A RESOLUTION authorizing arid directing the City Manager of the City of Yakima to
execute an amendment to a previous architectural services
agreement with Wardell Architects, P.S. in order to ratify additional
professional services regarding the removal of asbestos at the Police
Center Annex, 200 block, South Second Street, Yakima, Washington.
WHEREAS, the City desires that certain demolition and improvements be
performed regarding'' the Police Center Annex, 200 block, South Second Street, Yakima,
Washington; and
WHEREAS, the City required professional architectural services to develop
specifications for and oversee construction activities regarding certain demolition and
improvement work to the Police Center Annex, 200 block, South Second Street, Yakima,
Washington; and
WHEREAS, on August 4, 1998, the City Council authorized' execution of an
architectural services agreement with Wardell Architects, P.S., for said services; and
WHEREAS, in addition to the architectural services specified in said agreement,
in accordance with requirements of the Department of Labor and Industries it was
necessary to have a good faith survey conducted to determine whether lead and/or
asbestos were present at the Police Center Annex; and
WHEREAS, a lead and asbestos survey was conducted by Fulcrum
Environmental Consulting at the direction of Wardell Architects, P.S.; and
WHEREAS, said survey indicated that asbestos was present at the Police Center
Annex and had to be removed in order to complete the improvements to the building;,
and
WHEREAS, in order to remove the asbestos, it was necessary to have
appropriate technical specifications developed by Fulcrum Environmental Consulting at
the direction of Wardell Architects, P.S.; and
WHEREAS, on December 15, 1998, the City Council authorized execution of an
amendment to the agreement with Wardell Architects, P.S., to reflect the performance of
these additional services; and
WHEREAS, as asbestos removal work progressed, additional material
containing asbestos was found concealed under surface materials and it was necessary
to have Fulcrum Environmental Consulting perform additional professional services in
order to remove these materials; and
WHEREAS, Wardell Architects P.S. is requesting execution of an additional
amendment to the agreement to reflect the performance of these additional professional
services by Fulcrum Environmental Consulting at a costs of $512.42; and
WHEREAS, the City Council deems it to be in the best interest of the City of
Yakima to authorize execution of the attached amendment to the architectural services
agreement with Wardell Architects, P.S., regarding the Police Center Annex, in order to
ratify additional professional services necessary for the removal of asbestos at the Police
Center Annex, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:.
The City Manager of the City of Yakima is hereby authorized, and directed to
execute the attached and incorporated amendment to the architectural services
agreement with Wardell Architects, P.S., in. order to ratify additional professional
services necessary for the removal of asbestos at the Police Center . Annex, 200 block,
South Second Street, Yakima, Washington.

Dear Mr. Zais
As you are aware, we retained Fulcrum Environmental Consulting for services necessary in identifying
asbestos and lead in the annex building. Asbestos was found and its removal was included in the
general construction contract. As removal work was underway, additional material containing asbestos
was found concealed under surface materials. Fulcrum was called back to assess the findings in
compliance with State Labor and Industries requirements. Their bill for additional services is justified
as the original contract did not include services related to hidden conditions.

Enclosed is an invoice from Fulcrum Environmental Consulting for services required when additional
asbestos was uncovered during removal activities.
As we discussed previously, I contacted Fulcrum questioning their position that these were "out of
scope" services. Fulcrum's basic contract limited their work to initial fact finding and technical
specification development. It did not include services during construction or any follow-up work. We
negotiated the contract to keep costs at an absolute minimum. Keeping this in mind, Fulcrum appears
to have a legitimate claim for reimbursement of these services and we recommend payment.
We have enclosed a statement for their work. This amount is over our agreed upon maximum fee.
If a letter formally amending our contract is necessary please contact us.

SUMMARY EXPLANATION:
On August 4, 1998, Council approved an agreement with Wardell Architects, P.S., to
prepare specific drawings and oversee the remodeling of the former Butler Building, now
known as the Police Annex, for the purpose of vehicle storage (City Contract No. 98-82,
Resolution No R-98-116).
The contract was amended on December 15, 1998 to pay for associated costs with
asbestos identification and removal that was not included in the original contract. The
original authorized contract amount was $4,500. The costs of $3,405 associated with the
asbestos removal brought the new contract amount to $7,905 for this project.
During the asbestos removal, additional costs were identified that were out of the scope of
service which include material/quantity verification, sampling, site inspection, regulatory
agency interaction and analytical charges by Fulcrum Environmental Consulting, Inc.
These costs total $512.42, which will bring the new total of the contract to $8,417.42, if
approved by Council. Fulcrum's basic contract limited their work to initial fact finding and
technical specification development; it did not include services during construction or any
follow-up work.
The additional costs identified above could not have been estimated prior to construction,
as the actual asbestos status was unknown. There are no further anticipated additional
costs for this project at this time.

As a part of the remodeling project we have determined that the State Labor and Industries requirements
for Good Faith Surveys for asbestos and lead apply. Fulcrum Environmental Consulting is qualified to
provide such services and we have retained them for this work subject to your approval. Their findings
indicate asbestos is present in the area of the building affected by the remodeling Technical
specifications for approved removal of the asbestos must be prepared and we recommend Fulcrum for
this work as well. We recommend incorporating the asbestos related consulting into our current
professional services contract.
