BUSINESS MEETING
I ROLL CALL
C .
The City Council met in session on this date at 2:00 P.M. in the
"Council Chambers of City Hall, Yakima,'Washington.i Mayor.- Pat
'Berndt, presiding, Council members Clarence Barnett, Lynn Buchanan,
George Pechtel, Skip Semon and Bernard Sims present on roll call.
Council member Henry'Beauchamp absent and excused. Assistant City
Manager Stouder, Assistant City Attorney Tree, City Clerk Roberts
and Deputy City Clerk Lovell also'present. - •
2. PLEDGE OF ALLEGIANCE •
-
The Pledge of Allegiance was led by Council member Buchanan.
'3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER '.
Mayor Berndt distributed copies - of. the "Urban Agenda Priority
Issues" ".for "1990' Legislative. Session "' as established' by the
Association of ° Washington Cities (AWC). ' Mayor Berndt explained
that this list was determined by the mayors of the larger cities,
• but did not reflect thepriorities of" -the east sidel'of ' :the State.
Mayor Berndt stated that this priority list will serve as a
guideline, but the AWC will also continue to work on economic
issues and state mandated legislation. Mayor Berndt provided, this
material to Councit to let .them know what was going on, and
cautioned them they will have a great deal of work to do if they
want to be heard this year. Mayor Berndt stated that Priority 8
should have read - '?` "providing ; for economic development and
diversification including worker education and to match
the job market." Council member Buchanan emphasized the need for
- Council to be'involved with the Resolutions' Committee and' the. AWC
Board. Assistant City Manager Stouder stated that the governor is
also interested in establishing an Urban Agenda and coordinating
with the issues raised by AWC.
4. - CONSENT AGENDA. •
Mayor • Berndt referred to the ` items - placed - on the Consent Agenda,
questioning whether there were any additions or deletions from
'either Council members or citizens present. It was'.the general
(consensus of..the Council that the deletion of Item 9, as requested
by a citizen,:be made. The City Clerk read the Consent Agenda
items, including resolutions and ordinances by title. It was MOVED
BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA, AS READ, BE'
PASSED. The motion'carried by.unanimous roll call vote. Beauchamp
absent. - (Subsequent ' paragraphs preceded'' - by an asterisk ( *)
indicate items on the Consent Agenda handled under one motion

5. AUDIENCE PARTICIPATION' , •' r - "
Mayor Berndt read a'prbclamatt -Oh designating the week of September
17 -23, 1990 as Constitution Week. In observance of the 203rd
anniversary of the signing rof :'the Constitution, Mayor Berndt
encouraged all citizens to pay special attention to the Federal
Constitution and the advantages of American citizenship. Opal
Myhres accepted the proclamation on behalf of the 'Daughters off the
American Revolution.
6. HEARING CN DENIAL OF PRIVATE SECURITY _OFFICER'S LICENSE AS
REQUESTED BY` DANNY..GARCIA (QUASI- JUDICIAL HEARING MAY BE_CONDUCTED

IN- EXECUTIVE SESSION) ,
City C1erk'Roberts advised Council that Danny Garcia was unable to
attend the meeting, and he requested postponement of the hearing.
Council postponed the hearing for one week to September 25, 1990.
7. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
,DEBRIS PROGRAM
Code Administration Manager Bob Shampine stated that he had nothing
to add. There being no one present to speak to the issue, and
Resolution No. D -5816, having been read by it was MOVED BY
SIMS, SECONDED'BY"BUCHANAN,. ADOPT'THE' "RESOLUTION. The motion
carried by unanimous roll ball vote: Beauchamp absent:

AT FIRE .STATION NO. 2 FOR EARLY CHILDHOOD.PROGRAM .-'
RESOLUTION E NO. D =5817, A RESOLUTION authorizing' the lease of
certain Fire Department property t� Yakima Schbol District No. 7.

9. ' CONSIDERATION' OF RESOLUTION CALLING FOR. SPECIAL' • ELECTION CN
NOVEMBER 6TH CONCERNING AMENDMENT TO THE CIVIL` SERVICE PROVISIONS
IN.THE.CITY CHARTER AND AUTHORIZING PUBLICATION OF A "FACT SHEET"

Assistant City Manager Stouder explained to Council that the
proposed amendment was developed to streamline the recruitment
process and enable the City to fill certain professional, technical
and temporary positions. in a timely manner. 'Mr.. Stouder
mentioned the positions of Wastewater/Utility 'Engineer and
Rattlesnake' Feasibility Coordinator as examples-. positions that
were . difficult to- fill due to the constraints of the Civil Service
hiring process. Mr: Stouder stated that this amendment was not
meant .to' reduce•or eliminate current Union positions as they become
vacant:.° "'Mf : Stouder stated ,' that: it is impossible to' '-anticipate
positions ' that may be required in rthe - future as 'technology is
moving so quickly in•the professional.and technical world'.,

AFSCME Representative Paul Sears stated that the Union had no
quarrel with the City's intent, but felt that the language in the
amendment was too broad. Mr. Sears suggested that the language be

revised to make it more explicit, and stated that the Union would
be willing to help. AFSCME President Bob Desgroseliiere :agreed that
it was the language, not the resolution, that concerned the Union.
Mr. :Desgrosellier suggested postponement of the ballot• -measure to
the•next election to allow sufficient time to develdp - language that
would be acceptable to all parties. Council asked
if •it was the language. of the proposition or the resolution that
:boncerned_: the` Unon,'tand - was: advised. by Mr. Desgrosellier that it
• was the language of the, re concerning ":train " positions in
subsections F, G, and H.. Mr. Desgroselliero was concerned that some
technical positions might not be eligible for Civil Service

Assistant City Manager Stouder stated that the 45 -day filing period
deadline for the November election expires this week, and he was
concerned that a language agreement be reached in the next day or
'two.' Assistant City Attorney Tree - stated that a special Council
meeting would be required if any change was made in the language of
the resolution. Mr. Desgrosellier asked if the City has any
specific positions that would be affected if the vote was delayed.
Mr.. Stouder stated that'there'inight,be some newly created'positions
in the71991 budget that could be served by this amendment. Council
member Pechtel felt the•City cannot provide - services if-the hiring
process is not streamlined. Mr. Stouder offered -to meet with the
Union representatives in the near future to explain the City's
intentions and' alleviate the Union's concerns. Council member
Buchanan stated that he would like staff and Union administration
to resolve any problems that might exist, but he would like to see
'the :measure - go• 'forward' on the Novefflberl ballot"' froni('an ' economic
standpoint. Council members Barnett supported placing
the issue on this ballot as a means of streamlining—the hiring
process. Mr. Sears stated that he did not question the
• credibility-Or the intent of either Mr. Stouder or ' the.City,
however, he was concerned with the existing language in the
resolution. Mr. Sears does not see this as a "Union- City" issue
because some of _ po"sition"s' - would` exist outside` of;the Union.
Assistant City Attorney .Tree'stated that - the wording of the
resolution could not be changed inside the-45-day filing period.
He also stated that if' the ballot measure passes; no changes could
be made without another election measure to change the Charter.
In an effort to continue the spirit of cooperation between the
Council and the Union, Council member'Pe'chtel stated that he was
willing to attend a special meeting, if necessary, to consider any
- change in the language of the resolution. Resolution No': D -5818,

TO - REVIEW THE' RESOLUTION, AND `IF ANY LANGUAGE-IS :,CHANGED, THAT A
SPECIAL COUNCIL "MEETING BE HELD 'TO CONSIDER' THE CHANGES. The
motion carried by unanimous voice vote.i absent.
RESOLUTION - NO. D -5818, A RESOLUTION for the submittal to
the electors 'of the City of Yakima, Washington; at a special
election to beheld in conjunction with the,State"`General Election
to be held November 6, 1990 of a proposition as to whether

Article:XVI, Sections 2 and-6, of the Yakima City Charter shall be
amended.
Mayor' Berndt asked if it was possible for the "Fact Sheet" to be
distributed with utility bills "rather than a special mailing.
' Assistant City Manager said the City will try to have the "Fact
Sheet" included with the billings. Resolution No. D -5819, having
been 'read by title, it was MOVED BY " BUCHANAN,. SECONDED BY
PECHTEL; TO ADOPT THE RESOLUTION. The motion carried by unanimous

PERSONAL LIABILITY COVERAGE TO'INCLUDE INDEMNIFICATION FOR CERTAIN
POLICE DEPARTMENT VOLUNTEERS
RESOLUTION NO. D- 5820,A RESOLUTION providing for both repeal of
prior resolutions for indemnification -against personal liability
for City personnel and for provision of "broader coverage of City
personnel.' _
* 11. CONSIDERATION. OF RESOLUTION AUTHORIZING EXECUTION 'OF CONTRACT WITH
RONALD WHITAKER FOR' HEARING' EXAMINER PRO TEM-SERVICES
RESOLUTION 'NO. D- -5821, A RESOLUTION authorizing the execution of a
professional services contract for hearing, examiner pro -tem
services.

THE'DISTRICT COURT AGREEMENT
RESOLUTION NO. D -5822, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute a
modification of the agreement with Yakima County relating to Yakima
County District Court costs. '

-An Ordinance 'amending the 1990 Budget and appropriating funds for
an after- school recreational program at the Southeast Community
Center sponsored by the Southeast Yakima Rotary Club, having been
read by title only at the previous meeting, was- brought before the
Council for a second reading.
ORDINANCE NO. 3299, AN ORDINANCE amending the 1990 budget for the
City of Yakima; and making an appropriation of $3,333 in the Parks
• and Recreation Fund "for expenditure "during 1n0'"for an after - school

An ordinance amending the 1990 Budget and appropriating funds
for legal expenses related to Civil Service'litigation, having been
read by title only, was laid on the table for one week, until
September 25, 1990.
*17. FIRST READING OF AN ORDINANCE AMENDING THE' 1990 BUDGET AND
APPROPRIATING FUNDS FOR MEDICAL PREMIUM COSTS FOR FIRE DEPARTMENT
EMPLOYEES (NO FORMAL ACTION REQUIRED THIS MEETING)
An Ordinance amending the 1990 Budget and appropriating funds for
medical premium costs for the Fire Department employees, having
been read by title only, was laid on the table for one week, until
September 25, 1990.
18. OTHER BUSINESS
Council member Pechtel asked about the status of the Downtown Plan,
and was advised by Assistant City Manager Stouder that the Plan
will be presented to Council for adoption sometime in October.
