The City'Council.held a special meeting on this. date :at 2:00 P.M.
in the Council of City Hall, Yakima, Washington. Mayor
:Pat Berndt, presiding, Council members Clarence Barnett, Henry
Beauchamp, Lynn Buchanan,` George Pechtel, Skip Semon and Bernard
- Sirs - present •on roll call. City Manager Zais, ` City 'Attorney Vanek,
<City Clerk Roberts and Deputy City Clerk Lovell also present.
2. PLEDGE OF ALLEGIANCE'- •

3. OPEN DISCUSSION FOR THE GcOD•OF - THE ORDER ••
Mayor Berndt announced that the City Council has scheduled a
television appearance next Monday at 7:00'P.M: _ on - Channel 36.
Mayor Berndt, Council members Buchanan and Sims, and City Manager
• Zais will•participate in the discussion, which focus on the
1991 Budget. The program format will allow audience participation
.by telephone. . The Council has' made a commitment .to participate in
• programs =twice a.month to keep the public informed, -and-to allow
citizens the opportunity to express their opinions.' -
Mayor r. Berndt announced the impending resignation of Transit
Director Bill Schultz. Mr: - Schultz told the'Council of his future
plans, and thanked them for their support- during•his tenure with
the City. On behalf of the Council, Mayor Berndt wished him
continuing success as he faces new career opportunities..

5. CONSIDERATION OF - RESOLUTION AUTHORIZING •EXECUTION OF FIRE
PROTECTION AGREEMENTS WITH:
A. FIRE DISTRICT 10
City Manager Zais apologized to the Council that the information
for this item was not ready earlier for their review. However, the
complexity of the issue required extensive research and
negotiations which were not completed until late Monday. Fire
Chief Beeson introduced interested parties attending today's
• meeting, including Don Bundy, legal counsel for Fire District #10,
Phil Naud, Chairman of Commissioners for Fire District #10, and
Dick Smith, legal_counsel for Fire District #13.
Fire Chief Beeson stated that staff has been corking for several
months with the Commissioners of Fire'District #10 to formulate a
plan to maintain or improve the existing levels of fire protection
and emergency medical care services during the annexation process.

.. Chief'Beeson briefly summarized the resulting contract document and
offered to answer questions. Chief Beeson stated that four
annexations are currently underway in District #10, and this

will be a. surplus of funds :each year that the District will pay to
II the City. Chief Beeson pointed out that the contract does provide
for a reduction in service if there are revenue losses. Chief
Beeson also stated that th City ha.' a' -legalrobligation'-'to accept
paid District #10 personnel into the Yakima Department. The
effective' date of the contract is January -'1, 1991 and it will
remain in effect for either a five year terin' or until the
annexation of 50% of the 1990 assessed value of the real property
of the District territory. .

' Commissioner Phil Naud thanked the Council for the spirit of
cooperation that has been shown in formulating this agreement. He
also .expressed his appreciation for the hard work and assistance
provided by Chief Beeson. Mr. Naud commented•that he has come full
circle with Fire District #10, serving as a Commissioner from its
formation in 1959 to its dissolution. Mayor Berndt also noted the
excellent work'accomplished by all parties.
RESOLUTION NO. D -5835, A RESOLUTION authorizing the execution of an
agreement for services between the City of Yakima and Yakima County
Fire Protection District #10.
B. FIRE DISTRICT 13
Fire Chief Beeson stated that the three parties to this contract
are the City of Yakima, Fire District #13, and Yakima County. Fire
District #13 surrounds the Fairgrounds, and includes Phase 2 of the
Eastside Annexation, which becomes effective on November 1, 1990.
This agreement must be signed prior to that date in order to
provide fire protection for 16 properties that were not included in
the annexation. This contract allows for immediate dissolution of
the Fire District, provides protection for the property in
question, and allows the City to assume the Fire District's
contract with the County for Fairgrounds and County Shops
protection. Council member Barnett asked if the County
Commissioners are in agreement with the terms of the contract.
Chief Beeson stated that the County Commissioners ,have been
involved in the development of this agreement, and they have
indicated they will sign it today.

Chief Beeson stated that the City will provide fire suppression and
emergency medical service to the Fairgrounds and the County Shops
until March 1, 1991. City Manager Zais stated that this
contract insures that all properties will be protected by the City
until March 1. In the meantime, the City will prepare a proposal
to continue long term service to the Fairgrounds and the City Shops
after that date. He advised Council that Fire District #11 also

intends-to submit a proposal to the County. Council member Pechtel
praised staff for development of a fine, working agreement between
• all parties. Resolution No.D-5836, having been'read by title, it
was MOVED BY BUCHANAN, SECONDED BY SIMS,'TO'ADOPT THE RESOLUTION.
The motion carried by unanimous roll call, vote.: Attorney Dick
Smith stated that he, too, is coming full'cirble, having been
'involved at the, formation of Fire 'District #13, and now
participating :in its dissolution.
