1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Councilmembers Clarence Barnett, Henry
Beauchamp, Bill Brado, Lynn Buchanan, Skip Semon and Bernard Sims
present on roll call. City Manager Zais, City Attorney Vanek, City
Clerk Roberts and Clerk Harris also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmember Buchanan.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt announced that a card and cookies were delivered to
the Council by the Northeast Yakima Neighborhood Association.
Councilmember Buchanan reported on the National League of Cities
Conference, which he attended in Las Vegas. He requested at least
one more Councilmember attend these meetings, as they are very
informative and several seminars are held simultaneously. The
Council expressed interest in the workshop concerning bequests for
city parks and land swaps for parks.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Councilmembers or citizens present. It was the consensus of
the Council to remove Items Nos. 9, 10, and 21. Items Nos. 25
A & B (off agenda items) were added. The City Clerk then read the
Consent Agenda items, including resolutions and ordinances by
title. It was MOVED BY SIMS, SECONDED BY BIXHANAN, THAT THE
CONSENT NT ACRATIA, AS READ, BE PASSED. The motion carried by
unanimous roll call vote. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled under one
motion without further discussion.)
*5. APPROVAL OF MINUTES OF THE NOVEMBER 26, 1991 BUSINESS MEETING AND
THE DECEMBER 3, 1991 STUDY SESSION /BUSINESS MEETING
The Council minutes of the November 26, 1991 Business meeting and
December 3, 1991 Study Session /Business meeting were approved,
having been duly certified accurate by two Councilmembers and no
one present wishing to have said minutes read publicly.

7. PRESENTATION OF EMPLOYEE SERVICE AWARDS BY DEPARTMENT DIRECTORS
Employee service awards were presented to the following employees
by their division manager:
Police Department awards were presented by Police Chief Green.
Fire Department Awards were presented by Deputy Fire Chief
Martin. Public Works and Transit awards were presented by Jerry
Copeland. Parks and Recreation Manager Flaherty presented a
service award. Street and traffic awards were presented by Street
and Traffic Operation Manager Hussell.

8. REPORT AND LEGISLATION FROM ENGINEERING DIVISION REGARDING YAKIMA
AVE /I -82 /FAIR AVENUE PROTECT:
A. RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH THE STATE
DEPARTMENT OF TRANSPORTATION FOR PARTIAL REIMBURSEMENT OF COSTS
FOR INTERCHANGE IMPROVEMENTS
Director of Engineering and Utilities Covell explained the
agreements to the Council. Mr. Covell explained to Councilmember
Brado haw the value of the property was derived. Councilmember
Beauchamp questioned the number of employees that would be provided
with jobs. Mr. Lukehart replied that a Target store would be
built, but he did not know the number of employees. Resolution No.
D-6033 having been read by title, it WAS MUD BY SIl3, SIDED BY
BARNEIT, TO ADOPT ON. The motion carried by unanimous
roll call vote.

RESOLUTION NO. D -6033, A RF9oiiriai authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute an
agreement with the State of Washington, Department of
Transportation for partial reimbursement of costs for improvements
to the Fair Avenue and I -82 /Yakima Avenue interchange area.
B. RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH GARY
IUKEHART FOR CONVEYANCE OF PROPERTY FOR INTERCHANGE
IMPROVEMENTS
Resolution No. D-6034 having been read by title, it was !I]VID BY
SEWN, SECONDED BY SINS, TO ADOPT THE RFSOLDflOI. The motion
carried by unanimous roll call vote.
RESOLUTION NO. D -6034, A RESOLUTION authorizing execution of an
Agreement for Conveyance of Property for Improvement of Yakima
Avenue /I -82 Interchange Area and Fair Avenue.
9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT WITH
UNION GAP FOR LAW ENFORCEMENT DISPATCHING SERVICES
Counci]member Beauchamp asked if this contract would result in the
City being the sole dispatch center for Union Gap. Police Chief
Green explained that the City would handle all emergency calls on a
24 hour basis; Union Gap would handle its non - emergency calls
between 8:00 A.M. and 5:00 P.M., and that the City was not adding
any personnel. Resolution No. D-6035 having been read by title, it
was WVED BY BUCHANAN, SECONDED BY SINS, 10 ADOPT THE RESOLUIION.
The motion carried by unanimous roll call vote.
RESOLUITON W. D-6035, A RESOLUTION authorizing the execution of a
contract with the City of Union Gap for the sale of law enforcement
dispatching services.
10. CONSIDERATION OF RESOLUTION ADOPTING 1992 PARKS AND RECREATION TEE
SCHEDULE
Parks and Recreation Manager Flaherty explained to Councilmember
Barnett the advantage of continuing to rent Franklin Pool to
private parties. He stated after another year of operation, he
could give a better evaluation. Mayor Berndt stated the Yakima
County Substance Abuse Coalition has approved money for swimming
lessons and passes at Washington and Miller Pool and for two nights
of rentals of Franklin Pool for underprivileged youth. Resolution

CONSULTANTS FOR EMPLOYEE ASSISTANCE PROGRAM
RESOLUTION N. D -6O37, A RESOLUTION authorizing the execution of a
Consultant Services Agreement with Al Consultants Inc.
*12. CONSIDERATION OF RESOLUTION ID ADOPT AMENDED AFFIRMATIVE ACTION
PLAN
RESOLUTION I. D-6O38, A RESOLUTION adopting an Affirmative Action
Plan for the City of Yakima.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
YAKIMA . COUN'T'Y AND AREA AGENCY ON AGING FOR 1992 SOCIAL DAYCARE
PROGRAM
RESOLUTION M. D-6O39, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute an
agreement with the County of Yakima, Office of Aging and Long Term
Care, for a Social Day Care Program for Senior Citizens.
*14. APPROVAL OF NOVEMBER 1991 BUDGET REPORT
The November 1991 Budget report was accepted.
*15. SET DATE OF PUBLIC MEETING FOR JANUARY 14, 1992 TO CONSIDER HEARING
EXAMINER DECISION ON MASTER APPLICATION AND PARTIAL STREET VACATION
REQUESTED BY CENTRAL WASHINGTON COMPREHENSIVE MENTAL HEALTH
January 14, 1992 was set as the date of public meeting to consider
the Hearing Examiner's decision on a master application and partial
street vacation requested by Central Washington Comprehensive
Mental Health.
*16. SET DATE OF PUBLIC MEETING FOR JANUARY 14, 1992 ON LARRY LOVELESS
MASTER APPLICATION
January 14, 1992 was set as the date of public meeting on a Master
Application submitted by Larry Loveless for property located in the
vicinity of South 22nd Avenue and Viola Avenue.
*17. SET DATE OF PUBLIC HEARING FOR JANUARY 21, 1992 ON AMERICANS WITH
DISABILITIES ACT PLAN
January 21, 1992 was set as the date of public hearing on the
Americans With Disabilities Act Plan.
18. CONSIDERATION OF ORDINANCE ADOPTING A 1992 BUDGET
Item No. 18 was discussed after Items Nos. 19, 20, and 21. City
Manager Zais reviewed the 1992 budget and the amendments with the
Council. Ordinance No. 3421 having been read by title, it was
M)VID BY BUCHANAN, S6CONIDID BY SIMS, I0 ADOPT THE ORDINANCE.
The motion carried by 5 -2 roll call vote; Barnett and Brado voting

nay. Councilmember Barnett stated he voted nay because the budget
includes the sale of the shops complex to Transit, which he
opposes. Councilmember Brado stated he voted nay because of the
upcoming unknown cuts which may be made by the State legislators.
Mr. Zais announced that the City had received a budget award plaque
from the Government of Financial Officers Association for the 1991
City budget.
ORDINANCE ND. 3421, AN CRDINANCE adopting a budget for the City of
Yakima, Washington, for the year 1992; and making appropriations
for estimated expenditures.
19. CONSIDERATION OF ORDINANCES AMENDING CERTAIN PERMIT FEES:
A. BUILDING PERMITS
Items Nos. 19, 20 and 21 were discussed prior to Item No. 18.
Ordinance No. 3422 having been read by title, it was PINED BY SIMS,
SECONDED BY S MOM, TO ADOPT THE ORDINANCE. The motion carried by
4 -3 roll call vote; Barnett, Beauchamp and Brado voting nay.
ORDINANCE ND. 3422, AN ORDINANCE related to buildings; increasing
building permit fees; and amending Section 11.04.028 of the City of
Yakima Municipal Code.
B. PLUMBING PERMITS
Ordinance No. 3423 having been read by title, it was DINED BY
S11(1, SHOCNIDID BY SIMS, TO ADOPT THE ORDINANCE. The motion
carried by 4 -3 roll call vote; Barnett, Beauchamp and Brado voting
nay.
ORDINANCE ND. 3423, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Plumbing Code, 1991 Edition, of
the International Association of Plumbing and Mechanical Officials;
increasing various plumbing permit fees; amending Section
11.44.040, and all of the City of Yakima Municipal Code.
C. MECHANICAL PERMITS
Ordinance No. 3424 having been read by title, it was ll7VED BY SIMS,
SECONDED BY S MaN, TO ADOPT ORDINANCE. The motion carried by
4 -3 roll call vote. Barnett, Beauchamp and Brado voting nay.
ORDINANCE E ND. 3424, AN FINANCE relating to buildings; increasing
mechanical permit fees and enacting Section 11.32.077 of the City
of Yakima Municipal Code as a new section.
20. CONSIDERATION OF AN ORDINANCE ADJUSTING REFUSE ODLLE TION CHARGES
Ordinance No. 3425 having been read by title, it was ) ED BY SIMS,
SECONDED BY SEMEN, TO ADOPT THE: ORDINANCE. The motion carried by
6 -1 roll call vote; Brado voting nay.

FINANCE ND. 3425, AN 'ORDINANCE relating to health and sanitation;
increasing refuse charges; and amending Subsections 4.16.140C and
4.16.140 E of the City of Yakima Municipal Code.
21. CONSIDERATION OF AN ORDINANCE 'RELATING TO PUBLIC UTILITIES AND
PASSING ON STATE MANDATED YEE FOR WASTEWATER DISCHARGE PERMIT
Wastewater Superintendent Waarvick reviewed the Ordinance with the
Council. Counci]member Barnett questioned the pass through and
stated the round -offs of the monetary increases were inconsistent
with other City departments. Finance Manager Hanson explained the
procedure. Following further discussion, and Ordinance No. 3426
having been read by title, it was DOW) BY BUCHANAN, SECONDED BY
SENON, 9.0 AD(P.P �I)INNdCE. The motion carried by 6 -1 roll call
vote; Barnett voting nay.
ORDINANCE ND. 3426, . AN ORDINANCE relating to public services and
utilities; increasing sewer ready -to -serve charges and volume
charges; and amending Subsection 7.60.020 A of the City of Yakima
Municipal Code.
*22. CONSIDERATION OF AN ORDINANCE AMENDING THE MUNICIPAL CODE AND
ADJUSTING DOG LICENSE FEES
ORDINANCE NO. 3427, AN ORDINANCE relating to public safety and
morals, increasing dog license fees and amending Subsection
6.22.050A of the City of Yakima Municipal Code.
*23. CONSIDERATION OF AN ORDINANCE AMENDING RESTRICTION OF SALARY
INCREASES DURING PROBATION OF A MANAGEMENT EMPLOYEE
ORDINANCE NO. 3428, AN ORDINANCE related to personnel, restricting
salary adjustments for probationary employees; amending City of
Yakima Municipal Code Section 2.20.050.
*24. CONSIDERATION OF ORDINANCES REGARDING CITY MANAGEMENT COMPENSATION
PACKAGE FOR 1992:
A. ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN
ORDINANCE ND. 3429, AN ORDINANCE relating to City personnel;
adopting a classification and compensation plan for City employes
to be effective January 19, 1992; amending Subsections 2.20.110 A,
2.20.110 B, 2.20.110 C, 2.20.110 D, 2.20.110 E, 2.20.110 G,
2.20.110 H, and 2.20.110 K, all of the City of Yakima Municipal
Code.
B. ORDINANCE IMPLEMENTING A SECTION 125 PLAN
FINANCE ND. 3430, AN ORDINANCE relating to personnel; authorizing
the implementation of a Section 125 Spending Plan for the City of
Yakima; and enacting a new section, Section 2.20.150 of the City of
Yakima Municipal Code.

25. OTHER BUSINESS
*A. REQUEST FROM POLICE DEPARTMENT FOR APPROVAL OF EXPENDITURE
FOR POLICE MOBILE DATA TERMINAL SYSTEM
The request from the Police Department for approval of expenditure
for police mobile data terminal system was approved.
*B. SET DATE OF QUASI - JUDICIAL HEARING FOR JANUARY 7, 1992 ON
APPEAL BY ROBERT ACKERMAN FOR DENIAL OF TAXI DRIVER'S
LICENSE
The Quasi - Judicial Hearing on appeal of denial of taxi driver's
license requested by Robert Ackerman was set for January 7, 1992,
in the Council Chambers.
Mayor Berndt suggested Council request a copy of the material from
the National League of Cities attended by Councilmember Buchanan
regarding promotion of bequests to the Parks Division.
