fully disclose anticipatedactivities including building, road construction and utility placements. Obtaining a permit is a minimum of a 38 day process and may take up to 60 days if the original SEPA does not disclose all proposed activities. 9) The permit requires that Stormwater Pollution Prevention Plan (Erosion Sediment Control Plan) is prepared and implemented for all permitted construction sites. These control measures must be able to prevent soil from being carried into surface water (this includes storm drains) by stormwater runoff. Permit coverage and erosion control measures must be in place prior to any clearing, grading, or construction. 10) Toxic Clean-up Based upon the historic agricultural use of this land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine pesticides. If theses contaminants are found at concentrations above the MTCA clean—up levels Ecology recommends that potential buyers be notified of their occurrence. of all traffic signs within the neighborhood street name signs. The lights shall be on a TANKO Model EW-3870FX, 85 Watt or t 9 Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 5 INDEX # AA -I 11) Yakima Tieton Irrigation District Yakima Tieton Irrigation District has a 24 -inch steel main line along the west property line of the above indicated parcel. The district is very concerned as to how it will be able to maintain a pipe of such size with development in such close proximity. There will need to be some in-depth discussion with planning and developer regarding the access and use of the established easement. 12) On October 5, 2011 an amended preliminary plat drawing was submitted in response to many of these comments. Due to the responsiveness of the changes made in the amended plat a follow-up DST meeting was not held. 13) On December 9, 2011, the City of Yakima Planning Division received a comment letter from the Yakima County Flood Control District which required the following conditions be added to the plat recommendation: "Yakima County Surface Water Division is providing the following requirement in regards to the above mentioned development project. Yakima County owns, operates, and manages Drainage Improvement District (DID) #38. Drain pipe and easements for DID #38 are located in the proposed development. Public and private facilities and structures may not be constructed within the easement without Yakima County permission. Access to DID facilities is required in perpetuity. No new connections may be made or new flows directed to the DID. Any modifications or .relocations of this DID will require (a) a written request to Yakima County and (b) a signed agreement between the developer and Yakima County prior to any modification or relocation to the DID. Any agreed upon change or alignment, including to public right-of-way, will require granting of senior easements to DID #38 prior to relocation and subsequent execution of a Plat or other such instrument. An engineering study may also be required of the proposed DID relocation." IX. Jurisdiction. Sections 1.42.030, 14.05.050 and 14.20.100 of the Yakima Municipal Code (YMC) provide that the YPC shall hold a public hearing and submit a recommendation to the City Council relative to the subdivision criteria listed in Section 14.20.100 of the YMC and in Chapter 58.17 of the Revised Code of Washington. X. Preliminary Plat Review Criteria. Section 14.20.100 of the YMC provides that the YPC shall review a proposed preliminary plat during an open record public hearing to determine whether the following standards are satisfied: (1) Subsection 14.20.100(1) -- Consistency with the provisions of the City's Urban Area Zoning Ordinance: The proposed preliminary plat would be consistent with the intent and 6 Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 DOC. INDEX # AA -I character of the Single -Family Residential (R-1) zoning district set forth in Subsection 15.03.020(B) of the Urban Area Zoning Ordinance (UAZO). The stated intent is to establish new residential neighborhoods for detached single-family dwellings free from other uses except those which are compatible with, and serve the residents of, this district; to preserve existing residential neighborhoods for detached single-family dwellings free from other uses to ensure the preservation of the existing residential character, and serve the residents of, this district; and to locate moderate -density residential development with densities up to seven dwelling units per net residential acre in areas served by public water and sewer service. The proposed preliminary plat would be consistent with the use and density requirements of the R-1 zoning district. It would also be consistent with the following minimum development requirements set forth in Chapter 15.05 of the UAZO which must be met in order to assure land use compatibility and promote the public health, safety and welfare: (a) Lot Coverage: The maximum lot coverage is the maximum area that can be covered with structures and other impervious surfaces. The maximum lot coverage in the R-1 zoning district is 45 percent. This standard is intended to protect the open character of the zoning district according to Subsection 15.05.020(C) and Table 5-2 of the UAZO. The proposed single-family residences on the proposed Tots will meet this standard. (b) Lot Size: The minimum lot size in the R-1 zoning district for single-family residences served by a public water and sewer system is 7,000 square feet according to Chapter 15.05 and Table 5-2 of the UAZO. The proposed lots range in size from 8,214 to 11,470 square feet, which will meet this standard. (c) Lot Width: The minimum lot width behind the required front yard setback in the R-1 zoning district is 50 feet according to Chapter 15.05 and Table 5-2 of the UAZO. All proposed lots meet this standard. (d) Structure Setbacks: The minimum structure setbacks permitted in residential zoning districts are intended to provide privacy, light, air and emergency access. Setbacks along easements and rights-of-way are intended to minimize the impacts from traffic on adjoining property owners. The applicable minimum setbacks in the R-1 zoning district will be provided as set forth in Subsection 15.05.020(D) and Table 5-1 of the UAZO. (e) Access Required: All new development shall have a minimum of 20 feet of lot frontage upon a public road or be served by an access easement at least 20 feet in width. All lots within this preliminary plat have the required frontage or will be served by an easement that is 20 feet wide in accordance with Subsection 15.05.020(H) of the UAZO. (2) Subsection 14.20.100(2) -- Consistency with the provisions of the Comprehensive Plan: The Urban Area Comprehensive Plan Future Land Use Map III -3 designates the subject property as suitable for Low Density Residential development. The Low .Density Residential Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 7 DOC. INDEX # AA- designation is characterized by a residential density of less than 7.0 dwelling units per acre (YUACP page III -14). The following goals and policies apply to this preliminary plat application: (a) Goal 3.1: Provide for a broad distribution of housing in Yakima that meets the affordability and neighborhood design needs of the public. (b) Goal 3.3: Preserve existing neighborhoods. (c) Policy 3.3.1: Preserve the character of neighborhoods such as historical character, architecture, natural features and layout. (d) Policy 3.3.2: Ensure that new development is compatible in scale, style, density and aesthetic quality to an established neighborhood. (3) Subsection 14.20.100(3) -- Consistency with the provisions of this title, Title 14 entitled "Subdivision Ordinance": All lots in this preliminary plat will have access upon a public street; will be provided with all necessary public utilities; will exceed the minimum lot size for the R-1 zoning district of 7,000 square feet for single-family residences; and will meet or exceed the minimum lot width of 50 feet as measured at the rear of the required front yard setback. This review and the recommended conditions are intended to ensure consistency with the provisions of the City's subdivision ordinance which are more specifically addressed in the following sections. (4) Subsection 14.20.100(4)(a) -- Appropriate provisions for public health, safety and general welfare: The construction of new residential units which will complement adjacent uses will make appropriate provisions for the public health, safety and general welfare insofar as there is a need in this community for residences and insofar as this proposed preliminary plat would be required to comply with all applicable City development standards and all conditions of approval specified by the City Council. (5) Subsection 14.20.100(4)(b) -- Appropriate provisions for open spaces: Gallion Park is located about .71 miles south east of the proposed preliminary plat. That facility, together with lot coverage of 45 percent or less on the lots proposed for this preliminary plat, will satisfy this plat standard. (6) Subsection 14.20.100(4)(c) -- Appropriate provisions for drainage ways: Complete stormwater management and drainage design plans, specifications and calculations must be submitted pursuant to the Eastern Washington Stormwater Manual and the City of Yakima Stormwater Management Guide. Any underground injection wells shall be registered with the Department of Ecology. On-site drainage will be permitted by methods to be reviewed and approved by the City. The proposed preliminary plat in these ways makes appropriate provisions for drainage ways. Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 8 ®ce INDEX # AA -1 (7) Subsection 14.20.100(4)(d) -- Appropriate provisions for streets or roads, alleys and other public ways: The preliminary site plan shows adequate dimensions for street improvements that comply with City of Yakima Title 12 Development Standards. Sewer and storm drainage will need to be provided in accordance with City of Yakima standards. These conditions will make appropriate provisions for streets and other public ways. (8) Subsection 14.20.100(4)(e) -- Appropriate provisions for transit stops: There is a bus stop at Summitview and 72nd Avenue (Routes 1 and 8). This bus stop will make appropriate provisions for transit stops until such time as closer transit stops are provided. (9) Subsection 14.20.100(4)(f) -- Appropriate provisions for potable water supplies, irrigation and other water suppliers: All lots will be served with public domestic water and water for fire protection purposes by the Nob Hill Water Association. Since the property is within the Yakima Tieton Irrigation District, the District will have to sign off on the subdivision mylar. (10) Subsection 14.20.100(4)(g) -- Appropriate provisions for sanitary waste disposal: There will be appropriate provisions for sanitary waste disposal for the proposed preliminary plat in the form of public sewer service provided in accordance with the City of Yakima's Title 12 standards. Wastewater connection charges shall apply. Each lot shall be served by sanitary sewer through an individual side sewer connection to the main which shall be installed or shall have an approved bond in place to secure its installation prior to the recording of the final plat, and civil engineer design plans shall be submitted and approved by the City of Yakima Engineer in accordance with YMC Chapter 12.03. The utility easement in which the public pipe is to be located must be a minimum 16 -foot -wide easement, or greater depending on the depth of the pipe. No septic systems or other method of sewage disposal will be allowed in the proposed preliminary plat. (11) Subsection 14.20.100(4)(h) -- Appropriate provisions for parks and recreation: Appropriate provisions for parks and recreation areas for residents of this proposed preliminary plat include Gallion Park which is located in the West Valley area. (12) Subsection 14.20.100(4)(i) -- Appropriate provisions for playgrounds: Appropriate provisions for playgrounds exist for this proposed preliminary plat due to the size of the proposed Tots and the presence of Gallion Park in the West Valley area. (13) Subsection 14.20.100(4)(j) -- Appropriate provisions for schools and schoolgrounds. The nature of this development and the absence of comments from the School District suggest that this preliminary plat will not lack appropriate provisions for schools and school grounds. (14) Subsection 14.20.100(4)(k) -- Appropriate provisions for sidewalks: Since the proposed plat would have sidewalks along its frontage on public streets in accordance with the Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 9 D INDEX IP _A 4 - t City's Title 12 requirements, the proposed preliminary plat will make appropriate provisions for sidewalks. (15) Subsection 14.20.100(4)(1) -- Appropriate provisions for other planning features that assure safe walking conditions for students who walk to and from school: There was no evidence presented at the hearing of a need for other planning features to be provided within this preliminary plat in order to make appropriate provisions for safe walking conditions for students who walk to and from school. (16) Subsection 14.20.100(5) -- Public use and interest: The evidence indicated that this proposed preliminary plat, as conditioned, would be consistent with neighboring land uses and would help serve the residential needs of this area. With the recommended conditions, it will comply with the City's zoning ordinance, subdivision ordinance and comprehensive plan. It will also make appropriate and adequate provisions for the public health, safety and general welfare, open spaces, drainage ways, streets, transit stops, potable water, sanitary waste disposal, parks and recreation, playgrounds and sidewalks, and is in a location where additional provisions for schools or for additional planning features for students who walk to and from school have not been recommended or deemed necessary. XI. Consistency Analysis under Subsection 16.06.020(B) of the Yakima Municipal Code. The following analysis involves the consistency of the preliminary plat with applicable development regulations, or in the absence of applicable regulations, the adopted Comprehensive Plan as mandated by the State Growth Management Act and the Yakima Municipal Code. During project review, neither the City nor any subsequent reviewing body may re-examine alternatives to, or hear appeals on, the following items identified in these conclusions except for issues of code interpretation: (1) The type of land use contemplated by the proposal (a residential development in an R-1 zoning district) is permitted on this site so long as it complies with the conditions imposed by the Yakima City Council, as well as the regulations of the zoning ordinance, subdivision ordinance, building codes and other applicable regulations. (2) The level of development (lot size, contemplated density) would not exceed the allowable level of development in the Single -Family Residential (R-1) zoning district since the proposed lot sizes satisfy the zoning ordinance requirements. (3) The availability and adequacy of infrastructure and public facilities is not an issue because the additional infrastructure that would be provided at the applicant's expense would ensure that adequate infrastructure and public facilities are available for the proposed preliminary plat. (4) The character of the proposal, such as the proposal's consistency with applicable development standards of the City's Urban Area Zoning Ordinance, primarily involves consideration of specific development standards relating to lot size, access, potable water, Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 10 DOC. With the recommended conditions, the proposed preliminary plat would be consistent with the development standards of applicable City ordinances. CONCLUSIONS Based on the foregoing Findings, the YPC reaches the following Conclusions: (1) The YPC has jurisdiction to recommend to the Yakima City Council the approval of a proposed preliminary plat pursuant to Section 14.20.100 of the subdivision ordinance. (2) Notice of the public hearing of December 14, 2011, was given in accordance with applicable requirements. (3) The SEPA Determination of Nonsignificance (DNS) for this proposed preliminary plat was issued on October 28, 2011, and became final without any appeal. (4) The proposed preliminary plat was reviewed for traffic concurrency under the Transportation Capacity Management Ordinance. (5) This preliminary plat is within the Yakima Tieton Irrigation District and its "Irrigation Approval" is required on the face of the plat in accordance with Section 14.20.080 of the subdivision ordinance. (6) This preliminary plat is in compliance with the consistency requirements of Subsection 16.06.020(B) of the Yakima Municipal Code. (7) With the recommended conditions, the proposed preliminary plat as described in the application narrative and site plan received October 5, 2011, is in compliance with the City's Urban Area Comprehensive Plan, subdivision ordinance and zoning ordinance; makes appropriate and adequate provisions for the public health, safety and general welfare and for open spaces, drainage ways, streets, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds and sidewalks; and, according to the weight of the evidence presented at the hearing, does not require that specific provisions be made for the other requisite plat considerations such as additional schools, additional schoolgrounds or additional planning features that assure safe walking conditions for students who walk to and from school; and serves the public use and interest. RECOMMENDATION Based upon the findings outlined above, it was moved and seconded that the City of Yakima Planning Commission recommends APPROVAL of this proposed 31 -lot preliminary plat in accordance with the application and related documents submitted for file numbers PLP #003-11 and SEPA #036-11, and subject to the following conditions: Two Bluffs, LLC Long Plat #003-11, and SEPA #036-11 Southwest corner of Englewood and N. 74th Avenues, Yakima, WA 98908 11 DOC. INDEX �, ftp 1. Prior to final plat approval for any phase the applicable interior streets shall be engineered, constructed and approved or financially secured according to the standards and requirements of the City Engineer and YMC Title 12. 2. All lots shall be served with public water from the Nob Hill Water Association. No individual domestic or irrigation wells shall be permitted for any of the proposed lots. Prior to final plat approval, written verification from Nob Hill Water must be submitted to the Planning Division indicating that all construction required to provide each lot with domestic water has been completed and the fees paid. 3. All Tots shall be provided with public sewer service according to YMC Title 12 standards. Prior to final plat approval written verification from the City of Yakima Engineering Department must be provided to the Planning Division indicating that all sewer extensions have been completed and inspected or financially secured. 4. A minimum 8 -foot wide public utility easement must be provided adjacent to all public road rights-of-way. 5. Easements for new and/or future utilities shall be a minimum of 16 feet in width, provided that the width of easements for buried utilities will be twice the depth of the planned excavation. 6. All public and private utilities shall be located underground, with the exception of telephone boxes and such similar structures. 7. All public and private utilities to be located within public road rights-of-way must be constructed prior to the start of road construction. 8. Fire hydrants shall be placed at the locations specified by the Building Codes and Planning Division and the Yakima Fire Department. All lots must be provided with adequate fire flow. 9. All permits required by the Yakima Regional Clean Air Authority shall be obtained. The developer shall designate during working hours a responsible party to serve as contact for suspected air quality violations. 10. The developer shall contact the State Department of Ecology to determine if a baseline general permit for stormwater discharges will be necessary for this development. Application shall be made at least 30 days prior to the start of construction. A final binding stormwater and drainage control plan for the entire property shall be submitted and approved by the City's Engineering Division prior to construction of improvements for any area of the development. 12. A grading plan and permit application, meeting the standards of Appendix J of the 2009 International Building Code, shall be submitted and a permit obtained prior to construction of improvements for each phase of the development. 13. Erosion control methods such as temporary ponding, silt fencing, etc. must be in place prior to clearing, grading or construction. 14. All addresses shall be as specified in Exhibit "A" of this report. All addresses must be clearly shown on the face of the final plat as required by RCW 58.17.280. 15. This plat shall be subject to the following notes, which must be placed on the face of the plat: a. The addresses shown on this plat are accurate as of the date of recording, but may be subject to change. The City of Yakima Building Codes Division is responsible for the confirmation or reassignment of addresses at the time of building permit issuance. b. The owners shown hereon, their grantees and assignees in interest hereby covenant and agree to retain all surface water generated within the plat on-site. c. No driveway access shall be allowed onto 74th Avenue by any lots within this long plat. Shared driveway access will be allowed for lots 10, 11, 12, and 13 onto Englewood Avenue. 18. Irrigation approval, if any is required, shall be shown on the face of the final plat. 19. The requirements of the City's October 27, 2011, MDNS shall be completed or complied with prior to final plat approval. 20. Public and private facilities and structures may not be constructed within the easement for Drainage Improvement District (DID) #38 without the permission of Yakima County. 21. Access to DID #38 is required in perpetuity, and no new connections may be made or new flows directed to the DID. 22. Any modifications or relocations of DID #38 will require a written request to Yakima County and a signed agreement between the developer and Yakima County prior to any modification or relocation of the DID. Any agreed upon change of alignment, including to public right-of-way, will require granting of senior easements to DID #38 prior to relocation and subsequent execution of a Plat or other instrument. The Low Density Residential designation is characterized as "Primarily free standing single-family residences. Residential density is less than 7.0 dwelling units per acre". This proposed preliminary plat for single-family residences has a density of approximately 2.2 dwelling units per net residential acre and is consistent with that designation. Generally, the proposed preliminary plat is consistent with the Comprehensive Plan's other provisions that encourage infilling, recognize the need for public water and sewer, encourage disposal of surface drainage on-site and encourage development consistent with the general land use pattern in the area. The Goals and Policies that apply to this designation and proposed land use are as follows: Goal 3.1: Goal 3.2: Provide for a broad distribution of housing in Yakima that meets the affordability and neighborhood design needs of the public. Build sustainable new neighborhoods Goal 3.3: Preserve existing neighborhoods Policy 3.3.2: Ensure that new development is compatible in scale, style, density and aesthetic quality to an established neighborhood. 2 DOC. INDEX URBAN AREA ZONING ORDINANCE (UAZO) The main purposes of the Yakima Urban Area Zoning Ordinance Yakima Municipal Code (YMC) Title 15 (UAZO) are to implement the Yakima Urban Area Comprehensive Plan and promote the general health, safety and welfare of the present and future inhabitants of the Yakima Urban Area. YMC Section 15.01.030 describes the goals and policies intended to promote the purpose of the UAZO. Subsection 15.03.030(2) of the UAZO indicates that the intent of the Single -Family Residential (R-1) zoning district is to establish and preserve residential neighborhoods for primarily detached single-family dwellings and to locate moderate -density residential development up to 7 dwelling units per net residential acre in areas served by public water and public sewer. This proposed preliminary plat can be considered consistent with the intent of R-1 zone and complies with the following development standards of Chapter 15.05 of the UAZO: A) Lot Coverage: The maximum lot coverage permitted in the R-1 zoning district is 45% and all lots will comply with that limitation. B) Lot Size: The preliminary plat indicates lot sizes that range from 8,214 to 11,470 square feet. Table 5-2 of Chapter 15.05 of the UAZO provides that the minimum lot size for a single-family dwelling is 7,000 square feet. C) Lot Width: Table 5-2 of Chapter 15.05 of the UAZO prescribes a minimum lot width of 50 feet and all proposed lots meet that requirement. D) Density: With a density of about 2.2 dwelling units per net residential acre, the proposed preliminary plat complies with YMC § 15.05.030(B) and Table 4-1 of Chapter 15.04 of the UAZO which prescribe a maximum of 7 dwelling units per net residential acre in the R-1 zone. SUBDIVISION ORDINANCE As proposed, and with the recommended conditions, this preliminary plat meets all the design requirements in Chapter 14.30 of the City's subdivision ordinance and the development standards of YMC Title 12. The recommended conditions are intended to ensure consistency with the provisions of the City's subdivision ordinance and that appropriate provisions are provided for the following: Public health, safety, welfare: The construction of new detached single-family dwellings which will complement adjacent uses will promote the public health, safety and general welfare insofar as there is a need in this community for single-family dwellings and insofar as this proposed preliminary plat would be required to comply with all applicable City development standards, all mitigation measures in the SEPA MDNS and all conditions of approval specified by the City Council. Open spaces: The proposed lots are larger than minimum sizes required in the R-1 zoning district. Lot coverage of 45% or less in the R-1 zoning district will provide adequate light and air for future residents in accordance with the standards in the zoning ordinance without additional open spaces. Drainage systems: The SEPA MDNS requires that drainage system facilities will be provided in accordance with state and local regulations. Streets, alleys, and other public ways: While the gradient for some of the new streets proposed by this development are somewhat steep at ten percent or less, they do not exceed the gradient requirements of the International Fire Code and are therefore acceptable. 3INDEX DOC. # fj-1 Water supplies: Public water is required to be used for domestic and fire flow purposes. An adequate water supply for this development is available from Nob Hill Water Company. Sanitary waste disposal: Public sewer is required to service all lots. Sewer mains capable of handling the demands of this development will be installed, or their installation financially secured, prior to the recording of any phases of this plat. Parks and playgrounds: Gallion Park is located about .71 miles south east of the proposed preliminary plat and is the closest city park to the subject property. The proposed preliminary plat is not located in a planned parks and recreation area. Provisions for parks and recreation areas are not necessary within the proposed preliminary plat due to the size, number and location of the proposed lots and provisions for playgrounds exist at the schools which children within the proposed preliminary plat would be attending, and could also be individually provided on the lots themselves which are of a size which would allow for playground areas as needed or desired. Sites for schools: Summitview Elementary School is located approximately .71 miles south east of the proposed preliminary plat and West Valley High School is located about .14 miles to the west. No comments were received from the School District suggesting the need for an additional school at this location. Sidewalks: Sidewalks are required and will be provided on both sides of all streets. Serves the public interest and use: This proposed 31 lot residential subdivision is consistent with neighboring land uses and better serves the needs of the City of Yakima than the undeveloped status of the property. DEVELOPMENT SERVICES TEAM (DST) The following comments were submitted at the DST meeting held on September 21, 2011. Nob Hill Water Association Nob Hill Water Association will be able to provide fire flow of 4,000 gpm at 20 psi for the Englewood Ridge development. The static pressure for the development will be approximately 62 psi. In order to provide this fire flow we will have to utilize the 8" main line that is currently stubbed out from the Orchard Pointe subdivision on the west side of proposed Lot 9 of Englewood Ridge, to create a looped system. City of Yakima Surface Water Engineer Complete stormwater design plans, specifications and runoff/storage calculations supporting the stormwater design are required pursuant to the Eastem Washington Stormwater Manual and City of Yakima standards. These plans and control measures must be completed by a licensed Professional Engineer and then be reviewed and approved by the City of Yakima Surface Water Engineer prior to construction. UIC Registration - Stormwater In accordance with Chapter 2 Section 2.4 of the December 2006 edition of the Department of Ecology's Guidance for UIC Wells that Manage Stormwater Publication Number 05-10-067, Underground Injection Control (UIC) wells constructed on or after February 3, 2006 are 4 DOC. IND considered new and must be registered with the Department of Ecology (DOE) prior to construction. Therefore, if UIC wells are used in the drainage design, the UIC wells must be registered with DOE and a copy of the DOE UIC Well registration form with a Professional Engineer's stamp and signature for each well shall be delivered to the City of Yakima's Surface Water Engineer before final project approval shall be granted. There are no Yakima County DID drain lines in this area. All existing drain lines are City of Yakima drains. Any drain lines to be relocated shall be within the road right-of-way or within a public service easement. Relocated drain lines will need the approval of the City of Yakima Surface Water Engineer. City of Yakima Development Engineer In accordance with Yakima Municipal Code (YMC) sections 12.01.020, 12.05.010, 12.06.070, and 12.06.080, the developer is required to install the following improvements: Plans: The owner is required to submit civil engineering plans for improvements per the requirements of YMC Title 12, stamped and signed by a civil engineer. Utilities: Storm drainage is not shown on the submitted preliminary plan. Sanitary Sewer is available within the right-of-way of 74th Avenue and along the west boundary of the property. Stormwater shall be treated and disposed of per the Yakima County Regional Stormwater Manual for both private property and city right-of-way. Frontage: Frontage improvements shall consist of new curb, gutter, and sidewalk along the entire frontage of the property, along with '/2 roadway improvement, installing street lights at the proposed access road, "Two Bluffs" off of Englewood Ave and at the intersection of Englewood and 74th Avenues. Said improvements shall match existing adjacent curb, gutter and sidewalk in location. No driveway access shall be allowed onto 74th Avenue by any Tots within this long plat. Shared driveway access will be allowed for Tots 10, 11, 12, and 13 onto Englewood Avenue. This shall be noted on the recorded plat. Internal Roadway Requirements: The internal roadway shall meet all YMC Title 12 improvement requirements for residential streets including, but not limited to asphalt roadway, concrete curb, gutter and sidewalk. Utilities include street lights, domestic water, sanitary sewer, and stormwater treatment. All construction shall meet the requirements of the City of Yakima standard plans and specifications and is subject to final approval by the City of Yakima Engineer. City of Yakima Building Codes Code Administration will work with Nob Hill Water for placement of any new hydrants. Plan review, permits and inspections are required prior to occupancy of any structures. City of Yakima Streets & Traffic Operations Manager 5 INDEX No direct lot access to 74th Avenue is allowed. Lot 20 can share the flag lot access with Lot 19. Although 74th Avenue is not presently designated as a collector road, it is likely to be so in the future. I also have a concern with the potential of a steeply graded driveway onto 74th Avenue. The existing driveways on the east side of 74th Avenue are problematic in the winter and I would expect the same for any driveway on the west side that may require similar grades. I recommend a second public street access into the subdivision form Englewood Avenue. The purpose for this is to promote pedestrian activities and reduce inter -neighborhood trip lengths. Ideally, the second connection would have been directly into the adjacent neighborhood. No stub street was provided from the existing neighborhood so a direct connection is not possible. The developer is responsible for installation of all traffic signs within the neighborhood including stop signs, speed limit signs, and street name signs. Streetlights are to be installed at each intersection and at the end of the cul-de-sac. The lights shall be on a metered circuit. The luminaries shall be TANKO Model EW-3870FX, 85 Watt or approved equal. City of Yakima Transit Project Planner The proposed development is within Yakima Transit's service area. Yakima Transit requests sidewalks with ADA ramps (at intersections) throughout the development along the street frontages of both Englewood and 74th Avenues to allow access for youth, elderly, handicapped, and other individuals with special needs. City of Yakima Building Codes (Addressing) Addressing for this subdivision is provided in Exhibit "A" as attached. State of Washington Department of Ecology Projects with Potential to Discharge Off -Site Ecology concurs, the NPDES Construction Stormwater General Permit from the Washington State Department of Ecology is required if there is a potential for stormwater discharge from a construction site with disturbed ground. This permit requires that the SEPA checklist fully disclose anticipated activities including building, road construction and utility placements. Obtaining a permit is a minimum of a 38 day process and may take up to 60 days if the original SEPA does not disclose all proposed activities. The permit requires that Stormwater Pollution Prevention Plan (Erosion Sediment Control Plan) is prepared and implemented for all permitted construction sites. These control measures must be able to prevent soil from being carried into surface water (this includes storm drains) by stormwater runoff. Permit coverage and erosion control measures must be in place prior to any clearing, grading, or construction. Toxic Clean-up Based upon the historic agriculture use of this land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine pesticides. If theses contaminants are found at concentrations above the MTCA clean —up levels Ecology recommends that potential buyers be notified of their occurrence. On October 5' 2011, an amended preliminary plat drawing was submitted in response to many of these comments. Due to the responsiveness of the changes made in the amended plat a follow-up DST meeting was not held. 6 DOC. 8N EX Yakima Tieton Irrigation District Yakima Tieton Irrigation District has a 24 -inch steel main line along the west line of the above indicated parcel. The district is very concerned as to how it will be able to maintain a pipe of such size with development in such close proximity. There will need to be some in-depth discussion with the City of Yakima Planning Division and developer regarding the access and use of the established easement. PUBLIC COMMENTS. Seven public comments or inquiries were received during the open comment period for this proposal. ENVIRONMENTAL REVIEW. On October 28, 2011, a Mitigated Determination of Nonsignificance (MDNS) was issued by the City of Yakima. This MDNS was issued under WAC 197-11-355). In this determination mitigation measures were required covering the following points: A. Contractors doing clearing, grading, paving, construction or landscaping work must file a dust control plan with Yakima Regional Clean Air Authority (YRCAA). Burning is prohibited at all times during land clearing. B. Complete stormwater design plans, specifications and runoff/storage calculations supporting the stormwater design are required pursuant to the Eastern Washington Stormwater Manual and City of Yakima standards. These plans and control measures must be reviewed and approved by the City of Yakima Surface Water Engineer prior to construction. If Underground Injection Control (UIC) wells are used in the drainage design, the UIC wells must be registered with the Department of Ecology (DOE). C. A NPDES Construction Stormwater General Permit from the Washington State Dept. of Ecology is required. The permit requires that Stormwater Pollution Prevention Plan (Erosion Sediment Control Plan) is prepared and implemented for all permitted construction sites. Permit coverage and erosion control measures must be in place prior to any clearing, grading or construction. D. A Grading Plan, prepared in accordance with the requirements and specifications set forth in Appendix J of the 2009 International Building Code, shall be submitted and approved by the City Building Official prior to any grading or construction. Any - changes or deviations from these requirements shall be at the discretion of the City Building Official. On November 11, 2011, the appeal period for this MDNS lapsed and no appeals were filed. The complete text of the MDNS is attached as Exhibit "B" TRANSPORTATION CONCURRENCY. The following Traffic Capacity Analysis was completed on September 11, 2011. This application has been reviewed and approved for consistency with YMC 12.08 Transportation Capacity Management Ordinance. This development will not exceed the PM peak hour capacity of the City Arterial street system and reserve capacity exists on all impacted streets. This review does not include any site development or safety issues which may be 7 ' OCo 6N EX # A" -! �a discussed at the project level or SEPA review. The review does not address intersection level of service. TOPOGRAPHY Although the site is hilly, no portion of the preliminary plat area is designated as a critical area due to over steepened slopes, which are defined as slopes in excess of a 20% grade. The SEPA checklist indicates that portions of the site have up to an 10% grade and although this is not insignificant it is not considered to be a slope which cannot be accommodated through a combination of site grading, including terracing, and the possible use of retaining walls. In the City of Yakima all permits for grading and site development are subject to the requirements of Appendix J of the 2009 International Building Code and some retaining walls may need to be engineered, permitted and inspected. The roads shown on the plat indicate a maximum grade of 10% on N. 75thth Avenue. In order to achieve this gradient cuts and/or fills may be necessary for the construction of the roadway and this presents the possibility that some of the proposed Tots which border these streets may have their useable lot area affected. STREET ACCESS AND PARKING Interior streets shall be utilized for access to the lots being created. No direct access will be permitted from any of the lots onto N. 74th Avenue, Tots 11 — 14 may have direct access to Englewood Avenue, and a note shall be added to the final plat indicating these conditions. TIME LIMITATION Upon preliminary plat approval the applicant has seven years from the date of preliminary approval to submit the final plat.' Thereafter, 30 days prior to the expiration of preliminary approval the applicant must submit to the City Council a written request asking to extend the approval period for a maximum period of one year (YMC § 14.20.150 YMC). Before the final plat can be recorded all required infrastructure must be engineered, completed and inspected or engineered and financially secured and receive final plat approval from the City Council. From the foregoing findings, staff makes the following: CONCLUSIONS 1. The Planning Commission has jurisdiction. (RCW Ch. 58.17, YMC § 1.42.030, and YMC § 14.20.100) 2. This recommendation is based upon a project narrative and site plan received October 5, 2011, and additional materials that have been secured from the applicant, their consultants, and other agencies. 3. A Mitigated Determination of Nonsignificance (MDNS) was issued on October 28, 2011. No appeals were submitted during the 14 -day appeal period which ended on November 11, 2011. 1 !n SSB 6544 (Ch. 79, Laws of 2010), the 2010 legislature extended the statutory time period for submitting final plats from five years after preliminary plat approval to seven years after that approval. It also extended the vesting period for approved final plats from five to seven years. This legislation, which became effective on June 10, 2010, will sunset on December 31, 2014. 8 DOC. MIREX # A -I 4. This preliminary subdivision complies with the goals and objectives of the Urban Area Comprehensive Plan, the intent and purpose of the R-1 zoning district, the provisions of the Urban Area Zoning Ordinance, Subdivision Ordinance, Title 12's Development Standards and Chapter 12.08 the Traffic Concurrency Ordinance. 5. During project review it has been found that this request is in compliance with YMC §16.06.020 (B) for making a Determination of Consistency as follows: a. The proposed use is permitted within the R-1 zoning district. b. All necessary public facilities are available to serve this site. c. This proposal is consistent with existing development regulations for this location. RECOMMENDATION The Planning Division recommends that the 31 -lot subdivision known as Englewood Ridge be approved subject to the following conditions: 1. Prior to final plat approval for any phase the applicable interior streets shall be engineered, constructed and approved or financially secured according to the standards and requirements of the City Engineer and YMC Title 12. 2. All Tots shall be served with public water from the Nob Hill Water Company. No individual domestic or irrigation wells shall be permitted for any of the lots. Prior to final plat approval, written verification from Nob Hill Water must be submitted to the Planning Division indicating that all construction required to provide each lot with domestic water has been completed and the fees paid. 3. All lots shall be provided with public sewer service according to YMC Title 12 standards. Prior to final plat approval written verification from the City of Yakima Engineering Department must be provided to the Planning Division indicating that all sewer extensions have been completed and inspected or financially secured. 4. A minimum 8 -foot wide public utility easement must be provided adjacent to all public road rights-of-way. 5. Easements for new and/or future utilities shall be a minimum of 16 feet in width, provided that the width of easements for buried utilities will be twice the depth of the planned excavation. 6. All public and private utilities shall be located underground, with the exception of telephone boxes and such similar structures. 7. All public and private utilities to be located within public road rights-of-way must be constructed prior to the start of road construction. 8. Fire hydrants shall be placed at the locations specified by the Building Codes and Planning Division and the Yakima Fire Department. All lots must be provided with adequate fire flow. 9 DOC. INDEX 9. All permits required by the Yakima Regional Clean Air Authority shall be obtained. The developer shall designate during working hours a responsible party to serve as contact for suspected air quality violations. 10. The developer shall contact the State Department of Ecology to determine if a baseline general permit for stormwater discharges will be necessary for this development. Application shall be made at least 30 days prior to the start of construction. 11. A final binding stormwater and drainage control plan for the entire property shall be submitted and approved by the City's Engineering Division prior to construction of improvements for any area of the development. 12. A grading plan and permit application, meeting the standards of Appendix J of the 2009 International Building Code, shall be submitted and a permit obtained prior to construction of improvements for each phase of the development. 13. Erosion control methods such as temporary ponding, silt fencing, etc. must be in place prior to clearing, grading or construction. 14. All addresses shall be as specified in Exhibit "A" of this report. All addresses must be clearly shown on the face of the final plat as required by RCW 58.17.280. 15. This plat shall be subject to the following notes, which must be placed on the face of the plat: a. The addresses shown on this plat are accurate as of the date of recording, but may be subject to change. The City of Yakima Building Codes Division is responsible for the confirmation or reassignment of addresses at the time of building permit issuance. b. The owners shown hereon, their grantees and assignees in interest hereby covenant and agree to retain all surface water generated within the plat on-site. c. No driveway access shall be allowed onto 74th Avenue by any lots within this long plat. Shared driveway access will be allowed for lots 10, 11, 12, and 13 onto Englewood Avenue. 18. Irrigation approval, if any is required, shall be shown on the face of the final plat. 19. The requirements of the City's October 27, 2011, MDNS shall be completed or complied with prior to final plat approval. 20. All other requirements of the zoning and subdivision ordinance, although not specifically set forth herein, shall be complied with in their entirety. 21. We have reviewed the documents and have the following comments. Water Quality Project with Potential to Discharge Off -Site Ecology concurs, the NPDES Construction Stormwater General Permit from the Washington State Department of Ecology is required if there is a potential for stormwater discharge from a construction site with disturbed ground. This permit requires that the SEPA checklist fully disclose anticipated activities including building, road construction and utility placements. Obtaining a permit is a minimum of a 38 day process and may take up to 60 days if the original SEPA does not disclose all proposed activities. The permit requires that Stormwater Pollution. Prevention Plan (Erosion Sediment Control Plan) is prepared and implemented for all permitted construction sites. These control measures must be able to prevent soil from being carried into surface water (this includes storm drains) by stormwater runoff. Permit coverage and erosion control measures must be in place prior to any clearing, grading or construction. If the proposal's actions are different than the existing water right (source, purpose, the place of use, or period of use), then it is subject to approval from the Department of Ecology pursuant to Sections 90.03.380 RCW and 90.44.100 RCW. Erosion control measures must be in place prior to any clearing, grading or construction. These control measures must be able to prevent soil from being carried into surface water (including storm drains) by stormwater runoff. A Stormwater Pollution Prevention Plan (Erosion Sediment Control Plan) is required for all permitted construction sites. Under Ground Injection Control Wells Registration — In accordance with Chapter 2 Section 2.4 of the December 2006 edition of the Department of Ecology's Guidance for UIC Wells that Manage Stormwater Publication Number 05-10-067, Underground Injection Control (UIC) wells constructed on or after February 3, 2006, are considered new and must be registered with the Department of Ecology (DOE) prior to construction. Therefore, if UIC wells are used in the drainage design, the UIC wells must be registered with DOE and a copy of the DOE UIC Well registration form with a Professional Engineer's stamp and signature for each is required to be delivered to the City of Yakima's Surface Water Engineer before final project approval shall be granted. D. Noise: During project construction, all contractors shall adhere to the City of Yakima noise regulations regarding hours of construction. My concern relates to open space issues. There are significant errors in the application and attachments. Under 7.B and 7.C, the distances are off by one decimal point. The application states that the nearest school to the proposed subdivision is .11 mile away and the nearest park, a City of Yakima Park Owned Park on S. 80th Ave., is purported to be 0.22 mile away; both statements are in error, The West Valley Community Park on S.80th Ave is over 2 miles away [Galleon Park is actually closer to the proposed subdivision but it is still over a mile away]. Similarly, in item 12 of the Background section, the distances for Apple Valley School, Westwood Golf Course, and Meadowbrook Recreational Center are at least 1.0 mile further than stated, which are exponential errors. Furthermore, all of these places are on the other (south) side of Summitview Avenue. My point being, there is a notable lack of park land or open space in this part of Yakima where kids can play. There is no park land or publicly accessible open space within the Yakima City limits north of Summitview Avenue and west of 70th Ave. Parks and open space are very important to the well-being of a local community and enhances property values, and is safer for kids. l do not begrudge Two Bluffs LLC for wanting to develop a subdivision at this location. However I urge them, and the city, to set aside some open space within the proposed subdivision for a small park area, or a playground, for neighborhood use. I live on the back side of this parcel. When the original owner bought this property (I knew him well) he was told nothing could be built behind him. (We are on Glacier with our back fence abutting to the land). How big is this parcel you are wanting to build on? If it is just along Englewood that doesn't seem big enough to accommodate 31 parcels. My wife, Glenda, and I live on the corner of 74th and Englewood Avenues. We received a notice in the mail of a Land Use Review and I wanted to submit my main concern for consideration. First of all, I believe this project is a positive sign in tough economic times. The potential benefit to the community and local businesses is extremely high. The only concern I have regarding this project would be the traffic impact, especially on Englewood Avenue. As motorists travel down the western slope of Englewood and beyond 74th Avenue, they typically reach speeds far beyond the posted 35mph speed limit. A couple of years ago I made an inquiry about a possible 4 -way stop at the intersection but I was informed that it did not meet the criteria for such a change, mostly due to lack of traffic volume. This proposed development as described in the Land Use Review would likely increase traffic by a substantial amount so I would like to request the addition of a 4 -way stop to possibly reduce the risk of future incidents. My main catalyst for such a request would be the high amount of children who wait at that intersection for the school bus.
