ROLL CALL The City Council met in session on this date at 2:00 P.M. in the Council Chambers of City Hall, Yakima, Washington. Mayor Pat Berndt, presiding, Council members Clarence Barnett, Henry Beauchamp, Lynn Buchanan, George Pechtel, Skip Semon and Bernard Sims present on roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy. City Clerk Lovell present. 2. .'PLEDGE OF ALLEGIANCE • • The Pledge of Allegiance was led by City Attorney Vanek. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER • • Councilmember Buchanan cited the :large volume of construction he • has seen while flying, and :agreed with the Code Administrator's 'commentsthat the, construction industry is thriving in, Yakima. 4. CONSENT AGENDA • f . i .•r �, ..r, _ T . • Mayor Berndt referred to the items .placed on -the Consent Agenda, questioning' whether there were any additions or deletions from either Council members or citizens present. There being none, the City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE PASSED. The motion carried by unanimous roll call vote., (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent. Agenda handled F' under one motion - without further discussion.) *5. APPROVAL OF THE MINUTES OF THE APRIL 16 AND 26, 1991 ADJOURNED MEETINGS AND APRIL'16 AND 23, 1 - 991 BUSINESS MEETINGS • The Council•minutes of April 16 and 26, 1991 Adjourned meetings and April 16 and 23, 1991 Business meetings were approved, having been duly certified accurate by two Council members and no- one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION - - - • 2 .) Mayor'' 'Berndt read, a , . proclamation - designating May , : ,11 -12, 1991 as . "Yakima Air Fairc.International;" and. -extended-greetings to all participants. The proclamation was accepted by•Larry.[nlest. • Capitol Theatre Director Steve Caffrey read a proclamation designating May 5-11, 1991 as "Yakima Valley Tourism Week." Bob Van Dyke, firefighter for the City of Yakima, expressed frustration that - a manpower shortage in the department resulted in the" denial. of two Pension Board Members' attendance at a LEOFF AAD /1 332 MAY 7,1991 seminar. Since a final decision was reached at the administrative level, Mr. Van Dyke was advised that the Council meeting was not the proper forum for'discussion. City Manager Zais clarified that it is the responsibility of the administration to decide haw to man, staff and administer the department. Chief Beeson reassured Council that the department is adequately staffed to perform all necessary functions. 7. PUBLIC MEETING TO CONSIDER HEARING EXAMINER DECISION ON VACATION OF RIGHT -OF -WAY IN VICINITY OF SOUTH 2ND AVENUE, CHESTNUT AND WALNUT AVENUES, REQUESTED BY ESD #105 (CONTINUED FROM 4/23/91) This being the date set for public meeting, Associate Planner Dan Valoff reviewed the new map provided to illustrate the area under consideration. He explained that the vacation will not change the curb line or the street. Mayor Berndt opened the public meeting and asked if there was anyone present to comment on the issue. Jerry Henderson, Chief of Operations for Yakima Trolleys, stated that his organization has no objection to the vacation request since it will not impact the future use of the trolley tracks. There being no additional comment, Mayor Berndt closed the public meeting. Ordinance No. 3357, having been read by title, it was MOVED BY SIMS, SEOONDED BY . BEAUCHAMP, TO The motion carried by unanimous roll call vote. ORDINANCE NO. 3357, AN ORDINANCE vacating an eight and one -half foot wide strip of public right -of = way located'on the east side of South 2nd Avenue between Walnut Street and Chestnut Avenue, subject to all of the conditions contained in the Hearing Examiner's Recommendation. " 8. 1POBLIC HEARING''ON CITY COUNCIL REDISTRICTING BOUNDARIES This being the date set for public hearing, Supervising Associate Planner Joan Davenport explained that redistricting is required by City Charter whenever a new Census is complete or the population difference between any two districts exceeds 1O%. Mrs. Davenport outlined three possible' options for redistricting. Council boundaries, all of which keep existing voting precincts intact. Mayor Berndt opened the public hearing and asked if there was anyone present to comment on the issue. .john Klingele, 1312 West Walnut, spoke in favor of Option 2, which he felt had the most even lines and provided the best balance for future annexations. There being no additional comment, Mayor Berndt closed the public hearing and asked for Council direction. Councilmember Barnett stated that he favored Option 2 since it meets the established "- criteria and has the least variance in population. It was MOVED BY BARNETT, SECONDED BY BEAUCHAMP, "TO ADOPT OPTION 2 AND DIRECT STAFF TO PREPARE' THE NECESSARY LEGISLATION. The motion carried by unanimous voice vote. *9. NOTICE OF INTENTION TO COMMENCE MIDVALE ROAD /SO. 72ND AVENUE ANNEXATION PROCEEDINGS (STANDARD MOTIONS A AND B) May 7, 1991 was set as the time of a meeting with the initiating parties who have signed a Notice of Intent to Commence Annexation Proceedings, the initiating parties numbering 38 listed in Petition AAD /2 MAY 7, 1991 3 3 3 No. 1120. The Annexation proposed in Petition No. 1120 was accepted by the City of Yakima, and the area to be annexed was required to assume its share of the City's existing indebtedness, and a Notice of Intention to Annex was required to be filed with the Yakima County Boundary Review Board. *10. NOTICE OF INTENTION IO COMMENCE EAST VIOLA/FRONTAGE ROAD ANNEXATION PROCEEDINGS (STANDARD MOTIONS A AND B) . May 7, 1991 was set as the time of 'a meeting with the .initiating party who signed a Notice of Intent to Commence Annexation Proceedings, the initiating party being Concord Assets Group, Inc. / River's Edge Plaza Associates, L.P. ' The Annexation proposed by the above party was accepted and the area to be annexed was , required to assume its share of the City's existing indebtedness, and a Notice of Intention to Annex was required to be filed with the Yakima County Boundary Review Board. *11. .CONSIDERATION OF RESOLUTIONS AUTHORIZING SALE,OF SURPLUS PROPERTY: A. PUMPER FIRE TRUCK AND ACCESSORY EQUIPMENT RESOLUTION NO. D -5908, A RESOLUTION authorizing the 'sale of surplus personal property owned by the City. B. POLICE VEHICLE RESOLUTION NO. D- 5909, A RESOLUTION authorizing the sale of a surplus police_ car to the City of Moxee. *12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF PROFESSIONAL SERVICES AGREEMENT WITH SUSAN WEBB TO LEAD WORKSHOP FOR CITY EMPLOYEES ON SEXUAL HARASSMENT RESOLUTION NO. D -5910, A RESOLUTION authorizing the execution of a personal services agreement with Susan Webb. *13. CONSIDERATION OF RESOLUTION AUTHORIZING MODIFYING THE CITY TREASURER'S CHANGE AND PETTY. CASH FUND TO PROVIDE PETTY CASH FUND TO HOUSING SERVICES CENTER AND REBOUND PLUS OFFICE, RESOLUTION NO. D -5911, A RESOLUTION 'amending Resolution No. D -5844, adopted November 13, 1990, and authorizing the existence of a City Treasurer's Change Fund, and other petty cash funds, within the General Fund of the City of Yakima. *14. APPROVAL OF FINAL CONTRACT PAYMENT FOR NACHES RIVER WATER TREATMENT PLANT (STANDARD MOTION V-B — ACCEPT CONTRACT AND APPROVE FINAL PAYMENT) ' The report from the City Engineer dated April 24, 1991, with respect to the completion of the work on the Naches River Water Treatment Plant, performed by Diamaco, Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized.. AAD /3 ' MAY 7, 1991 3'� *15. APPROVAL OF FIRST QUARTER 1991 CAPITAL IMPROVEMENT PROTECTS ENGINEERING REPORT The First Quarter 1991 Capital Improvement Projects Status report, was accepted. • *16. APPROVAL OF FOURTH QUARTER 1990 CENTRAL BILLING REPORT •The Fourth Quarter 1990 Central Billing Accounts Receivable status report was accepted. *17. SECOND READING OF. AN ORDINANCE AMENDING THE 1991 TRANSIT CAPITAL FUND, APPROPRIATING FUNDS FOR PURCHASE' OF TROLLEYS An Ordinance amending the 1991 Transit Capital Fund and appropriating funds for the purchase of four trolleys, having been read by title only at the April 23, 1991 meeting, was brought before the Council for a second reading. ORDINANCE NO. 3358, AN ORDINANCE amending the 1991 budget for the City of Yakima; and making an appropriation of $5000,000 in the Transit Capital Fund for expenditure during 1991 for purchase of trolleys. 18. OTHER BUSINESS The following ballot position were drawn for the November election: Ballot Position,1:. District 4, Councilmember Pechtel. Ballot Position 2: District 3, Councilmember Buchanan. Ballot Position 3: District 2, Councilmember Barnett. Ballot Position 4: District 1, Mayor Berndt. Councilmember Semon reported on the Eastern Washington Coalition meeting he attended in Odessa. He felt the major concerns discussed by the Coalition were not.-necessarily _consistent with the priorities established by the City of Yakima. Councilmember Buchanan encouraged Council representation on the AWC Board if the City expects its agenda to be heard. Councilmember Pechtel indicated that he is willing to serve on the Public Works Trust Board. City Manager Zais will submit an application for Mr. Pechtel._ Councilmembers requested a report on the plans for the City -wide 4th of July celebration, and reminded staff that a resolution will be required to waive transit fares for the event. Councilmember Pechtel praised the firefighters who saved a child's life in a fire this morning, and suggested that Council formally recognize their heroic action. Fire Chief Beeson said his staff is, arranging a presentation to be made within two weeks. Council discussed traffic and signage concerns at 7th Avenue and Walnut, including future expansion plans at St. Elizabeth Medical Center. Councilmember Beauchamp requested that staff verify if the Medical Center parking lot is in compliance with the landscaping requirements of the Urban Area Zoning Ordinance.
