In accord with that authority, the City assesses wastewater collection and treatment rates and charges as established in 7.60 of the YMC. To maintain pace with all the regulatory compliance issues identified over the next ten years, wastewater rates ultimately need to be increased. Should rates not be increased, the only alternative would be to significantly increase the Division's debt service; reducing its available cash and cash transfers in order to meet regulatory mandates; thus avoiding penalties and potential third party lawsuits. The current debt service is approximately 19% of the Division's current budget; with the maximum allowed to be 25 %. In order to provide an unbiased comprehensive analysis of the Wastewater Division's financial needs, the City contracted with FCS Group to conduct a rate study over a ten -year period (2012- 2021). Such services provide the City with an honest in -depth look as to what proper funding levels are really required to ensure the citizens of Yakima with wastewater services now, and in the future; while remaining compliant with all of the federal and state rules and regulations. FCS Group's ten -year review of the Wastewater Division's maintenance program, capital needs, and regulatory requirements for both the WWTP and the sanitary sewer collection system indicated a funding need of approximately $71,000,000. FCS Group also identified the need to eliminate the 25% subsidy of the Pretreatment Program currently being provided from wastewater user rates. This requires a change of philosophy as this has been a long standing policy implemented by City Council. Based on regulatory requirements, replacement costs, and current funding levels, FCS Group has proposed an annual rate increase of 5.1 % for the next three -years to provide the Wastewater Division with proper funding levels. Proposed changes from FCS Group's recommendation: • s Increase the current "Outside City" rates for both BOD and TSS by the same percentage as "Inside City." FCS Group recommended implementing a 1.5 factor of the "Inside City" rates to establish the "Outside City' rates. This would significantly increase the rate for both parameters. • Initiate a FOG charge for "Outside City" based on 5.1% of the current "Inside City" FOG rate. In 2007 • when the "Inside City" FOG rate was first established, there was no consideration or implementation of an "Outside City" rate. o Reduce the current 25% subsidy for "Inside City" Pretreatment Charges by 5% per year for the next five years, while retaining the current "Outside City" charges. FCS Group recommended a highly aggressive approach by immediately eliminating all subsidies within the first year; followed by rate increases for such charges each year thereafter. Phasing the subsidy removal would be less of a financial impact to the • commercial and industrial businesses. The discussion of the needed rate increase for each of the next three years was previously presented to City Council in a Study Session on June 14, 2011 with the information being sent to the following: •Greater Yakima Chamber of Commerce •Hispanic Chamber of Commerce •Yakima Valley Regional Library •Central Washington Home Builders Association •Del Monte •Seneca Foods Aik •Jewel Apple 'City of Yakima website No comments on the proposed rate increase were received by the City. The rate proposal has also been submitted for Council approval as a Major Policy Issue and has been incorporated into the Wastewater Division's 2012 Budget. Deferment of adequate rate increases will only serve to significantly increase the financial needs and immediate costs of the City's largest asset; while placing the entire infrastructure in immediate jeopardy. Having an appropriate rate structure and available funding to support the maintenance, repair, and replacement of the infrastructure is crucial in protecting public health and promoting economic development. It is therefore staffs recommendation to Council to revise Chapter 7.60 Wastewater Collection and Treatment Rates and Charges of Yakima Municipal Code for 2012, 2013, and 2014 as proposed to provide the Wastewater Division with proper funding levels. WHEREAS, the City of Yakima (City) is authorized by Title 35 RCW to acquire, construct, own operate, and provide financing for waterworks and systems of sewerage, and to establish rates, fees, and charges therefore; and WHEREAS, the City Council determines that it is in the best interests of the citizens of the City that ordinances related to such systems of sewerage, wastewater rates, fees, charges, and related matters be amended as set forth in this Ordinance; and WHEREAS, the City Council determines that the rates, fees, and charges contained in this Ordinance are fair, just and reasonable; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA Section 1. Strong Waste Surcharge. For customers located inside the city discharging wastewater which contains more than three hundred parts per million of biochemical oxygen demand (BOD) and /or total suspended solids (TSS), there shall be a surcharge, in addition to the ready -to -serve charge and the volume charge, which shall be calculated utilizing the national average values of BOD and TSS concentrations typical to each classification under the Standard Industrial Code or by actual concentrations verified by the city. If the customer chooses, at its expense, to install a sampling station, the strong waste charge shall be calculated based upon actual concentrations. Any testing done by the city may be charged at the rates set forth in YMC 7.60.105. The following formula shall be utilized to calculate the strong waste charge: Monthly surcharge = (unit costs per pound of BOD or TSS) times (weight of one gallon of water) times (customer's monthly volume in one hundred cubic feet divided by one thousand three hundred thirty- seven) times (customer's concentration of BOD or TSS in parts per million per [the national average values] or [verified concentrations] minus three hundred). Section 3. Section 7.60.035 of the Municipal Code is amended to read as follows: • 7.60.035 Septage and exceptional wastewater disposal charges. 11 A. Septage Wastewater Disposal Charge. Receiving costs shall be calculated by the wastewater manager and based on actual or estimated staff time, materials, and related • costs incurred in connection with receiving the particular waste at issue. (3) Testing Cost. The costs of any testing are set forth in YMC 7.60.105. The wastewater manager shall have final authority over what tests shall be required for any discharge. C. The amount of the disposal fee, at the rate specified in subsection A or B of this section, shall be based upon the actual quantity measured and discharged. Measurement shall be through methods and instruments as determined by the city. (Ord. 2007 -65 § 6, 2007: Ord. 2003 -75 § 6, 2003). Section 4. Section 7.60.105 of the Municipal Code is amended to read as follows: 7.60.105 Rates, charges and fees for pretreatment program. A. It is the purpose of this section to provide for the payment of rates, charges and fees for certain discharges to the wastewater system, to compensate the city for the cost of administration of the pretreatment program established in Chapter 7.65. Connection charges for dischargers subject to Chapter 7.65 are as set forth in Chapter 7.68 of this code. B. Rates, Charges and Fees to Be Published. The wastewater manager shall maintain a schedule of current rates, charges and fees, shall post such schedule conspicuously, and shall make copies available to interested persons. Upon request, the wastewater manager shall prepare an estimate of annual fees for a significant industrial user. C. Significant Industrial Users (SIUs). Commencing on the effective date of the ordinance codified in this section, SIU permit fee amounts shall be set at ninety percent S of that amount identified in the industrial facility categories of WAC 173 - 224 -040. The permit fee shall cover the costs of administering the SIU wastewater discharge permit program including inspections, technical assistance, education, and compliance administration. Costs associated with any sampling and testing shall be in addition to the permit fee. This annual fee is based on the state's fiscal year (July 1st —June 30th). D. Base Fee for Minor Industrial Users (MIUs). Commencing on the effective date of the ordinance codified in this section and until amended pursuant to subsection F of this section, minor industrial users (as defined in Chapter 7.65) shall pay a base fee for pretreatment service. Significant industrial users shall not be subject to a base rate. E. Charges and Fees for Related Services. Commencing on the effective date of the ordinance codified in this section and until amended pursuant to subsection F of this section, significant industrial users shall pay the sampling and laboratory testing charges and fees provided below for those specific services described or fisted below. All customers shall also be subject to the sampling, laboratory testing, and flat rate charges and fees provided below, in addition to any base rate provided for in subsection D of this section, but only for those services requested by the customer or provided as part of a required compliance inspection. (1) Sampling Charge. The sampling charge includes sampler set -up, pick -up, and statistical analysis, as well as billing program charges from the customer service manager. See Chapter 7.65. F. Amendment of Base Rates, Charges and Fees. (1) The base rate or rates ( "rates" for purposes of this subsection) set forth in subsection D of this section may be amended from time to time by ordinance of the city • council. Any such amendment shall be based upon changes in the city's cost of providing wastewater pretreatment service as reflected in the city's annual budget. The base rates set forth in subsection D of this section are to be billed at eighty (80 %) percent beginning in 2012, eighty -five (85 %) percent beginning in 2013, and ninety (90 %) percent beginning in 2014 for customers located within the city limits. Other customers will be billed at one hundred percent of base rates. These percentages may be amended by ordinance of the city council. (2) The charges and fees set forth in subsection E of this section may be amended from time to time by ordinance of the city council upon recommendation of the wastewater manager. Such amendments shall be based on changes in the costs of providing sampling, laboratory and miscellaneous wastewater pretreatment services. In determining whether there has been a change in the costs of providing service, the city council may consider the city's expenses associated with obtaining services from private laboratories and other third persons, and the city's own administrative and other costs. The charges and fees set forth in subsection E of this section are to be billed at eighty (80 %) percent beginning in 2012, eighty -five (85 %) percent beginning in 2013, and ninety (90 %) percent beginning in 2014 for customers located within the city limits. Other customers will be billed at one hundred percent of the charges and fees set forth in subsection E. These percentages may be amended by ordinance of the city council. G. Money to Be Credited to Wastewater Operating Fund. All moneys collected pursuant to this section shall be paid into and credited to the wastewater operating fund as provided in Chapter 3.101. This ordinance shall be in full force and effect thirty (30) calendar days after its passage, approval and publication as provided by law and by the City Charter. The wastewater manager shall maintain a schedule of current rates, charges and fees, shall post such schedule conspicuously, and shall make copies available to interested persons. Upon request, the wastewater manager shall prepare an estimate of annual fees for a significant industrial user. C. Significant Industrial Users (Sills). Commencing on the effective date of the ordinance codified in this section, SIU permit fee amounts shall be set at ninety percent of that amount identified in the industrial facility categories of WAC 173 - 224 -040. The permit fee shall cover the costs of administering the SIU wastewater discharge permit program including inspections, technical assistance, education, and compliance administration. Costs associated with any sampling and testing shall be in addition to the permit fee. This annual fee is based on the state's fiscal year (July 1st —June 30th). D. Base Fee for Minor Industrial Users (MIUs). Commencing on the effective date of the ordinance codified in this section and until amended pursuant to subsection F of this section, minor industrial users (as defined in Chapter 7.65) shall pay a base fee for pretreatment service.
