BUSINESS MEETING 1. ..ROLL . • - - The City Council net in session on this date:at 2:00 P.M. in the Council Chambers of City Hall, .Yakima, Washington: Mayor Pat Berndt, presiding; Councilmembers Clarence •Barnett, Henry ,Beauchamp., Lynn Buchanan,. George .Pechtel, Skip Semon and Bernard _ Sims present on :roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Lovell also present. 2 -.. INVOCATION /PLEDGE OF ALLEGIANCE . Councilmember Buchanan led the Pledge of Allegiance. • '3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Parks and - Recreation' Manager' Flaherty•:introduced :George Loudon, the t new Allied.Arts Executive Director. •• Mr. Flaherty reported on the success of several summer recreation f' - -; rograms,.including the Fishing Derby. Sue George - spoke about "Kids Konnection, ". an after - school: program :offered in-several.,locations. Mr. Flaherty noted the successful aquatics program,. and praised Council for deciding to install the water slide at Franklin Pool. • 4. CONSENT AGENDA • Mayor Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Councilmembers or citizens present. There being none, the City Clerk then read the Consent Agenda • items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT'THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote. (Subsequent paragraphs preceded byy an asterisk-, {.. *) _indicate .items on the Consent Agenda handled under one motion without further discussion.) - *5. APPROVAL OF MINUTES' OF THE AUGUST 20 ;,1991 BUSINESS MEETING The Council minutes of the August 20, 1991 Business meeting were approved, having been' duly certified, accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION • Anne. .Tipton and Megan Norman. expressed appreciation, to Council for implementation of the.free downtown trolley system. Mayor Berndt read a proclamation designating . the month of September, 1991 as Yakima Greenway Month. The proclamation was accepted by Greenway Executive Director, Barbara Feasey. 4 9 2 SEPTEMBER 3, 1991 7. QUASI- JUDICIAL HEARING ON APPEAL BY WILLIAM O'NEIL OF DENIAL OF ISSUANCE OF TAXI DRIVER'S' LICENSE (MAY BE CONDUCTED IN EXECUTIVE SESSION) City Attorney Vanek advised.Council that this hearing could be held in either open or executive session, at the discretion of the .appellant. William O'Neil waived his right to Hove into Quasi - Judicial session. Mr. O'Neil advised Council that'he is bondable, and has a Washington State Driver's License with no special insurance requirements. Although he is a convicted felon, it has been nine years since his incarceration. He'asked for leniency, since his'10 -year exclusion for a taxi license expires in 1992. Mr. O'Neil indicated that he did not fully disclose his criminal record on the application because he thought*a 7 -year time limit was in effect. Mayor Berndt explained that Council assumes a certain responsibility when taxi 'licenses '.are• - issued; and must consider the public. Councilmember Pechtel supported the idea of helping ex- convicts return to productive employment. It was MOVED BY PECHTEL,:SECONDED BY BEAUCHAMP, TO UPHOLDTHE APPEAL AND ISSUE A TAXI DRIVER LICENSE" TO WILLIAM O'NEIL. Councilmember Beauchamp questioned Mr. O'Neil's work record, and encouraged him to work toward a more stable employment history. Councilmember Semon questioned - the.information that was withheld, and doubted that a good faith effort was made on the application. The question was called for a vote-on notion. The motion failed on a 2 -5 vote; Barnett and Pechtel voting aye. *8. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF 911 LEASE RESOLUTION NO. D -5990, A RESOLUTION authorizing the execution of a lease agreement regarding Fire Station No. 1, for 911 services, with the County of Yakima. *9. CONSIDERATION OF RESOLUTION APPROVING PRELIMINARY PLAT AND A PRELIMINARY SUBDIVISION AT SOUTH 22ND AVENUE AND WEST VIOLA AND APPROVING ADMINISTRATIVE ADJUSTMENT, TO ALLOW PARKING RESOLUTION NO. D = 5991, A RESOLUTION approving the preliminary plat and preliminary subdivision submitted by Larry Loveless (Barnaddy Addition) for five lots at the southwest corner of South 22nd Avenue and West Viola Avenue in the City of Yakima, subject to all of the conditions contained in the Hearing Examiner's Recommendation; approving an administrative adjustment that would allow tandem parking; and authorizing the Mayor to sign the preliminary plat. *10. SET DATE OF PUBLIC MEETING FOR SEPTEMBER 17, 1991 .ON VACATION OF STREET AT SOUTH 6TH AVENUE, REQUESTED BY YAKIMA SCHOOL DISTRICT NO. 7 FOR DAVIS HIGH SCHOOL EXPANSION September 17, 1991 was set as the date of public meeting to consider the Hearing Examiner's recommendation on the Yakima School District (Davis High School) request to vacate right -of -way for 6th Avenue, and the alley between 6th and 7th Avenues, between Pine and Tieton. -2- SEPTEMBER 3, 1991 4 9 3 *11. Recreation Fund, having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE-NO. AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $3,017 in the Parks & Recreation Fund for expenditure during 1991 for an After School Recreational•Program at the Southeast Community Center. 13.
