Mayor Pat Berndt, presiding, Councilrrembers - Clarence - Barnett, Henry Beauchamp, Lynn Buchanan, ,George Pechtel, - and.Skip Semon present on roll - 'call. Councilmember Bernard Sims absent and excused. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Lovell :also present. 2. ,INVOCATION /PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Barnett. . • 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER , None. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the Consent,Agenda, questioning whether there were any additions; or .deletions frcn either Councilmembers or citizens present. There being none, the City Clerk then read the Consent Agenda items, including resolutions- and by -title. It was MOVED BY BUCHANAN, SECONDED. BY SEMON; THAT THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote; Sims absent. (Subsequent paragraphs preceded.by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) 5. AUDIENCE PARTICIPATION Robert Bounds expressed appreciation for Council support during his 16 years as a City employee. Mayor Berndt thanked Mr. Bounds for his years of service,-and wished him well in his retirement. 6. REPORT FROM TRAFFIC, ENGINEERING DIVISION REGARDING PETITION FOR SIGNAL AT 40TH AND ARLINGTON AVENUES Streets and Traffic Operations Manager Hussell-stated that staff recommends denial of the signalization request for the Arlington/ 40th Avenue intersection. Staff studied the intersection after receiving a petition frcxn Eisenhower High School parents and faculty. Mr. Hussell said this intersection did not meet any of the 11 traffic warrants required :for••installation "of ra signal. Currently,, there are 10 intersections that do meet traffic warrants that await funding.. Staff opposes this request,based upon the lack of funding, and -the fact that no warrants were met. • Diane Murphy, 6008 Scenic Drive, spoke on behalf of the Eisenhower High School PISA, .Booster . Club, teachers and students. She 4 3 4 JULY 2, 1991 requested additional data on warrants #3, #4'and #5. Mrs. Murphy represents a large citizenry`'that ' is•'deeply concerned about the situation, and she urgedCOUncil` td. take action before a serious accident occurs. Mayor Berndt asked staff to meet with Mrs. Murphy and provide her with the requested information. It was MOVED BY BUCHANAN, SECONDED BY 'BEAUCHAMP, TO ACCEPT THE STAFF RECOMMENDATION. The motion carried by 5 -1 voice vote; Pechtel voting nay. Councilmember Pechtel 'stated that community knowledge should • be considered when making a determination, and the City should address situations that are important to the community. Mayor Berndt suggested a cooperative effort between the City and the School District to solve the problem at this intersection. F . *7. CONSIDERATION OF RESOLUTION AUTHORIZING' PUBLIC FIREWORKS DISPLAY AT THE YAKIMA SPEEDWAY RESOLUTION NO. D-5957, A RESOLUTION granting' the permit for the public display'of fireworks to Pyro Spectaculars, Inc. *8. - CONSIDERATION OF RESOLUTION ADOPTING AN AMENDED INVESTMENT POLICY FOR THE CITY OF YAKIMA RESOLUTION ' NO. D -5958, A RESOLUTION revising the City of Yakima • investment policy for public funds. *9. SECOND READING OF AN ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR YAKIMA SCHOOL DISTRICT NO. 7 AFTER SCHOOL • PROGRAMS • -An Ordinance: amending the 1991 budget and appropriating funds for after school `programs ' fo°r Yakima School ' District 'No. " 7; having been read by title Only at the meeting, was brought before the Council for a second reading. ORDINANCE NO. 3376, AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $41,591 in the Parks and Recreation Fund for expenditure during 1991 for an after school program for at -risk youth. *10. SECOND READING OF AN ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR A SUMMER PROGRAM FOR THE DEVELOPMENTALLY DISABLED SPONSORED BY YAKIMA COUNTY DEPARTMENT OF COMMUNITY SERVICES AND YAKIMA SCHOOL DISTRICT NO. 7 • An Ordinance amending the 1991 budget and appropriating funds for a summer program for the developmentally disabled sponsored by Yakima County Department of Community Services and Yakima School District No. 7, having been read by title only at the previous meeting, was brought before the Council for a second reading. • ORDINANCE '3377, 'AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $9,936 in the Parks and Recreation Fund for expenditure during 1991 for a summer recreation youth program for disabled children. *11. SECOND READING OF ORDINANCE AMENDING THE 1991 BUDGET AND APPROPRIATING FUNDS FOR THE WASTEWATER FACILITY CONSTRUCTION -2- JULY 2, 1991 4 3 5 PROJECT . • • _ • An Ordinance amending-the 1991 budget and appropriating funds for the Wastewater facility construction project, having been read by title only at the previous meeting, was brought _before the Council for a second reading. ORDINANCE 3378, AN ORDINANCE amending the 1991 budget for the City of Yakima; making - appropriations for the Wastewater-Facilities Construction Project from Unappropriated Fund Balances •within various Funds for expenditure during 1991. 12. OTHER BUSINESS • It was MOVED BY - PECHTEL, - SECONDED - BY BEAUCHAMP TO APPOINT WARREN VAN HOOSE 1i0 THE'LOCAL REVIEW BOARD FOR HISTORIC -- PRESERVATION, TO FILL THE UNEXPIRED TERM OF FRANCES HARE. The motion by unanimous voice vote; Sims absent. Assistant City Attorney Paolella advised Council of a new state law prohibiting outdoor burning, and its impact on the City. He explained that the Clean . Air Act of 1991 was adopted by emergency declaration, effective May 15, 1991. Section 402 outlaws outdoor burning in certain areas of the state, including (1) areas that violate federal or state clean air quality standards; (2) areas within urban growth boundaries as defined under the Growth Management Act; and (3) cities of 10,000 population or greater that threaten to exceed air quality standards. Mr. Paolella said the Yakima County Clean Air Authority and the Department of Ecology are responsible for enforcement of clean air standards. Mayor Berndt suggested a cooperative effort between local jurisdictions to ensure that all parties, follow the • • Same rules. Councilmember Beauchamp suggested that it is time for the City to begin challenging some of- the regulations that are enacted at the federal and state levels. The Legal staff will return, to Council in the near future with an ordinance that will conform the- :Municipal.Code and the. adoption of the Uniform Fire Code to the new state law. Councilmember Barnett requested that staff schedule a meeting with other local jurisdictions before the ordinance is adopted. Councilmember Buchanan requested that a . boundary'map - be included -with the ordinance. City Manager ,Zais reported that the 1991 -92 State Budget includes funding for a City criminal justice facility. The project requires $1.5 million in local funds to match the $3 million, state award. Staff will begin•work• immediately on - planning and siting determin A joint planning report will "be prepared for this facility and the public safety /fire facility needs approved in the 1991 Budget. Mr. ,Zais said that Council will determine whether to combine the fire and police projects into one public safety facility bond issue. These will not be Councilmatic bonds, • and will be put to a popular vote. -3- -- 4 3 6 JULY 2, 1991 Councilmember Barnett asked that the proposals include the option to consider the facilities as separate bond issues. Councilmember Barnett asked if the County has reconsidered a joint jail facility in light of this recent award.
