BUSINESS MEETING
JUNE 25, 1991
1. ROLL CALL
•
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Councilmembers Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, George Pechtel, Skip Semon and'Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek,
and City Clerk Roberts also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Invocation was given by Councilmember Beauchamp.

4. CONSENT AGENDA
•
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or. deletions from
- either Councilmembers or citizens present. ; It was the general
consensus that Items Nos. 11 and 14 be removed from the Consent
Agenda. The City Clerk then read the Consent Agenda items,
as amended, including resolutions and ordinances by title. It was
MOVED BY SIMS,. SECONDED BY BUCHANAN, THAT CONSENT AGENDA, AS
READ, BE PASSED. The motion carried by unanimous roll call vote.

7. PUBLIC MEETING TO CONSIDER HEARING EXAMINER RECOMMENDATION ON
VACATION OF ALLEY BETWEEN NORTH 1ST STREET AND NORTH FRONT STREET,
AS REQUESTED BY YAKIMA COUNTY (SEE ORDINANCE VACATING ALLEY)

This being the time set for a public meeting on the vacation of an
alley , ',-requested by Yakima County;:.Dan Valoff, City
Planner, stated Yakima is proposing to vacate the alley
between North Front Street and North First Street and East "A"
Street and East Lincoln Avenue for the purpose of constructing a
200 bed special detention facility. The request is to also approve
. the Class 3 use of a special detention facility. The utilities
located within these alleys will be relocated or abandoned, as
appropriate, by the utility company. Mr. Valoff , responded to
Council's questions and concerns regarding the use of dry wells,
utility relocation, and parking. Mayor Berndt opened the public
meeting for public testimony, after Councilmembers declared there
had been no outside contact regarding this application. Dan Hesse,
Yakima County Public Works Director, stated the County wants to
build a special detention facility to accommodate approximately 200
people. The alley has to be vacated so they can build over it.
The telephone, and electric lines will be placed underground.
iCouncilmember Sims inquired,if' the State has provided adequate
funds to build this facility. County Commissioner Deccio responded
the County has $2.6 million to build a 200 bed facility, however,
they don't know if they can do it for that amount of money. They
will 'build a facility even if they have to downTthe ' amount of
beds. City Manager Zais asked if the design would accommodate
expansion in the future. Mr. Hesse stated that it does not at the
present, but if the funds allow to design for expansion, they would
consider it. There being no other citizen wishingito speak. to this- -
issue, the public meeting was closed. Ordinance No. 3373 having
been read by title, it was MOVED BY BUCHANAN, SECONDED BY PECHTEL,
THAT THE'ORDINANCE BE PASSED. The motion carried by unanimous roll
call 'vote.
• ORDINANCE 'NO. 3373, AN ORDINANCE vacating two'alley rights -of -way
located between North Front Street and North 1st Street and between
East "A" Street and Lincoln Avenue, and approving Class 3
Application for special detention facility, all subject to all of
• ' the conditions contained in the Hearing Examiner's Recommendation. - •
8. CONSIDERATION OF RESOLUTION RELATING TO HAZARDOUS VEGETATION AND
DEBRIS ABATEMENT PROGRAM
Bob Shampine, Code Administration Manager, removed an address from
the abatement list, •809 South pith Avenue,, _ stating that 'Tot had
been cleared. It was noted that the first address on the list had
also been cleared, as.indicated in the staff report. Donald
Katnmerzell,"1807 So. 10th Avenue, addressed the Council regarding
the residence at 2603 Powerhouse Road which belongs to his Mother.
He' stated he started cleaning the lot and is almost complete.
Mr. Shampine assured him that staff can't take any abatement action
for ten days and if it is - clear by that time, they won't take any
further action. Councilmember Pechtel asked if this program would
�'. apply : - to the lot at 3rd - and Yakima Avenues; which used to be the
• • parking for''the Jed's:building? Resolution,No. D- 5939, having been
read by title, it was MOVED BY'BUCHANAN, :BY'SIMS, THAT THE

9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF INTERAGENCY
AGREEMENT WITH DEPARTMENT OF ECOLOGY FOR ASSISTANCE IN THE
VISIONING YAKIMA 2010 PROJECT
Mayor Berndt 'stated she is proud of this effort and thought staff
should have an opportunity to speak about this agreement. Chris
Waarvick, Wastewater Superintendent, stated that in March - he was
contacted by Joan -Pelley of the State Department of Ecology,
interested in `what we are doing with our Visioning 2010 Project.
They are granting funds to assist in publication and other costs.
Mayor Berndt reported that Assistant City Manager Stouder spoke at
a'seminar at AVE about this project and people were very interested
in what we were doing. Resolution No. D- 5940, having been read by
title, it was .. MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE
RESOLUTION BE ADOPTED. The motion carried by unanimous roll call
vote.
RESOLUTION NO. D-5940, A RESOLUTION authorizing execution of an
interagency agreement with the Washington State Department of
Ecology for assistance in the Visioning Yakima 2010 Project.:
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT
AMENDMENT WITH GARY HALL AND ASSOCIATES FOR ASSESSMENT FOR ASBESTOS
' AT`PUBLIC WORKS I' .
RESOLUTION NO. D -5941, A RESOLUTION authorizing the City Manager
and the City Clerk of Yakima to execute an amendment to the
Agreement with Hall Engineering Associates, for - professional
• services.
11. CONSIDERATION OF :RESOLUTION APPROVING APPLICATIONS FOR FIREWORK
- STANDS
Councilmember Semon shared his concerns about continuing to allow
fireworks within the City limits. Now that we have an opportunity
to have a community -wide subsidized celebration for the 4th of
July, fireworks should be eliminated in the City. He realizes
people use this as fund raisers,-but he is now advising them that
he is going to try to eliminate fireworks in the City.
Councilmember Buchanan stated:-that .fireworks are prohibited,
Council would have to think about enforcement. Fire Chief Beeson
stated there has been a reduction in fireworks related incidences,
however, part of* that is due to the reduced time allowed for
fireworks. Mayor Berndt suggested approaching the County for a
broader -based effort. .Councilmember Barnett stated the City should
allow for adequate public' hearing on this proposal. Resolution

contract with Brown and Caldwell Engineers, Inc. for professional
engineering services examining treated wastewater sludge and other
treatment residuals management.

AIRPORT GRANT - .AMENDMENT •
RESOLUTION NO., D -5944, A RESOLUTION authorizing, ratifying, and
adopting Amendment Number 1 to Grant Agreement for federal
assistance, between the Federal Aviation Administration, and the
Yakima Air Terminal Board for project number 3 -53- 0089 -11.
14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CABLE TV
PROFESSIONAL' SERVICES CONTRACT <
Councilmember Semon stated he has questions about this contract,
including_ whether we need to have a document prepared that details
the advances of technology in the cable business. He requested
this item be postponed until Wendy Warren, Cable TV Manager, is
available to respond to his questions. It was MOVED BY SEMON,
SECONDED BY BUCHANAN, TO DEFER `THIS FOR:THREE WEEKS. The motion
carried by unanimous voice vote.

* 15. CONSIDERATION OF RESOLUTION AUTHORIZING ADVANCEMENT OF CITY FUNDS
FOR DOMESTIC WATER MAIN CONNECTIONS IN THE FAIRVIEW -SUMAC - AREA
RESOLUTION NO. D -5945, A RESOLUTION certifying existence of an
emergency situation and authorizing advancement of City funds for
the immediate' connection of domestic water mains to houses. within
the Fairview -Sumac area.
* 16. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
ST. ELIZABETH MEDICAL CENTER FOR PREVENTATIVE HEALTH CARE SERVICES
TO CITY EMPLOYEES
RESOLUTION NO. D -5946, A RESOLUTION authorizing the execution of an
agreement with St. Elizabeth Medical Center to provide certain
preventive health care services to City employees.

*27. CONSIDERATION OF ORDINANCE IMPLEMENTING A VOLUNTEER FIREFIGHTERS'
RELIEF AND PENSION ACT
ORDINANCE` -' NO. " - 3375, AN ORDINANCE relating to administration;
implementing the Volunteer Firefighters' Relief and Pension Act;
establishing a local Board of Trustees to administer said Relief
and Pension Act; and enacting Chapter 1.91 as a new chapter of the
City of Yakima Municipal Code.

An Ordinance amending the 1991 Budget and appropriating funds for
wastewater facility construction project, having been read by title
only, was laid on the table for one week until July 2, 1991.
29. OTHER BUSINESS
City Manager Zais commented that several staff members and the
Council met with representatives from Fire District No. 10
(Fruitvale) to discuss their concerns about the transition of that
District into the City. Thirteen individuals from that District
volunteered to serve on the City's Auxiliary Force, and there are
others who have not yet made a decision to join. The Fire
District Commissioners had also expressed concern about the
defibrillator service they provide, but not offered by the City.
Chief Beeson will be coming to the Council with a request for
support and legislation to implement this program, using EMS levy
funds. One of the best ways to help in the transition is to hire
their two staff members on a temporary basis to prepare their
records for .transition to the City. The District Chief can also
help with the training of the Auxiliary Force, and definitely with
recruitment. The Chief is eligible for re- instatement as a
dispatcher. Councilmember Sims expressed a desire to see Council
recognize those individuals who volunteered for the Fruitvale Fire
District. Chief Beeson suggested a plaque be prepared, to be
placed at the station, which describes the history of their
organization at the time the District was being dissolved. Mayor
Berndt stated that staff can follow through on this suggestion. .
Councilmember Pechtel pointed out there is an article in Sunset
Magazine about the City's downtown trolleys. The public is
increasingly taking advantage of the free trolley rides.
Councilmember Barnett asked if Council would eventually get a
report on the downtown trolleys similar to the fixed route report
on the cost per mile and cost per passenger? Mr. Haddix replied
that Council will receive that information it a.monthly• report.

Mayor Berndt reported on the AEC Conference she, Dick 'Zais, Fred
Stouder, and.MarketarOliver attended. She reported on a new State
law which will ban outdoor burning in urban areas, to be effective
this September. Legislation will have to be adopted by the Council
to comply with, this., new, law ti , She ,also, reported that - businesses
with'.:: over. 10V :'
employees will, have'to ,have:, a, commuter :system in
place to reduce'commuter trips by'15°%' by 1995.''She ,stated she
can't see working in Yakima. AWC can send Kathleen Collins
here to speak to Council on this issue, and if she comes, the State
Legislators should be invited to attend. AWC suggested the City
request an exemption from this law. City Manager Zais reported on
new legislation from the national level. The Federal Government is

going to beorcing local governments to pay for services, i.e. the
Clean --Air Acts: There - will- be more action on the Stormwater Act,
the Water Quality Act, and the Americans With Disabilities Act.
AEC has suggested the cities stop accepting these laws without some
resistance. Marketa Oliver reported on the session she attended
'regarding recycling. City Manager Zais reported that Councilmember
Pechtel was one of three councilmembers across the state who was
- approved by the --AEC Board for -referral -to the Governor--for

consideration of appointment to the Public Works Trust Fund Board.
