1. ROLL CALL

City Attorney Vanek City Clerk -Roberts and :Deputy City Clerk
Lovell also present. City Manager Zais present after 2:13 P.M.

The Invocation was given by Council member Beauchamp.

3. OPEN DISCUSSION FOR THE GOOD'OF THE ORDER - '
Mayor Berndt explained that the - reason the City was not included
in the recent federal grant to the Lower Valley Drug Task Force was
. because the City already has a Task Force in;place that is funded
through a different process.
4. - CONSENT AGENDA - .
Mayor Berndt referred to the items placed on the Consent Agenda,
. questioning whether there were any additions or deletions from
either Council members or citizens present. Council member Barnett
requested that Item No. 10 -B be removed from the Consent Agenda.
- • Council member Buchanan requested that Item No. 8 be added to the
., ,Consent Agenda:1 "'It`:wa"s the, general consensus.'of ^the Council that
the - deletion of Item No- 10 -Brand the'addition of Item No. 8, as
requested, be made. The City. Clerk then the Consent Agenda
items, including resolutions and ordinances by title. It was MOVED
' BY BEAUCHAMP, SECONDED BY THAT THE CONSENT AGENDA, AS
READ, BE ADOPTED. The motion carried by unanimous roll call vote.

*5. APPROVAL OF MINUTES OF THE AUGUST 7, 1990 SPECIAL COUNCIL MEETING
AND AUGUST 14, 1990 CITY COUNCIL MEETING
The Council minutes of the.August 7, 1990 Special Council meeting
and August 14, 1990 Council meeting were approved, having been duly
- . certified accurate by two Council members and no one present
wishing to have said minutes read publicly. '

Code Administration Manager Bob Shampine stated that he had nothing
to add. There being no one present to speak to the issue, and
Resolution No. D -5802, having been read by'title, was MOVED BY
BUC NAN,- SECONDED:BY "PEGITEL, TO ADOPT - THE RESOLUTION. The motion
carried`by unanimous roll call vote. Sims absent.

*8. NCYTICE OF INTENT TO COMMENCE ANNEXATION PROCEEDINGS FOR NORTH
FRUITVALE PHASE II (STANDARD MOTIONS A & B) (CONTINUED FROM
8/21/90)
August 28, 1990 was set as the time of a meeting with the
initiating party who has • signed a Notice of Intent.to Commence
Annexation Proceedings, the initiating party being Ace
Hardware Corporation.
The annexation proposed by Ace Hardware Corporation was accepted by
the City of Yakima and the area. to be• annexed was required to
assume its share of the City's existing indebtedness, and a Notice
of Intention to Annex was required to be filed with the Yakima
County Boundary Review Board.
*9. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH
GAY AND OSBORNE FOR SUPERVISORY CONTROL AND' 'DATA ACQUISITION
SYSTEM DESIGN FOR THE WATER, TREATMENT PLANT
RESOLUTION NO. T-5803; A RESOLUTION "authorizing execution of a
contract for engineering services with Gray & Osborne, Inc.,
Consulting Engineers. '

RESOLUTION NO. D- 5804, A RESOLUTION authorizing the sale of surplus
personal' property owned by the City. •
B. VEHICULAR PROPERTY
Council member Barnett asked•why three nine -year old vehicles with
relatively low' mileage' have been declared .surplus. Jerry
Copeland', Director of Public Works, was unable to provide specific
information, but stated that the vehicles were difficult to
maintain, and some replacement parts were impossible to locate.
Resolution No. D -5805, having been read by title, it was - MOVED BY
BUCHANAN, SECONDED' BY PECHTEL,'`'TO` ADOPT THE' `RESOLUTION.' The motion
carried by unanimous roll call vote. Sims absent.

*11. SET DATE OF PUBLIC HEARING FOR SEPTEMBER 11, 1990 ON EASTSIDE
ANNEXATION PHASE II
September 11, 1990 was set as the date of public hearing on the
Eastside Annexation Phase II.

APPROPRIATING FUNDS FOR THE PUBLIC WJPKS TRUST FUND
An Ordinance amending the 1990. Budget and appropriating funds for
the' Public Works Trust Fund project (Tieton Drive, 16th - 4th
Avenues), having been read by title only at the August 21, 1990
meeting, was brought.before the Council second reading.
ORDINANCE NO: 3295, AN ORDINANCE amending the 1990 budget for the
City of Yakima making appropriation for the reconstruction of
Tieton Drive between 16th Avenue and 4th Avenue.
*15. SECOND READING OF AN ORDINANCE AMENDING THE 1990 BUDGET AND
APPROPRIATING $25,000 FOR CAPITOL THEATRE
An Ordinance amending the 1990 Budget and appropriating funds for
Capitol Theatre cash flow -and working capital, having been read by
title only at the August,,21 meeting, was brought before the
Council for a second reading.
