BUSINESS MEETING
• 1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council' Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Councilmembers Clarence Barnett, Henry
Beauchamp, Lynn Buchanan, George •Pechtel, Skip Semon and Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek,
and Deputy City Clerk Lovell also present.

2. INVOCATION /PLEDGE OF ALLEGIANCE
The Pledge of Allegiance'wastled by °Councilmember Pechtel.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
None.
4. CONSENT AGENDA .
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning' whether there were any additions or deletions from
either Council members or citizens present. It was the consensus
of •Council that the addition of Items No. 6, 7 and 14 and the
deletion of Item No. 10, as requested, be made. The Deputy City
Clerk then read the'Consent Agenda items, including'resolutions and
ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN,
' THAT THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by
unanimous roll call vote. ' (Subsequent paragraphs preceded by an
asterisk ( *) indicate items. on the Consent Agenda handled under
one motion without further discussion.)

5. AUDIENCE PARTICIPATION
Mel Wagner, representing the Board of Directors of the Yakima
July 4th Committee, described•the festivities planned for a free,
old- fashioned •community celebration. Plans call for activities and
entertainment during the day; followed by a fireworks display in
the evening. The focus of the celebration will be military
veterans and youth, with special recognition for Bravo Company.
Mr.' Wagner'stated that the celebration will be funded by donations
from local businesses and the sale3of buttons. The committee
requested assistance from the City in the form of free shuttle
service to the Fairgrounds. It was MOVED BY BARNETT, SECONDED BY
BEAUCHAMP, TO`DIRECT STAFF TO PREPARE THE NECESSARY LEGISLATION FOR
THE CITY TO' PROVIDE FREE "SHUTTLE SERVICE TO THE 4TH OF JULY
CELEBRATION.' The motion carried by'unanimous voice vote.
Mayor Berndt read a proclamation designating May 17 -18 as Poppy
Days. The proclamation was accepted by Irene Raptchoff.
Mayor Berndt read a proclamation designating May 15th as Transit
Appreciation Day. Acting Transit Manager Haddix introduced Arlene

Frasu, the 1990 Transii''Operator of)the Year, who accepted the
proclamation on behalf the Yakima Transit Operators.
Mayor Berndt read a proclamation designating May 19 -25 as National
Public Works Week. The proclamation was accepted by Engineering
and Utilities Director Covell and Public Works Director Copeland.
. Larry Mathews, 805 South 17th Avenue, expressed concern with the
City's failure to fill staff vacancies in the Fire Department and
the reduction in the size of fire fighting crews.
Phil Pleasant, 701 South 7th Avenue, criticized the lack of
representation by blacks in the First Quarter` CIP Engineering
Report. He also suggested that the Council address airport access
if they hope to encourage economic development in Yakima.

*6. CONSIDERATION OF RESOLUTION PERMITTING EXPANSION OF THE GILBERT
PARK PARKING LOT AND GRANTING A NON- EXCLUSIONARY LICENSE
RESOLUTION NO. D -5912, A RESOLUTION authorizing the expansion of
the Gilbert Park parking lot and granting a nonexclusive license
for its use to the Allied Arts Council of the Yakima Valley, Inc.
*7. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION. OF AGREEMENT WITH
THE YAKIMA AREA ARBORETUM, INC. FOR DEVELOPMENT AND. MAINTENANCE OF
THE YAKIMA ARBORETUM
RESOLUTION NO. D -5913, A RESOLUTION authorizing the City Manager
' and'-'City Clerk to execute an agreement with the Yakima Area
Arboretum, Inc: for development 'and " maintenance"of' the Yakima
Arboretum and terminating the =former agreement between the City,
the Yakima Area Arboretum, Inc., and the Yakima River Regional
Greenway Foundation.
*8. NOTICE OF INTENTION TO COMMENCE WEST CHESTNUT /SO. 72ND AVENUE
ANNEXATION PROCEEDINGS (STANDARD MOTIONS A AND B)
May 14, 1991 was set as the time of a meeting with the initiating
parties who have signed a-Notice of Intent to Commence Annexation
Proceedings, the initiating parties' named in Petition No. 1122,
numbering 74.
The annexation proposed by the signing Petition No. 1122,
was accepted by the City of Yakima, and the area to be annexed was
required to assume its share of the City's existing indebtedness,
' and' Notide Intentionoto Annex was directed to be filed with
the Yakima` County Boundary Review Board; , i-

May 14, 1991 was set as the time of a meeting with, the initiating
parties who have signed a Notice of Intent to Commence Annexation
Proceedings, the initiating parties named in Petition No. 1121,
numbering 30.

The annexation.proposed by the parties signing Petition No. 1121;
was accepted by the City of Yakima, and the area to be annexed was
required to assume its share of the City's existing indebtedness,
and a Notice of Intention to Annex was directed to be filed with
the Yakima County Boundary_ Review Board.
10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF.MODIFICATION
OF THE CAPITOL THEATRE OPERATING AGREEMENT •
Phil Pleasant,:701 South 7th Avenue, objected to additional funding
for the.CapitolTheatre, citing a lack of staff support for black
programming. It was MOVED BY SIMS, SECONDED BY SEMON;' TO ADOPT THE
• RESOLUTION. The motion carried by unanimous roll call vote.
RESOLUTION NO. D -5914, A RESOLUTION authorizing execution of the
1991 Modification of Capitol Theatre Operating Agreement. .
*11. CONSIDERATION OF RESOLUTION DECLARING FREE DOWNTOWN TROLLEY BUS
SERVICE . I
RESOLUTION NO. D5915, A RESOLUTION declaring downtown trolley bus
service fare
*12. APPROVAL OF 1990 TRANSIT DIVISION ANNUAL REPORT
The 1990 Transit Division Annual Report was accepted.

A. FIRST QUARTER 1991 CENTRAL BILLING REPORT
The First Quarter 1991 Central Billing Report was accepted.
B. APPROVAL OF APRIL 1991 BUDGET REPORT
The April 1991 Budget Report was accepted.

*14. CONSIDERATION OF LEGISLATION REGARDING PURCHASE OF CHESTNUT MANOR
FOR ELDERLY HOMEOWNERSHIP PROGRAM:
A. ORDINANCE AUTHORIZING EXECUTION OF PURCHASE AGREEMENT
ORDINANCE NO.- 3359, AN ORDINANCE of the Council of the City of
Yakima, Washington, authorizing 'the purchase of an apartment .
building in the City for the purse of historic preservation to be
used .for the development of a program for ownership of such
apartments by lbw- income elderly or handicapped residents and
establishing the elderly homeownership program. •
B. -FIRST READING OF ORDINANCE' AMENDING. THE COMMUNITY DEVELOPMENT

• An Ordinance amending the Community Development Fund and
appropriating funds for the elderly homeownership program, having
been read by title only, was laid on the table for one week, until
May- 21,=' 1991.

COUNCILMEMBER DISTRICTS
ORDINANCE NO.73360, AN ORDINANCE relating to city government
administration; designating and describing City Council Election
Districts by the adoption of an election district map; assigning
. City .' Council "district position numbers "; and 'amending Chapter
- 1.04, "City Council Election Districts," .and Sections 1.04.010,
1.04.020, and 1.04.030 of the City of Yakima Municipal Code.

*17. CONSIDERATION OF AN ORDINANCE AMENDING THE .CLASSIFICATION AND
COMPENSATION PLAN FOR CERTAIN CITY EMPLOYEES (ASSISTANT I.D. TECH
AND SUPERVISING CODE INSPECTOR)
ORDINANCE N0.•3362,. AN' ORDINANCE relating to "City personnel;
adopting a classification and compensation plan for City employees
to be effective June 16, 1991; amending Subsections 2.20.100 A,
2.20.100 C, 2.20.110 A, and 2.20.110 F, all of the City of Yakima
Municipal Code.
18. OTHER BUSINESS
Public Works. Director Copeland reviewed : the bid received for
trolley operator service, and showed a comparison to service that
could be provided by City forces: It MOVED BY` SIMS, SECONDED
BY BEAUCHAMP_,'1O`AUTHORIZE STAFF °'TO BE 1 SPONSIBLE
DRIVING FOR -+ THE QOMING•YEAR. The motion carried by unanimous voice
vote.

SESSION REGARDING PERSONNEL, PROPERTY ACQUISITION, AND COLLECTIVE
BARGAINING, WITH IMMEDIATE ADJOURNMENT THEREAFTER TO MAY 21, 1991,
11:30 A.M. AT PUBLIC WORKS COMPLEX. The motion carried by
unanimous voice vote.
20. ADJOURNMENT
Following. the completion of the Executive Session, the meting was
adjourned at 3:40 P.M.
