The City Council met in session on this date at 2:00 P.M. in the , Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt,. ';:presiding; 'Councilmembers °_'Clarence Barnett, Henry Beauchamp, Lynn Buchanan., George Pechtel and Bernard Sims present on roll call. Councilmember Skip Semon present after 2:05 P.M. City Manager Zais,'; •Attorney , Vanek; City' Clerk Roberts and Deputy City Clerk Lovell also present. 2. INVOCATION /PLEDGE OF ALLEGIANCE • • The Pledge of Allegiance was led by Councilmember Buchanan. 3. EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION It was MOVED BY BUCHANAN, SECONDED BY SIMS,' 10 MOVE IN'IO EXECUTIVE SESSION REGARDING PROSPECTIVE LITIGATION FOR APPROXIMATELY TEN • MINUTES. The motion carried by unanimous voice vote; Semon absent. Council moved into Executive session at 2:05 P.M., and reconvened at 2:15 P.M. Semon present after 2:05 P.M.) 4. OPEN DISCUSSI N FOR.THE GOOD-OF THE - ORDER • None. 5. .CONSENT AGENDA . Mayor Berndt referred td the items placed on the - Consent Agenda, questioning whether, there were any additions or deletions from either Councilmembers or citizens present. It was the consensus of Council that the. deletion of ItemNo. 10, as requested, be made. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY PECHTEL, SECONDED BY BUCHANAN-, THAT THE CONSENT AGENDA,. AS READ, BE-PASSED. - The motion , :carried by unanimous .roll call vote. AUDIENCE PARTICIPATION • Mayor Berndt presented a Certificate of Appreciation to Juanita . Fitzpatrick for her efforts in nominating the City of Yakima for a Midland 'Community Spirit Award. Yakima.was recently selected as a 1991 recipient of the "award in recognition of local community efforts in the War on Drugs. Mayor Berndt and other local representatives will.attend,the' award ceremony in Washington, D.C. _ Councilmember Pechtel commented that'the City has:come:full circle, • 4 4 0 JULY 9, 1991 and he is pleased';with the success in making Yakima "Washington's Best Neighborhood.'" r: 7. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND DEBRIS ABATEMENT PROGRAM Code Administration Manager Shampine stated that he had nothing to add. - There being no one present to speak to the issue, and Resolution No. D -5959, having been read by title, it'was 1MOVED BY BUCHANAN, SECONDED BY SIMS, TO -ADOPT THE RESOLUTION.. The motion carried by unanimous roll call vote. . ' RESOLUTION NO. D -5959, A - RESOLUTION: authorizing the Code Administration Manager to clear- certain weedy lots. - *8. CONSIDERATION OF RESOLUTION ADOPTING REGULATIONS REGARDING DISINTERMENT AT TAHOMA CEMETERY RESOLUTION NO. D -5960, A RESOLUTION adopting a regulation governing disinterments at the Tahoma Cemetery. *9. NOTICE ! OF• INTENTIONL%ICY COMMENCE': ANNEXATION' OF PROPERTY IN VICINITY ' OF :WEBSTER AVENUE :AND' `MUOTH WAY,' REQUESTED BY' VORENKAMP ' '_ (STANDARD • MOTIONS A AND B) July 9 1991 was set as the time of a meeting with the initiating parties who signed a Notice of Intent to Commence Annexation Proceedings, the initiating parties being Richard J. Vorenkamp and Marilyn J. Vorenkamp. The annexation proposed by Mr. and Mrs. Richard Vorenkamp was accepted by the City of Yakima, and the area to be annexed - is required to assume its share of the City's existing indebtedness, and staff is directed to file a Notice of Intention to Annex with the Yakima County Boundary Review Board. - 10. CONSIDERATION OF RESOLUTION AUTHORIZING APPLICATION OF PUBLIC WORKS TRUST FUND LOAN FOR SEWER PROJECTS - ROUND 7 John .Klingele,, 1312 West 'Walnu't objected to _the - City's use .of long term loans to pay'for routine maintenance projects. He was opposed to • incurring ' - long 'term "debt to pay for items with a short life expectancy, and felt these projects should be paid as current expenses and budgeted annually. Engineering and Utilities Director Covell responded that this loan allows the City to leverage existing funds to complete more projects. He added that the rehabilitated facilities will have a minimum life expectancy in excess - of 50 years. City! Manager Zais_'noted that .past City practices encouraged long term debt. However, since 1976, no bond issues have extended beyond. 20 years. The payment schedule and attractive interest rate on this loan allow the opportunity to Maximize existing funds. Resolution No. - D -5961, having been read • • by title, it was MOVED BY BUCHANAN, SECONDED BY PECHTEL, TO ADOPT THE ORDINANCE. The motion carried by unanimous roll call vote. -2- JULY 9, 1991 441 RESOLUTION NO. D -5961, A RESOLUTION authorizing the City Manager to sign all applications, loan agreements and amendments, and other documents relating to Works Trust Fund collection system planning, design, and construction loan financing. *11. SET DNTE OF PUBLIC HEARING BEFORE THE HEARING EXAMINER ON AUGUST 7, 1991 ON REQUEST TO VACATE SOUTH 6TH AVENUE BETWEEN TIETON AND PINE, AND ALLEY BETWEEN 5TH AND 6TH AVENUE BETWEEN TIETON AND PINE, REQUESTED BY THE YAKIMA SCHOOL DISTRICT RESOLUTION NO. D -5962, A RESOLUTION fixing time for public hearing before the Hearing Examiner on August 7, 1991, on a petition to vacate South 6th Avenue between Tieton Drive and Pine Street and vacate alley between 5th and 6th Avenues between Tieton Drive and Pine Street. 12. OTHER BUSINESS Councilmember Pechtel questioned the chronology in the staff report of events related to the Franklin Pool Waterslide Project. City Clerk Roberts requested the appointment of a Council representative to the City's Volunteer Firefighters Pension Board. Councilmembers will make an appointment as soon as possible. EXECUTIVE SESSION It was MOVED BY BUCHANAN, SECONDED BY SEMON, TO MOVE INTO EXECUTIVE SESSION REGARDING PENDING AND PROSPECTIVE LITIGATION, WITH IMMEDIATE ADJOURNMENT THEREAFTER' TO JULY 16, 1991 AT 11:30 A.M. AT THE WASTEWATER TREATMENT PLANT. The motion carried by unanimous voice vote.
