ROLL CALL '- The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Councilmembers Clarence Barnett, Henry Beauchamp, Bill Brado, Lynn Buchanan, Skip Semon and Bernard Sims present on roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Clerk Harris also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Berndt. 3. ADMINISTRATION OF OATH OF OFFICE TO CLARENCE BARNETT, PAT BERNDT, BILL BRADO AND LYNN BUCHANAN _ Bill Brado, having been elected to the office of Councilmember, and Clarence Barnett, Pat Berndt and Lynn Buchanan, having been re- elected at the November 5, 1991 election, and the Oath of Office having been administered by the City Clerk, are now duly seated as Councilmembers for the City of Yakima. 4. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Mayor Berndt announced the public hearing for the rezone of the Stone Church has been changed to January 9, 1992 at 9:30 A.M., at the Yakima Convention Center. City Manager Zais made the Council aware that the Councilmembers are not allowed to receive any mail, phone, or personal contact regarding the rezone prior to the hearing, because it eventually may be heard by the Council in a quasi- judicial hearing. Letters addressed to Council concerning this issue have been directed to the Planning Department to be given to the Hearing Examiner. Councilmember Beauchamp asked for the proper actions if they are contacted prior to the hearing. City Attorney Vanek replied that at the hearing they would have to disclose the extent of their conversations. He suggested Council advise citizens trying to contact them that this was not proper. 5. ELECTIONS: A. MAYOR This being the time for the election of Mayor, Mayor Berndt opened the nominations. Councilmember Semon nominated Pat Berndt for Mayor, it was seconded by Councilmember Sims. Councilmember Barnett nominated Lynn Buchanan for Mayor, it was seconded by Councilmember Brado. The nominations were closed; Pat Berndt was elected Mayor by a 4 -3 roll call vote. Barnett, Brado and Buchanan voting nay. B. ASSISTANT MAYOR /MAYOR PRO TEM Mayor Berndt opened the nominations for Mayor Pro Tem (Assistant Mayor). Councilmember Sims nominated Lynn Buchanan, it was seconded by Councilmember Brado. The nominations were closed; Lynn Buchanan was elected Mayor Pro Tem by unanimous voice vote. 117 6. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Councilmembers or citizens present. It was the general consensus of the Council to add Item No. 16A (an off - agenda item and remove Item No. 11. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY SEMON, THAT THE CONSENT AGENDA, AS READ, BE ADOPTED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 8. AUDIENCE PARTICIPATION Phil Pleasant, 1202 Fair Avenue, discussed the Martin Luther King holiday and stated his feelings that more minority businesses should have the opportunity to receive additional consideration for City contracts. Kay Chin, 22 West Park, distributed copies of the letters to the editor printed in the Seattle Chinese Post, written by Mayor Berndt and Councilmember Buchanan, in response to a letter from the editor of Seattle Chinese Post of Seattle's Chinatown. Mr. Chin thanked them for responding to the letter in favor of Yakima. 9. HEARING ON APPEAL OF DENIAL OF TAXI DRIVER'S LICENSE REQUESTED BY ROBERT ACKERMAN (MAY BE CONDUCTED IN EXECUTIVE SESSION) Mr. Ackerman was not present; therefore the appeal was not heard. *10. CONSIDERATION OF RESOLUTION AMENDING PETTY CASH FOR THE POLICE DEPARTMENT FOR SPECIAL INVESTIGATIONS FUND RESOLUTION NO. D -6040, A RESOLUTION amending Resolution No. D -5911, adopted May 7, 1991, and authorizing the existence of a City Treasurer's Change Fund, and other petty cash funds, within the General Fund of the City of Yakima. 6 122 JANUARY 7, 1992 11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT TO AGREEMENT WITH YAKIMA SCHOOL DISTRICT NO. 7 TO CONTINUE AFTER- SCHOOL PROGRAMS Parks and Recreation Manager Flaherty explained the After - School Program and the funding to the Council. Councilmember Beauchamp stated he felt the program had been a real success in the S.E. neighborhood and he wished to see it continue. It was MOVED BY SIMS, SECONDED BY SEMON, TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. D -6041, A RESOLUTION authorizing the continuation of the agreement with Yakima School District #7 for an After - School Program. *12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH YAKIMA VALLEY COUNCIL OF CAMP FIRE FOR AFTER - SCHOOL PROGRAM AT 16TH AND WILLOW HOUSING AUTHORITY PROJECT RESOLUTION NO. D -6042, A RESOLUTION authorizing an agreement between the City and the Yakima Valley Council of Camp Fire to provide an After - School Recreational Program for Youth At Risk. *13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH JUDY LEBENS TO PROVIDE FOOTCARE SERVICES AT THE SENIOR CITIZEN CENTER RESOLUTION NO. D -6043, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Judy Lebens, R.N. to provide footcare services at the Yakima Senior Center. *14. SET DATE OF PUBLIC MEETING FOR JANUARY 21, 1992 TO CONSIDER THE HEARING EXAMINER RECOMMENDATION ON THE M.C. SNACK REZONE January 21, 1992 was set as the date of public meeting to consider the Hearing Examiner recommendation on the rezone of property at 1102 -1108 North 23rd Avenue and 2310 River Road, requested by M.C. Snack. *15. FIRST READING OF ORDINANCE AMENDING THE 1992 PARKS AND RECREATION FUND FOR YOUTH AFTER - SCHOOL PROGRAM SPONSORED BY YAKIMA COUNTY SUBSTANCE ABUSE COALITION An Ordinance amending the 1992 Budget and appropriating funds into the Parks and Recreation Fund for an After - School Recreational Program for At -Risk Youth, having been read by title only, was laid on the table for one week, until January 14, 1992. 16. OTHER BUSINESS *A. CONSIDERATION OF A RESOLUTION AUTHORIZING EXECUTION OF AN EMERGENCY MEDICAL MUTUAL AID AGREEMENT WITH SOUTH CENTRAL REGIONAL EMERGENCY MEDICAL SERVICES PROVIDERS RESOLUTION NO. D -6049, A RESOLUTION AUTHORIZING EXECUTION OF AN EMERGENCY MEDICAL MUTUAL AID AGREEMENT WITH SOUTH CENTRAL REGIONAL EMERGENCY MEDICAL SERVICES PROVIDERS. 7 123 JANUARY 7, 1992 Councilmembers Barnett and Buchanan requested information about the leaf pick -up schedule in their areas. Public Works Director Copeland replied that they were behind schedule and he would have a revised schedule published in the newspaper and give that information to the Council. Mayor Berndt requested Public Works remove graffiti on the retaining wall in the vicinity of Nob Hill Boulevard and 18th Avenue. Mr. Copeland assured the Mayor that it would be taken care of. It was MOVED BY SIMS, SECONDED BY BUCHANAN, TO REAPPOINT MICHAEL DELGADO TO THE HOUSING AUTHORITY BOARD. The motion carried by unanimous voice call vote. City Manager Zais introduced an off - agenda item concerning the industrial park information which will be on next week's agenda. Assistant City Manager Stouder provided the Council with details on the City's plan to help develop a 160 acre industrial park on River Road between Sixth and Sixteenth Avenues. Mr. Stouder stated the City is applying for a $5000,000 grant from the State Community Economic Revitalization Board to add to $127,00 in local funds to extend water and sewer lines to the site. This grant, in reality, could become a twenty year loan with one - half percent interest, deferred for the first five years. In response to questions from Councilmembers Beauchamp and Brado, Mr. Stouder stated that road improvements in this area would cost an additional $1 million and would involve local and federal Economic Development Administration funds. Contingent upon the funding, which could take six to eighteen months for approval, the City will continue with the project. Yakima County Development Association Director, Tim McGree, encouraged the Council to endorse the grant applications, stating several firms have expressed a strong interest in the prospective industrial park. He stated up to three hundred jobs and a.$35 to $40 million investment in private money are involved'with prospective firms. Councilmember Semon asked about the possibility of property owners raising the prices for their property to unrealistic figures. Mr. McGree discussed this possibility; sixteen property owners would be involved with the acquisition of this property. Following further discussion, it was MOVED BY SIMS, SECONDED BY SEMON, TO AUTHORIZE THE STAFF TO BRING TO COUNCIL THE INFORMATION FOR A RESOLUTION FOR THE GRANT APPLICATION REGARDING INDUSTRIAL SITE DEVELOPMENT. The motion carried by unanimous voice vote. Mayor Berndt advised Council that she would be leaving for Washington D.C. today to meet with various agencies regarding substance abuse. Executive Session It was MOVED BY BARNETT, SECONDED BY SIMS, TO MOVE INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING PROSPECTIVE LITIGATION, WITH IMMEDIATE ADJOURNMENT THEREAFTER TO JANUARY 14, 1992 AT 7:00 A.M. AT THE CONVENTION CENTER. The motion carried by unanimous voice vote.
