WHEREAS, by application dated June 6, 2011, Justin Gaddis and Roland McLaughlin
requested the rezone of Yakima County Assessor's Parcel No.'s 181321 -44407 and 181321-
44482, located at 424 South 49th Avenue and 423 South 501h Avenue, Yakima, Washington
(hereinafter "Subject Property "), from Two - Family Residential (R -2) to Local Business (B -2); and
WHEREAS, on August 10, 2011 the Planning Commission for the City of Yakima
conducted an open- record public hearing regarding the requested rezone; and
WHEREAS, on August 17, 2011 the Planning Commission issued Planning
Commission's Recommendation regarding RZ #009 -11 and EC #025 -11, (the "recommendation ")
recommending that the Subject Property be rezoned from Two - Family Residential (R -2) to Local
Business (B -2); and
WHEREAS, at a closed- record public hearing held on September 20, 2011, the City
Council considered the requested rezone, including the documents and other evidence which
comprise the record developed before the Planning Commission, the Planning Commission's
Recommendation, and the statements and comments of interested persons; and
WHEREAS, the City Council finds that the considerations of the Planning Commission in
response to the requirements and criteria of Yakima Municipal Code ( "YMC ") § 15.23.030(E)
are correct and appropriate, and that the same should be adopted by the City Council as its
findings herein; and
WHEREAS, the City Council finds that it is in the best interest of the City to enact the
following to approve the requested rezone, Now Therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The property located at 424 South 49th Avenue and 423 South 50th
Avenue, Yakima, Washington (Yakima County Assessor's Parcel No.'s 181321 -44407 and
181321 - 44482, legally described in Exhibit "A ", attached hereto and incorporated herein by this
reference, are hereby rezoned from Two - Family Residential (R -2) to Local Business (B -2).
Section 2. The findings within the August 17, 2011 Planning Commission's
Recommendation, (RZ #009 -11 and EC #025 -11) regarding this rezone are hereby adopted by
the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are
incorporated herein by this reference as if fully set forth herein.
Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land
use, and other similar maps maintained by the City of Yakima shall be amended or modified,
subject to the conditions stated below, to reflect this rezone.
Section 4. Severability: If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision
shall not affect the validity of the remaining portions of this ordinance.
Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this
ordinance with the Yakima County Auditor.
Section 6. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by and by the City Charter.

SUMMARY EXPLANATION: Justin Gaddis and Roland McLaughlin seek to rezone two
parcels of property from Two - Family Residential (R -2) to Local Business (B -2).
On August 10, 2011, the Yakima Planning Commission held an open record public hearing to
consider this rezone application. On August 17, 2010, the Yakima Planning Commission
• rendered its recommendation for unconditional approval of said rezone.
Attached is the legislative ordinance that will change the zoning district from Two - Family
Residential (R -2), to Local Business (B -2) if the City Council takes an affirmative action.

South 50th Avenue, Yakima, Washington. The parcel numbers are 181321-44407 &
Ill. Application. This is an application to rezone two parcels from the R-2 zonintq
district to the B-2 zoning district. The parcels are located at the northeast corner of 49t
Avenue and Tieton Drive and the northwest corner of 50th Avenue and Tieton Drive.
Both parcels contain a single-family residence and have side yards that abut Tieton

The proposed B-2 zoning of the subject properties complies with the following goals and
policies of the Comprehensive Plan:
Goal 3.11: Provide medium scale commercial uses that serve multiple
neighborhoods and residential areas
Policy 3.11.7: Adequate buffering shall be provided between adjacent
residential land uses.
Policy 3.11.8 Ro motor vehicle access to the commercial site shall be rout94'

5. Adequacy of public utilities:

according to the application, the property owners have indicated a desire to retain the
;txisting structures • the property if it can be accomplished. Therefore, any proposed
use would be small based on site specific requirements such as driveway restrictions or
landscape buffers, which will be determined at the project review level.
This request can be considered non project because any commercial development will
require separate land use review and approval before the project may proceed. As it
currently exists, the site does not comply with the zoning ordinance's developm-

the B-2 zone.

The applicants propose a rezone of two contiguous parcels of property from R-2 to B-2. Both
properties are comer lots which front at 424 South 49th Avenue and 423 South 50th Avenue,
contain single family dwellings, and have side yards abutting Tieton Drive. No project is
planned at this time. Properties to the east, west and south (across Tieton Drive) of the site are
zoned B-2 and Light Industrial (M-1) and are developed with commercial and industrial uses.
Properties to the north of the site are zoned R-2 and consist of duplexes and single-family
residences.

The project site is currently zoned Two-Family Residential (R-2). The Future Land Use Map

APPLICATION BACKGROUND
The City of Yakima and Yakima County Assessor's records indicate that the home at 424 South
49'h Avenue was constructed in 1940, and the home at 423 South 50th Avenue was constructed in
1955, while both were under Yakima County's jurisdiction. This "Glennwood" area of "West
Valley" was annexed into the City of Yakima by three separate annexations completed in the
years of 1964, 1965 and 1990. This area has been a B-2 zoned commercial node dating back as
early as 1965, and has continued to expand over the years, more recently with new commercial
buildings across Tieton Drive to the south in 2007. The small commercial node at 5015 Tieton
Drive was rezoned from M-1 and R-2 to B-2 in 2007. The previous "Little Paws Playhouse"
business at 4813 Tieton Drive was a small engine repair business in 1986, and the barber shop at
4811 Tieton Drive dates back to 1965. Following annexation, growth, and improvements to
Tieton Drive, development of additional properties in this area has continued, creating the
commercial node that exists today.
ENVIRONMENTAL REVIEW
The applicants submitted a non-project environmental checklist for this rezone on June 6, 2011.
Following a Notice of Application and 20-day comment period, a Final Determination of
Nonsignificance (DNS) was issued for this proposal on July 20, 2011. No appeal of this DNS
has been received. Subsequent project specific development proposals will be subject to
additional environmental review in accordance with the provisions of Yakima's Municipal Code
and Washington State's Environmental Policy Act.

Comments Received
A Notice of Application and Public Hearing for the proposed rezones was sent to thirty-one
adjoining property owners and 62 agencies. Two letters from the neighborhood in opposition to
the rezones were received during the 20-day comment period that ended on July 19, 2011. Cited
in these letters are concerns about the possibility of future businesses creating additional traffic,
noise, and parking in the surrounding neighborhood, the downgrading of the neighborhood, and
poor ingress and egress to the site.
REZONE REVIEW CRITERIA
Within the Yakima urban area, recommendations for approval of rezone applications are
governed by seven criteria specified in YMC § 15.23.030(D).
1. Testimony at public hearing:
Neighboring property owners have been mailed a Notice of Application and Public Hearing
scheduled before the Yakima Planning Commission, and are invited to submit written and oral
comments on the proposed amendments through the close of the public hearing. Notice of
Application was mailed June 29, 2011 to all property owners within 300 feet of the subject
properties. Upon review of the public comments received, it may be appropriate for the Planning
Commission to modify the Staff's recommendation

2. Suitability of the property for the proposed use:
Because each parcel has direct access to two public streets and their proximity to varied land
uses in the surrounding area, the property is well suited for most potential uses permitted within
the B-2 zoning district. Some of these potential uses include daycare centers, group homes,
professional offices, service agencies, banks, beauty and barber shops, bakeries, bars, and small
retail shops for books, cameras, office supplies, clothing, electronics, and fabrics. However, it
should be noted that any proposed use on the property will be limited in scope, as the overall
property is small in size, and development would be limited by lot coverage, setbacks, site
screening, landscaping and parking requirements. In addition, when development is proposed,
the zoning ordinance's standards will ensure that the project is compatible with surrounding land
uses. Permitted uses that may have compatibility issues will be processed as Type (2) or Type
(3) uses which include public notice and/or public hearing. This property is a natural fit to serve
as a potential part and extension of the B-2 zoning that currently exists along Tieton Drive
between 48th and 51St Avenues.
3. Recommendations from interested agencies:
Recommendations or comments received from interested City departments and outside agencies
did not oppose the rezone. Specific recommendations or comments from interested departments
were submitted as a result of the Development Services Team (DST) meeting held on June 22,
2011 regarding the requested rezone. Comments submitted are as follows:
a. Code Administration: Comments may be forthcoming for future development.
b. Streets and Traffic Division: No comments regarding the rezone. Comments regarding access
and sidewalk improvements will be submitted if the sites redevelop in the future.
c. Nob Hill Water Association: Nob Hill Water has no comments regarding the proposed non-
project rezone
d. Washington State Department of Ecology: Based upon the historical agricultural use of this
land, there is a possibility the soil contains residual concentrations of pesticides. Ecology
recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine
pesticides. If these contaminants are found at concentrations above the MICA clean-up levels,
Ecology recommends that the potential buyers be notified of their occurrence.
4. Compliance with the Yakima Urban Area Comprehensive Plan:
The 2006 Yakima Urban Area Comprehensive Plan Future Land Use Map 111-2 indicates
"Neighborhood Commercial" for these two lots. The Neighborhood Commercial Future Land
Use designation fully supports the Local Business (B-2) zoning classification. This rezone
proposal would bring the zoning and future land use of the property into compliance with one
another, and therefore would comply with and fulfill the future land use designation as
determined by the Comprehensive Plan.
The proposed B-2 zoning of the subject properties complies with the following goals and policies
of the Comprehensive Plan:

Policy 3.4.3: In the residential areas where commercial and residential uses are heavily
mixed, encourage the establishment of neighborhood commercial services and foster
mixed uses including retail, office and apartments. This is particularly important in areas
on South Second Street and South Third Street north of East Race Street. Discourage
commercial uses that are non-neighborhood related.
5. Adequacy of public utilities:
Both parcels are served by all necessary public facilities such as water, sewer, irrigation, natural
gas, electricity, telephone and transit. The properties have direct frontage and access onto Tieton
Drive, an arterial roadway. Additionally, the site is protected by Yakima City Police and the
Yakima Fire Department.
6. Compatibility of the proposed zone change and associated uses with neighboring land
uses:
The proposal is compatible with existing neighboring uses because commercial zoning and
development currently exists to the west, east and south of the subject properties. Although
residential properties abut this proposal on the north, the proposed Local Business zoning district
generally permits compatible uses that abut neighboring residential districts. The B-2 district is
often-times used as a buffer between arterial streets, other commercial and industrial uses and the
existing residential uses that it abuts because of the limited number of land uses that are
permitted in the B-2 zone. Compatibility will be determined for all future proposed uses based
upon Table 4-1 of the Yakima Urban Area Zoning Ordinance, and any potential incompatibilities
by proposed uses in the future will be addressed by the zoning code through normal site plan
approval. In addition, the two subject parcels are generally small in size, and according to the
application, the property owners have indicated a desire to retain the existing structures on the
property if it can be accomplished. Therefore, any proposed use would be small based on site
specific requirements such as driveway restrictions or landscape buffers, which will be
determined at the project review level.
7. Public Need/Change in Circumstance:
The public need arises from the fact that the West Valley area has experienced significant growth
over the past 10-20 years. Consequently, a need to provide the necessary commercial services
for the area has also grown. Provided that this land is rezoned it can be used for additional
commercial services for the surrounding neighborhood and the traveling public using Tieton
Drive as route to and from the area. This site provides an excellent location for infill and

expansion of the existing commercial node in this area. Approval of this application would also
prevent the need to establish a new commercial cluster in the general area because this rezone
would permit the existing cluster to expand, as anticipated by the Future Land Use Map of the
Comprehensive Plan.
This request can be considered non project because any commercial development will require
separate land use review and approval before the project may proceed. As it currently exists, the
site does not comply with the zoning ordinance's development standards for traffic circulation,
parking, site screening, landscaping and lot coverage in the B-2 zone.

The city of Yakima Planning Division has reviewed this rezone request and offers the following
conclusions:
I The Yakima Planning Commission has jurisdiction under YMC 15.23.03 )0 (C), (D) and
(E) to issue a recommendation on this rezone application to the City Council.
2. The public notice requirements of YMC Chapter 15 and 16 have been satisfied.
3. Testimony at the public hearing should be considered in determining whether this
proposal is compatible with the surrounding land uses.
4. There was no appeal of the City's issuance of a Determination of Nonsignificance (DNS)
on July 20, 2011 for the Environmental Checklist submitted with this application under
file number SEPA#025-1 1.
5. During project review, consistency of the rezone with development regulations, and with
the Comprehensive Plan under the criteria required by YMC § 16.16.020 (B) is
determined by consideration of the following factors:
a. The Neighborhood Commercial Future Land use Designation fully supports
the proposed B-2 zoning designation.
b. The density of the development is not a factor with this application,
c. Adequate public facilities are available to serve this site.
d. As this is a non-project rezone, all applicable zoning ordinance standards for
development can be deemed to be consistent with development standards of the
Zoning Ordinance. Any characteristics of any future potential uses of the
property would be subject to development standards applicable to the B-2 zoning
district and to the requirements for approval of any administrative adjustment of
such standards.

Toxies Cleanup
Based upon the historical agricultural use of this land, there is a possibility the soil contains
residual concentrations of pesticides. Ecology recommends that the soils be sampled and
analyzed for lead and arsenic and for organochlorine pesticides. If these contaminants are found
at concentrations above the MTCA clean-up levels Ecology recommends that potential buyers be
notified of their occurrence.

The State Environmental Policy Act (SEPA), RCW Ch. 43.21C, requires all governmental agencies to consider the
environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be prepared
for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist
is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts
from the proposal, if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS

A. How is the subject property suitable for uses permitted under the proposed
zoning?
The subject properties are suitable for uses permitted under the proposed zoning change
because the property is flat, located on a two comers, front on an arterial, abut other
Local Business commercial zoning on the west, east and south (across Tieton Drive).
Light Industrial zoning is generally located to the southeast of the subject properties.
Properties to the north are zoned Two-family Residential and consist of duplexes and
single-family residences. Both properties are also served with all urban services and
facilities. If the proposed rezone is approved, the property will ultimately be "melded"
with commercial uses which lie to the west, east and south to create a larger cluster of
commercial development. It is likely that the two properties will be developed
individually and create opportunities for small businesses to locate within them.
Most land uses which are permitted by the zoning ordinance in this zoning district
provide retail/service opportunities to the travelling public that frequent this area of
Yakima. Uses within the zoning ordinance, and permitted in this zone, are small-scale
uses that are generally compatible with surrounding land uses. Uses that may have
incompatibility issues are generally processed as Class 2 or Class 3 Uses, as deemed
appropriate by the zoning ordinance. Conditions of approval may be added to specific
land uses to ensure compatibility with existing land uses in the immediate area.
However, it should be noted that any proposed use on the property will be limited in
scope, as the overall property is small, and development will be limited by lot coverage
and parking requirements.
What is the status of the existing land use?
The status of the existing land use is that both parcels contain existing single-family
residences on average size lots, approximately .25 acres for each lot. Both lots are
completely landscaped with typical residential style landscaping consisting of grass,
shrubs and trees.

B. How is the re.7nni, request in comnliance with and/or how does the re nest
deviate from the Yakima Urban Area Com rehensive Plan?
The rezone request is in compliance with the Yakima Urban Area Comprehensive Plan
because the proposal meets many of the goals, objectives and policies of the Plan for
commercial development. Specifically, this request encourages commercial development
within the urban area, within the city limits, along an arterial street route, served with full
urban standards and provides a convenient location consistent with the development
pattern of the community (Reference Yakima Urban Area Comprehensive Plan --Goal
3.12 and supporting Policies 3.12.1 through 3.12.8). This request will also bring
additional commercial land into an existing commercial node, thus, permitting the
opportunity for a slightly larger commercial node for a local businesses and services to
locate.
Yes, there are adequate public facilities to serve this proposal. The properties front on
Tieton Drive (an arterial roadway) and is served with all other infrastructure including
domestic water, sanitary sewer, natural gas, electricity, telephone and any other needed
utilities. Additionally, the site is protected by the Yakima Police and Fire Departments.
Are the existing public facilities capable of supporting the most intensive use
of the new (requested) zone? If not, what mitigating measures are going to
be implemented to address any short falls in public services that may exist?
Yes, the existing public facilities are capable of supporting the most intensive use of the
new zone. The property is served with full urban services and facilities. If any short fall
exists in the delivery of facilities, necessary mitigation will take place by the developer to
ensure adequate public facilities are in place at his/her/their expense, as required through
land use concurrency.

D. 19 How is the proposed zone change compatible with the existing, ne._LI___*_
uses.
The proposed zone change is compatible with existing neighboring uses because
commercial zoning and development currently exists to the west, east and south of the
subject properties. Although residential properties abut this proposal on the north, the
proposed Local Business zoning district generally permits compatible uses that abut
neighboring residential districts. The district is often-times used as a buffer between
arterial streets, other commercial and industrial uses and the existing residential uses that
it abuts because of the limited number of land uses that are permitted in the Local
Business Zoning District. As the two subject parcels are generally small in size, any
proposed use will be small based on required setbacks, parking and lot coverage
requirements. Both property owners have indicated a desire to retain the existing
structures on the property, if it can be accomplished.
A review of the area indicates that commercial properties in the area are fully built-out,
which creates a need for additional commercial zoning in this area. This proposal, if
successful, will follow the trend of local business/service land uses and be limited to
small-scale commercial endeavors that are deemed compatible with the neighborhood
through the zoning ordinance.
What mitigating measures are planned to address incompatibility, such as
sitescreening, buffering building design, open space, traffic flow alteration,
etc.?

cluster in the general area because this proposal permits an existing cluster to expand, as

SUMMARY EXPLANATION: On August 17, 2011, the Yakima Planning Commission issued its
recommendation to approve a rezone of two parcels of property located at 424 South 49th
Avenue and 423 South 50th Avenue from Two-Family Residential (R-2) to Local Business (B-2)
(File No. RZ#009-1 1). You are now being asked to set September 20, 2011 as the date of a
"Closed Record" public hearing for City Council consideration of the Planning Commission's
recommendation.

BOARD RECOMMENDATION: The Yakima Planning Commission issued its recommendation
for the unconditional approval of this rezone request on August 17, 2011.

Compliance with the Washington State Environmental Policy Act (SEPA)
July 20, 2011
On June 29, 2011 the City of Yakima, Washington issued a Notice of Application and Environmental
Review regarding a SEPA review application submitted by Justin Gaddis and Roland McLaughlin. This
review concerns the environmental analysis for the rezone of two parcels of property from Two-Family
Residential (R-2) to Local Business (B-2). The subject properties are located at 424 South 49th Avenue
and 423 South 50th Avenue Avenue, Yakima, Washington.

Following the required 20-day public comment period, and consideration of all comments received, the
City of Yakima has issued the enclosed SEPA Threshold Decision.
The SEPA decision may be appealed within 14 calendar days following the date of mailing. The appeal
period ends at 4:30 pm on August 3, 2011. Appeals must be in writing and on forms available from the
City of Yakima Planning Division, 129 North 2nd Street, Yakima, Washington. The fee of $580.00 must

I received the "Public Notice of Land Use Review" for the rezoning of the property of
Justin Gaddis and Roland McLaughlin. I reviewed the information. I strongly oppose the
rezoning of the two residential properties that is located at 423 S 50th and 424 S 491h Ave.
We bought our first house more towards the "east side" of town. Based on what we saw
going on in the early nineties we felt we should sell, and get out of the neighborhood ... so
we did. Did not want to sell so soon but did not feel we should stay there any longer. We
found the house we are currently in on S 49 "' and were thrilled to find something in our
price range since we felt we were being pushed out by the older neighborhood's crime
problems from the first home.
The homes proposed to be re -zoned to Local Businesses are wrong, and we simply
oppose of having the residential houses turned into commercial for the reasons, facts, and
possible risks that are listed below:
1.) More traffic, which makes it unsafe for children that just want to ride their
bikes in their own neighborhood. There is a school bus stop on one of the streets.
Right now it's hard to turn onto S 49th from Tieton after work.
2.) Noise: People coming and going all times of the day. They will use 49th and
50th as an outlet because Tieton street gets to busy at the end of the day.
3.) Parking: People will be parking in front of resident's driveways.
4.) Congestion: Location is too close to the end of the road / stop sign. There
will be problems with people trying to turn into and out of the street. It's a
problem has it is now.
5.) Downgrade the neighborhood: The rezoning will cause actual
"homeowners" to sell their homes, and then more homes will be at risk of
becoming rentals. People that rent homes do not have pride of ownership, and do
not take care of the property. A rental is a rental.
The facts listed below are what we are experiencing right now with the businesses
we have on 49th and 48th Ave at this time.
1. Jackson's Sport Bar: Increase in traffic (usually drunk and are driving at very unsafe
speeds on South 49`x') One night it was high speeds. The skid marks were at least one
house length, and ended about two feet away from a residences parked car that was in his
driveway. This person drove up and down for about ten minutes at very high speeds. I do
recall that in the past the neighborhood did not want Jackson's coming in when the city
announced its proposal.
2. El Porton: Noise, Every month starting at 9:45 pm their have the carpets cleaned by a
commercial carpet cleaner. The equipment /generator that is used by the carpet cleaners is UA
extremely loud. This noise goes on from 9:45 pm until 1:00 am in the morning. In the
parking lot behind El Porton people /employees sit in their cars and turn their music asr
loud as they can. You can call the police, or just tell them yourself to shut it off, but it
will happen again and again.
4. World Treasures Imports that was located at 4811 1/2 was selling drugs. This
business did close about two years ago. It was not fun times for the neighborhood when
this so- called small business was in our neighborhood.
S. Pet Daycare This business is no longer there. When they were present the customers
were usually in a hurry like a mother w/ children dropping off their pets. They would use
S 49`x' as access to get to the business along Tieton, and usually traveling at high
speeds.....not a good mixture with children riding their bikes on a side street, or if you
are just backing out of your drive way, and here they come at a high speed.....their
reaction time is cut in half to stop in time. A new business is currently moving in I
wonder what type of clientele they will be bring to the neighborhood this time.
For the City of Yakima to just assume, or even attempt to justify that rezoning the
residences at 423 S 50t" and 424 S 49`x' Ave will work out ok in the Cities laws, and
terms is just simply neglectful, and very unprofessional. The "Grapevine" adult store is a
prime example of sloppy research, and neglect to the area neighborhoods and schools. Go
door to door in the neighborhoods that you want to rezone, and you will surely get
opposition. I can only hope other people will speak up. Many times people do not speak
up for all kinds of reasons .... no one will listen, they cannot appear because of work, or
simply do not feel their opinion will count. The neighborhood deals with enough
"commercial" chaos. We have had our share, and simply don't need anymore. If this re-
zoning goes through it will only cause good landowners to leave; and therefore more
rental homes and not proud responsible homeowners.
The 7nain reason for this letter of opposition is for the right to raise children in a safer
neighborhood. Any parent would want to raise their children in a decent neighborhood,
which is hard to come by in this town if you are not earning a very good wage. We and
other parents are concerned, and our hands become tied when someone comes around
wanting things to change for their own financial gain.
The Experiences I listed on page one and two are Known Facts, and I feel that they
should be taken seriously as the Reasons I listed also on page one. It's a known fact that
commercial and residential to not mix well, and once again we oppose this re- zoning
plan. The homes were built for residential use, I and others ask the City of Yakima that
you leave them that way. This will help preserve the good neighborhoods we have
