2011-025 Rezone Two Contiguous Parcels; 702 West Walnut Street and 202 South 7th Ave.
ORDINANCE 2011 -25 AN ORDINANCE relating to land use regulation and zoning; rezoning, without conditions, two parcels of property located at 702 -708 West Walnut St. and 202 South 7th Avenue, Yakima, Washington from Historical Business (HB) to Multi- family Residential (R -3) as more fully described herein; and approving, without conditions, the recommendation of the Planning Commission for the City of Yakima regarding the same; Lars and Amber Hanson being identified as the applicant herein. WHEREAS, by application dated March 4, 2011, Lars and Amber Hanson requested the rezone of Yakima County Assessor's Parcel No.'s 181324 -42481 and181324- 42482, located at 702 -708 West Walnut St. and 202 South 7th Avenue, Yakima, Washington (hereinafter "Subject Property "), from Historical Business (HB) to Multi- family Residential (R -3); and WHEREAS, on May 25, 2011 the Planning Commission for the City of Yakima conducted an open- record public hearing regarding the requested rezone; and WHEREAS, on June 1, 2011 the Planning Commission issued Planning Commission's Recommendation regarding UAZO RZ #002 -11 and EC #009 -11, (the "recommendation ") recommending that the Subject Property be rezoned from Historical Business (HB) to Multi- family Residential (R -3); and WHEREAS, at a closed- record public hearing held on June 21, 2011, the City Council considered the requested rezone, including the documents and other evidence which comprise the record developed before the Planning Commission, the Planning Commission's Recommendation, and the statements and comments of interested persons; and WHEREAS, the City Council finds that the considerations of the Planning Commission in response to the requirements and criteria of Yakima Municipal Code ( "YMC ") § 15.23.030(E) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following to approve the requested rezone, Now Therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The property located at 702 -708 West Walnut St. and 202 South 7th Avenue, Yakima, Washington (Yakima County Assessor's Parcel No.'s 181324 -42481 and 181324-42482, legally described in Exhibit "A ", attached hereto and incorporated herein by this reference, is hereby rezoned from Historical Business (HB) to Multi- family Residential (R -3). Section 2. The findings within the June 1, 2011 Planning Commission's Recommendation (UAZO RZ #13 -07, EC #29 -07) regarding this rezone are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(F), and are incorporated herein by this reference as if fully set forth herein. Section 3. The Official Yakima Urban Area Zoning Map and all other zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified, subject to the conditions stated below, to reflect this rezone. Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 6. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. The procedural aspects of this application are as follows: (1) The Yakima Planning Commission conducted an open record public hearing on May 25, 2011. (2) Testimony in favor of the application was presented by Assistant Planner Christine Wilson and by: Richard L'oofburrow, architect. (3) No testimony was presented in opposition to requested rezone. (4) No written opposition was submitted. ' (5) On May 25, 2011, Mrs. Wilson submitted Staff Comments to the Yakima Planning Commission which recommended an unconditional rezone. (6) The Yakima Planning Commission endorses the approval of this rezone by a vote of six in favor zero opposed and submits this recommendation for Council consideration. Summary of Recommendation and Decision. The Yakima City Planning Commission recommends approval by the Yakima City Council of an unconditional rezone from the Historical Business (HB) zoning district to the Multi - Family Residential (R -3) zoning district. Basis for Recommendation. Based upon the Commission members having individually viewed the site; the information contained in the staff report, exhibits, testimony, and other evidence presented at an open record public hearing held on May Lars and Amber Hanson 1 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7th Avenue RZ # -11; SEPA #009 -11 VF 50 o 25, 2011; and a review of the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance; the Yakima Planning Commission makes the following: FINDINGS I. Applicants /Property Owners. The applicants and property owners are Lars and Amber Hanson. II. Location. The requested rezone is located at 702 -708 West Walnut St. and 202 South 7th Avenue, Yakima, Washington. The parcel numbers are 181324 -42481 and 181324- 42482. III. Application. This is an application to rezone two parcels from the HB to the R -3 zoning district. The parcels are located at the southwest corner of W Walnut Street and South 7th Avenue and contain a single - family residence and two commercial buildings. As submitted this is a non project rezone request; however, it is understood that the property is subject to a purchase option executed between the landowners and the Yakima School District and may be expected to be utilized in the planned expansion and modernization of Davis High School. The school district's use of this property would not be permitted under the current HB designation but could be considered under the requested R -3 zoning as a part of an anticipated Class (3) land use review. IV. Public Notice Mailing of hearing notice Posting of property Legal Ad published April 1, 2011 April 1, 2011 April 1, 2011 No public comments were received during the 20 -day comment period that ended on April 21, 2011. V. State Environmental Policy Act. A Determination of Nonsignificance (DNS) was issued by the City of Yakima for the requested rezone on May 10, 2011. No appeal was filed during the SEPA appeal period which expired on May 24, 2011. VI. Transportation Capacity Management Ordinance. This proposal is an exempt activity under the Transportation Capacity Management Ordinance. Any redevelopment of the site may require a traffic concurrency review. VII. Current Zoning and Land Uses. The project site is currently zoned Historical Business (HB). The Future Land Use Map designates this property as High Density Residential. Adjacent properties have the following characteristics: Lars and Amber Hanson 2 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7th AvenueRZ #002 -11; SEPA #009 -11 Location Zoning Future Land Use Designation North R -3 High Density Residential South R -3 High Density Residential East R -3 High Density Residential West R -3 High Density Residential Existina Land Use Single Family Dwelling Parking Lot ' Senior High School Apartments VIII. Summary of the Main Points of the Testimony at the Hearing. The main points of the testimony presented at the hearing are as follows: (1) Assistant Planner Christine Wilson presented her staff report recommending approval of this application for a rezone of two parcels at 702 -708 West Walnut St. and 202 South 7th Avenue from the Historical Business (HB) to the Multi - Family Residential (R -3) zoning district. (2) Local Architect Richard Loofburrow testified in support of the approval of the rezone application. IX. Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following criteria specified in Subsection 15.23.030(D) of the Urban Area Zoning Ordinance: 1. Testimony at public hearing: Other than staff, the only testimony presented came from Richard Loofburrow, representing the applicants, Lars and Amber Hanson. Mr. Loofburrow's firm Loofburrow -Wetch Architects, 201 W Yakima Avenue, is responsible for the design work involved with the proposed expansion of A. C. Davis High School. In addition to supporting the rezone request he presented a brief overview of the proposed expansion, explained that the project was endorsed by a recently approved school bond issue and noted that the school provided a needed community service. 2. Suitability of the property for the proposed use: Because of its access to two public streets and proximity to varied land uses in the surrounding area, the property is well suited for all potential uses permitted within the R- 3 zoning district. Some of these potential uses include single - family homes, duplexes, apartment buildings, churches, daycares, group homes, libraries, and schools. When developed, the Zoning Ordinance's standards will ensure that it is compatible with surrounding land uses. Permitted uses that may have compatibility issues will be processed as Type (2) or Type (3) uses. This property is well suited to be used in the Lars and Amber Hanson 3 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7th AvenueRZ #002 -11; SEPA #009 -11 i1 future expansion of Davis High School. If that were to occur, the school use would require a Type (3) land use review and public hearing. 3. Recommendations from interested agencies: Recommendations or comments received from interested City departments and outside agencies did not oppose the rezone. Specific recommendations or comments from interested departments were submitted as a result of the Development Services Team (DST) meeting held on March 30, 2011 regarding the requested rezone. Comments submitted are as follows: a. Water and Irrigation Division: There's an existing looped 6 -inch waterline in S. 7th Avenue, and a looped 8 -inch waterline in W. Walnut Street. The site has a 1 -inch service with two % -inch meters. One meter serves 700 W. Walnut Street and one serves 702, 704, and 706 W. Walnut Street, as well as 202 S. 7th Avenue, (which is on a separate parcel). Two se arate parcels are not allowed to be served by one water meter, therefore 202 S. 7t Avenue needs to have its own water service and meter installed. The property is in the Low Level Pressure Zone. Water system static pressure range is 61 -75 psi. Available fire flow from the 6 -inch waterline is 1,600 gpm, which also serves an existing fire hydrant on the southeast corner of S. 7th Ave. and W. Walnut Street. The site is within the Capitol Hill Irrigation System. There's an existing 4 -inch PVC irrigation main in the alley. 702 W. Walnut St. is not within the irrigation system and does not have a service. 202 S. 7th Ave. has one irrigation service. b. Wastewater Division: Additional wastewater connection charges may apply. c. Yakima Transit: Yakima Transit has no issues with the proposed rezone. The rezone is consistent with Yakima Transit's policies to locate higher density /intensity development along transit routes. Yakima Transit's Routes 2 and 5 travel along the site. d. Code Administration: There are no issues or comments related to the rezone. The applicants may have future requirements if a project is proposed. e. State of Washington Department of Ecology: 1) Based upon the historical agricultural use of this land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine pesticides. If these contaminants are found at concentrations above the MTCA clean -up levels, Ecology recommends that potential buyers be notified of their occurrence. 2) Rezoning of a piece of property is often the first step in a proposed development. If a subsequent individual or common Lars and Amber Hanson 4 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7'" AvenueRZ #002 -11; SEPA #009 -11 plan of development ground disturbance exceeds one acre in size a NPDES Construction Stormwater Permit may be required. The process requires going through SEPA, developing a stormwater pollution prevention plan, submitting an application and a 30 -day public notice process. This may take 45 -60 days. A permit and stormwater plan is required prior to beginning ground- breaking activities. f. State of Washington Department of Commerce: A letter was received from this State department confirming receipt of the rezone and SEPA applications on April 4, 2011, and notice was given that they were processed with the Material ID # 16856 as required under RCW 36.70A.106. Copies were forwarded to other state agencies. They noted that if the material is a draft amendment, then final adoption may occur no earlier than sixty days following the date of receipt by Commerce, and asked for submission of the final adopted amendment to Commerce within ten days of adoption. 4. Compliance with the Yakima Urban Area Comprehensive Plan: The existing High Density Residential Future Land Use designation fully supports the Multi - Family Residential (R -3) zoning classification. This rezone is in compliance with the Future Land Use Map III -2 and Land Use Compatibility Chart III -11 of the Comprehensive Plan. The proposed R -3 zoning of the subject properties complies with the following goals and policies of the Comprehensive Plan: Policy 3.1.1.3: Provide high- density residential as a transitional use between commercial /office and medium density residential areas. Policy 3.1.1.4: Development shall be located along arterials or collector streets and should have good access to public transit. Policy 3.1.1.6: Connect schools, parks and meeting places with neighborhoods through a system of pedestrian network such as sidewalks, greenways and pathways. Goal 3.15: Work with school districts and private school officials to properly locate school facilities as necessary to maintain high quality education for Yakima residents. Policy 3.15.1: Encourage the location of new high schools on the periphery of residential neighborhoods, where access to major roads is available. Lars and Amber Hanson 5 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7t" AvenueRZ #002 -11; SEPA #009 -11 Cry .= Policy 3.15.4: Locate schools on relatively flat land that is in the center or on the borders of the neighborhoods being served. Elementary schools should be located on collector streets, middle and high schools should be located on arterial streets. 5. Adequacy of public utilities: The applicant's two parcels are served by all necessary public facilities such as water, sewer, irrigation, and transit. The properties have direct frontage and access onto two public thoroughfares, West Walnut Street to the north and South 7th Avenue to the east. They also have access to an alley on the west. Additionally, the site is protected by Yakima City Police and Yakima Fire Department. 6. Compatibility of the proposed zone change and associated uses with neighboring land uses: The proposal is compatible with existing neighboring uses because the subject parcels are currently surrounded by R -3 zoned properties and varied uses that serve the surrounding neighborhood. Any potential incompatibilities by proposed uses in the future will be addressed by the zoning code through normal site plan approval. The proposed rezone would also allow the property to possibly be incorporated into the future expansion of Davis High School, which would serve the surrounding neighborhood and the entire community. If the school did not develop on this property, compatibility will be determined for all future proposed uses based upon the Table 4 -1 of the Yakima Urban Area Zoning Ordinance. 7. Public Need /Change in Circumstance: While submitted as a non project rezone it is known that there is an accepted purchase offer from the Yakima School District which is contingent upon this rezone's approval. Its proposed use would be to become part of the proposed expansion of Davis High School. Public need is therefore fulfilled by the fact that the high school needs to expand because of an increase in the student population and the currently outmoded and inefficient school facilities. This site is ideally suited for the expansion of the school. This application was considered to be non project because any school expansion will require a separate land use review and approval before the project may proceed. As it currently exists the site does not comply with zoning ordinance's development standards for traffic circulation, parking, site screening, landscaping and lot coverage. This property is a natural fit to serve as a potential part of the future expansion of Davis High School. If that were to occur, the school use would require Type (3) land use review and public hearing. 3. Recommendations from interested agencies: Recommendations or comments received from interested City departments and outside agencies did not oppose the rezone. Specific recommendations or comments from interested departments were submitted as a result of the Development Services Team (DST) meeting held on March 30, 2011 regarding the requested rezone. Comments submitted are as follows: a. Water and Irrigation Division: There's an existing looped 6 -inch waterline in S. 7th Avenue, and a looped 8 -inch waterline in W. Walnut Street. The site has a 1 -inch service with two 3/4- inch meters. One meter serves 700 W. Walnut Street and one serves 702, 704, and 706 W. Walnut Street, as well as 202 S. 7th Avenue, (which is on a separate parcel). Two separate parcels are not allowed to be served by one water meter, therefore 202 S. 7th Avenue needs to have its own water service and meter installed. The property is in the Low Level Pressure Zone. Water system static pressure range is 61 -75 psi. Available fire flow from the 6 -inch waterline is 1,600 gpm, which also serves an existing fire hydrant on the southeast corner of S. 7th Ave. and W. Walnut Street. The site is within the Capitol Hill Irrigation System. There's an existing 4- inch PVC irrigation main in the alley. 702 W. Walnut St. is not within the irrigation system and does not have a service. 202 S. 7th Ave. has one irrigation service. b. Wastewater Division: Additional wastewater connection charges may apply. . c. Yakima Transit: Yakima Transit has no issues with the proposed rezone. The rezone is consistent with Yakima Transit's policies to locate higher density /intensity development along transit routes. Yakima Transit's Routes 2 and 5 travel along the site. d. Code Administration: There are no issues or comments related to the rezone. The applicants may have future requirements if a project is proposed. e. State of Washington Department of Ecology: 1) Based upon the historical agricultural use of this land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and'arsenic and for organochlorine pesticides. If these contaminants are found at concentrations above the MTCA clean-up levels, Ecology recommends that potential buyers be notified of their occurrence. 2) Rezoning of a piece of property is often the first step in a proposed development. If a subsequent individual or common plan of development ground disturbance exceeds one acre in size a NPDES Construction Stormwater Permit may be required. The process requires going through SEPA, developing a stormwater pollution prevention plan, submitting an application and a 30 -day Lars and Amber Hanson 702 W. A permit and stormwater plan is required prior to beginning ground- breaking activities. f. State of Washington Department of Commerce: A letter was received from this State department confirming receipt of the rezone and SEPA applications on April 4, 2011, and notice was given that they were processed with the Material ID # 16856 as required under RCW 36.70A.106. Copies were forwarded to other state agencies. They noted that if the material is a draft amendment, then final adoption may occur no earlier than sixty days following the date of receipt by Commerce, and asked for submission of the final adopted amendment to Commerce within ten days of adoption. 4. Compliance with the Yakima Urban Area Comprehensive Plan: The existing High Density Residential Future Land Use designation fully supports the Multi - Family Residential (R -3) zoning classification. This rezone is in compliance with the Future Land Use Map I1I -2 and Land Use Compatibility Chart 111- 11 of the Comprehensive Plan. The proposed R -3 zoning of the subject properties complies with the following goals and policies of the Comprehensive Plan: Policy 3.1.1.3: Provide high- density residential as a transitional use between commercial /office and medium density residential areas. Policy 3.1.1.4: Development shall be located along arterials or collector streets and should have good access to public transit. Policy 3.1.1.6: Connect schools, parks and meeting places with neighborhoods through a system of pedestrian network such as sidewalks, greenways and pathways. Goal 3.15: Work with school districts and private school officials to properly locate school facilities as necessary to maintain high quality education for Yakima residents. Policy 3.15.1: Encourage the location of new high schools on the periphery of residential neighborhoods, where access to major roads is available. Policy 3.15.4: Locate schools on relatively flat land that is in the center or on the borders of the neighborhoods being served. Elementary schools should be located on collector streets, middle and high schools should be located on arterial streets. 5. Adequacy of public utilities: The applicant's two parcels are served by all necessary public facilities such as water, sewer, irrigation, and transit. The properties have direct frontage and access onto two public thoroughfares, West Walnut Street to the north and South 7th Avenue to the east. They also have access to an alley on the west. Additionally, the site is protected by Yakima City Police and Yakima Fire Departments. 6. Compatibility of the proposed zone change and associated uses with neighboring land uses: Lars and Amber Hanson 702 W. The submittal will have a narrative describing the proposed high school expansion, a comprehensive master plan that will indicate site development plans, parking and traffic flow, building placement and design, site screening, and open space. Through public meetings and review by the Yakima School District Board of Directors it was agreed that Yakima School District is in need of expanding the existing AC Davis High School to accommodate increased enrollment and to provide a modern learning facility. A bond issue was successfully passed in 2009 allowing for the funding of an expanded and renovated AC Davis HS. The subject property is planned to be developed for the future expansion of the high school, and the rezone to R -3 would allow the property to serve the expansion approved by the voters. The procedural aspects of this application are as follows: (1) The Yakima Planning Commission conducted an open record public hearing on May 25, 2011. (2) Testimony in favor of the application was presented by Assistant Planner Christine Wilson and by: Richard Loofburrow, architect. (3) No testimony was presented in opposition to requested rezone. (4) No written opposition was submitted. (5) On May 25, 2011, Mrs. Wilson submitted Staff Comments to the Yakima Planning Commission which recommended an unconditional rezone. Applicants /Property Owners The applicants and property owners are Lars and Amber Hanson. II. Location. The requested rezone is located at 702 -708 West Walnut St. and 202 South 7th Avenue, Yakima, Washington. The parcel numbers are 181324 -42481 and181324- 42482. III. Application. This is an application to rezone two parcels from the HB to the R -3 zoning district. The parcels are located at the southwest corner of W Walnut th Street and South 7Avenue and contain a single - family residence and two commercial buildings. As submitted this is a non project rezone request; however, it is understood that the property is subject to a purchase option executed between the landowners and the Yakima School District and may be expected to be utilized in the planned expansion and modernization of Davis High School. The school district's use of this property would not be permitted under the current HB designation but could be considered under the requested R -3 zoning as a part of an anticipated Class (3) land use review. IV. Public Notice Mailing of hearing notice April 1, 2011 Posting of property April 1, 2011 Legal Ad published April 1, 2011 No public comments were received during the 20 -day comment period that ended on April 21, 2011. V. State Environmental Policy Act A Determination of Nonsignificance (DNS) was issued by the City of Yakima for the requested rezone on May 10, 2011. No appeal was filed during the SEPA appeal period which expired on May 24, 2011. VI. Transportation Capaci!y Capacity Management Ordinance. This proposal is an exempt activity under the Transportation Capacity Management Ordinance. Any redevelopment of the site may require .a traffic concurrency review. VII. Current Zoning and Land Uses The project site is currently zoned Historical Business (HB). The Future Land Use Map designates this property as High Density Residential. Summary of the Main Points of the Testimony at the Hearing., The main points of the testimony presented at the hearing are as follows: (1) Assistant Planner Christine Wilson presented her staff report recommending approval of this application for a rezone of two parcels at 702 -708 West Walnut St. and 202 South 7th Avenue from the Historical Business (HB) to the Multi - Family Residential (R -3) zoning district. (2) Local Architect Richard Loofburrow testified in support of the approval of the rezone application. IX. Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following criteria specified in Subsection 15.23.030(D) of the Urban Area Zoning Ordinance: 1. Testimony at public hearing: Other than staff, the only testimony presented came from Richard Loofburrow, representing the applicants, Lars and Amber Hanson. Mr. Loofburrow's firm Loofburrow -Wetch Architects, 201 W Yakima Avenue, is responsible for the design work involved with the proposed expansion of A. C. Davis High School. In addition to supporting the rezone request he presented a brief overview of the proposed expansion, explained that the project was endorsed by a recently approved school bond issue and noted that the school provided a needed community service. 2. Suitability of the property for the proposed use: Because of its access to two public streets and proximity to varied land uses in the surrounding area, the property is well suited for all potential uses permitted within the R- 3 zoning district. Some of these potential uses include single - family homes, duplexes, apartment buildings, churches, daycares, group homes, libraries, and schools. When developed, the Zoning Ordinance's standards will ensure that it is compatible with surrounding land uses. Permitted uses that may have compatibility issues will be processed as Type (2) or Type (3) uses. This property is well suited to be used in the Lars and Amber Hanson 3 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7th AvenueRZ #002 -11; SEPA 4009 -11 future expansion of Davis High School. If that were to occur, the school use would require a Type (3) land use review and public hearing. 3. Recommendations from interested agencies: Recommendations or comments received from interested City departments and outside agencies did not oppose the rezone. Specific recommendations or comments from interested departments were submitted as a result of the Development Services Team (DST) meeting held on March 30, 2011 regarding the requested rezone. Comments submitted are as follows: a. Water and Irrigation Division: There's an existing looped 6 -inch waterline in S. 7th Avenue, and a looped 8 -inch waterline in W. Walnut Street. The site has a 1 -inch service with two % -inch meters. One meter serves 700 W. Walnut Street and one serves 702, 704, and 706 W. Walnut Street, as well as 202 S. 7th Avenue, (which is on a separate parcel). Two se arate parcels are not allowed to be served by one water meter, therefore 202 S. 7t Avenue needs to have its own water service and meter installed. The property is in the Low Level Pressure Zone. Water system static pressure range is 61 -75 psi. Available fire flow from the 6 -inch waterline is 1,600 gpm, which also serves an existing fire hydrant on the southeast corner of S. 7th Ave. and W. Walnut Street. The site is within the Capitol Hill Irrigation System. There's an existing 4 -inch PVC irrigation main in the alley. 702 W. Walnut St. is not within the irrigation system and does not have a service. 202 S. 7th Ave. has one irrigation service. b. Wastewater Division: Additional wastewater connection charges may apply. c. Yakima Transit: Yakima Transit has no issues with the proposed rezone. The rezone is consistent with Yakima Transit's policies to locate higher density /intensity development along transit routes. Yakima Transit's Routes 2 and 5 travel along the site. d. Code Administration: There are no issues or comments related to the rezone. The applicants may have future requirements if a project is proposed. e. State of Washington Department of Ecology: 1) Based upon the historical agricultural use of this .land, there is a possibility the soil contains residual concentrations of pesticides. Ecology recommends that the soils be sampled and analyzed for lead and arsenic and for organochlorine pesticides. If these contaminants are found at concentrations above the MTCA clean -up levels, Ecology recommends that potential buyers be notified of their occurrence. 2) Rezoning of a piece of property is often the first step in a proposed development. The process requires going through SEPA, developing a stormwater pollution prevention plan, submitting an application and a 30 -day public notice process. This may take 45 -60 days. A permit and stormwater plan is required prior to beginning ground- breaking activities. f. State of Washington Department of Commerce: A letter was received from this State department confirming receipt of the rezone and SEPA applications on April 4, 2011, and notice was given that they were processed with the Material ID # 16856 as required under RCW 36.70A.106. Copies were forwarded to other state agencies. They noted that if the material is a draft amendment, then final adoption may occur no earlier than sixty days following the date of receipt by Commerce, and asked for submission of the final adopted amendment to Commerce within ten days of adoption. 4. Compliance with the Yakima Urban Area Comprehensive Plan: The existing High Density Residential Future Land Use designation fully supports the Multi - Family Residential (R -3) zoning classification. This rezone is in compliance with the Future Land Use Map III -2 and Land Use Compatibility Chart III -11 of the Comprehensive Plan. The proposed R -3 zoning of the subject properties complies with the following goals and policies of the Comprehensive Plan: Policy 3.1.1.3: Provide high- density residential as a transitional use between commercial /office and medium density residential areas. Policy 3.1.1.4: Development shall be located along arterials or collector streets and should have good access to public transit. Policy 3.1.1.6: Connect schools, parks and meeting places with neighborhoods through a system of pedestrian network such as sidewalks, greenways and pathways. Goal 3.15: Work with school districts and private school officials to properly locate school facilities as necessary to maintain high quality education for Yakima residents. Policy 3.15.1: Encourage the location of new high schools on the periphery of residential neighborhoods, where access to major roads is available. Lars and Amber Hanson 5 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7'h AvenueRZ #002 -11; SEPA #009 -11 1 { Policy 3.15.4: Locate schools on relatively flat land that is in the center or on the borders of the neighborhoods being served. Elementary schools should be located on collector streets, middle and high schools should be located on arterial streets. 5. Adequacy of public utilities: The applicant's two parcels are served by all necessary public facilities such as water, sewer, irrigation, and transit. The properties have direct frontage and access onto two public thoroughfares, West Walnut Street to the north and South 7th Avenue to the east. They also have access to an alley on the west. Additionally, the site is protected by Yakima City Police and Yakima Fire Department. 6. Compatibility of the proposed zone change and associated uses with neighboring land uses: The proposal is compatible with existing neighboring uses because the subject parcels are currently surrounded by R -3 zoned properties and varied uses that serve the surrounding neighborhood. Any potential incompatibilities by proposed uses in the future will be addressed by the zoning code through normal site plan approval. The proposed rezone would also allow the property to possibly be incorporated into the future expansion of Davis High School, which would serve the surrounding neighborhood and the entire community. If the school did not develop on this property, compatibility will be determined for all future proposed uses based upon the Table 4 -1 of the Yakima Urban Area Zoning Ordinance. 7. Public Need /Change in Circumstance: While submitted as a non project rezone it is known that there is an accepted purchase offer from the Yakima School District which is contingent upon this rezone's approval. Its proposed use would be to become part of the proposed expansion of Davis High School. Public need is therefore fulfilled by the fact that the high school needs to expand because of an increase in the student population and the currently outmoded and inefficient school facilities. This site is ideally suited for the expansion of the school. This application was considered to be non project because any school expansion will require a separate land use review and approval before the project may proceed. As it currently exists the site does not comply with zoning ordinance's development standards for traffic circulation, parking, site screening, landscaping and lot coverage. CONCLUSIONS Based upon the foregoing findings, the Yakima Planning Commission concludes as follows: Lars and Amber Hanson 6 rezone from HB to R -3 located at 702 -708 West Walnut St. and 202 South 7'h AvenueRZ #002 -11; SEPA #009 -11 atr`,_ (1) The Planning Commission has jurisdiction under Subsections 15.23.030(C) and 15.23.030(E) of the Yakima Municipal Code to make a recommendation to the Yakima City Council regarding this rezone application. (2) The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. (3) SEPA review resulted in the issuance of a Final Determination of Nonsignificance (DNS) which was issued for this proposal on May 10, 2011. No appeal of this DNS was received. Subsequent project specific development proposals will be subject to additional environmental review in accordance with the provisions of Yakima's Municipal Code and Washington State's Environmental Policy Act. (4) The proposal was determined to be exempt from review under the Transportation Capacity Management Ordinance. (5) The requested rezone satisfies the seven rezone criteria found in Subsection 15.23.030(E) of the Yakima Municipal Code and the four consistency criteria in Subsection 16.06.020(B) of the Yakima Municipal Code which are the applicable criteria to determine whether the requested rezone should be approved. RECOMMENDATION By a vote of six in favor and none opposed the Yakima Planning Commission recommends to the Yakima City Council the approval of an unconditional rezone of the subject properties from the Historical Business (HB) zoning district to the Multi - Family Residential (R -3) zoning district.
