BUSINESS MEETING
1. ROLL CALL - _ . __
The City Council met in session on this date at 2:00 P.M. in the
Council, Chamber's'' of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett, Lynn Buchanan,
George Pechtel, Skip Semon and Bernard Sims present on roll call.
Council member Henry Beauchamp absent and excused. City Manager
Zais, City Attorney Vanek, and Deputy City Clerk Lovell also
present.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council member Barnett.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
None.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. A citizen requested
that Item No. 16 be removed from the Consent Agenda. It was the
general consensus of the Council that the deletion of Item No. 16,
as requested, be made. The Deputy City Clerk then read the Consent
Agenda items, including resolutions and ordinances by title. It
was MOVED BY SIMS, SECONDED BY BUCHANAN, THAT THE CONSENT AGENDA,
AS READ, BE PASSED. The motion carried by unanimous roll call
vote. Beauchamp absent. (Subsequent paragraphs preceded by an
asterisk ( *) indicate items on the Consent Agenda handled under
one motion without further discussion.)
*5. APPROVAL OF MINUTES OF THE JULY 24, AND AUGUST 7, 1990 CITY COUNCIL
MEETINGS AND JULY 31 AND AUGUST 1," 1990 ADJOURNED CITY COUNCIL
MEETINGS
The minutes of the July 24 and August 7, 1990 Council meetings and
July 31 and August 1, 1990 Adjourned Council meetings were
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
6. AUDIENCE PARTICIPATION
Dave Flaherty, Parks and Recreation Manager, invited Council
members to attend the Allied Arts Festival in the Park, which will
be held in Gilbert Park this weekend.

Mr. Flaherty introduced Ron Draggoo, the newly hired Administrative
• Specialist in the Parks and Recreation Department.
7. PUBLIC MEETING ON THE HEARING EXAMINER'S DECISION REGARDING THE
VACATION OF AN ALLEY IN THE VICINITY OF SOUTH 6TH STREET AND
CENTRAL AVENUE AS REQUESTED BY THE CITY'S HOUSING SERVICES OFFICE
(SEE ORDINANCE VACATING ALLEY)
- This being the date set for public•'meeting Supervising Associate
Planner Joan Davenport advised the Council that the request is for
vacation of an undeveloped and unimproved alley in the vicinity of
• South 6th Street and Central Avenue. The Housing Services Office
has purchased four adjacent properties under the Rehab /Resale
Program and will deed them to individual families, who will be
assisted by Habitat for Humanity in the'construction of four single
family homes. The Department received no opposition to the request
"for vacation, and staff recommends approval.
Mayor Berndt opened the public meeting and asked if there was
' anyone present to speak in favor of the vacation. There being
none, Mayor Berndt asked if there was anyone present to speak in
• opposition - ho the vacation. There being no comment, Mayor Berndt
closed'the public meeting. Ordinance No. 3292, having been read by
title, it was MOVED BY BUCHANAN, SECONDED BY SIMS, TO ADOPT THE
ORDINANCE. The motion carried by unanimous roll call vote.
Beauchamp absent.
ORDINANCE NO. 3292, AN ORDINANCE vacating an undeveloped alleyway
in the vicinity of South 6th Street and Central Avenue in the City
of Yakima.
8. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS' VEGETATION AND
DEBRIS PROGRAM
Glenn Rice, Director of Community and Economic Development, stated
that he had nothing to add. There being no one present to speak to
' 'the . isue, and`ReSblution No. D -5801 having been read by title, it
- -' ' was ' MOVED' BUCHANAN, SECONDED BY SEMON;TO ADOPT THE RESOLUTION.

RESOLUTION • NO. D -5801, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
9. REPORT FROM PUBLIC WORKS DEPARTMENT REGARDING' INVENTORY OF
SEALCOATED STREETS IN THE CORPORATE LIMITS AND RESPONSE TO REQUEST
FOR SEALCOATING ON 18TH AVENUE IN THE VICINITY OF WILLOW
Jerry Copeland, Public Works Director, circulated a photograph
showing flooding problems at a 56th Avenue residence, and
he emphasized the necessity for the proper drainage of streets.
Mr. Copeland stated that he had-little to =add' to the report, but
was`i' available to answer questions. Council'nember Barnett asked

about anticipated revisions to the staff recommendation to
' maintain the current policy and code requirements for permanent
- streets. Mr. :Copeland - indicated that several' departments are
' ; looking 'at—development standards, and some changes might be
required to meet recent standards and design data.

In Brule, 9 North 65thAvenue, requested -. that Council consider
improvements on 18th Avenue, between Jerome and Willow Avenues.
The dirt street is bordered by the City on one side by the
County on the other, and assistance has been ,requested from both
jurisdictions since •1988. Mr. Brule owns a warehouse complex
,.,- _ between 16th and 18th Avenues, and Good Samaritan Health Care
Center is located between 16th and 17th Avenues and plans to build
a $3 million retirement home in the area.. .Mr. Brule stated that
605 feet Avenue was sealcoated in 1986 with excellent
results, and -they would like the same materia=l used on 18th Avenue.
Mr. Brule•stated that. his company- owns- 25 % -of -the property on the
street, but - -they have been unable to fonn,an-LID because it is a
low income 'property area. Mr. Copeland suggested that a one party
LID might -be' a possibility, but it would have to be a joint
City /County effort. Mr.• -Copeland al -so suggested dust abatement
treatment, - but-cautioned that it would only.. take care of dust, and
not help the traffic surface. Council member Semon asked how much
an - LID: would ;cost-, , and was given , an estimate7 Dennis Covell,
. Director-of Engineering Utili ties; -of $30 -35 per lineal foot.
Council member Sims commented that the Council, has heard this
.-request before,'andhe suggested that the City initiate action with
the . County to see if the problem -can be corrected. Glenn Rice,
,. Directoriof.Community and Economic ;Development,_suggested that part
of the answer -might be-to include the area:in one - of the upcoming
• annexations. Mr. Brule commented-that . the., ! taxes paid by his
company and Good Samaritan will increase to about $46,000 after the
new retirement home is constructed: Council member Buchanan
suggested that the County should be involved since they receive the
majority of the tax revenue.
Larry Mathews, 805 South -17th Avenue, expressed his support of the
staff recommendation for current policy on permanent streets. He
suggested that Mr. Brule's problem might be solved if the City does
some.-grading and applies a light- surface coating of aggregate.
• In that case, the City would not be in the situation of maintaining
a substandard street. It was MOVED BY BUCHANAN, SECONDED BY SIMS,

REASONABLE' PERIOD OF TIME. Reginald Goforth, 20 North 36th Avenue,
suggested that Council- should consider improving the road all
the way to Englewood instead of just a small portion. THE QUESTION
WAS CALLED FOR A VOTE ON THE MOTION ON THE FLOOR, and the motion
carried by unanimous voice vote. Beauchamp absent.
10. NOTICE.' OF INTENT -E0 'COMMENCE ANNEXATION PROCEEDINGS FOR NORTH
FRUITVALE PHASE II (STANDARD MOTIONS A & B)

Associate Planner John Elsden reported that the City has received
a -petition from Ace Hardware Corporation to commence annexation
for North Fruitvale Phase-II.- Ace Hardware-has, approximately 23%
of the assessed - value-in the proposed - annexation area. A total of
181 parcels -are included' in the annexation,- with a $24 million
• valuation, 'and an area of 286 acres. At this time Council is being
• asked to approve standard motions -, A & B pertaining to this
,annexation.. Forbes Mercy, 2707 Castlevale Road, requested that
Council expand ;the. boundary-of the ,annexation to include his

property.,, Mercy stated that the low' income portions of the
area would make it difficult,for him to annex into the City at a
later time, and he would like to become a City.resident and have
the opportunity to use city services and facilities. Glenn Rice,
7- Director, of.Community and Economic.Development,. stated that he had
already met with Mr. Mercy to discuss" this request, and he
suggested that staff explore the possibility, and report back to
, z.
Council. Council member Sims asked :who would be responsible for
f ire protection:.service. in.ahe ,Cowiche, „Canyon_ area after the
annexation. Mr. Mercy replied that” the City ',would assume that
responsibility according to current RCW interpretation. It was
MOVED BY BUCHANAN, SECONDED BY PECHTEL1 TO DEFER ACTION TO NEXT
WEEK 10 GIVE STAFF AN OPPORTUNITY RESEARCH THE REQUEST. The

11. REPORT. FROM PARKS,. -.A ND,..RECREATION., DIVISION., REGARDING MONITORING
RESULTS OF TEE NO.'3 AT FISHER PARK GOLF COURSE
Dave Flaherty, Parks and Recreation Manager, presented a report
concerning monitoring.of_ errant golf balls at Fisher Park Golf
Course. Earlier this summer, the Council had requested an
additional 'monitoring period of at least_30 days after the third
tee was moved closer to the green. . Mr. Flaherty distributed
photographs and reported that after the tee modification, an
average. of one.all.,,_ per day, _ ide. , ,lands outs . course, with an
average,,. of. one'. b . ball every'__three °days landing on the Rodvold
' property. ;Council member Barnett asked__what happened to the
Original recommendation by the Parks and Recreation Commission to
install a fence, and was told by Mr. Flaherty that the Commission
. - felt that the net would not be 100% effective and would not solve
the neighborhood concerns. Mr. Flaherty stated that the Department
feels they have done the best that they can, and suggests no
additional corrective action. Mayor Berndt. stated that a certain
number of balls are intentionally being.hit out of the course, and
the :City certainly. discourages that practice. It was MOVED BY
BUCHANAN, SECONDED BY SEMON, TO ACCEPT :THE REPORT AND STAFF
REOOMMENDINTION. The motion carried by 5 -1 voice vote. Barnett
voting nay. Beauchamp absent. Linda Rodvold stated that she has
suffered personal property damage,from golf balls, and she felt
the - Council was not trying to, correct the problem. She stated that
- she would not.give up her efforts to have a. tall net installed
• along the third fairway.

hearing before,the Hearing`, Examiner for Septemb 19, 1990 on a
petition to vacate' and relocate a portion_of Spruce Street, between
South 1,2th and South 13th Avenues.
16. REPORT FROM :THE.WATER DIVISION, REGARDING. WATER, TREATMENT PLANT
FILTER REBED'.PROJECT`
Larry Mathews, 805. South. 17th Avenue; asked questions regarding the
filter media used by the Water Treatment Plant. He was concerned
that., some,.,of. the;,flock. material_goes,.through, the,,system, and Water
Division 'Superintendent 'Ty Wick' confirmed that some material is
lost during processing. Mr. Mathews referred to a 1/13/89 article
in the Wall Street Journal that related Alzheimer's Disease to
aluminum. • Since, the water.treatment process used by the City uses
aluminum sulfate_as.a settling agent, Mr. Mathews talked to D6HS
officials regarding limits on the levels of aluminum contaminants.
Mr. Mathews also spoke with EPA and DOE personnel regarding his
concerns. He .learned.that, the pH of the water must be closely
regulated or there will be some carry through of the aluminum
compound, and solubility of the aluminum varies with the pH of the -
water. Council member Semon advised Mr. Mathews that the Council
does not have the scientific expertise to become involved in the
chemistry .process,._ and he suggested that;Mr. discuss these
technical matters with staff. Mr. Mathews'stat`ed` the Council
had a responsibility to the people of Yakima:and their health, and
Mr. Semon expressed complete confidence in the ability of staff
,members to assure quality control. Mr,.,Wick stated that the City
is within all Department of. Health guidelines and they have issued
a paper stating that aluminum no threat at this time.
Council member Pechtel stated that he spent 1 -1/2 hours at the
Water Treatment Plant yesterday, and he now understands the need

• for "'the new' media material. He also 'complimented the Water
'Department staff for high quality'of .the 'work they perform.
• John Klingele,` 1312 W.'Walnut, was hoping that there would be more
comparison of 'the types of media as was indicated on March 20th.
Mr. ' Kl ingele: 'felt that' -it was important r thatrthe new media be
utilized as soon as possible,. and.+he encouraged Council to
appropriate the necessary funds. • It was MOVED BY PECHTEL, SECONDED

The report from the City Engineer dated August 14, 1990, with
respect to the completion of the work on the Wastewater Treatment
_ _Plant_ Industrial Waste Pump Station . Rehabilitation project,
performed by Pease'Construction, was approved and payment of the
final estimates, as amended, and therein set forth•was authorized.
