A RESOLUTION authorizing and directing the City Manager and City Clerk to execute an
Interlocal Agreement with the City of Union Gap for project
administration on the South 3rd Avenue construction project.
WHEREAS, the City of Union Gap has received a federal aid project grant
through the Washington State Department of Transportation to construct street
improvements to South 3rd Avenue between Washington Avenue and Ahtanum Road; and
WHEREAS, the, City of Yakima acknowledges the requirement of the
Washington State Department of Transportation and the Federal Highway Administration
to provide project administration; and
WHEREAS, the City of Union Gap is not authorized and certified to administer
federal aid projects; and
WHEREAS, the City of Yakima is authorized and certified to administer federal
aid projects and is willing to administer the City of Union Gap South 3rd Avenue project;
and
WHEREAS, it is in the best interest of the City that the City of Yakima enter into
the attached proposed interlocal agreement, now therefore:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager and City Clerk of the City of Yakima are authorized and directed to
execute the interlocal agreement with the City of Union Gap to administer the City of Union
Gap South 3rd Avenue project, a copy of which agreement is attached and by reference
made a part hereof.

INTERLOCAL AGREEMENT
This agreement is made and entered into by and between the City of Univ;
a municipal corporation of the State of Washington, hereinafter referred to as "Link
and the City of Yakima, a municipal corporation of the State of Washington, here.
referred to as "Yakima".

WHEREAS, Union Gap is not a "certified agency" to perform federal aid project
administration; and
WHEREAS, Union Gap has received a federal aid project grant through the
Washington State Department of Transportation to construct street improvements to South
3rd Avenue between Washington Avenue and Ahtanum Road. A copy of the Washington
State Department of Transportation approval letter concerning the same is attached hereto
and incorporated by this reference; and
WHEREAS, Yakima is a certified agency to perform federal aid project
administration; and
WHEREAS, it is in the best public interest of Union Gap and Yakima to perform the
street improvements; and
WHEREAS, this type of agreement is authorized by RCW 39.34.
NOW,therefore, in consideration of the mutual covenants and benefits to be derived
hereby, it is agreed as follows:
1. Union Gap authorizes Yakima to perform, on Union Gap's behalf, all
administrative duties required for proper expenditure of Federal
Transportation Funds including advertisement for bids, project award and
construction administration. Yakima shall perform such work in compliance
with the Washington State Department of Transportation Local Agency
Guidelines;
2. Yakima shall work in conjunction with Union Gap's consultant, Bucher,
Willis & Ratliff Corporation for all preliminary engineering and with Union
Gap's consultant, when selected, for construction engineering. Yakima shall
not duplicate such services. The consultant shall submit payment requests
for their engineering work and contract payments for the contractor to
Yakima which Yakima shall review and submit to Union Gap for payment.
Union Gap shall pay the consultant and the contractor, and all other costs
related to the projects, directly (not through Yakima).
3. Yakima shall submit to Union Gap for approval all contracts,
investments, design and engineering prior to commencement of work.

4. Yakima shall be responsible for administering this agreementand
coordinating activities between Yakima, Union Gap and consultant.. Yakima
shall seek concurrence of Union Gap on any change order in excess of
$1,000.00. Yakima shall furnish to Union Gap copies of all documents and
letters relating to this project.
5. Union Gap shall pay the cost of administrative duties performed by
Yakima in accordance with the terms of this agreement; provided, however,
Yakima agrees that° in no event will such charges exceed $10,000. The
costs shall include labor, material, advertising costs, transportation expense,
and other necessary costs arising directly from the performance of this
agreement. Yakima shall submit to Union Gap a certified statement of costs
and work performed on a periodic basis. Union Gap shall pay the amount
due Yakima within 30 days following submission of such certified statement.
6. Union Gap and Yakima shall each enact resolutions in accordance
with RCW 39.34 to authorize this Interlocal Agreement. In the event of
dispute under this agreement, venue shall be Yakima County, Washington.

SUMMARY EXPLANATION:
The City of Union Gap has received federal and. state grant funding (TEA -21) for the
reconstruction of South 3rd Avenue from Washington Avenue to Ahtanum Road. The City
of Union Gap is not authorized to directly administer the federal grant and the Yakima
Engineering Division is authorized to directly administer these types of projects.
The Engineering Division has the desire and ability to complete this project for the City of
Union Gap within the time frame desired, for the compensation provided.
The Engineering Division administered similar projects for Union Gap, namely Rainier
Place in 1991, and South 18th Street in 1995. This agreement is similar to those previous
agreements.

A RESOLUTION authorizing an Interlocal Agreement with the .'City`of:YYakima.
WHEREAS, the City of Union Gap is not a "certified agency" 'authorized to perform federal
aid project administration; and
WHEREAS, the City of Union Gap has received a federal aid project grant through the
Washington State Department of Transportation to construct street improvements'.to South 3rd
Avenue between Washington Avenue and Ahtanum Road; and
WHEREAS, the City of Yakima is a certified agency to perform •,federal aid: project
administration and is willing to provide those services on behalf of the City of Union Gap; -
NOW, THEREFORE, be it resolved by -the Union Gap City Council as follows:
1. The Mayor for the City of Union Gap is hereby authorized to execute, on behalf of the City.
of Union Gap an Interlocal Agreement with the City, of Yakima, a true copy. of which is
annexed to this resolution and incorporated herewith as Exhibit "A";
2. Financing for this joint undertaking shall include payment by Union .Gap to the City of
Yakima in amounts not to exceed $10,000.00 for services rendered; `
3. The property (street improvement) involved will continue to belong to the City of Union Gap
after completion;
4. Administration of the joint undertaking shall be in cooperation between the City of Yakima
and Union Gap's consultant, Bucher, Willis and Ratliff Corporation, for all preliminary
engineering and construction engineering. Funds shall be invoiced and paid in the manner
described specifically in the Interlocal Agreement.

Dear Mr. Hams:
The Transportation Improvement Board approved the FY 1998 Urban Arterial Trust Account (UATA) Program
Priority Array at its meeting on May 23, 1997. We are pleased to announce that the subject project ranked within
the funding level. The total amount of UATA funds obligated for the project is $1,237,500.
Your next step is to submit a prospectus to the Board for funding consideration. Projects may receive funding
approval at some or all the phases shown below.
• The predesign phase provides funds for environmental impact analysis and predesign studies for major
projects where the agency does not have a specific plan.
• The design phase provides funds for design engineering, right of way appraisals and acquisition, and
environmental impact analysis on projects where the agency has a specific plan,
• The construction phase provides funds for construction and construction engineering.
The TIB staff will assist you in the development of the proper prospectus for project approval.
The Board has estimated the available revenue for new project starts, The Board requests prospectuses for more
projects than can currently be funded (over -obligation) without causing construction delay. Over -obligation
promotes competition between agencies for construction funds. It also allows timely use of construction funds.
Each funded agency must contact the T1B staff to determine when construction funds may be available for their
project. Remember, the first project submitted for construction funding is the first project in line to receive
funding, provided the prospectus is complete and correct.
Most projects receive initial UATA funding approval at design phase. Several blank design prospectuses are
enclosed for your convenience. If you need a predesign or construction prospectus, please contact the TIB office.
Forms are also available through the Internet on the TIB home page. The Internet address is
http://www.wa.gov/tib. Submit your completed prospectus as directed in the TIB Guidelines. If you have any
