1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City =Hall,, Yakima; Mayor Pat
Berndt, presiding, Council members Hehry'Beauchamp, Lynn Buchanan,
Skip 'Semon Sims present on roll call. Assistant City
Manager•Stouder, City Attorney Vanek, City Clerk Roberts and Deputy
City Clerk Lovell also present. Council members Clarence Barnett
and George Pechtel absent and excused. Council member Pechtel and
City" Manager.Zais'attending ar hearing on'law and justice issues.
2. PLEDGE OF ALLEGIANCE _
' The Pledge of Allegiance was led by Glenn Rice, Director of
Community and Economic Development.
- "3.' OPEN FOR - THE GOOD OF THE ORDER
Mayor' Berndt announced `Council member Pechtel; City Manager
Zais and`.: Finance` Director Hanson! in Everett'today' testifying
before the Joint - Legislative Task Force - on City- County Finances
regarding ongoing law and justice funding needs.
Mayor: :Berndt'reported that She traveled to•Washington, D.C. last
week to accept a grant for the Drug Coalition. She had the
opportunity to speak to Senators Adams - and Gorton and Congressman
Morrison about financial assistance from the federal level. The
response from the legislators was not encouraging, and Mayor Berndt
stressed that the City - must now concentrate on the State level and
local efforts_for funding.. r.
Mayor Berndt introduced and welcomed • Oliver, the new
Administrative Assistant to the City_`Manager.•
4. CONSENT AGENDA r<

Mayor. Berndt referred_'to the::_ items_ placed on the Consent Agenda,
questioning whether there any additions or deletions from
either 'Council members or' citizens present. Mayor. Berndt stated
that Item No. 10 has'been removed from the.Agenda at the request of
an absent Council member. The Clerk then read the Consent
Agenda items, including resolutions and ordinances by title. It
was BY BY BUCHANAN, THAT THE CONSENT AGENDA,
AS' READ, BE PASSED. : The ' motion - carried by unanimous roll call
'vote. Barnett and Pechtel absent. '(Subsequent paragraphs preceded

*5. APPROVAL OF MINUTESTOFtiTHE'TSEPTEMBER"25 1990 COUNCIL MEETING
The Council minutes of September 25, 1990 were approved, having
been duly certified accurate by two Council members and no one
present wishing to have,sa'id- minutes read publicly.
6. AUDIENCE PARTICIPATION
Mayor Berndt read a proclamation designating the week of October
- 14-20,:''1990 as' Dental -Hygiene ` Week in- the City of Yakima, and
encouraged' citizens to•part'icipate in programs aimed at increasing
awareness of oralrhealth. rNicolai Kreger accepted_the proclamation
. on' behalf of 'the Yakima Valley'Dental Hygiene Society and made a
few - comments about the rdental -
Mayor Berndtrread`a proclamation designating the week of October
15=19, 1990 as Venture Club of'Yakima Week. Deanne Lange accepted
the proclamation on behalf of the Venture Club, and invited
interested individuals to attend a meeting on October 16, 1990.
-7. ' CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
DEBRIS PROGRAM }�
Code Administration Manager Bob Shampine stated "that'he hadLnothing
to add. There being no one present to speak to the issue, and
Resolution No. D- 5828;. having been read by title, it was MOVED BY
SIMS,.SECONDED BY BE11JCHAMP, 10 ADOPT ThE RESOLUTION. The motion
carried_by unanimous roll call vote. Barnett and Pechtel absent.
RESOLUTION NO.- •D -5828, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
8. ' REPORT FROM COUNCIL TRANSIT COMMITTEE REGARDING PROPOSED DOWNTOWN
SHUTTLE DEMONSTRATION PROGRAM c
Transit Manager Bill Schultz offered to answer questions regarding
the proposed downtown shuttle service. Mr. Schultz :circulated a
picture of the proposed vehicles, and stated that they would be
ti leased from a California firm. All-of the would meet
federal requirements' for accessibility. Mayor Berndt
asked for a comparison of the lease cost as opposed to purchase of
vans. Mr. Schultz stated that vans had not been researched, - as the
concept called for a vehicle that would carry at least 25
passengers and have publicr 'relations appeal Mr.- Schultz stated

that - a one -year trial period would allow `time: to test the
equipment, -as well as the service. , Mr.' Schultz explained that
three vehicles ,'would be needed for dailye and one spare
vehicle would ;be I - required- for backup. '
"'` • Council:: - member Beauch bbUt ,the cost " `difference between
lease 'and purchase, and was iadvised .by; Mr: Schultz that! the lease
option gives thefPCity :'the opportunity to evaluate the service
without making a long'term capital commitment. The' lease cost
would be applicable to purchase price if decision' is made to
buy the vehicles. Council member Beauchamp was concerned that a
vehicle with only one door would create exiting problems and slower
service. Mr. Schultz did not see this as a problem since the

vehicles do not carry a large number of passengers, and people
would not - stopping to Tay fares. Mayor Berndt asked if there
was room advertising on the vehicles, and Mr: Schultz stated
that available that can'be used as a revenue source.
Council member Beauchamp asked about.the.'•impact this service would
have on current transit system revenue. Mr: Schultz replied that
'funds' are currently available for the program, but it is impossible
to predict years in the future due to .'the of
federal funding•. Mr. Schultz emphasized that :this program will be
catefully in one year to determine:if :the 'service should
•be continued. . Gbals of: the program would `: `include `"reduction of
automobile traffic, improved parking and improved air quality in
the downtown area. Council member Beauchamp stated that he liked
the concept, but was worried about long term financing. Council
member Semon felt that downtown merchants would be supportive of
the program. Council member stated that the Transit Committee
has been discussing idea for many years, and that it was time
to test the concept for the good of the community.
Richard Andring, 203 South 8th Avenue, spoke against the proposed
concept 'stating that westside parking was insufficient to support
the program. Mr. Andring also questioned the expense of the
proposal, and felt that Transit funds should not be used for an
' experimental concept Jerty Henderson, .309 "NOt.th .- 35th Avenue,
spoke in favor'of the proposal on behalf of the Westside Merchants
Association and the Yakima Trolleys. Mr: Henderson .urged Council
to'':approvethe concept to encourage - .development' of the Central
Business District. He believed that these vehicles would appeal to
the people, and would enhance Yakima's growing reputation as "Rail
Town." Mr. Henderson felt the program was a unique opportunity for
the City, and he'encouraged promotion by the merchants to make it
successful. Council member Beauchamp agreed that the trolleys
'would be an' asset to the "con"v"ention^ and - tourism :bu`sine'ss:

There being no further discussion, it :was' MOVED BY - BUCHANAN,
• SECONDED BY SIMS, TO APPROVE THE PROPOSAL AND :DIRECT STAFF TO
PREPARE THE NECESSARY LEGAL DOCUMENTS. The motion 'carried by
unanimous voice vote. Barnett and Pechtel absent.
9. REPORT FROM PARKS AND i'RECREATION, DIVISION"REGARDING'r1'990 SUMMER
PLAYGROUND'PROGRAM
Parks and Recreation Manager Dave Flaherty and Recreation
Supervisor' Denise Nichols presented a' report on . the .highly
successful 1990 summer playground program. Ms. Nichols stated
that this was the second year of operation, and the program
received - excellent " a ttendance and" ` positi`ve `feedback from the
public. She observed that United Way support program
expansion this year. Council member. - Sims .:suggested including
Kiwanis Park in the program next year. Mr. Flaherty replied that
this will be considered, and he has met with the Housing Authority
to discuss programs for the high number of children in the area.
- However, the Division has limited funding, and 'expansion of the
playground program would require a reduction in another area.
Mr. Flaherty stressed the importance of organized playground
programs as a positive activity for children in the City.

Council member Sims encouraged` expansion of recreation
opportunities .for youth, stating that money is better spent on
these programs rather than corrective -law and justice measures.
Public Works Director Jerry Copeland stated that the Division will
continue to seek outside resources for expansion of their programs.
Mayor Berndt reported that the Coalition for the War on Drugs has
provided funds to the Housing' %Authority to allow children to
become involved with athletic programs. Mr.,Copeland expressed
appreciation to the Mayor for "her efforts to secure participation
by the YMCA in the playground program. It was MOVED BY BUCHANAN,

10. CONSIDERATION OF ' REQUEST FROM VISITOR AND. CONVENTION BUREAU
ADVISORY BOARD REGARDING EXPANSION STUDY OF THE YAKIMA CENTER
This item was_removed from the Agenda at the request of an absent
Council. member.
*11. CONSIDERATION OF RESOLUTION'AUTHORIZING'THE CITY MANAGER TO EXECUTE
AGREEMENTS WITH S. L.• START AND ASSOCIATES FOR WORK EXPERIENCE
PROGRAM -- _.
- RESOLUTION 'NO. D -5829, A RESOLUTION" ratifying the Occupational
Internship Work - Site' Agreements the City has entered - into with
S. L. Start -& Associates, ' Inc., and authorizing` the• City Manager
to execute • agreements for future participation in this
internship program.'
*12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT FOR
DISPOSAL• OF WASTEWATER= TREATMENT PLANT SLUDGE
RESOLUTION NO. D -5830, A RESOLUTION authorizing the execution of a
contract with Charron Company, Inc. for disposal of Wastewater
Treatment Plant sludge.
*13. CONSIDERATION OF' RESOLUTION?AUTHORIZING :.EXECUTION'`OF "AGREEMENT FOR
INDUSTRIAL WASTE SPRAYFIELD MAINTENANCE AND SERVICE
RESOLUTION NO. D -5831, 'A RESOLUTION authorizing the execution of a

maintenance and service.

APPROPRIATING. FUNDS FOR CAPITOL THEATRE LIGHTING SYSTEM (NO FORMAL
ACTION 'REQUIRED THIS MEETING):'
An Ordinance-amending the 1990 budget and'appropriating funds for
Capitol Theatre lighting system, having been read by title only,
was laid on the table for one week, until October 16, 1990.

Council member' Semon asked why. :'weedy`ibt "'o rdinancesJeannot be
included on Agenda. - City Attorney Vanek. replied that
State law requires the City Council to hold a public hearing and
allow concerned individuals the opportunity to speak.
Council member Sem_on complimented' the Housing. Division for their
recent newsletter, suggested that other departments consider
producing similar material.
James Dykes, 880 Road, requested' that the City take
responsibility for maintenance of the abandoned trolley .tracks in
the West Valley area. When the City took ownership of the tracks,
the agreement stipulated that maintenance would be ongoing.•" Glenn
Rice, Director of Community and Economic Development, stated that
_ he has talked .to - Mr. Dykes about this concern, but the City is
still uncertain about the ownership and the legal status of the
property involved. Mayor Berndt stated that the City has a
responsibility that :.' should' 'be fulfilled. City • •Attorney Vanek
stated that this is a very complex issue and title to the property
is unclear at this time. Assistant City Manager Stouder stated
that the City will explore the cost of seasonal maintenance, and
Mayor Berndt suggested that the City could possibly contract to
have the County perform some of the work.
