AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City
employees to be effective July 10, 2011; amending Subsections 2.20.100A, 2.20.10013,
2.20.100E, 2.20.110A 2.20.110B, and 2.20.110D all of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA: -
Section 1. Subsection 2.20.100A of the City of Yakima Municipal Code is hereby amended to read as
follows:
"2.20.100 Classification Plan.
A. Plan Adopted. A classification plan for city employees is hereby adopted to be effective
July 10, 2011, which plan shall consist of the various following subsections of this section."
Section 2. Subsection 2.20.10013 of the City of Yakima Municipal Code is hereby
amended to read as follows:

Section 4. Subsection 2.20.110A of the City of Yakima Municipal Code is hereby
amended to read as follows:
"2.20.110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule
constituting Subsection B through G of this section, for the classes allocated to these pay ranges shall
be in full force and effect as of July 10, 2011. The pay rates shall constitute full compensation for
those employees with a work week of forty hours as set out in other sections of this code. Employees
whose work week is less than forty hours shall be paid at the rate which is in the same proportion to
the rates set out herein that their work week bears to forty hours. The hourly rate for those employees
of the Fire Department whose work week exceeds forty hours shall be computed according to the
provisions of Section 2.22.030 of this code
The performance of employees in the series designated Subsection B shall be evaluated
annually in accordance with a management performance evaluation plan. The result of the
performance evaluations shall be the determination by the City Manager of the actual salary of each
employee in the designated positions, and the determination by the City Council of the actual salary of
the City Manager, which actual salaries shall be no less than the minimum nor no greater than the
maximum set out in the pay range applicable to the position, according to the following schedule:"

SUMMARY EXPLANATION:
This classification and compensation ordinance incorporates the recommendations of the
Charter Civil Service Commission as approved at their meeting on June 6, 2011.
This classification and compensation ordinance reflects a new classification of Transit .Vehicle
Driver recommended to be allocated to Pay Code 645 ($12.68 - $15.19/hr- - $2197.82 -
$2632.88/mo).
Attached for Council's information are the reports presented and approved by the Civil Service
Commission outlining the new classification.
In addition this ordinance includes a housekeeping item amending the Classification and
Compensation Plan to add the classification and allocation of Municipal Court Department
Assistant Pay Code 990 ($13.56 - $16.43/hr -- $2350.35 - $2847.81)
All recommendations are subject to the City Council review and approval.

In order to be in compliance with the U.S. Department of Transportation (DOT) regulations,
Yakima Transit requests modifications to certain transit & transit - related safety- sensitive job
classifications to inform prospective employees that they will be subject to drug and alcohol
testing under the Federal Transit Administration's (FTA) drug & alcohol regulations.
These job classifications include: Mechanic I; Transit Operator; Fleet Maintenance; Transit
Field Operator Supervisor; Transit Dispatcher; Transit Service Worker.
Currently, safety- sensitive transit job classifications state that employees in these categories are
.subject to. Federal Motor Carrier Safety Administration's (FMCSA) drug & alcohol regulations
instead of FTA drug & alcohol regulations.
The proposed language reads as follows:
For safety- sensitive Transit job classifications:
Shall be subject to drug 'and alcohol testing pursuant to Department of
Transportation (DOT) regulations (49 CFR Part 40) and the Federal Transit
Administration's Regulations (49.CFR Part 655).
For Mechanics, who perform both Transit and non - Transit work:
Shall be subject to drug and alcohol testing pursuant to Department of
Transportation (DOT) regulations (49 CFR Part 40) and either the Federal Transit
Administration's Regulations (49 CFR Part 655) or the Federal Motor Carrier Safety
Regulations (49 CFR Part 382), as applicable.
In addition the following Class Specifications have been updated to reflect current job
responsibilities: Transit Dispatcher; Transit Service Worker; Transit Vehicle Cleaner. (See
attached)

RE: Transit Dispatcher, Transit Service Worker and Transit Vehicle Cleaner position
The job descriptions for the positions of Dispatcher, Service Worker and Cleaner have been
updated to the current responsibilities of the employees in those job categories. Through the
past few years with the introduction of different technologies in the field of public transportation
that the division has had to implement, some modifications to the job descriptions are needed to
reflect the appropriate tasks
The tasks which are added to the Dispatch position are done so with keeping the level of
authority the same. The two basic categories in this job classification. 1 — Office dispatching and
2 — Maintaining the service in good order on the road.
The tasks which are added to the Service Worker and Cleaner positions are mainly related to
the upkeep of the Bus zone (stop, bench and shelter) areas. These additions are also kept at
the skill and authority level as the rest of the tasks that are included in the current job
descriptions.
We have met with the Union concerning the changes in the job descriptions. Please reference
Article 9 — Management Rights, Section 9.1; Subsection A, B,F,G and F; page 7, of the
AFSCME Transit Contract. (Included)
RECOMMENDATIONS
Recommending no increase in pay for any of the three positions at this time.
Additional Background Information RE: FTA Drug & Alcohol Testing
Yakima Transit currently receives federal funds to supplement transit operations. In order to
receive those funds, Yakima Transit must comply with drug and alcohol testing requirements, 49
CFR Part 655 "Prevention Of Alcohol Misuse And Prohibited Drug Use In Transit Operations."
Some of those funds come from the FTA directly, but also through grants administered by the
Washington State Department of Transportation ( WSDOT) on behalf of the FTA. In March
2010, WSDOT conducted an annual audit of our operations and although WSDOT didn't
release actual findings, they did send back a checklist showing where Yakima Transit was
deficient. One of those issues was that current safety- sensitive transit job classifications do not
inform prospective employees that they will be subject to FTA drug and alcohol testing for four
specific groups: Supervisors, Mechanics, Dispatchers, and Operators.
All four of those job classifications are safety- sensitive positions under FTA regulations and the
employees in those categories are regulated by the City's Substance Abuse Policy, which
follows both FTA and FMCSA drug and alcohol regulations. Currently, the job descriptions
inform prospective employees that they .will be tested in accordance with the Federal Motor
Carrier Safety Administration's (FMCSA) drug and alcohol regulations (49 CFR Part 382).
Although this may be true for Mechanics, because a Mechanic may also work on non - transit
vehicles; it isn't true for the Transit -only employees or mechanics when they are working on a
transit vehicle. If Mechanics were separated into two groups: FTA and FMCSA, different
regulations would apply to those different classes. The regulations for both subagencies are
relatively similar.

It may also be important to note that the mechanics, that perform work on our transit vehicles,
do not work directly for Transit. They are employed in the Equipment Rental Division. Yakima
Transit pays the Equipment Rental Division directly for those services. If those classifications
aren't changed to reflect FTA regulations, Yakima Transit will not be able to continue using
those Mechanics to perform the service, which could increase Transit's costs to have the
services performed and could remove some of Equipment Rental's flexibility for assigning work
as well as providing employment.
Differences
Of the notable differences between FTA and FMCSA regulations, random pool testing levels are
typically higher for FMCSA regulated employees than for FTA regulated employees. The base
testing rate for both subagencies is 50% for Random Drug and 25% for Random Alcohol. (49
CFR §§ 382.305 & 655.45) Every year,
the testing level for the random pool for
each DOT subagency is set by that
subagencys administrator, subject to
rules that relate to the previous years'
testing results. (See Table 1 below) This
allows the subagencies to decrease the
level of testing if there were a relatively
low number of positive test results.
The other two notable differences are
with penalties for violations and post -
accident testing. Both subagencies have
different penalties for violations. (71 FR
69496) Post - accident testing varies
between the two regulations. With FTA,
all accidents where the driver may have
been at fault require testing. (49 CFR
655.44) FTA also requires companies/
agencies to test anyone who could have
contributed to the accident, which might
be a supervisor, mechanic, or dispatcher.
With FMCSA, a fatality or bodily injury
accompanied with a citation for a moving
violation. (49 CFR 382.303) Under
FMCSA, only the driver is tested.

TITLE: TRANSIT VEHICLE (15 PASSENGERS OR LESS) DRIVER
DEFINITION: Under general supervision of the Transit Supervisor;
operates a City Transit Vehicle in a safe and efficient manner transporting
passengers, while displaying a professional attitude and effective customer
relations in demand - response and fixed service route services
DUTIES
ESSENTIAL FUNCTIONS: Operates a Transit vehicle, providing
transportation for passengers in the safest and shortest distance possible or
as instructed by dispatch; obeys traffic rules and regulations; adheres to
policies and procedures; monitors the safe mechanical operating condition of
assigned vehicle; picks up and discharges passengers as instructed.
Collects appropriate tickets, cash and/or token fares, through operation of a
• fare box collection system; checks monthly passes and other fare information.
Perform pre -trip vehicle inspection, which includes, checking fluid levels and
adding fluids. If necessary, checking belts, lights, tire pressure, and
wheelchair lift. Adjust mirrors and seat.
Inspects vehicle at the end of each shift for damage to the vehicle and lost
articles; removes passenger and schedule information, debris and other items
from the vehicle.
Assists senior citizens and/or disabled passengers in and out of vehicles as
required and ensures they are properly secured using provided wheelchair
and ambulatory securement systems devices.
Must be punctual, reliable and maintain regular attendance in order to
contribute individually to the efficient and effective delivery of transportation
service.
Completes driver logs, accident or incident reports, on- the -job- injury claims,
surveys, and other required written materials in a timely manner.

PHYSICAIL DEMANDS: Work is performed primarily driving a Transit
vehicle and talking/listening on the phone, in person, or on a mobile radio.
Continual use of both hands in reaching/handling /grasping /fingering /pushing
while performing duties and operating a Transit vehicle. Be able to
continually lift 25 pounds overhead; to lift up to 50 pounds to carry items
short distances for - passengers; push/pull up to 300 pounds to push
wheelchair passengers; stand and walk short distances several times/hour to
assistant passengers. Frequent stooping /bending/kneeling /climbing stairs
from the knees /waist neck while performing duties. Continual use of all
senses including feehng/hearing /seeing while performing duties and
communicating with co- workers, general public and passengers. Must be •
able to distinguish color and maintain long term and short term memory.
Will be working in all weather extremes and be exposed to insets, water, dirt
dust, noxious odors, fumes, vibrations and traffic. Reasonable
accommodations may be made to enable individuals with disabilities to
perform the essential functions.
UNUSAL WORKING CONDITIONS: Must be able to climb up several
flights of stairs to escort passengers and go up and down two steps when
getting on and off the Transit vehicle 20 -30 times a day. Operators may drive
for long periods of time with few breaks, and must maintain a tight time
schedule throughout the shift. Operators drive in traffic congestion and in all
kinds of weather conditions. Must be able to perform more than one task at
the same time; such as driving the vehicle, answering questions, using the
radio. Operators may be able to maneuver in and out of confined spaces
periodically throughout the shift.
Subject to adverse weather and traffic conditions, exhaust fumes and
equipment noises. Also, subject to exposure to potential contact with verbally
or physically abusive individuals. Must report to work on time and be ready
for work.

• LICENSES, REGISTRATION AND CERTIFICATES: Must possess and
maintain a valid Washington State driver's license.
MINIMUM CLASS REQUIREMENTS; Applicants for this position must
have a high school diploma or GED. Must have a minimum of five years
licensed driving experience. Must be 21 years of age or older at the time of
application and have an acceptable motor vehicle driving record including no
moving traffic violations in the past three (3) years AND no involvement in
any at fault accidents within the past five years (5) as evident by current
driving abstract. Abstract dated no more than one month prior to hire date
must be provided by applicant. Applicants must successfully pass the State
Patrol Background Check. Must pass a job -offer employment related
physical examination to include a drug and alcohol screen prior to
appointment and maintain good physical condition which, either with or
without accommodation, allows completion of all essential duties. Applicant
must be able to reach to the side and overhead to adjust mirrors and have
sufficient strength to operate the vehicle. Must possess eyesight correctable
to 20/40, and visual acuity to determine color, depth, and field of vision.
Must have normal hearing with ability to perceive the nature of sounds with
no more than a 40 db loss @ 500 Hz, 1000 Hz and 2000 Hz with or without
correction. Shall be subiect to random controlled substance and
• alcohol testing, pursuant to Department of Transportation (DOT)
regulations (49 CFR Part 40) and the Federal Transit
Administration's Regulations (49 CFR Part 655).
