CITY OF YAKIMA; WASHINGTON
BUSINESS MEETING
JUNE 11, 1991
1. ROLL CALL.
The City Council met in session on this date at 2:00 P.M. in the
Council. Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Councilmembers Clarence Barnett, Lynn Buchanan,
George Pechtel, Skip Semon and Bernard Sims present on roll call.
•Councilmember Henry Beauchamp absent and excused. City. Manager
Zais, City Attorney Vanek, City Clerk Roberts - ar'id Deputy City'Clerk
Lovell also present.
2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by City Manager Zais.

3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
- Councilmember Barnett said that the Washington Army National Guard
Band will present a free family concert at Sunfair Park tomorrow
night at 7:00 P.M: The public is invited to attend.
4. CONSENT AGENDA •
Mayor Berndt referred to'the items*placedon.the Consent Agenda,
questioning whether there were any additions or deletions from
either Councilmembers or,citizen present. It was'the consensus of
Council that the addition:,' of Item No. 8, as requested, be made.
The City Clerk then read the Consent Agenda items, including
resolutions and..'orainances by. title. It was MOVED BY SIMS,
SECONDED BY'BUCHANAN; THAT THE CONSENT AGENDA, AS READ, BE PASSED.
The motion carried by unanimous roll call vote; Beauchamp absent.
(Subsequent paragraphs preceded by an asterisk ( *) indicate items
on the Consent Agenda handled under one motion without further
discussion.) .
*5. APPROVAL OF THE MINUTES OF THE MAY 21, 1991 ALJOURNE15 AND BUSINESS
MEETINGS AND MAY 28,. 1991 ADJOURNED MEETING
The - Council minutes - of the May 21, 1991 Adjourned and . Business
, meetings .and.the May 28,.'..1991 Adjourned`, meeting were ;approved,
having been duly certified accurate by two Councilmembers and no
one present wishing to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
Justine Weatherford, 6 North 6th Avenue, requested repair of
sidewalks near the Sun Tower Retirement Home. Mrs. Weatherford
fell and was injured on the sidewalk last week; her husband
distributed a photograph of her injuries. Streets and Traffic
Operations Manager Hussell advised Council that temporary repairs

were made after this incident, and,this.; area is scheduled for
permanent repair this summer..
Larry Mathews, 805 South 17th Avenue, requested additional funding
for the Dial -a -Ride program, to prevent a reduction in service to
nursing homes. Mr. Mathews suggested that funding for downtown
trolley service could have been better spent on the Dial -a -Ride
program. Elizabeth Ainsworth, 4902 Viewland, spoke in support of
the request for increased funding. Councilmember Buchanan
observed that the budget for Dial -a -Ride has increased and service
has been expanding every year. Councilmember Pechtel noted that
the downtown trolleys.are handicapped accessible and provide free
transportation for all segments of the population. City'Manager
Zais stated that City staff and members of the Transit Committee
have been meeting with 'representatives _from the nursing home
industry, and every effort will be made to`ireet their needs.
7. PUBLIC HEARING ON ANDREWS /HUNTER ANNEXATION (SUMMITVIEW,.BETWEEN
61ST AND 63RD AVENUES)
This being the time set for public hearing, Associate Planner Bruce
Benson had nothing to add to the staff report. Councilmember Sims
asked why the area of the annexation was not larger. Senior
Planner John Elsden said the property owners who petitioned for
annexation did not want to wait the additional 6 -12 months that
would be required for a larger annexation.
Mayor Berndt opened the public hearing and asked if there was
anyone present to speak to the issue. On behalf of the applicants,
Randy Herzog, 5405 Bristol Way, spoke in favor of the annexation.
Russ Thomas, a nearby property owner, asked about plans for future
development of the property. Mayor Berndt stated that development
is not being considered at this hearing, and the zoning will remain
unchanged. Roberta Byrne, 109 North Shamrock, said she is
- concerned,that the property will be developed, for.. commercial use.
Mayor Berndt restated that the R -1 designation will not be affected
by today's action. She encouraged interested parties to stay
involved in the process if a rezone request is submitted for the
property. Don 'Hovis, 6212 Summitview, said he understood that
Yakima County had already denied a rezone applidation, and that
prompted the property owners to petition for annexation. Mayor
Berndt said the City and County use the same Hearing Examiner, and
the same decision would be reached for either jurisdiction. There
being no further comments, Mayor Berndt closed the public hearing.
Ordinance No. '3372, having been read by title, it was MOVED BY
SIMS, SECONDED BY BUCHANAN, TO - ADOPT THE ORDINANCE. The motion
carried by unanimous roll call vote; Beauchamp absent.
ORDINANCE NO: 3372, AN ORDINANCE annexing property to the City of
Yakima and zoning said property.

adopting Amendment No. 1 to the grant agreement for federal

LOUNGE AT 607 E. YAKIMA AVENUE, REQUESTED, BY CAVANAUGH'S
The Right -of -Way Use Permit for a walkway awning at Johnny's Lounge
at 607 E. Yakima Avenue, requested by Cavanaugh's, was approved.
. *13. RESET DATE OF PUBLIC MEETING TO JUNE 25, 1991 TO CONSIDER HEARING
EXAMINER RECOMMENDATION ON'VACATION OF ALLEY BETWEEN NORTH 1ST
STREET AND NORTH FRONT STREET, "AS REQUESTED BY YAKIMA COUNTY
June 25, 1991 was set as the date of public meeting to consider the
Hearing Examiner's recommendation on the vacation of an alley
between North 1st Street and North Front Street, as requested by
Yakima County.
*14. APPROVAL OF MAY 1991 BUDGET REPORT -

15. OTHER BUSINESS
City Manager Zais requested that Council officially designate
voting delegates to the AWC conference next week. It was MOVED BY
SIMS, SECONDED BY SEMON, '10 DESIGNATE BERNDT, CITY MANAGER
ZAIS AND CITY ATTORNEY VANEK 'AS VOTING DELEGATES TO THE ANC
CONFERENCE. The motion carried by unanimous voice vote;
Beauchamp absent.
