Phil Pleasant, 701 South 7th Avenue, questioned the Council action of June• 19, 1990, which .increased the bid limit on supplies, . - equipment, material -and service's to $25,000 (Council member Buchanan .present after 2 :10. P.M.) Mr. Pleasant felt this action . was not responsive to community needs, and that this increase • should not have been made prior to. final development of the WMBE program. . felt -.that minority .businesses might lose City contracts if - they are -not given the opportunity to 'participate in • .the-. bid - process. Council_ member.. Sims stated that the Council - .represents—all-citizens . in .the ,community and must• take necessary • - action to =keep the cost of government:down. Council member Pechtel •'-i said that he; was assured by Purchasing Agent -Reid. that any minority --businesses wis'hing<; be. contacted will be notified, in addition to J the'. three bids. PUBLIC HEARING ON;._PROVIDENT, INDUSTRIES ANNEXATION (PETITIONER - YAKIMA COUNTY; .SEE :ORDINANCE ANNEXING PROPERTY) This being the date set for public hearing, Associate Planner John Elsden stated that staff had nothing more to add at this time. Council member Barnett questioned the attachedmap which indicated an irregular boundary. Associate Planner Elsden stated that the 7applicant did not want to be part of a larger annexation at the time they applied, but future -plans call for, this area to be . . included in a larger annexation. Mayor Berndt opened the public hearing. There being no one present to speak :to the issue, and Ordinance No 3280 having been read by title,. it was MOVED BY - - . SIMS, SECONDED BY BUCHANAN, THAT THE ORDINANCE BE PASSED. The motion carried by unanimous roll call vote. ORDINANCE NO. 3280, AN ORDINANCE annexing property to the City of Yakima and zoning said property. 7. PUBLIC HEARING ON ARLINGTON STREET /50TH AVENUE ANNEXATION (SEE ORDINANCE ANNEXING PROPERTY) This being the date set for public hearing, Associate Planner John Elsden stated that staff had nothing more to add at this time. Mayor Berndt opened the public hearing and asked if ,there was anyone present to speak in favor of the proposal. There being none,. the Mayor asked if there was anyone present wishing to speak in opposition of the annexation. Tim Mabry, 815 South 50th Avenue, • • asked if the. City planned.to remove the•street barricade that has . been in place for the past 17 years. Public Works Director Jerry Copeland. stated that the barricade is located on: public property, but the City, does not .anticipate removal unless residents in the area ask for the thoroughfare to be opened. .There being no further . _comment,..,the Mayor closed the public hearing: Ordinance No. 3281, . having been read by title, it was MOVED BY BUCHANAN, SECONDED BY SIMS, THAT THE ORDINANCE BE PASSED. The, motion carried by unanimous roll call vote. ORDINANCE NO. 3281, AN ORDINANCE annexing property to the City of Yakima and zoning said property. : • 14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF MEMORANDUM OF AGREEMENT WITH THE UNITED STATES ARMY RESERVE TO TRANSPORT THE .CITY'S MILITARY TANK.. FROM ELKS.MEMORIAL PARK TO TAHOMA CEMETERY Parks. and Recreation Manager Dave Flaherty, requested that this item be removed from the Consent Agenda „so.the Council could recognize the 737 Army Reserve Unit for their generous offer to move the tank. for the City.' Manager Flaherty introduced Sergeants . Roach, Grogan,. and Ard who were then thanked for their effort. The tank is scheduled to be moved on July 22, 1990 by either towing or by trailer. D -5769, A RESOLUTION authorizing the execution of a Memorandum of Agreement with the United States Army Reserve. AAD /2 31 JUNE 26, 1990. *8. CONSIDERATION OF RESOLUTION GRANTING PERMITS FOR THE RETAIL SALE OF FIRE WORKS:FOR 1990 • RESOLUTION NO. D -5764, A RESOLUTION granting permits for the retail sale of fireworks within the City of Yakima for 1990. 9. REPORT FROM ASSISTANT CITY MANAGER ON COMPREHENSIVE METROPOLITAN PLAN, DRAFT RFP AND SCHEDULE Assistant City Manager Stouder presented a request to Council to seek proposals from consultants to develop a new Yakima Metropolitan Comprehensive Plan. The study will include a visioning process to help set goals to guide the future of the metropolitan area. Several factors have driven the City to develop a plan; including recent growth and challenges coming to the urban area, the age of the current land use plan, and the recently passed Washington State Growth Management Act. The proposed Plan will • complement the water and sewer elements that have been developed over the past few years. The four components to be addressed by the plan include .land use, parks and recreation, drainage, and regional transportation. Assistant City Manager Stouder stated the proposal targets a starting date•of September, 1990 to enter into contracts and could be more than a two year process. Council member Barnett asked several questions related to the proposed funding of the concept. Assistant City Manager Stouder explained that until all of the proposals have been reviewed, we will not have a firm idea of the total budget or time schedule. The project cost will also be subject to requirements mandated by Growth Management Act legislation. Council member Barnett asked if Yakima County has agreed to participate in any way in development of this plan since the project encompasses the entire Yakima urban area. Assistant City Manager Stouder indicated that numerous discussions • have been held with the County, but it will be difficult to reach • an agreement until actual cost figures are determined. . However, joint City /County cooperation will continue to be a • priority. If this concept is approved today, City staff plans to return to Council in early September to outline the work program • and budget issues prior to issuance of contracts. Mayor Berndt asked Assistant City Manager Stouder to bring the Council up to date on the visioning process. He stated that the visioning process would be a broadly based, highly involved effort by the community to set goals for the future of Yakima. Those goals would then drive some of the elements of the Comprehensive Plan. Mayor Berndt indicated that plans have been developed to have a small, initial steering committee in place by mid -July. By Fall, a larger - canmittee.of 20 -30 would be in place and ready to interact in the community. Any person interested in serving on the steering committee should contact Mayor Berndt. The motion carried by unanimous voice vote. *10 CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH HDR ENGINEERS, INC. TO PERFORM ANALYSIS OF CONCRETE BASIN • STRUCTURES AT THE WASTEWATER TREATMENT PLANT RESOLUTION NO. 'D-5765,'A RESOLUTION authorizing the City Manager and City Clerk to execute an agreement with HDR Engineers, Inc., of AAD /3 32 - JUNE 26, 1990 Bellevue, Washington to perform analysis and make recommendations on concrete basin structures at the Wastewater Facility. 11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF PROFESSIONAL SERVICES AGREEMENT WITH HUIBREGTSE, LOUMAN ASSOCIATES, INC., FOR AUTOMATED MAPPING SERVICES Planning Manager Don Skone outlined the request from the Planning Department to contract professional mapping services in order to complete the City's automated GDMS mapping system by the end of August. Council member Sims asked if the City would lose any mapping expertise by hiring outside consultants. Planning Manager Skone replied that current City staff is knowledgeable with this material, and will be able to maintain the system once the consultants complete their input. Resolution No. D -5766, having been read by title, it was MOVED BY 'BUCHANAN, SECONDED BY SIMS,' THAT THE RESOLUTION BE-ADM-TED. The motion carried by unanimous roll call vote. RESOLUTION. NO. D -5766, A RESOLUTION authorizing the City Manager and the City Clerk of the City of Yakima to execute an agreement with Huibregtse, Louman Associates, Inc., an independent contractor to perform automated mapping personal services in an amount not to exceed $5,000.00. *12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF RENEWAL AGREEMENT WITH CRAIG ACKERSON FOR PROFESSIONAL SERVICES FOR YAKIMA CABLE TV RESOLUTION NO.' D -5767, A RESOLUTION authorizing execution of a Cable Television Consulting Service Agreement. * 13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF LETTER OF AGREEMENT WITH THE YAKIMA AIR TERMINAL BOARD FOR CLOSURE PROCEDURES RELATING TO EMERGENCIES AT THE YAKIMA AIR TERMINAL RESOLUTION NO. D 5768, A RESOLUTION authorizing and directing the Chief of the Fire Department of the City of Yakima to execute a Letter of Agreement with the Yakima Air Terminal Board for closure procedures relating to emergencies at the Yakima Air Terminal. 14. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF MEMORANDUM OF AGREEMENT WITH THE UNITED STATES ARMY RESERVE TO TRANSPORT THE CITY'S MILITARY TANK FROM ELKS MEMORIAL PARK TO TAHOMA CEMETERY This item was removed from the Consent Agenda and discussed following Item No. 7. * 15. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF INTERLOCAL COOPERATIVE LEASE AND PURCHASE AGREEMENT WITH WASHINGTON STATE DEPARTMENT OF INFORMATION SERVICES RESOLUTION NO. D -5770, A RESOLUTION authorizing the execution of an "Interlocal Cooperative Lease and Purchase Agreement" with the Washington State Department of Information Services. AAD /4 33 JUNE 26, 1990 *16. CONSIDERATION OF RESOLUTION FIXING A DATE OF PUBLIC HEARING BEFORE THE CITY HEARING EXAMINER ON JULY 18, 1990 TO CONSIDER A VACATION OF ALLEYWAY IN THE VICINITY OF SO. 6TH STREET AND CENTRAL AVENUE RESOLUTION. NO.' D- 5771, A' RESOLUTION fixing a time for a public hearing before the Hearing Examiner on July 18, 1990 to consider vacation of an undeveloped alleyway in the vicinity of South 6th Ilr Street and Central Avenue in the City of Yakima. *17. REPORT FROM PUBLIC WORKS DEPARTMENT REGARDING GRAFFITI CONTROL ON PUBLIC /PRIVATE PROPERTY The report from the Public Works Department regarding graffiti control on public and private property, was accepted. *18. REPORT FROM PARKS AND RECREATION DIVISION ON STATUS OF BOND ISSUE PROJECTS The report from the Parks and Recreation Division on the status of the "Parks Yes" Bond issue projects, was accepted. *19. SET DATE OF HEARING FOR JULY 24, 1990 ON THE SIX YEAR CAPITAL IMPROVEMENT PROGRAM July 24, 1990 was set as the date of public hearing on the Six -Year Capital Improvement Program for 1991 -1996. *20. SET DATE OF PUBLIC MEETING FOR JULY 17, 1990 ON THE NORTH NOB HILL COALITION APPEAL TO HEARING EXAMINER DECISION ON CLASS 3 APPLICATION OF B & D DEVELOPMENT FOR PROPERTY AT 2309 W. NOB HILL BLVD. July 17, 1990 was set as the date of a public meeting on the Nob Hill Neighborhood Coalitidn appeal of the Hearing Examiner decision on the Class 3 application of B & D Development to construct a fast food and retail development in the vicinity of 2309 West Nob Hill Blvd. *21. SET DATE OF PUBLIC MEETING FOR JULY 17, 1990 REGARDING MORRIS STOTSENBERG APPEAL OF HEARING EXAMINER'S DECISION FOR ZONING COMPLIANCE AND RIGHT -OF -WAY PERMIT FOR PROPERTY AT 2401 W. NOB HILL BLVD. July 17, 1990 was set as the date of public meeting on the Morris Stotsenberg appeal of the Hearing Examiner decision for zoning compliance and right -of -way permit for property located at 2401 West Nob Hill Blvd. *22. APPROVAL OF FINAL CONTRACT PAYMENT FOR 8TH STREET /YAKIMA AVENUE INTERSECTION RECONSTRUCTION PROJECT (STANDARD MOTION V -B, ACCEPT CONTRACT AND APPROVE FINAL PAYMENT) The report fran the City Engineer dated June 18, 1990, with respect to the completion of the work on the 8th Street and Yakima Avenue Intersection, performed by Superior Paving Company, was approved, the work accepted and payment of the final estimates as therein set forth was authorized. AAD /5 34 JUNE 26, 1990 *23. CONSIDERATION OF LEGISLATION REGARDING YAKIMA CENTER INSURANCE COVERAGE: A. RESOLUTION AUTHORIZING EXECUTION OF. MEMORANDUM OF UNDERSTANDING WITH THE YAKIMA VALLEY VISITORS AND CONVENTION BUREAU RESOLUTION NO D -5772, A RESOLUTION authorizing the City Manager and the City Clerk of the City of Yakima to execute a Memorandum of Understanding regarding insurance coverages between the City of Yakima and Yakima Valley Visitors and Convention Bureau. B. FIRST READING OF AN ORDINANCE APPROPRIATING FUNDS INTO THE TOURIST PROMOTION FUND FOR GENERAL LIABILITY INSURANCE (NO FORMAL ACTION REQUIRED) An Ordinance appropriating funds into the Tourist Promotion Fund for general liability insurance, having been read by title only at this meeting, was laid on the table for two weeks, until July 10, 1990. *24. SECOND READING OF AN ORDINANCE APPROPRIATING FUNDS FOR THE INDUSTRIAL COATING MAINTENANCE PROJECT AT THE WASTEWATER TREATMENT PLANT An Ordinance appropriating funds for the Industrial Coating Maintenance Project at the Wastewater Treatment Plant having been read by title only at the previous meeting, was brought before the Council for a second reading. ORDINANCE NO. 3282, AN ORDINANCE amending the 1990 budget for the City of Yakima; and making an appropriation of $40,000 in the Wastewater Facilities Capital Reserve Fund for expenditure during 1990 for removal, sandblasting and painting of a secondary digester dome and mechanical bar screen housing. 25. OTHER BUSINESS A. APPOINTMENTS TO YAKIMA CENTER ADVISORY COMMISSION Council member Buchanan reported that the Yakima Center Advisory Commission will have four vacancies effective this month. Candidates have been interviewed, and the Commission has recommended appointments for Michael Antrobus, Bruce Patterson, Ray Dilschneider and Mitch Van Wormer. It was MOVED BY BUCHANAN, SECONDED BY BARNETT, TO APPROVE THE APPOINTMENTS TO THE YAKIMA CENTER ADVISORY BOARD. The motion carried by unanimous voice vote.
