RESOLUTION NO. R-2020-107
repealing the City Council's temporary moratorium issued as Proclamation
No. 2020-05 on June 2, 2020, staying the issuing of citations and/or towing
unlicensed vehicles for violations of Yakima Municipal Code 9.47.
WHEREAS, on March 12, 2020 the Mayor issued emergency proclamation and order
(Proclamation No. 2020-01) declaring a state of emergency in the City of Yakima due to the onset
of the COVID-19 pandemic; and
WHEREAS, on March 13, 2020 the Yakima City Council ratified and confirmed the
Mayor's declaration of emergency and subsequently have confirmed numerous extensions of the
emergency; and
WHEREAS, on June 2, 2020, as a result of concern for residents who may not be able to
afford normal vehicle licensing costs and were remaining at home in response to the ongoing
pandemic the City Council ratified and confirmed Mayoral Proclamation No. 2020-05, thereby
enacting a temporary moratorium staying the City's issuance of citations and/or towing unlicensed
vehicles for violations of Yakima Municipal Code (YMC) 9.47; and
WHEREAS, the City Council has now determined that as the emergent nature of the
COVID-19 pandemic has become less threatening there is a need to resume enforcement of
YMC 9.47 to address a growing number of vehicular parking violations that are threatening the
peace and safety of the City's residents; and
WHEREAS, the City Council has determined that it is in the best interest of the City and
its residents to end the temporary moratorium initiated on June 2, 2020 staying the City's issuance
of citations and/or towing unlicensed vehicles for violations of Yakima Municipal Code (YMC) 9.47
and to restore the enforcement of that Section, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The temporary moratorium initiated on June 2, 2020 staying the City's issuance of citations
and/or towing unlicensed vehicles for violations of Yakima Municipal Code (YMC) 9.47 is hereby
repealed and full enforcement of YMC 9.47 is restored, effective immediately.
ADOPTED BY THE CITY COUNCIL this 6th day of October, 2020.

ITEM TITLE: Resolution repealing the City Council's temporary moratorium,
issued as Proclamation No. 2020-05 on June 2, 2020, staying the
issuance of citations and/or towing unlicensed vehicles for
violations of Yakima Municipal Code 9.47

SUMMARY EXPLANATION:
The City Council authorized the Mayor's proclamation declaring a state of emergency in March
2020, to provide the City an opportunity to respond to immediate needs and threats resulting from
the onset of the COVI D-19 pandemic, as well as to be amendable to potential emergency
response resources. Within the parameters of the state of emergency the Council subsequently
approved the Mayor's declaration of a temporary moratorium on the enforcement of certain
parking violations identified in YMC 9.47. The temporary moratorium was deemed necessary to
respond to the impacts of stay at home orders and income reductions on residents' ability to
license their vehicles and to move the vehicles regularly.
More recently the pandemic threat has become more manageable and as a result, the City
Council finds it necessary to repeal the previously ordered moratorium and resume normal
enforcement of the provisions of YMC 9.47.
