Executive Session (one hour): • Collective Bargaining • Prospective Litigation • Pending Litigation Executive session was held and adjourned at 5:56 p.m. 6:00 P.M. — BUSINESS MEETING 1. Roll CaII All Council members were present. Staff included City Manager Zais, City Attorney Cutter and City Clerk Kloster 2. Invocation /Pledge of Allegiance — Mayor Micah Cawley Mayor Cawley gave an invocation and led the Pledge of Allegiance 3. Open Discussion for the Good of the Order A. Proclamations • Earned Income Tax Credit Awareness Day Council Member Adkison read a proclamation declaring January 29, 2010 as Earned Income Tax Credit Awareness Day. Michelle Besso accepted it. B. Presentations /recognitions /introductions • Recognition of former Council Member Sonia Rodriguez Mayor Cawley read a proclamation of commendation for Sonia's service to the citizens of Yakima and presented a plaque to her. • Recognition of life- saving individuals by Yakima Fire Department Deputy Fire Marshal Ron Melcher recognized Stephanie Pruett, Tara Prescott, Mike Henne, Ed Vertrees and Sara Wisner who were involved in saving the life of Ellen Davis at the West Valley Walmart. C. Status reports on prior meeting's citizen service requests — None D. Appointments to Boards, Commissions and Council Committees • Yakima Arts Commission ACTION: Motion carried to refer the recommendations back to the Council Rules and Procedures Committee to standardize the process to require members to be Yakima citizens. VOTE: 6 -1, Coffey voting no. ACTION: Amended motion carried to assign the Council Rules and Procedures Committee to look at standardizing all Boards and Commissions. VOTE: 6 -1, Coffey voting no. 4. Consent Agenda Item No. 17 was added to the consent agenda and Item Nos. 8 and 18 were removed from the consent agenda. ACTION: Motion carried to adopt the consent agenda as read. VOTE: Unanimous *A. Consideration of approval of Council Minutes • Special Meeting /Budget Wrap Up — December 1, 2009 • Business Meeting — December 8, 2009 and January 5, 2010 ACTION: Council meeting minutes were approved. *B. Consideration of approval of Council Committee Meeting Minutes -- None 5. Audience Participation Jonathan Frazier spoke about the "lingerie" coffee stands and urged the Council to categorize these businesses as adult entertainment and requiring them to comply with the adult entertainment ordinance. Rebecca Withrow addressed the Council on the ongoing gang problem in Yakima and encouraged the Council and citizens to contact Jamie Pederson, Chair of the House Judiciary Committee to pursue legislation to eliminate gang houses. Diane Fortier distributed flyers regarding the Yakima Classic 2010 "Sun & Shine" car show to be held in Yakima in July. Brandon Brunais expressed his concerns about the continuing problems with panhandlers in the city and requested Council to review the anti - panhandling law the City of San Francisco has passed. He believes Yakima needs a more aggressive ordinance that will allow police to deal with the problem. 7:00 P.M. — PUBLIC HEARING 6. Public Hearing and Consideration of an Ordinance annexing the Foursquare Church /Hochrein annexation area to the City of Yakima The public hearing was held. ACTION: Motion carried to pass the ordinance. VOTE: Unanimous ORDINANCE NO. 2010 -03 2 CITY MANAGER'S REPORTS 7. Consideration of 2009 Fourth Quarter Capital Improvement Projects report ACTION: Motion carried to accept the report. VOTE: Unanimous 8. Consideration of a Resolution authorizing execution of an agreement with the Japanese Bochi Association for a Japanese garden at Tahoma Cemetery ACTION: Motion carried to adopt the resolution. VOTE: Unanimous RESOLUTION NO. R- 2010 -11 *9. Consideration of a Resolution authorizing execution of an agreement with Yakima County Office of Aging and Long Term Care (ALTC) for the City of Yakima Day Break Adult Day Care and Respite Services Program at the Harman Center ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -12 *10. Consideration of a Resolution authorizing execution of an agreement with Yakima Valley Community College for Retired and Senior Volunteer Program (RSVP) support services ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -13 *11. Consideration of a Resolution authorizing execution of personal services agreements with instructors, officials and referees for various Parks and Recreation Division programs during 2010 ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -14 *12. Consideration of a Resolution authorizing execution of a professional services agreement with the Yakima Valley Basketball Officials Association (YVBOA) for officiating services during the 2010 basketball season ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -15 *13. Consideration of a Resolution authorizing execution of an interlocal jail agreement with the City of Wapato ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -16 *14. Consideration of a Resolution modifying the City Treasurer's Petty Cash and Change Funds ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -17 *15. Consideration of a Resolution authorizing the 2010 agreement with Allied Arts Council of Yakima Valley for a Visual and Performing Arts Program for Youth ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -18 *16. Consideration of final contract payment for Columbia Asphalt and Gravel, Inc — River Road Project (Standard Motion V -B — Accept the project and approve the final payment) ACTION: Project was accepted and final payment was approved. 3 ORDINANCES *17. Consideration of Legislation regarding a grant agreement between the City of Yakima and Washington State Division of Archives and Records Management: A. Resolution authorizing execution of a grant agreement with the State of Washington, Division of Archives and Records Management for local public records management and preservation efforts ACTION: Resolution adopted. RESOLUTION NO. R- 2010 -19 B. First reading of an Ordinance amending the 2010 budget and making an appropriation of $10,000 in the 000 - General Fund (no action required at this meeting; second reading scheduled 2 - 2 - 10) 18. Consideration of an Ordinance amending the Classification and Compensation Plan for the position of Lead Police Support Services Supervisor and amending the Yakima Municipal Code ACTION: Motion carried to pass the ordinance. VOTE: Unanimous ORDINANCE NO. 2010 -04 19. Other Business Council Member Coffey referred to the City's panhandling ordinance. She suggested contacting businesses near the major areas where panhandling occurs to make them aware of the law so they can report any problems. Council Member Lover acknowledged the increase in panhandling, joblessness and homelessness and questioned whether Yakima's rate of increase is the similar to the rest of the state. He requested this issue be referred to a Council committee for • further review. Council Member EttI asked for an update on the person selected by OIC for the block watch program. He was advised that Juan Romo was hired in the position. Council Member Edler addressed the "lingerie" coffee stand barista issue. ACTION: Motion carried to ask Legal to draft legislation that follows Everett and Snohomish County's lead declaring these adult businesses and move us in the direction of categorizing them as such. VOTE: 4 -3, Cawley, Ensey and Lover voting no. Council Member Coffey recommended having a study session for more discussion on the issue after Legal has drafted the ordinance. It was also suggested to discuss this subject in the upcoming retreat. ACTION: Motion carried to televise the retreat if this subject would be added. VOTE: 4 -3, Cawley, Coffey and Ettl voting no. City Manager Zais advised he will be awarding the bid for the Lincoln Avenue railroad grade separation underpass and reviewed the process that was taken to get to this point. Further discussion followed on constructing the underpasses. 20. Adjournment — 8:20 p.m. ACTION: Motion carried to adjourn to January 23 at 8:30 a.m. in the Yakima VOTE: Unanimous 4
