ROLL CALL The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Counci]members Clarence Barnett, Henry Beauchamp, Lynn Buchanan, and Skip Semon present on roll call. Counci]members George Pechtel and Bernard Sims absent and excused. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Clerk Harris also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE The Invocation was given by Councilmember Beauchamp. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Mayor Berndt announced she has been invited to Washington, D.C., to participate in the Community Mobilization Efforts Against Drugs, funded by the office of Substance Abuse and Prevention. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions fram either Councilmembers or citizens present. Items Nos. 10 and 12 were removed fran the Agenda. It was the general consensus of the Council that the addition of Item No. 9, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was }DYED BY BUCHANAN, SECONDED BY BEAUCHAMP, THAT AVMIDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote; Pechtel and Sims absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE NOVEMBER 12, 1991 ADJOURNED AND BUSINESS COUNCIL MEETINGS AND NOVEMBER 15, 1991 ADJOURNED MEETING The Council minutes of the November 12, 1991 Adjourned and Business meetings and November 15, 1991 Adjourned meeting were approved, having been duly certified accurate by two Councilmembers and no one present wishing to have said minutes read publicly. 6. PUBLIC HEARING ON PRELIlMMNARY 1992 BUDGET This being the time set for public hearing, Mayor Berndt ask anyone wishing to speak to come forward. -1- NOVEMBER 26, 1991 7 5 Hazel Hasse, 409 'S:-.47th Avenue xplained the Older American Nutrition program and asked for funding from the City of $20,000. Ms. Hasse explained the additional demand for home delivered meals, the added expenses, and their budget. The Council questioned Ms. Hasse about additional funding that the program receives, and if this would be a one -time request. Ms. Hasse responded that they receive Federal funding from the Older American Act Title III, indirect support from the County and that it probably would not be a one -time only request. Glenn Phipps, Ki -Yak Program Specialist, spoke to the Council rconcerning a request for $5,000 in cash and $10,000 in -kind services to promote the 1992 Washington State Agricultural Showcase. Mr. Phipps presented a video from Congressman Morrison, supporting the program. Leslie Ganz, Senior Associate, TRADEC, spoke giving additional information and the proposed benefit to the City by supporting this request. Yakima County is one of the sponsors of this program. Mayor Berndt made the audience aware that all requests are heard today, but voting and decisions will not be made until December 7, 1991. George Loudon, 1509 Summitview, presented the Council with information on the Artsvan budget and how it is spent. One hundred and twenty eight on -site visits were made to twelve City parks by the Artsvan this summer. Bill Salatino, 209 Park;Avenue,..stated he has lived in Yakima for seventy two years and he protested a rise in utility rates and taxes. Ron King, 320 Stanley Blvd., discussed with Council the urgency for additional facilities for sports activities. He also inquired if Olympia Advertising Agency is still involved with the trolley advertising. Public Works Director Copeland replied that the agency is no longer involved and the Transit Division will handle its own advertising in the future. Lou Alderman, 101 N. 48th Avenue; United Home Builders, spoke opposing the 10% increase in building permit fees. Mr. Alderman stated his reasons for opposing this increase and gave suggestions for decreasing costs. He reviewed the high increases that have occurred in the last few years. Bob Gent, 215 S. 15th Avenue, on behalf of the Yakima Association of Realtors, added his opposition to the increase in fees because he feels this is an affordable housing issue. Councilmember Buchanan stated he felt a decrease in cost would be reflected by a decrease in service. Bruce Smith, 4404 Maple, appealed to the Council to reconsider the acquisition of property for the Transit transfer facility. He discussed the alternative options and stated he was certain he could save the City a great deal of money. He proposed building the facility for the City and leasing it to the City, at a large -2- 7 6 NOVEMBER 26, 1991 savings. This possibility was discussed with the Council and it was the general consensus of the Council that they would look at and consider these proposals. Jerry Maggart, 1101 Azar, added his ideas and agreed with Mr. Smith's comments concerning the savings to the City. He spoke for the property owners that would be displaced because of this property acquisition. Parking was also a major concern which was discussed. John Edwards, 2300 River Road; owner and developer of Track 29, spoke in favor of the Transit terminal being built in that area. Councilmeamber Semon stated the reason Front Street was eliminated as a possibility was because of the historic buildings in the area, which cannot be removed. Mr. Edwards remarked that none of the historic buildings would need to be removed. Mayor Berndt suggested the speakers be given the available material on the project and a meeting with the Transit Division be arranged. Marilyn Young, 520 Santa Roza, spoke concerning her property on S. 4th Street. She has received notice from the City with an offer to buy, which she believes is not a fair market offer. Mrs. Young stated she has lost 50% of her tenants because of the City's notice that they had 90 days to vacate. The Council was not aware that the tenants had already received notices to vacate. This was discussed by City Manager Zais and Dixie Kracht, Block Grant Manager. Ms. Kracht explained the notices must be sent by Federal mandate so the tenants may be made aware of Federal assistance in relocating. John Klingele, 1312 W. Walnut, discussed policy issues concerning street light installation, street sweeping, refuse rates, fifty - fifty sidewalk repairs, inflatable pool toys, new water pipes, wastewater collections and new fire hydrants. There being no one else present wishing to speak, Mayor Berndt closed the public hearing. Mayor Berndt requested Item 8A to be taken care of at this time. 8. A. PRESENTATION BY VAL FINLAYSON, CHAIR OF VISIONING YA}IMA 2010 STEERING COMMITTEE Val Finlayson, Chair of Visioning Yakima 2010, gave the Council a report on the committee's status. Mayor Berndt read a proclamation commending the dedication and service of Mr. Finlayson and the community leaders for the success of Visioning Yakima 2010. Mr. Finlayson was presented with a plaque /clock in appreciation of his outstanding efforts on this project. Theresa Schuknecht, Yakima Police Department, and Jim Schoenrock, Yakima Substance Abuse, were presented with a plaque from the National Association of Town Watch as a national winner for its outstanding participation in the 8th Annual National Night Out crime and drug prevention program. -1- NOVEMBER' 26, 1991 7 7 • 7. PUBLIC HEARING ON 1992 PRELIMINARY COMMUNITY DEVELOPMENT BLACK GRANT BUDGET AND YAKIMA COMMUNITY DEVEUJP MENT PLAN' Block Grant Manager Kracht presented her budget to the Council, including a request for three new employees. She explained these positions. would be funded by fees and block grant funds. The various means of funding were discussed. The Council commended Ms. Kracht for the excellent job being done at finding affordable housing for Yakima residents. This being the time set for public hearing, Mayor Berndt asked for anyone from the audience wishing to speak. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF PROPERTY ACQUISITION AGREEME TS AT 505 SOUTH 3RD AVENUE: A. PURCHASE AND SALE AGREEMENT WITH UNION PACIFIC RAILROAD B. ENVIRONMENTAL TESTING AGREMME3T WITH CHEN NORTHERN This Item was removed from the Agenda. *11. CONSIDERATION OF RESOIUTION APPOINTING GLEN WARREN AS THE CITY'S PUBLIC DEFENDER FOR 1992 (CONTINUED FRCVI 11/19/91) RESOLUTION ND. D-6027, A Rl WTI 1 appointing Glen P. Warren as City of Yakima Public Defender for the calendar year 1992. 12. CONSIDERATION OF JOINT CITY /COUNTY RESOLUTION APPROVING CERTAIN AIR TERMINAL BOARD RESOLUTIONS (AVAILABLE TUESDAY) This Item was removed from the. Agenda. *13. APPROVAL OF THIRD QUARTER 1991 ENGINEERING CIP REPORT The Third Quarter 1991 Engineering Capital Improvement Project Status Report was accepted. *14. APPROVAL OF REPORT ON VEhUCLE ACCIDENTS REVIEWED BY SAFETY COMMITTEE IN NOVEMBER The report on the vehicle accidents reviewed by the Safety Committee in November 1991 was accepted. 7 8 NOVEMBER 26, 1991 *15. CONSIDERATION OF ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION PLAN FOR POLICE ASSOCIATION AND FIRE PERS EMPLOYEES ORDINANCE NO. 3419, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective January 1, 1992; amending Subsections 2.20.110 A, 2.20.110 I, and 2.20.110 J all of the City of Yakima Municipal Code. 16. OTHER BUSINESS Mayor Berndt ask for further clarification of the letters which were sent to the tenants residing on the site proposed for the Transit terminal. Block Grant Manager Kracht explained the Federal law which requires the City to notify the tenants that they could be displaced and therefore entitled to relocation and displacement funds. It was the consensus of the Council that this was unfortunate for persons involved but unavoidable because of the existing laws. It was the consensus of the Council to continue the budget review session next Tuesday, December 3, 1991, at 8:00 A.M., recess for one -half hour lunch, then resume the budget review at 12:30 P.M. and begin the Council meeting at 2:00 P.M. The wrap -up session will be Saturday, December 7, at 9:00 A.M.
